REGULAR SESSION
January 15, 1973 - 7:30 P.M.
The City Council of the City of Waterloo, Iowa, met in Regular Session in the
Council Chambers of the City Hall in said City at 7:30 P.M. on January 15, 1973.
Mayor Turner in the Chair.
Present: Councilmen Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey.
Absent: Councilman Keller.
Councilman Glenda Mabrey offered the invocation.
63275 - Moved by Cohea, seconded by Miller that the Agenda, as proposed, for the
Regular Session of January 1.5, 1973 at 7:30 P.M., be accepted and appro-
ved.
Motion carried.
63276 = Moved by Morrissey, seconded by Cavanaugh that the Minutes, of the Regu-
lar Session held January 8, 1973 at 7:30 P.M., be approved.
Motion carried.
63277 - Moved by Cavanaugh, seconded by Cohea that the proof of publication of
the Notice of Public Hearing on Re -zoning, upon the request .f W. W.
Sindlinger, Atty. in behalf of Country Manor, Inc., upon the recommend-
ation of the City Planning ComsniaAon and the City Council's own motion
to rezone certain real property located in Section. 4 -88N -15W (Prarie
Meadow West, Highway #412 and Ansborough Avenue area), as fully described
in said Notice published in the Waterloo Daily Courier on DecemLer 289
1972, from "R-1, R -P" Planned Residence District to "R-3, R -P" Planned
Residence District, be received and placed on. file.
Motion carried.
63278 The Mayor announced the time had arrived to near objections, if any, and
asked if anyone present wished to be heardor make objections, or if
there were any written objections filed with. the Clerk.
The Clerk reported there were no written objections placed on file and
no one appeared to object orally.
In the discussion the following questions were asked and answered:
1 - Stuart Birley askedwhat part of the area requested for rezone was
presently "R-1, R -P" Planned Residence District. Fred Debe answered
presently this classification started at Olmpic Drive and the re-
quested rezone would allow moving Olympic Drive approximately 150°
north, which would reduce the number of single family dwellings
from 79 to 42 but the single dwelling lots would be increased in
size.
2 - G. Marrin Lewis, 856 Sunrise Boulevard, stated he was concerned
about opening all of the streets onto a main thoroughfare. Fred
Debe replied this requested rezone would restrict all streets whi.cti
now open onto Olympic Drive.
3 - Rowena Smith, 3750 Loralin Drive, asked what type of house would be
built and Fred Debe said the houses would be in the $20,000 valua-
tion bracket.
4 - W. W. Sindlinger said the builder would attempt to keep multi -family
dwellings to the south near. Highway #412. Fred Debe reported that

in order to develop the area fully, the need was for 50% multi-
family and 38%3 single family dwellings; the reason for the rezone
request was to locate the street in a permanent location.
5 - Councilman Dykeman asked if there would be a buffer between single
family dwellings and the condominiums. Mr. Debe answered that
Olympic Drive was to divide the single family dwellings from the
condominiums.
Thereupon, it was moved by Mabrey, seconded by Cohea that an Ordinance
be drawn and submitted for said re -zoning ,>
On roll call, Cavanaugh Cohea, Dykeman, Mabrey, Miler and Morrissey
voted Aye. Nay: None. Absent: Keller. Mayor declared the motion
carried.
63279 An Ordinance amending Ordinance No. 2479, as amended, by adding Sub -
Section No, 37 to Section 2A-5 of said Ordinance, rezoning certain pro-
perty in the City of Waterloo, Iowa, with the City of Waterloo Iowa,
to retain easement rights, was read by the Clerk.
Moved by Dykeman, seconded by tiller that said Ordinance be recorded
as having passed its first reading.
On roll call, Cavanaugh, Cohea,, Dykeman, Mabrey, Miller and Morrissey
voted Aye. Nay: None, Absent: Keller. Mayor declared the motion
carried.
63280 m loved by Cavanaugh, seconded by Morrissey that the proof of publication
of the Notice of Public Hearing on Re -zoning, upon the request of Rich-
ard H. Young, upon the recommendation of the City Planning Commission
and the City Council's own motion, to rezone Lots 52, 53 and 54 in
Southgate Third Addition (NE ccr. of Park Lane and Brockway Road) , as
fully described in said Notice published in the Waterloo Daily Courier
on December 289 1972, from °''R-4" Multiple Residence District to 'S-1"
Shopping Center, be received and placed on file°

63281 The Mayor announced the time had arrived to hear sbject.ion, if any, and
asked if anyone present wished to be heard car make objections, or if

63282 - An Ordinance amending Ordinance No. 2479, as amended, by adding Sub -
Section No. 38 to Section 2A-5 of said Ordinance, rezoning certain
property in the City of Waterloo, Iowa, was read by the Clerk.
Moved by Miller, seconded by Cohea that said Ordinance be recorded as

in attendance at the meeting.

City Engineer, tra_nsnitting the request from Jorgensen Constrecti.on Co,
in behalf of Priebe Eros. and Sons, Inc., Waterloo, Iowa, for permission
to widen the existing 35° curb cut to 45' at 1625 West 4th Street, on
the Williston Avenue side, as shown on the attached print, and recommend-
ing approval subject to the provisions of his letter;, he received, placed
on file, recommendations approved and permission granted in accordance
therewith and at no cost to the City of Waterloo, lora.

63286 - Under Council Action #62887 of 10/16/72, further action was deferred c..
"An ordinance vacating all that part of the existing alley in Pleasant
View Additicn lying west of LaPorte Road between Plymouth Avenue a -id East
Ridgeway Avenue and east: from a point 10 feet east of the west line cf
Lot 364 in Pleasant View Addition" until access to Lot 479 could be re-
solved.
Moved by Morrissey, seconded by Dykeman that the corrm'inicaticn from the
Director of Public Works recommending that vacation of that part of the
existing alley in Pleasant View Addition lying west of LaPorte Road be-
tween Plymouth Avenue and East Ridgeway Avenue and east fronta point 10
feet east of the west line of Lot 364 in. Pleasant View Additionhe denied
as the only access to Lot 478 is from this alley, be received, placed on
file and action deferred until January 22, 1973.

63287 - Moved by Dykeman, seconded by Cohea that the communication from the City
Engineer, advising improvements required as a condition precedent to the
final approval of Westchester Road extension from Station. 1C'12 to Sta-
tion 19+06,07 in the Waterloo Country Club Addition, in. the City of Wat-
erloo, Iowa, have been completed, approved by his office, submitting a
combination maintenance bond for four year streets and four year sewers
and reporting the perfcrmAce bond may be released, be received,, placed
on file, approved said 4 -year maintenance bond accepted and performance
bond released,

63288 - Ricriard Jenkins, President of the Cedar Skyline Corporation, gave an oral.
progress report on the Conway Square Civic Center and the redevelopment
of the center city, and presented a written, itemized "Total Aiticipated.
Expenses for Project" report.
Robert Broshar and Wayne Snyder of 'Thorson-Brom-Broshar-Snyder, Archi-
tects, gave a slide presentation.
Joe Stovall asked how taxes paid by low-income people would be affected,
Mayor Turner said the Council was on record to not increase taxes.
Mayor Turner, then publicly thanked Mr. Jenkins and the Architects for
their work.
Moved by Dykeman, seconded by Cohea that the Total Anticipated Expenses
for Project report be received, placed on file and tree firm of jhorsor.-
Brom-Broshar-Snyder, Architect, instructed to proceed withdesign and
plans for the Conway Square Civic Center.

63289 - Moved by Mabrey, seconded by Miller that the Memorandum of Working Agree-
ment between the Mayor and Council of the City of Water.lcc, Iowa and
Municipal Employees' Local Union No. 1127, affiliated with Laborers In-
ternational union of North America AFL-CIO, dated January 3, 1973 he
received, placed on file and Resolution No. 22371, approving said Agree-
ment and authorizing the Mayor to sign and execute same in behalf of the
City of Waterloo, Iowa, be adopted.

voted Aye. Nay: None. Absent: Keller. Mayor declared the resolution
adopted.
63290 - Moved by Morrissey, seconded by Mabrey that the communication from the
City Engineer, transmitting an. Iowa State Highway Commission Amendment
to Iowa State Highway Commission Resolution Noo 67-F-122 and Addendum
to Iowa State Highway Commission Project Agreement for Primary Road Ex-
tensions No. 72-3-079, togetn.er with plan prints 11 and 17-b, reporting
said Commission is proposing to pave Mullan Avenue between Washington
Street north to the railroad tracks and requesting the City assume all
costs of signalization of the railroad tracks involved under this Adden-
dum at an approximate cost of $50,000,and recommending approval, be re-
ceived, placed on file, approved and Resolution No. 22372, approving said
Amendment and Addendum and authorizing and directing the Mayor and City
Clerk to sign same in behalf of the City of Waterloo, Iowa, be adopted.

63291 Moved by Cavanaugh, seconded by Dykeman that Resolution No. 22373, ap-
proving the minutes of the Waterloo Commission on Human Rights for their
meetings held on October 5, 1972 and November 16, 1972, in the City of
Waterloo, Iowa, be adopted.

voted Aye. Nay: None. Absent: Keller. Mayor declared the resolution
adopted.

installation of certain street lights in the City of Waterloo, 1cwa,, be

the City Engineer, reporting under the 1973 capital improvement budget,
the estimated allocations for sanitary sewer are

that the Orange Township sanitary sewer project is scheduled for ccmple-
tion before any street improvements can be made, paving is proposed for
Spring, thus making the sanitary sewer at an estimated cost of
$327,657.11 necessary for letting as soon as possible, be received,
placed on file and action deferred until January 22, 1973,
