The City Council of the City of Waterloo, Iowa, met in Regular Session in the Council Chambers in the City Hall in said City at 7:30 P.M. on August 20, 1973. Mayor Turner in the Chair. Present. Councilmen Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey. Absent: None. Councilman Glenda Mabrey offered the invocation. 64300 - Moved by Cohea, seconded by Keller that the Agenda, as amended, for the Regular Session of August 20, 1973 at 7:30 P.M:, be accepted and approved. Motion carried. 64301 - Moved by Cavanaugh, seconded by Miller that the Minutes of the Regular Session held August 13, 1973 at 7:30 P,.M., be approved. Motion carried. 64302 - Moved by Morrissey, seconded by Cohea that the proof of publication of the notice of public hearing to vacate a portion of unopened Kingsley Avenue lying east of the east line of Ansborough Avenue and west of NWly line of alley which parallels the C,N,W:R.,R. South of Lots 16, 17 and 18 in Lewis Miller's Small Farms, as fully described in the Waterloo Daily Courier on July 26 and August 2, 1973, be received and placed on file. Motion carried. 64303 - The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objections, or if any written objections had been filed with the Clerk. No one appeared to object orally, and the Clerk reported no written ob- jections had been filed. Thereupon, it was moved by Mabrey, seconded by Cavanaugh that an Ordin- ance be drawn and submitted vacating a portion of unopened Kingsley Ave- nue lying east of the east line of Ansborough Avenue and west of the northwesterly line of the alley which parallels the C.N.W.R-R,, being all that part lying South of Lots 16, 17 and 18 in Lewis Miller's Small Farms, in the City of Waterloo, Iowa, as described in the published notice in the Waterloo Daily Courier on July 26 and August 2, 1973. Motion carried. 64304 - An Ordinance vacating a portion of unopened Kingsley Avenue lying east of the east line of Ansborough Avenue and west of the northwesterly line of the alley which parallels the C.N,W.R.R., being all that part lying South of Lots 16, 17 and 18 in Lewis Miller's Small Farms, in the City of Waterloo, Iowa, was read by the Cleric. Moved by Dykeman, seconded by Cohea that said Ordinance be recorded as having passed its first reading. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay. None. Absent: None. Mayor declared the motion carried. - 2 - 64305 - Moved by Miller, seconded by Dykeman that the proof of publication of the notice of public hearing to vacate all the alley in Block 16, all of Clinton Street between Blocks 16 and 17, and all of Clinton Street between Blocks 1 and 2, Riverview Addition, as fully described in the Waterloo Daily Courier on July 26 and August 2, 1973, be received and placed on file. Moved by Keller, seconded by Miller that said Ordinance be recorded as having passed its first reading. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay. None. Absent. None. Mayor declared the motion carried. 64308 - Moved by Miller, seconded by Morrissey that the proof of publication of the Notice of Public Hearing for the amending of the Westfield -Virden Urban Renewal Project Iowa R-7, as fully described in the Waterloo Daily Courier on August 8 and 15, 1973, be received and placed on file. Motion carried. 64309 - Community Development Adminstrator Mercer spoke in favor of the $4.7M Amendatory Application, reporting it involved the construction of River Road,public improvements on Jefferson Street and West Third Street, Randall -Wellington, various other improvements and flood control, and presented to the Council letters of support from the following: U. Moved by Miller, seconded by Cohea that the above letters of support be received and placed on file. Motion carried. 64310 - Joe McMartin, 605 Burton Avenue, asked whether anyone from the Omaha HUD office would be in attendance at this hearing. Mayor Turner reported that no one from the Omaha Office would be present to explain the project, and further stated that this hearing was to satisfy the federal require- ment. Gayle Harrison, 1009 Conger Street, raised the question as to why the houses on Conger Street would be moved. The Mayor reported that the dike would be behind the houses on. Conger Street, with. Conger Street in front of them and it would not be a very good location for these houses unless they were moved. Ralph Thierman, 501 Riverside Drive, raised the question as to whether the houses in the 500 block of Riverside Drive would be included as well as the 400 block. The Mayor stated these houses would be included in the project. Mayor Turner then asked the question of the people present if they were objecting to the Amendatory and all three asserted they were not object- ing to the project, just raising questions. Thereupon, it was moved by Keller, seconded by Dykeman that Resolution No. 22749, a resolution approving the amending of the Westfield -Virden Urban Renewal Project, Iowa R-7, in the City of Waterloo, Iowa, be adop- ted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 64312 - Moved by Morrissey, seconded by Cohea that the communication from the Director of Public Works, submitting the following bids for the purchase of one (1) four -door sedan to be used by the Street Department, and rec- ommending acceptance of the low bid of Tate Cadillac Old4 Co., Inc., Waterloo, Iowa, in the amount of $2,175.00 with trade-in, be received, placed on file, approved and Resolution No. 22750, approving acceptance of said bid and authorizing the City Clerk to draw a warrant in payment therefor, be adopted: Name of the Bidder Amount Tate Cadillac Olds Co., Inc., Waterloo, Iowa With trade-in $2175.00 Schukei Motor Company, Waterloo, Iowa With trade-in $2186.48 On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. August 20, 1973 - 5 - 64314 - William Kroenecke, 3029 Huntington Road, objected to the dust problem on Huntington Road caused by hauling to the dike, stating the Road was to be watered every three hours and this was not adequate dust control. City Engineer King reported he was having Merlyn Nyght of the Engineer- ing Department check this dust problem and report back, and stated he had a report that one of the trucks which was to water the road had broke down. Moved by Mabrey, seconded by Morrissey that the above objection to the dust on Huntington Road be received, placed on file and the City Engi- neer instructed to check and report back to the Council. Motion carried. 64315 - City Engineer King said he had some concern about the curb repair that should be done in the Park Avenue and Cedar Street area. Moved by Morrissey, seconded by Cavanaugh that the communication from the City Engineer, transmitting a request from Flinn and Saito in behalf of the W. H. Hartman Publishing Company (Waterloo Daily Courier) for per- mission to relocate two curb cuts on Park Avenue and to replace sidewalk on Park Avenue and Cedar Street, as shown on the attached plat, and rec- ommending approval subject to the provisions of his letter, concurred by the Police Department, be received, placed on file, recommendations approved and permission granted in accordance therewith at no cost to the City of Waterloo, Iowa. Motion carried. 64316 - Moved by Dykeman, seconded by Miller that the communication from the City Plan and Zoning Commission, transmitting the request of S. F. McKenna for the Council on its own motion to rezone Lot 1, in Block 1 of Cole's Second Addition (SE side of West 4th Street and NE side of Bayard Street, from "R-4" Multiple Residence District to "C-1" Commer- cial District, as shown on the attached plat, and recommending approval, be received, placed on file, recommendations approved, date of hearing set as September 10, 1973 at 7:30 P.M. and the Clerk instructed to pub- lish the necessary notice. Motion carried. 64317 - Moved by Cavanaugh, seconded by Miller that the communication from the Community Development Administrator, submitting for Council considera- tion the offer from Johnny C. Rice, R.R. Noo 5, to purchase Disposal Parcel Noo 97A in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7, for side yard purposes, in the City of Waterloo, Iowa, for the sum of $100.00, together with a map, and reporting the Community Devel- opment Board approved said sale, be received, placed on file, Resolution No. 22751, a resolution authorizing the sale of Disposal Parcel No. 97A in the Westfield -Virden Urban Renewal Area, Project Noo Iowa R-7, be adopted, and the date of hearing set as September 24, 1973 at 7:30 P,M.. Mayor declared the resolution adopted. 64318 - Moved by Miller, seconded by Morrissey that the communication from the Community Development Administrator, submitting for Council considera- tion an offer from Norman and Dorothy Cohea to sell to the City of Water- loo property located at 1300 West Parker Street, for the sum of $11,500 for Unit C Waterloo Flood Control Project purposes, and recommending approval, be received, placed on file, approved and Resolution No. 22752, August 20, 1973 - 6 64318 - (Continued) a resolutionaccepting and approving a certain offer to sell real prop- erty to the City and accepting and approving certain deed, be adopted. Kanago for per- mission to construct a temporary concrete driveway without regard to sidewalk grade at 936 Lorraine Avenue, Waterloo, Iowa, together with $3.00 in cash for recording waiver, and recommending approval subject to the provisions of his letter, be received, placed on file, request approved and Resolution Noo 22753, granting permission and authorizing construction irrespective of a later official grade, be adopted. Motion carried. 64321 - Moved by Mabrey, seconded by Dykeman that the communication from the Community Development Administrator, transmitting "Modification of Con- tracts" for advance non-federal work, Cedar River at Waterloo, Iowa, Local Flood Protection Project, and requesting execution, be received, placed on file, approved, Resolution No. 22754, a resolution approving a Modification to an Agreement with the U.S. Army Corps of Engineers for advance non-federal work to be performed by the City of Waterloo, Iowa, in connection with the Local Flood Control Project, authorized by Cong- ress for the City of Waterloo, adopted and the Mayor and City Clerk authorized to execute same in behalf of the City of Waterloo, Iowa. City Engineer, transmitting Contract and Bond of Rohlin Con- struction Company, Inc., Estherville, Iowa, for construction of the 1973 Paving Project #2 -EDA 05-11-01380, Contract Noo 133, in the amount of $204,547.00, be received, placed on file and Resolution No. 22755, ap- proving said Contract and Bond, be adopted. Mayor declared the resolution adopted. 64323 - Housing Inspector Hoffman reported he had an objection from Robert Mason, Attorney, and he wanted the :Hous in g Ordinance to pass on second reading so they would have another week to study the ordinance. Councilman Keller said he, also, received an objection because of the additional department needing to approve any building or remodeling, he didn't like to see this additional delay, and requested an additional week for study. Moved by Dykeman, seconded by Miller that the rules requiring ordinances to be read in full on three separate days be suspended, that said ordin- ance be recorded as having passed its second and third readings (the first having passed under C.R,#64270 of 8/13/73) and be now placed on its final adoption, On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Mayor declared the ordinance adopted. 64326 - An Ordinance amending Ordinance Noo 2479, as amended, by adding Sub -Sec- tion No. 50 to Section 2A-5, rezoning certain property in the City of Waterloo, Iowa, was read by the Clerk. Moved by Mabrey, seconded by Miller that the rule§ requiring ordinances to be read in full on three separate days be suspended, that said ordin- ance be recorded as having passed its second and third readings (the first having passed under C.R. #64273 of 8/13/73) and be now placed on its final adoption. Mayor declared the motion carried. 64327 - Moved by Miller, seconded by Cohea that Ordinance No. 2640, an Ordinance amending Ordinance No. 2479, as amended, by adding Sub -Section No. 50 to Section 2A-5, rezoning certain property in the City of Waterloo, Iowa, be adopted. August 20, 1973 - 8 - 64328 - City Attorr y Lybbert reported the Traffic Ordinance was a culmination of a lot of work by Asst, City AttorneyJohn Warren, Lt. Junior Grimm of the Police Department and Quintin Parker of the Traffic and Street Signs De- partment, stating this was the first change in the ordinance in a number of years, and advising the Council to hold a public hearing in order to not have to publish the entire ordinance which was in book form. An Ordinance regulating, governing and controlling traffic and use of the streets, alleys and driveways of the City of Waterloo and providing penalties for violation of the provisions thereof and repealing all ord- inances inconsistent therewith, was read by the Clerk. Moved by Miller, seconded by Dykeman that the rules requiring ordinances to be read in full on three separate days be suspended, that said ordin- ancewbe recorded as having passed its first, second and third readings, and be now placed on its final adoption. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 64329 - Moved by Miller, seconded by Mabrey that Resolution No. 22756, fixing a date for public hearing on the adoption of a Traffic Ordinance for the City of Waterloo, Iowa, be adopted, said date being set as September 4, 1973. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 64330 Moved by Morrissey, seconded by Cavanaugh that Resolution No. 22757, ap- proving the minutes of the Community Development Board for their regular meeting held July 10, 1973, in the City of Waterloo, Iowa, be adopted. Mayor declared the resolution adopted. 64331 - Moved by Cavanaugh, seconded by Morrissey that the communication from the City Engineer, transmitting a statement dated 8/14/73 from Brice, Petrides & Associates, Inc., Engineers, Waterloo, Iowa, for final engi- neering services for the Maywood Sewers Project, Component 2, Contract No. 162, and recommending approval, be received, placed on file and Reso- lution No. 22758, approving the statement of said firm and authorizing payment accordingly, be adopted. Mayor declared the resolution adopted. 64332 - Moved by Morrissey, seconded by Cohea that the communication from the City Engineer, transmitting Final Estimate No. 1 Report as submitted by Brice, Petrides & Associates, Inc., Engineers, as to work performed and materials furnished by Hurst Plumbing Co., Inc., Contractors, Waterloo, Iowa, for the construction of the Westfield_ Avenue Saditary Sewer, known as Contract No. 179, in the City of Waterloo, Iowa, and recommending approval, be received, placed on file, approved and Resolution No. 22759, approving the Final Report and authorizing payment accordingly, be adopted. August 20, 1973 9 64333 - Moved by Cohea, seconded by Morrissey that the City Engineer be instruc- ted to prepare the plans, specifications, form of contract, form of pro- posal, preliminary estimate of cost, etc. for the 1973 Resurfacing pro- gram I., Contract No, 137, in the City of Waterloo, Iowa, Motion carried, 64334 - City Engineer King explained the slurry seal to be used in the 1973 Re- surfacing Program No, 1, Contract No. 137, and Director of Public Works Culver reported that the City would try this prcess to see how it worked and would evaluate same to determine how much further to go in the future with such a project. Moved by Cavanaugh, seconded by Cohea that the communication from the City Engineer, transmitting plans, specifications, form of contract, form of proposal, prelithinary estimate of cost, etc., for the 1973 Re- surfacing Program No. I, Contract No. 137, in the City of Waterloo, Iowa, be received and placed on file, Motion carried, 64335 Moved by Cohea, seconded by Morrissey that Resolution No. 22760, a reso- lution preliminarily approving the plans and specifications, form of con- tract and bond, estimate of cost, etc. for the 1973 Resurfacing Program I, Contract No. 137, in the City of Waterloo, Iowa, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye, Nay: None. Absent: None. Mayor declared the resolution adopted. 64336 - Moved by Mabrey, seconded by Cavanaugh that the City Clerk be instructed to publish the 'Notice of Public Hearing" on the plans and specifications form of proposal, form of contract and bond, estimate of cost, etc., for the construction of the 1973 Resurfacing Program No, 1, in the City of Waterloo, Iowa, known as Contract Noo 137, and the taking of bids for the improvement, said date having been set as September 10, 1973 at 7:30 P,M. in the City Hall in the Council Chambers. Motion carried. 64337 - Moved by Cohea, seconded by Keller that the applications and fees as shown on the attached sheet for various Beer Permits and/or Beer and Liquor Licenses as designated, at the locations shown, in the City of Waterloo, Iowa, be, and the same are hereby approved for the issuance of said Permits and/or Licenses, that the approval be endorsed on the applications and forwarded with fees and/or certified fee receipts to the Iowa Beer and Liquor Control Department, and duplicate copies of applications, be received, placed on file, and Resolution No. 22761, approving the applications, be adopted.
