The City Council of the City of Waterloo, Iowa, met in Regular Session in the Council Chambers in the City Hall in said City at 730 P.M. on May 21, 1973. Mayor Turner in the Chair° Present: Councilman Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey. Absent.: None. Councilman Glenda Mabrey offered the invocation. 63807 - Moved by Cohea, seconded by Morrissey that the Agenda, as proposed, for the Regular Session of May 21, 1973 at 7:30 P.M., be accepted and appro- ved Motion carried, 63808 - Moved by Keller, seconded by Cohea that the Minutes of the Regular Ses- sion held May 14, 1973 at 730 P.M,, be approved. Motion carried. 63809 - Moved by Miller, seconded by Mabrey that the proof of publication of the notice of public hearing to vacate, sell and convey to The National Bank of Waterloo a part of an alley described as NWly 10' of SEly 110' of Lots 5, 8 and 9, Block 4, Original Plat of East Waterloo (Water Street area), in the City of Waterloo, Iowa, as more fully described in the publication in the Waterloo Daily Courier on April 26 and May 3, 1973, be received and placed on file. Motion carried® 63810 The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objections, or if any written objections had been filed with the Clerk. No one appeared to object orally, and the Clerk reported no writtenob- jections had been filed. Thereupon, it was moved by Cavanaugh, seconded by Cohea that an Ordinance be drawn and submitted vacating a part of an alley described as NWly 10° of SEly 110' of Lots 5, 8 and 9, Block 4, Original Plat of East Waterloo (Water Street area), in the City of Waterloo, Iowa, as fully described in the published notice in the Waterloo Daily Courier on April 26 and May 3, 1973. Motion carried, 63811 An Ordinance vacating a part of the Alley in Block 4, Original Plat, Waterloo, Iowa, East Side of the Cedar River in the City of Waterloo, Iowa, was read by the City Clerk Moved by Dykeman, seconded by Miller that the said Ordinance be recorded as having passed its first reading. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: Noneo Absent: None. Mayor declared the motion carried. - 2 - 63812 - Moved by Morrissey, seconded by Cavanaugh that the proof of publication of the notice of public hearing to vacate all the alleys in a square block in the Logan Avenue Project Iowa R-2 area, (block bound by Argyle Street on the north, Almond Street on the south, East Fourth Street on the east and Iowa Street on the west), as fully described in the Water- loo Daily Courier on April 26 and May 3, 1973, be received and placed on file. Motion carried. 63814 - An Ordinance vacating certain alleys in the Logan Avenue Urban Renewal Project Iowa R-2 in the City of Waterloo, Black Hawk County, Iowa, was read by the Clerk. Moved by Mabrey, seconded by Cohea that the rules requiring ordinances to be read in full on three separate days be suspended, said ordinance be recorded as having passed its first, second and third readings, and be now placed on its final adoption. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 63815 - Moved by Cohea, seconded by Morrissey that Ordinance No. 2629, an Ordin- ance vacating certain alleys in the Logan Avenue Urban Renewal Project Iowa R-2 in the City of Waterloo, Black Hawk County, Iowa, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the ordinance adopted. 63816 Moved by Miller, seconded by Cohea that the communication from Charles F. Hinton, Attorney, making an offer to purchase a 1941 American La - France Fire Engine, known as No. 3, and a junked American LaFrance Eng- ine, known as No. E, for the amount of $450.00 and $15.00 respectively, be received, placed on file and said offer approved and accepted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. May 21, 1973 - 3 - 63817 - Mayor Turner recognized the Students from. Central Hign School who were in attendance at the Council Meeting. 63818 - Clarence McConkey, 104 Bruce Lane, told the Council ne wanted to see a further study on sidewalks. Devonshire Drive was reported to be in the sidewalk program as outline by the Mayor's Advisory Safety Committee and he wanted to know if the sidewalks in the program were ordered to be put: in this year. Mayor Turner reported that the sidewalk program was controversialand would need more study before they could be ordered in under an assess- ment program, and further stated, the Council had not made a decision on the sidewalks but would like to see sidewalks started to be construc- ted on a voluntary basis, and then completed under an assessment program, 63819 - Moved by Miller, seconded by Cavanaugh that the communication from the City Engineer, transmitting the request from Jack E. Broell for permis- sion to black top the parking on Lots 12, 13 and 14, First Addition to Calloway, known as 607 Ansborough Avenue, for beautification purposes only (not to be used for parking), be received, placed on file and ap- proved at no cost to the City of Waterloo. Motion carried. 63820 - Moved by Cohea, seconded by Mabrey that the communication from the City Engineer, transmitting five (5) copies of Iowa State Highway Commission Application Form #559 from Robert Youngblut requesting permission to con- struct a 36' Type "B" (commercial) entrance to U.S. Highway 20 at Sta. 202+75 on east side (518 Broadway), as shown on the attached print, and recommending approval subject to the provisions of his letter, concurred by the Police Department, be received, placed on file, recommendations approved, and the Mayor and City Clerk authorized to sign said applica- tion in behalf of the City of Waterloo, Iowa. Motion carried. 63821 - Councilman Miller asked if the City participated in tne cost of paving completed during 1972 for the First United Methodist Church. City Engineer King reported tne Church paid for all of the paving but the City did participate in the storm sewer costs which served the alley between West Fourth. Street and West Fifth Street, and Randolph. Street and Wellington Street. Councilman Keller commented that there were more people who used the alley between West Fourth Street and Park Avenue and South Street than the First Congregational Church. Mayor Turner reported the Church would not object to an assessment pro- gram. Moved by Mabrey, seconded by Cavanaugh that the communication from the City Engineer, transmitting the request of the First Congregational Ch- urch, 608 West Fourth Street, for paving of an alley between West Fourth Street and Park Avenue and South Street servicing parking lots and church facilities, together with plat, and recommending if tne City is to main- tain the surface improvements, this should be a 5" black base, witn a 2" surface, or a 6" port.land cement and subject: to the provisions of his letter, be received, placed on file and recommendations approved and said improvement ordered to be included at 1.00% in the assessable paving program Motion carried. Bamsey for permis- sion to construct a temporary concrete driveway without regard to side- walk grade at 1826 Falls Avenue, Waterloo, Iowa, together with $3.00 check for recording waiver, and recommending approval subject to the provisions of his letter, be received, placed on file, request approved and Resolution No, 22560, granting permission and authorizing construc- tion irrespective of later official grade, be adopted, On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye, Nay: None. Mayor declared the resolution adopted, 63823 - Mayor Turner reported there were quite a few school children who lived on the north side of Rainbow Drive and it was necessary to have side- walks for them to proceed down to Rainbow Drive where a traffic signal was Located at Spieker Road and recommended that these sidewalks be ordered in as soon as possible, Moved by Dykeman, seconded by Cohea that the report of the Mayors Ad- visory Safety Committee on a pedestrian stop light at DeSoto Avenue and Rainbow Drive and/or sidewalk along the north side of Rainbow Drive from Letsch Road to Hackett Road, referred to said Committee under Council Action #63733 of 5/7/73, be received, placed on file, approved and the City Engineer instructed to proceed to notify tcie property owners under an assessment program. Motion carried, 63824 - Moved by Morrissey, seconded by Cavanaugh that the Financial Report of the Board of Waterloo Water Works Trustees for the Quarter ending March 31, 1973, be received and placed on file. Motion. carried. 63825 - Moved by Cavanaugh, seconded by Keller that the communication from the City Engineer, submitting an Agreement between the City of Waterloo and the Giese Construction Company dated 5/22/73 for the use of existing City streets for haul roads, together with an Agreement dated 5/16/73 between Giese Construction Company and the City of Waterloo Park Commis- sion for construction of a haul road in Park grounds at the Ansborough Avenue Bridge, in conjunction with the Local Flood Protection Program, Stage I, and recommending acceptance under the stipulation that repre- sentatives from Giese Construction Company and from the City of Waterloo review the condition of the haul roads before and after construction and that Giese Construction Company will maintain these roads during its op- eration and will return same to their original condition at the comple- tion of the project, be received, placed on file and Resolution No. 22561, approving and accepting said Agreement and authorizing and direct- ing the Mayor and City Clerk to execute same in behalf of the City of Waterloo, be adopted. Mayor declared the resolution adopted° 63826 - Councilman Miller asked what tne property (3016+ acres) lying soutn of Black Hawk Road,which tne City was offering to purcnase, would be used for. City Engineer King reported this property would make a good access for the City Park in tnis area. May 21, 1973 - 5 63826 - (Continued) Moved by Dykeman, seconded by Miller that the communication from the City Engineer, transmitting a contract dated 5/15/73 between the City of Waterloo and John Bo, Robert A. and Richard H. Young, wherein tne City offers to purchase certain real property in SW4 SW4 of Section 28 -89N -13W (3016# acres) lying south of Black Hawk Road, in the City of Waterloo, Iowa, for the sum of $2,150000, with the exact payment amount to be determined by a survey based on the rate of $700 per acre, for Huntington Road Storm Sewer Right -Of -Way in conjunction with Phase "A" Army Corps of Engineers' Flood Control Dike, Contract No. 88 purposes, together with appraisal, recommending approval and requesting permission to proceed with the survey and payment, be received, placed on file, ap- proved and accepted, the Mayor and City Clerk authorized and directed to execute the contract in behalf of the City of Waterloo, the City Engi- neer granted permission to proceed with said survey and the City Clerk instructed to issue a warrant for the amount as determined by the survey based on the rate of $700 per acre, in payment tnerefor. Mayor declared the motion carried. 63827 Moved by Cavanaugh, seconded by Miller that the communication from the City Engineer, transmitting Contract and Bond of Don Gardner Construc- tion Company, Waterloo, Iowa, for construction of a Municipal Service Station, 1326 Black Hawk Street, Contract Noo B-26, in the amount of $18,371.84, be received, placed on file and Resolution No. 22562, appro- ving said Contract and Bond, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent° None. Mayor declared the resolution adopted. 63828 - Moved by Morrissey, seconded by Cavanaugh that the communication from the City Attorney, transmitting a Quit Claim Deed dated 5/16/73 from St. Francis Hospital of Franciscan Sisters, conveying unto the City of Waterloo, Iowa, certain real property in the SE4 of Section 3-88-13 for St. Francis Drive purposes, together with recommendation of the City Plan and Zoning Commission, be received, placed on file and Resolution No. 22563, approving and accepting said deed and directing the recording of same, be adopted. Mayor declared the resolution adopted. 63829 - Moved by Miller, seconded by Cohea that the communication from the City Plan and Zoning Commission, transmitting Final Plat of Hammond Hills, Waterloo, Iowa, a copy of said Commission's Resolution of Approval, Eng- ineer's Certificate of Survey, Deed of Dedication, Report of the City Engineer, Contract for installation of sewers and street improvements with Waiver of Assessment, and recommending approval, be received, pla- ced on file and Resolution Noo 22564, approving said Final Plat, be adopted. Mayor declared the motion carried. 63831 - An Ordinance amending Ordinance No. 2479, as amended, by adding Sub - Section No. 45 to Section 2A-5 of said Ordinance, rezoning certain prop- erty in the City of Waterloo, Iowa, was read by the City Clerk. Moved by Mabrey, seconded by Miller that the rules requiring ordinances to be read in full on three separate days be suspended, that said ordin- ance be recorded as having passed its second and third readings (the first having passed under C,R.#63781 of 5/14/73) and be now placed on its final adoption. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye, Nay: None. Absent: None. Mayor declared the motion carried. 63832 - Moved by Cohea, seconded by Morrissey that Ordinance No, 2630, an Ordin- ance amending Ordinance No. 2479, as amended, by adding Sub -Section Noe 45 to Section 2A-5 of said Ordinance, rezoning certain property in the City of Waterloo, Iowa, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the ordinance adopted. 63833 - Mayor Turner reported the City of Waterloo was going to handle emergency ambulance calls only, pointing out that we were not putting anyone out of business, we were going to charge for this service, and we would not go outside of the Citylimits with our emergency ambulance service. Councilman Dykeman pointed out that if an individual wanted to call a private ambulance service in an emergency, he would be free to do so but the City's police calls would be referred to the City's emergency ambulance service. 63834 - An Ordinance amending Chapter 5 of the City Code of Ordinances of the City of Waterloo, Iowa, entitled "Ambulances" by adding a new subsection to Section 5-2 exempting ambulances operated by the City or Governmental Agencies and by repealing Section 5-8 requiring license holders to main- tain two ambulances and personnel on twenty-four hour duty and by adding. a new Section 4 providing for charges for City operated ambulance ser- vice, was read by the City Clerk. Moved by Dykeman, seconded by Cohea that said Ordinance be recorded as having passed its first reading. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye° Nay: None. Absent: None. Mayor declared the motion carried. May 21, 1973 - 7 - 63835 - Ray Mount of the Waterloo Ambulance Service raised the questionas to when his contract with the City for emergency ambulance service would be terminated, stating he had a termination letter from the City. He also pointed out that he had turned over to the collection agency over $5,000 in uncollected accounts so the City could expect to do tine same in its operation. Mayor Turner reported the City would take over the emergency ambulance service on the 31st day of May, 1973 but might have to call the Waterloo Ambulance Service for back up emergency calls, and would take emergency ambulance calls only and not convalescent calls. Mr. Mount said he thought the Council action was hasty and that it was making a mistake, that he was concerned with the City of Waterloo and would still serve the public. 63836 - An Ordinance establishing a McElroy Auditorium and Conway Civic Center Board, was read by the City Clerk, Moved by Keller, seconded by Dykeman that the rules requiring ordinances to be read in full on three separate days be suspended, that said ordin- ance be recorded as having passed its first, second and third readings, and be now placed on its final adoption. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye, Nay None. Absent None. Mayor declared the motion carried. 63837 - Moved by Morrissey, seconded by Cohea that Ordinance No. 2631, an Ordin- ance establishing a McElroy Auditorium and Conway Civic Center Board, be adopted. Mayor declared the resolution adopted. 63839 - Moved by Mabrey, seconded by Cohea that the communication from the Com- munity Development Administrator, transmitting a proposed "Resolution establishing fair reuse value for certain parcels to be disposed of in the Logan Avenue Urban Renewal. Area Project Iowa R--2", be received, pla- ced on file and Resolution No. 22566, establishing said fair reuse value, be adopted,: On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Mayor declared the resolution adopted. 63840 Moved by Cohea, seconded by Morrissey that the communication from the Community Development Administrator, transmitting a proposed "Resolution establishing fair reuse value for certainparcels to be disposed of in the Westfield -Virden Urban Renewal Area, Project Iowa R-7", be received, placed on file and Resolution No. 22567, establishing said fair reuse value, be adopted. Mayor declared the resolution adopted. 63842 - Moved by Dykeman, seconded by Miller that the communication from the City Engineer, reporting the City's share of the construction costs for the storm sewer extension to serve the waterhead south of Ridgeway Ave- nue and west of Minnesota Street to be $4,870.00, approved by Council Action #63048 of 11/27/72, and recommending payment, be received, placed on file, recommendations approved and Resolution No. 22569, approving said payment, be adopted. Mayor declared the resolution adopted. 63843 Councilman Dykeman pointed out that the City of Waterloo still had recip- rocal agreements to come to the assistance of other towns when a problem was too large for their service and help was needed. Moved by Dykeman, seconded by Keller that the communication from the Chief of the Waterloo Fire Department, reporting on fire insurance rates and fire protection provided for some of the townships and towns outside of the City of Waterloo corporate limits, and recommending discontinu- anca of said fire protection effective as of September 1, 1973, but re- taining the present reciprocal agreements with surrounding towns or cit- ies as they are at the present time, be received, placed on file, recom- mendations approved and the Fire Chief authorized to proceed in accord- ance therewith effective as of September 1, 1973. Motion carried. 63844 - Moved by Miller, seconded by Cohea that the communication from the Elec- trical Inspector,transmitting Resolution No. 7448 adopted 1/11/37 order- ing four 100 candlepower street lights on San Souci Road, reporting said street lights are the last within the city limits, and recommending same be changed to 175 -Watt Mercury Vapor Lamps, be received, placed on file, approved and Resolution No. 22570, ordering the removal of the four 100 candlepower street lights on San Souci Road and replacement of same with 175 -Watt White Mercury Vapor Lamps, be adopted. Mayor declared the resolution adopted. 63847 - Moved by Cohea, seconded by Morrissey that the communication from the Director of Public Works, recommending the appointment of Earl Showers, 136 Greenwood Avenue, as Deputy Weed Commissioner, beginning June 1, 1973, at a salary of $3.78 per hour, be received, placed on file, appro- ved and Resolution No, 22572, appointing Earl Showers as Municipal Dep- uty Weed Commissioner, at said salary, subject to approval of the County Board of Supervisors of Black Hawk County, be adopted.
