REGULAR SESSION
June 11, 1973 - 7:30 P,M,
The City Council of the City of Waterloo, Iowa, met in Regular Session in the
Council Chambers in the City Hall in said City at 7:30 P.M. on June 11, 1973.
Mayor Turner in the Chair.
Present: Councilmen Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and
Morrissey.
Absent: None.
Councilman Charles Dykeman offered the invocation.
63949 - Moved by Cohea, seconded by Miller that the Agenda, as proposed, for the
Regular Session of June 11, 1973 at 7:30 P.M., be accepted and approved.
Motion carried.
63950 - Moved by Morrissey, seconded by Cavanaugh that the Minutes of the Regular
Session held June 4, 1973 at 7:30 P.M., be approved.
Motion carried.
63951 - Moved by Miller, seconded by Cohea that the application and bond from
Sunnyside Country Club for permission to stage a fireworks display at
1600 Olympic Drive on July 4, 1973, with alternate date of July 8, 1973,
in case of inclement weather, be received, placed on file and permission
granted subject to approval of Fire Chief.
Motion carried.
63952 - Moved by Keller, seconded by Miller that the application and bond from
Tunis Speedway for permission to stage a fireworks display at 3717 Uni-
versity Avenue on July 4, 1973, with alternate date of July 8, 1973, in
case of inclement weather,be received, placed on file and permission
granted subject to approval of Fire Chief.

63953 - Moved by Miller, seconded by Mabrey that the communication from the City
Engineer, transmitting a request from Robert E. Mullen for permission to
construct a temporary asphalt driveway without regard to sidewalk grade
at 352 Fletcher Avenue, Waterloo, Iowa, together with $3.00 check for re-
cording waiver, and recommending approval subject to the provisions of
his letter, be received, placed on file, request approved and Resolution
No. 22607, granting permission and authorizing construction irrespective
of a later official grade, be adopted.
On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and
Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the
resolution adopted.
63954 - Moved by Miller, seconded by Mabrey that the communication from the City
Engineer, transmitting the request from Northland Products Company for
permission to black top the parking area in front of their plant at 1000
Rainbow Drive, for beautification purposes only (not to be used for park-
ing), be received, placed on file and approved at no cost to the City of
Waterloo.

63955 - Moved by Mabrey, seconded by Cohea that the communication from the City
Engineer, transmitting the request of Denman Phillips Construction Co.,
Inc., Waterloo, Iowa, for a ninety (90) day time extension for the com-
pletion of 1972 Sidewalk Repair Program, Contract #39, Component 2, in
the City of Waterloo, Iowa, and recommending approval, be received, pla-
ced on file and request granted.
Motion carried.
63956 - Moved by Dykeman, seconded by Morrissey that the communication from the
City Engineer, transmitting the request of Clayton E. Marquart:, Inc.,
Waterloo, Iowa, for a ninety (90) day time extension for the completion
of the 1972 Sidewalk Repair Program, Contract #39, Components 1 &. 3, in
the City of Waterloo, Iowa, and recommending approval, be received, pla-
ced on file and request granted.
Motion carried.
63957 - Bob Gunderson, City Plan and Zoning Administrator, reported that 22 out
of 31 property owners on Reber Avenue and 11 out of 15 on West Third
Street were against the installation and use of gas storage and distribu-
tion center in the shopping center site on the north side of Reber Avenue
and west side of Fletcher Avenue.
Moved by Cohea, seconded by Cavanaugh that the petition of Cleon Risse,
733 Reber Avenue, et al, objecting to the installation and use of gas
storage and distribution center in the Reber Square Shopping Center on
the north side of Reber Avenue and west side of Fletcher Avenue (see re-
vised site development plan, C.R.#63891, 5/29/73), be received and placed
on file.
Motion carried.
63958 - Under Council Action #63891 of 5/29/73, action was deferred on the revised
site development plan for the Reber Square Shopping Center, and was now
presented for consideration.
Councilman Mabrey asked if the gas distribution installation was in the
original building permit. The Building Official reported this was re-
quested later.
Moved by Dykeman, seconded by Keller that the revised site development
plan for the Reber Square Shopping Center allowing the Dillion Investment
Co., Inc. to install a gas storage tank and pumps at the Quick Shop gro-
cery store on the NW corner of the intersection of Reber Avenue and
Fletcher Avenue, be denied.
On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morri-
ssey voted Aye. Nay: None. Absent:None. Mayor declared the motion
carried.
63959 - Moved by Miller, seconded by Cohea that the communication from the City
Engineer, transmitting a request from F. A. Moser & Associates, Inc.,
Waterloo, Iowa, to close Fletcher Avenue at the Dike crossing for approx-
imately fifteen (15) working days, and to reduce the traffic at the Dike
crossing of Westfield Avenue to one lane during the John Deere inventory,
and recommending approval with the Corps' contractor instructed to pro-
ceed on the Dike contract at said locations, be received, placed on file,
recommendations approved and the Corps' contractor instructed to proceed
accordingly.

63960 - City Engineer King reported they would coincide the construction of the
Dike at Fletcher Avenue and the vacation period of John Deese Waterloo
Tractor Works. Councilman Dykeman raised the question of what if the con
tractor did not finish the work during thisthree week period. The City
Engineer said that this would still be the best time to do the work.
Moved by Cavanaugh, seconded by Morrissey that the communication from the
City Engineer, transmitting Change Order No. 1 for Huntington Road Storm
Sewer -Phase "A" Army Corps of Engineers' Flood Control Dike, Contract No.
88, at an additional cost of $3,500.00 (authorized under C.R.#63622, 4/10
73) and recommending approval, be received, placed on file and approved,
and the Mayor and City Clerk authorized and directed to sign same in be-
half of the City of Waterloo.
On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and
Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the
motion carried.
63961 - Moved by Mabrey, seconded by Cohea that the communication from Mayor
Turner, transmitting Planned Use Report Entitlement Period 3, January 1 -
June 30, 1973, and reporting on the use of the Federal Revenue Sharing
Funds, be received, placed on file, approved, and Resolution No, 22608,
directing the City Clerk to publish the notice of Revenue Sharing Alloca-
tion, be adopted.
On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and
Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the
resolution adopted.
63962 Moved by Keller, seconded by Miller that the communication from the City
Engineer, submitting a contract dated 6/11/73 with Schenk Engineering
Company, Waterloo, Iowa, for engineering services in preparation of de-
sign, plans, specifications, contract documents, cost estimate, staking,
etc. for paving, storm sewer and grading improvements for San Marnan Dr -

with Kimball Avenue, with the City's cost to be for the
dedicated right-of-ways, and the adjacent property owners to be assessed
507 of the cost,to be included with the paving assessment, and recommend-
ing approval, be received, placed on file, approved and Resolution No.
22609, approving and directing the execution of said contract by the
Mayor and City Clerk in behalf of the City of Waterloo, Iowa, be adopted.

Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the
resolution adopted.
63963 - Moved by Dykeman, seconded by Miller that the communication from the City
Engineer, submitting a contract dated 6/11/73 with Brice, Petrides &
Associates, Inc., Engineers, Waterloo, Iowa, in the amount of $9,800.00,
for engineering services for a Study of Improvements of Westfield Avenue
Storm Sewer, as shown on the attached plat, and recommending approval
with a report to the Council on 11/12/73 and an interim report on the
existing pump station maintenance and repair, be received, placed on file
approved and Resolution No. 22610, approving and directing the execution
of said contract by the Mayor and City Clerk in behalf of the City of
Waterloo, Iowa, be adopted.

63972 - Moved by Mabrey, seconded by Cohea that the following application, toget-
her with doctor's certificate and approval of the Chief of Police, for
taxicab driver's license, be received, placed on file and the license

63973 - Moved by Cohea, seconded by Mabrey that the following application for
dance license, approved by the Building Official, Fire Chief and Police
Chief, together with fee in the amount of $25.00, be received, placed on

63974 - Moved by Dykeman, seconded by Miller that the application and fee of
Merlin L. Uhlenhake, 157 University Avenue, for license and permission
to operate one (1) mobilized ice cream truck on the streets of the City
of Waterloo, Iowa, for a period of six months commencing June 11, 1973
and ending December 11, 1973, be received, placed on file and license
granted subject to certain restrictions.

63975 - Moved by Miller, seconded by Cohea that the report of the City Attorney,
advising that the bond filed with the City Clerk up to the close of bus-
iness on June 11, 1973, as shown on the list attached to said report,
have been approved by him, be received, placed on file, and the report
and bond approved.
