Mayor Turner in the Chair. Present: Councilmen Cavanaugh, Cohea, Dykeman, Keller, Mabrey and Miller. Absent: Councilman Morrissey. Councilman Charles Dykeman offered the invocation. 64019 - Moved by Cohea, seconded by Keller that the Agenda, as amended, for the Regular Session of June 25, 1973, at 7:30 P.M,, be accepted and approved. Motion carried. 64020 - Moved by Cavanaugh, seconded by Mabrey that the Minutes of the Regular Session held June 18, 1973 at 7:30 P.M,, be approved. Motion carried 64021 - Moved by Miller, seconded by Cohea that the proof of publication of No- tice of Hearing on proposed plans and specifications and proposed form of contract for the construction of the 1973 Concrete Paving and Repair Program No. 1, City of Waterloo, Iowa, and the Taking tf Bids for the Im- provement, Contract No. 136, be received and placed on file. Motion carried. 64022 The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objection, or if there were any written objections filed with the Clerk. No one appeared to object orally, and the Depit.y Clerk reported that no written objections had been filed. Thereupon, it was moved by Dykeman, seconded by Miller that Resolution No. 22635, confirming the approval of the plans, specification, form of contract, etc. for the 1973 Concrete Paving and Repair Program No. 1, Contract No, 136, in the City of Waterloo, Iowa, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey and Miller voted Aye. Nay: None. Absent. Morrissey. Mayor declared the resolution adopted. 64023 - Moved by Mabrey, seconded by Keller that Resolution No. 22636, ordering the construction of the 1973 Concrete Paving and Repair Program No. 1, Contract No. 136, in the City of Waterloo, Iowa, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey and Miller voted Aye. Nay: None. Absent. Morrissey. Motion carried. 64026 - The City Engineer, having checked the bids submitted for the 1973 Concrei Paving and Repair Program No. 1, in the City of Waterloo, Iowa, known as contract No. 136, reported that after checking the extensions and totals of the bids, the bid of Cedar Valley Corp. of Waterloo, Iowa in the amount of $585,190.81, was the lowest legal bid received. Moved by Dykeman, seconded by Cohea that Resolution No. 22637, accepting the bid of Cedar Valley Corp. of Waterloo, Iowa in the amount of $585,190.81 for the construction of the 1973 Concrete Paving and Repair Program No. 1, Contract No. 136, in the City of Waterloo, Iowa, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey and Miller voted Aye. Nay: None. Absent: Morrissey. Mayor declared the resolution adopted. 64027 - Moved by Cohea, seconded by Keller that the proof of publication of the notice of public hearing to vacate, sell and convey to Richard Garthoff and William E. Collins the north one-half and the south one-half of a 120' dead end East-West Alley in Block 7, Russell Heights Addition, on the east side of West Eleventh Street between Patton Avenue and Mitchell Avenue, in the City of Waterloo, Iowa, as more fully described in the publication in the Waterloo Daily Courier on May 31 and June 7, 1973, be received and placed on file. Thereupon, it was moved by Keller, seconded by Dykeman that an Ordinance be drawn and submitted vacating the north one-half and the south one- half of a 120' dead end East-West Alley in Block 7, Russell Heights Addi- tion, on the east side of West Eleventh Street between Patton Avenue and Mitchell Avenue, in the City of Waterloo, Iowa, as fully described in the published notice in the Waterloo Daily Courier on May 31 and June 7, 1973. Motion carried. 64029 - An Ordinance vacating the north one-half and the south one-half of a 120' dead end East-West Alley in Block 7, Russell Heights Addition, on the east side of West Eleventh Street between Patton Avenue and Mitchell Ave- nue, in the City of Waterloo, Iowa, was read by the Deputy City Clerk. Moved by Mabrey, seconded by Miller that the rules requiring ordinances to be read in full on three separate days be suspended, said Ordinance be recorded as having passed its first, second and third readings, and be now placed on its final adoption. Collins of a 120' dead end East-West Alley in Block 7, Russell Heights Addition, on the east side of West Eleventh Street between Patton Avenue and Mit- chell Avenue, in the City of Waterloo, Iowa, be adopted. Motion carried. 64034 - An Ordinance vacating all alleys in a square block originally known as Block 7, Original Plat of West Waterloo (bound by Commercial Street on the Northeast, West Fourth Street on the Southeast, Jefferson Street on the Southwest and West Park Avenue on the Northwest), in the City of Waterloo, Black Hawk County, Iowa, was read by the Deputy City Clerk. Moved by Keller, seconded by Miller that the rules requiring ordinances to be read in full on three separate days be suspended, said ordinance be recorded as having passed its first, second and third readings, and be now placed on its final adoption. Mayor declared the motion carried 64043 - Moved by Cavanaugh, seconded by Dykeman that the communication from the City Plan and Zoning Commission, transmitting the resubmission of a re- quest from Hugh Field, Attorney, in behalf of Display, Inc., for the Coun cil on its own motion to rezone Lots 479 and 480 in Pleasant View Addi- tion, except that part conveyed for highway purposes (East Ridgeway Ave- nue at its former intersection with LaPorte Road), in the City of Water- loo, Iowa, from "R-2" One and Two Family Residence District to "C-2" Com- mercial District, as shown on the attached plat, reporting the petition of consent was filed with the original request under Council Action #63539 of 3/26/73 and the consensus of said Commisson was to allow the existing billboard to become a legal use provided the waiver of access to both LaPorte Road and East Ridgeway Avenue are signed, be received, placed on file, approved and date of hearing set as July 16, 1973 at 7:30 P.M, and the Clerk instructed to publish the necessary notice. Motion carried. 64045 - Moved by Mabrey, seconded by Cohea that the communication from the Com- munity Development Administrator, submitting for Council consideration the offer from Bayard B. Taylor, 400 Dane Street, to purchase Disposal Parcel No. 30c and 38a in the Logan Avenue Urban Renewal Area, Project No. Iowa R-2, for side yard purposes, in the City of Waterloo, Iowa, for the sum of $200.00, together with a map, and reporting the Community De- velopment Board approved said sale, be received, placed on file, Resolu- tion No. 22639, a resolution authorizing the sale of Disposal Parcel No. 30c and 38a in the Logan Avenue Urban Renewal Area, Project No. Iowa R-2, be adopted, and the date of hearing set as August 6, 1973 at 7:30 P.M. Motion carried. 64050 - The Engineers, having checked the bids submitted for Sewage Treatment Plant Improvements, Phase V, in the City of Waterloo, Iowa, reported that after checking the extensions and totals of the bids, the bid of E. B. Spencer Engineering Co. and Youngblut Construction Company, Inc., Waterloo, Iowa, in the amount of $1,367,387.00, is the lowest bid re- ceived. Moved by Mabrey, seconded by Dykeman that Resolution No. 22643, accept- ing the bid of E. B. Spencer Engineering Co. and Youngblut Construction Company, Inc., Waterloo, Iowa, for the construction of the Sewage Treat- ment Plant Improvements, Phase V, in the City of Waterloo, Iowa, in the amount of $1,367,387.00, be adopted. Moved by Cohea, seconded by Keller that the rules requiring ordinances to be read in full on three separate days be suspended, that said ordinance be recorded as having passed its second and third readings (the first havll ing passed under C.R.#63987 of 6/18/73) and be now placed on its final adoption. Mayor declared the ordinance adopted. 64055 - Moved by Dykeman, seconded by Cohea that the communication from the Com- munity Development Administrator, reporting on Relocation Grievance Pro- cedure and transmitting a proposed "Resolution to appoint the members of the Community Development Board as the Relocation Grievance Board for the City of Waterloo and to approve the Relocation Grievance Procedure", be received, placed on file and Resolution No. 22645, appointing said members and approving said Procedure, be adopted. June 25, 1973 - 8 64056 - Moved by Mabrey, seconded by Cohea that the communication from the Execu- tive Director of the Low Rent Housing Commission, transmitting said Com- mission's Resolution No. 1973-27 adopted on 6/6/73 requesting a date be set for a public hearing for low-cost housing project for Ia-50-3 Turnkey Project, be received, placed on file, approved and Resolution No. 22646, a resolution of the Waterloo City Council ratifying and approving the con struction of 50 units of public housing within the City of Waterloo, Iowa as approved by the Department of Housing and Urban Development and as ap- proved by the Waterloo Low Rent Housing Commission and authorizing a pub- lic hearing to be held as to said project all in accordance with Chapter 403A.28 of the 1973 Code of Iowa, be adopted and said date set as July 16, 1973.
