REGULAR SESSION
June 4, 1973 - 7:30 P.M.
The City Council of the City of Waterloo, Iowa, met in Regular Session in the
Council Chambers in the City Hall in said City at 7:30 P.M. on June 4, 1973.
Mayor Turner in the Chair.
Present: Councilmen Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Mc rrissey.
Absent: Councilman Keller.
Councilman Glenda Mabrey offered the invocation.
63910 - Moved by Cohea, seconded by Cavanaugh that the Agenda, as amended, for the
Regular Session of June 4, 1973 at 7:30 P.M., be accepted and approved.
Motion carried.
63911 - Moved by Cavanaugh, seconded by Morrissey that the Minutes of the Regu-
lar Session held May 29, 1973 at 7:30 P.M., be approved.
Motion carried,
63912 - Moved by Miller, seconded by Cohea that the proof of publication of the
Notice of Public Hearing on plans and specifications for the relocation
of Randall -Wellington Pumping Station and the taking of bids, Contract
No. 176, be received and placed on file.
Motion carried.
63913 - The Mayor announced the time had arrived to hear objections, if any, to
the proposed plans and specifications, etc. for the Relocation of Randall
Wellington Pumping Station, Contract Noo 176, and asked if anyone present
wished to be heard or make objection, or if there were any written objec-
tions filed with the Clerk.
No one appeared to object orally, and the Clerk reported no written ob-
jections had been filed.
There being no objections made or filed, it was moved by Morrissey, sec-
oned by Miller that Resolution No, 22594, confirming the approval of the
plans, specifications, etc. fat the Relocation of Randall -Wellington
Pumping Station, Contract No. t76, be adopted.
On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey
voted Aye. Nay: None. Absent: Keller. Mayor declared the resolution
adopted.
63914 - Moved by Cohea, seconded by Morrissey that Resolution No. 22595, ordering
the Relocation of Randall -Wellington Pumping Station, Contract No. 176,
in the City of Waterloo, Iowa, be adopted.
On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey
voted Aye. Nay: None, Absent: Keller. Mayor declared the resolution
adopted.
63915 - No bids received.
Moved by Mabrey, seconded by Dykeman that the City Clerk be instructed
to republish Notice for taking of bids for the Relocation of Randall
Wellington Pumping Station, in the City of Waterloo, Iowa, Contract No,
176, said date being reset as June 25, 1973 at 7:30 P.M.

63916 - Moved by Cavanaugh, seconded by Morrissey that the proof of publication
of the Notice of Proposal to Dispose of Real Estate known as Lot 11,
McIntyre's Subdivision, in the City of Waterloo, Iowa, as fully described
in the said notice published in the Waterloo Daily Courier on May 10 and
17, 1973, to James Esters, for the sum of $100.00 plus costs, be received
and placed on file.
Motion carried,
63917 - The Mayor announced the time had arrived hear objections, if any, and
asked if anyone present wished to be heard or make objections,, or if
any written objections had been filed with the Clerk.
No one appeared to object orally and the City Clerk reported there had
been no written objections placed on file.
After public hearing and no objections having been made or filed, it was
moved by Dykeman, seconded by Miller that Resolution No, 22596, approv-
ing and authorizing the sale and conveyance of Lot 11, McIntyre's Sub-
division, as fully described in the Notice of Proposal to Dispose of Real
Estate published in the Waterloo Daily Courier on May 10 and 17, 1973,
to James Esters for the sum of $100.00 plus costs, and directing and
authorizing the Mayor and City Clerk to execute and deliver a deed for
said property, be adopted.
On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey
voted Aye. Nay: None. Absent: Keller. Mayor declared the resolution
adopted®
63918 - Carl Kessel of 2362 Independence Avenue spoke in regard to the drainage
ditch west of Bishop Avenue. Mr. Kessel asked if there will he a similar
drainage ditch east of Bishop Avenue and if the property owners could
dig their own drainage ditch in back of their property. City Engineer,
Richard King reported a drainage ditch on the east side of Bishop Avenue
is not planned at the present time. However, he could set grade stakes
to show the level of the drainage ditch. The City Engineer stated if
he had signatures from all or most of adjacent property owners, the de-
tails could be worked out on this drainage ditch.
Carl Kessel stated he would get signatures and report back to the City
Engineer.
63919 - Richard L. King, City Engineer, presented to the Council petitions re-
questing the installation of sanitary sewer in Suburban Heights area.
Moved by Morrissey, seconded by Mabrey that the above petitions be re-
ceived, placed on file and referred to the City Engineer to be included
in a future program at the time of sanitary sewer servicing of Triangle
Terra° e

63920 - Moved by Dykeman, seconded by Miller that the application and bond from
Crossroads Merchants' Association of Waterloo, requesting permission to
stage fireworks display at 2060 Crossroads Blvd., on July 3, 1973, be
received, placed on file and permission granted subject to approval of
the Fire Chief.
Motion carried.
63921 - Moved by Cohea, seconded by Morrissey that the communication from the
Grace Lutheran Church, West Seventh and Allen Street, asking permission

to erect directional signs in three locations, Fourth and Allen (both
ways), Johnson and Williston (both ways), and at Washington and Seventh
(both ways), be received, placed on file and request granted.

63922 Moved by Mabrey, seconded by Cohea that the communication from the Black
Hawk County Auditor advising offers have been made for Lot 2, Block 6,
Ricker & Bratnober's Land Co. Add., Lot 2, Block 2, Lane & Fay-Mler's Add
Lot 29, Behm Add., SE 35' Lot 10, Block 45, Original Plat Wloo East for
an amount less than taxes due, on which Black Hawk County holds title,
and requesting City Council to accept offers for Lot 2, Block 6, Ricker
& Bratnober's Land Co. Add., Lot 2, Block 2, Lane & Fowler's Add., Lot
29, Behm Add., S(E 35' Lot 10, Block 45, Original Plat Wloo. East toget-
her with reports of the Director of Public Works, City Engineer, City
Plan and Zoning Commission Administrator, and Building Official, be re-
ceived, placed on file, sale of Lot 2, Block 6, Ricker & Bratnober's

63923 - Moved by Dykeman, seconded by Morrissey that the communication from the
City Engineer, transmitting the request from Architectural. Sheet Metal
Products, Inc., Waterloo, Iowa, for permission to widen the existing
curb cut to 24 feet at 1715 Jefferson Street, as shown on the attached
print, and recommmending approval subject to the provisions of his let-
ter, be received, placed on file, recommendations approved and permis-
sion granted in accordance therewith and at no cost to the City of Water-
loo, Iowa.

63924 - Moved by Miller, seconded by Mabrey that the communication from the City
Engineer, transmitting the request from. Charles W. Granger for permis-
sion to construct temporary asphalt driveway without regard to sidewalk
grade at 3641 Kimball Avenue, Waterloo, Iowa, together with $3000 in.
cash for recording waiver, and recommending approval subject to the pro-
visions of his letter, be received, placed on file, request approved and
Resolution No. 22597, granting permission and authorizing construction
irrespective of later official grade, be adopted.
On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey
voted Aye. Nay: None. Absent: Keller. Mayor declared the resolution
adopted.
63925 - Councilman Miller asked if Mr, Gene Condon has a permit for a driveway
at this time.
Mayor Turner reported he is widening the driveway and wanted to place
sidewalk next to the curb because of the grade. This is a deviation
from the policy of the City.
Councilman Dykeman asked the City Engineer the amount of the drop. City
Engineer, Richard King, reported the drop was less than 6".
Moved by Dykeman, seconded by Cohea that the communication from Mr. Gene
Condon of 3211 W 9th Street requesting sidewalk along the curb adjacent

63925 - to his property, together with report from. the Assistant City Engineer,
stating by city policy, we do not installsidewalk next to a curb be-
cause this area is used for storing snow and is hazardous with respect
to pedestrians being close to traveled street, be received, placed on
file and request denied.

63925A- Moved by Cavanaugh, seconded by Cohea that the communication from the
City Engineer, transmitting Change Order #2 at a decrease in cost of
$328.93 for work performed by Denman Phillips Construction Cmpany, Inc.
for the Grant Educational Park, Project Iowa OSC-54 (PICS, C-atract No.
3, and recommending approval, be received, placed on file, approved and
the Mayor and City Clerk authorized to sign same in behalf of the City
of Waterloo, Iowa.
On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey
voted Aye, Nay° None. Absent: Keller. Mayor declared the motion
carried.
63926 - Mayor Lloyd Turner reported that he is concerned because J. L. Rooff, Jr
Excavating Company has not cleaned up their present contract with the
City
Jim Rooff assured the Mayor he would complete the work as soon as possi-
ble, that he had been held up with a court case on one of the properties
He, also, assured the Mayor he could handle triis contract and will com-
plete the work within the 90 -day period.
Moved by Miller, seconded by Mabrey that the Contract and Bond of J. L.
Rooff, Jr, Excavating Company, Waterloo, Iowa, for the Demolition of
500-502-504 Commercial Street; 209-13 Park Avenue; 505 Jeffe:rE n Street;
Parking Lots; 228-226-224-222-220-218-216 West Fourth Street; Alley be-
tween Park Avenue and West Fourth Street and Alley from Jefferson to
East and West Alley, 1973 Conway Square Civic Center Demolition, Contract
No. 2, in the amount of $43,520.00, be received, placed on file and Res-
olution No. 22598, approving said Contract and Bond, be adopted.

63927 - Moved by Morrissey, seconded by Cohea that the communication from. the
Cit:y'Engineer, transmitting a contract dated 5/16/73 between the City
of Waterloo and the Waterloo Community School District wherein the City
offers to purchase certain real property for R -O -W in Sec. 29 -89N -13W,
Commencing at a point 430 ft. south and 50 ft. west of the northeast
corner of Sec. 29-T89N-R13-W of the fifth principal meridian, Black
Hawk County, Waterloo, Iowa, thence south 890 ft. to a point 50 ft. west
of the east line of said section, thence west 25 ft., thence south 561
ft, to a point 75 ft. west of the east line of said section, thence west
30 ft., thence north 1,451 ft. to a point 55 ft. west of point of begin-
ning, thence east 55 ft, to the point of beginning. Said parcel contain
ing 1.51 acres, in the City of Waterloo, Iowa, in lieu of no assessment
for storm sewers and street paving of site development, and sum of $1.00
for 1972 Grading Program #1, Contract No. 12, purposes, and recommending,
approval, be received, placed on file, approved and accepted, the Mayor
and City Clerk authorized and directed to execute same in behalf of the
City of Waterloo, Iowa.

City Engineer, transmitting a contract dated 5/11/73 between the City
of Waterloo and the Waterloo Community School District wherein the City
offers to purchase certain real property in Sec. 29 -89N -13W, Commencing
at a point 75 ft. west and 33 ft, north of the east quarter corner of Sec-
tion 29-T89N-R13W on the fifth principal meridian, thence north 726 ft.

63928 - parallel with the east line of said section thence west 30 ft., thence
south 696 ft., thence_southwest 50 ft. to.a point 70 ft. west of point
of beginning, thence east 70 ft. to point of beginning, Black Hawk Coun
ty, Waterloo, Iowa (22.380 sq ft or O.51 acres) for the sum of
$1,745.64, for 1972 Grading Program #1, Contract No. 12, R -O -W purposes,
and recommending approval, be received, placed on file, approved and ac-
cepted, the Mayor and City Clerk authorized and directed to execute
same in behalf of the City of Waterloo, Iowa, and the City Clerk in-
structed to issue a warrant for $1,745.64 in payment therefor.

63929 Moved by Miller, seconded by Cohea that the communication from the City
Attorney, transmitting a Warranty Deed dated 5/29/73 from Vernon H.
Rausch and Hazel Ge Rausch, husband and wife, and Floyd D. Matejka and
Jeanette J. Matejka, husband and wife conveying unto the City of Water-
loo, Iowa, certain real property in Riverview Addition, be received,
placed on file and Resolution No. 22599, approving and accepting said
deed and directing the recording of same, be adopted.

voted Aye. Nay: None. Absent: Keller. Mayor declared the resolu-

lution preliminarily approving the plans and specifications, form of
contract, form of proposal, preliminary estimate of cost, etc. for the
construction of the 1973 Concrete Paving and Repair Program #1 - Con-
tract Noo 136, in the City of Waterloo, Iowa, be adopted.

to publish the Notice of Public Hearing on Plans and Specifications and
Proposed Form of Contract for the 1973 Concrete Paving & Repair Program
- Contract Noo 136, and the taking of bids for such improvements, said
date being set as June 25, 1973 at 730 P.M.

Building Official, transmitting petition and waiver for as„,essment from
Leota C. Stewart, Titleholder and Theodore and Ella Mae Griggs Contract

Street, be received, placed on file and approved.

63937 - Moved by Cohea, seconded by Morrissey that the Engineers' plans and speci
fications, form of contract, form of proposal, preliminary estimate of
cost, etc., for the Metropolitan Transit Authority Service and Storage
Building - Contract #B-27, in the City of Waterloo, Iowa, be received
and placed on file.
Motion carried.
63938 - The plans were explained by Director of Public Works, Jay Culver, who
showed plan for entering and leaving the building on W 13th and W 14th
Streets, with no entries from Black Hawk Street which is a busy street.
Mayor Turner asked Dale Mercer, Community Development Administrator, what
was the amount of the Federal Grant on this building. The Community De-
velopment Administrator reported the amount was $125,000.00. The Federal
Government share is 2/3 of this cost. He also reported there is a con-
tingency fund of 10% or $19,000.00, which could be applied for if the
contract overran the estimate of $135,000.00, and that the Department of
Transportation has approved the plans and specifications.
Moved by Miller, seconded by Cohea that Resolution Noe 22602, a Resolu-
tion preliminarily approving the plans and specifications, form of con-
tract, form of proposal, preliminary estimate of cost, etc. for the con-
struction of the Metropolitan Transit Authority Service and Storage Build.

City Engineer, transmitting Final Estimate Report and Certificate of
Completion and Recommendation of Acceptance as submitted by Brice, Pet-
rides and Associates, Inc., Engineers, as to work performed and materials
furnished by Denman Phillips Construction Company, Inc., Waterloo, Iowa,
for the construction of Project No. Iowa OSC-54 (PIC), Grant Educational
Park, City Contract No. 3, in the City of Waterloo, Iowa, and recommend-
ing approval, be received, placed on file, approved and Resolution No.
22603, approving the report, accepting the work and authorizing payment
in full accordingly, be adopted.

voted Aye. Nay: None. Absent: Keller. Mayor declared the resolution

63941 - Moved by Miller, seconded by Cavanaugh that the Completion Report of the
Building Official as to work performed and materials furnished by Wells
Electric, Inc., Contractors forthe remodeling of the canteen for North-
east Iowa Crime Commission Office, Purchase Order Noo 27824, and recom-
mending approval, be received, placed on file and Resolution No. 22604,
approving the report, accepting the work and authorizing payment in full
accordingly, be adopted.

Waterloo, Iowa, be, and the same is hereby approved for the issuance of
license, that the approval be endorsed on the application and forwarded
to the Iowa Beer and Liquor Control Department with certified fee receipt
duplicate copies of the application, etc., be received, placed on file,
and Resolution No. 22605, approving the application, be adopted:

tions and bonds for permission to sell cigarettes at various ''°cations
in the City of Waterloo, Iowa, be received, placed on file, the bonds
approved and permits granted.

63946 - Moved by Morrissey, seconded by Mabrey that the following application,
together with doctor's certificate and approval of the Chief of Police,
for taxicab driver's license, be received, placed on file and the lic-
ense granted:

63947 - Moved by Cohea, seconded by Dykeman that the report of the City Attorney,
advising that the bonds filed with the City Clerk up to the close of
business on June 4, 1973, as shown on the list attached to said report,
have been approved by him, be received, placed on file, and the report
and bonds approved.
