The City Council of the City of Waterloo, Iowa, met in Regular Session in the Council Chambers of the City Hall in said City at 7:30 P.M. on March 5, 1973. Mayor Turner in the Chair. Present: Councilmen Cavanaugh., Cohea, Miller and Morrissey. Absent: Councilmen Dykeman, Keller and Mabreyo Community Development Administrator, Dale Mercer, offered the invocation, 63456 - Moved by Cohea, seconded by Miller that the Agenda, as amended, for tne Regular Session of March 5, 1973 at 7:30 P0Mc, be accepted and approved. Motion carried. 63457 - Moved by Morrissey, seconded by Cavanaugh that the Minutes of the Regular Session held February 26, 1973 at 7:30 P.M., be approved. Motion carried. 63458 - Councilman Miller questioned whether these venicles purchased through tne Highway Commission will have the same warranty as they would if purchased from a local dealer. City Engineer Dick King reported that bids taken through the Iowa Highway Commission guarantee warranty through a local dealer. Moved by Cohea, seconded by Cavanaugh that the communication from the City Engineer, transmitting a proposal. from Kingma Motors for the pur- chase of a Dodge D-100 1/2 Ton Pickup Truck with Club Cab for the sum of $2,560035 (the successful low bidder being through the Iowa State Highway Commission purchase of vehicles for governmentaldepartments with- in the State of Iowa) to be used by the Engineering Department, and recom- mending acceptance, be received, placed on file, recommendations approved and Resolution No. 22438, approving and accepting said proposal and auth- orizing the City Clerk to draw a warrant in payment thereof be adopted„ On roll call, Cavanaugh, Cohea, Miller and Morrissey voted Aye. Nay: None. Absent: Dykeman, Keller and Mabrey, Mayor declared the resolu- tion adopted. 63459 - Mayor Turner recognized the students from Central High School, who were in attendance at the Council Meeting. 63460 Under Council Action #63341 of 2/5/73, action was deferred on the request of Ronald Roberts et al to rezone certain property. Moved by Miller, seconded by Cohea that the communication from the City Plan and Zoning Commission, recommending acceptance of the dedication of right-of-way for a future street, for the Council to proceed on its own motion to rezone a part of SW Fractional Quarter of Section 7 -88N -13W lying North side of West Shaulis Road between U.S. Highway No. 63 and West Fourth Street, in the City of Waterloo, Iowa, from "A-1" Agricult- ural District to "R-4" Multiple Residence District, as shown on the at- tached print and legally described in Exhibit "A", and recommending ap- proval, be received, placed on file, and recommendations approved, and date of hearing set as March 26, 1973 at 7:30 P.M. and the City Clerk instructed to publish the necessary notice on the 8th day of March, 1.973 2 63460 - (Continued) On roll call., Cavanaugh, Cohea, Miller and Morrissey voted Aye, Nay: None, Absent: Dykeman, Keller and Mabrey. Mayor declared the motion carried. 63461 - Moved by Cavanaugh, seconded by Miller that the Audit Report covering the Year 1972 for the Motor Vehicle Parking Facilities Funds of the City of Waterloo, Iowa, as made by Carney, Alexander, Marold & Co., Certified Public Accountants, Waterloo, Iowa, be received and placed on file. Motion carried, 63462 - Moved by Morrissey, seconded by Cohea that the lease agreement dated 2/26/73 between Black Hawk County and the City of Waterloo, Iowa, for No. 2 Fire Station, 716 Commercial Street, for the purpose of operating the food stamp program, be received, placed on file and Resolution No. 22439, approving said lease agreement and authorizing and directing the Mayor and City Clerk to sign same on behalf of the City of Waterloo, be adopted, On roll call, Cavanaugh, Cohea, Miller and Morrissey voted Aye. Nay: None. Absent: Dykeman, Keller and Mabrey. Mayor declared the resolu- tion adopted. 63463 - An Ordinance amending Ordinance No. 2479, as amended, by adding Sub -Sec- tion No, 42 to Section 2A-5, rezoning certain property in the City of Waterloo, Iowa, was read by the Clerk. Moved by Miller, seconded by Cavanaugh that said Ordinance be recorded as having passed its second reading (the first having passed under C.R.# 63438 of 2/26/73). On roll call, Cavanaugh, Cohea, Miller and Morrissey voted Aye. Nay None. Absent Dykeman, Keller and Mabrey. Mayor declared the motion carried. 63464 - Moved by Cavanaugh, seconded by Morrissey that Resolution No., 22440, ap- proving the Municipal. Street Finance Report to the Iowa State Highway Commission for the Year 1972 covering various expenditures for Street and Parking Purposes on Municipal Streets and Parking in the City of Waterloo, Iowa, be adopted,, On roll call, Cavanaugh, Cohea, Miller and Morrissey voted Aye. Nay: None, Absent: Dykeman., Keller, and Mabrey_ Mayor declared the resolu- tion adopted,. 63465 Moved by Cohea, seconded by Morrissey that the Completion Report of the City Engineer as to work performed and materials furnished by Cedar Falls Construction Company, Cedar Falls, Iowa, Contractors, for the U,S, High- way #218 South Widening Program, Contract #129, in the City of Waterloo, Iowa, and recommending approval, be received, placed on file, and Resolu- tion No, 22441, approving the report, accepting the work and authorizing payment in full accordingly, be adopted. On roll. call, Cavanaugh, Cohea, Miller and Morrissey voted Aye. Nay: None. Absent: Dykeman, Keller and Mabrey. Mayor declared the motion carried, 63467 - Moved by Cohea, seconded by Morrissey that the following application, bond and fee for Beer Permit at the location designated in the City of Waterloo, Iowa, be, and the same is hereby approved for the issuance of license, that the approval be endorsed on the application and forwarded to the Iowa Beer and Liquor Control Department with certified fee re- ceipt, duplicate copies of the application, etc., be received, placed on file, and Resolution No. 22442, approving the application, be adopted! Jr.'s By Lo Market, 926 Linn Street Motion carried, 63469 - Under C.R. #63450 of 2/26/73 action was deferred for one week on the ap- plication of the Community Mortgage and Investment Co, dba Smitty's Mo- bile Home Village for a Mobile Home Park renewal license at 1531 Sager Avenue, and was now presented for consideration. Moved by Cohea, seconded by Miller that the report of the Community Mort- gage and Investment Co. dba Smitty's Mobile Home Village, 1531 Sager Ave- nue, outlining the redevelopment plans for said Mobile Home Village, be received, placed on file and said Mobile Home Park renewal license gran- ted, Motion carried. March 5, 1973 - 4 - 63470 Moved by Miller, seconded by Cohea that the reportof the City Attorney, advising that the bonds filed with the City Clerk up to the close of bus- iness on Murch 5, 1973,.as shown on the list attached to said report, have been approved by him, be received, placed on file, and the report and bonds approved° Motion carried° 63471 - Moved by Miller, seconded by Cohea that the Council adjourn.
