The City Council of the City of Waterloo, Iowa, met in Regular Session in the Council Chambers in the City Hall in said City at 7.30 P,M, on August 27, 1973. Mayor Turner in the Chair. Present. Councilmen Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey. Absent: None. Councilman Charles Dykeman offered the invocation. 64342 - Moved by Cohea, seconded by Morrissey that the Agenda, as amended, for the Regular Session of August 27, 1973 at 730 P>M,., be accepted and ap- proved. Motion carried. 64343 - Moved by Cavanaugh, seconded by Cohea that the Minutes of the Regular Session held August 20, 1973 at 7:30 P.M,, be approved. Motion carried. 64344 - Moved by Miller, seconded by Keller that the proof of publication of the Notice of Public Hearing on plans and specifications for the Demolition and Reconstruction of Ranchero Road Bridge, 1973, in the City of Water- loo, Iowa and the taking of bids for the improvement, Bridge Contract No. 10, be received and placed on file. Motion carried. 64345 - The Mayor announced the time had arrived to hear objections, if any, to the proposed plans and specifications, etc. for the Demolition and Recon- struction of Ranchero Road Bridge, 1973, known as Bridge Contract No. 10, and asked if any one present wished to be heard or make objection, or if there were any written objections filed with the Clerk. No one appeared to object orally, and the Clerk reported no written ob- jections had filed. There being no objections made or filed, it was moved by Keller, second- ed by Miller that Resolution No. 22762, confirming the approval of the plans, specifications, etc, for the Demolition and Reconstruction of Ranchero Road Bridge, 1973, known as Bridge Contract No. 10, in the City of Waterloo, Iowa, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: None, Mayor declared the resolution adopted. 64346 Moved by Mabrey, seconded by Cohea that Resolution No. 22763, ordering the Demolition and Reconstruction of Ranchero Road Bridge, 1973, in the City of Waterloo, Iowa, known as Bridge Contract No. 10, be adopted. Motion carried. 64349 - Moved by Cavanaugh, seconded by Mabrey that the proof of publication of the Notice of Public Hearing on plans and specifications and proposed form of contract for the 1973 Sanitary Sewer Program II, Contract No. 173, Alternate Outlet, be received and placed on file. Motion carried. 64350 - The Mayor announced the time had arrived to hear objections, if any, to the proposed plans, specifications, etc. for the construction of the 1973 Sanitary Sewer Program II, Contract No. 178, and asked if anyone present wished to be heard or make objection, or if there were any writ- ten objections filed with the Clerk. The Clerk reported there were no written objections, and no one appeared to object orally. After public hearing and no objections having been made or filed, it was moved by Cohea, seconded by Cavanaugh that Resolu- tion No. 22764, confirming the approval of plans, specifications, etc., for the construction of the 1973 Sanitary Sewer Program II, Contract No. 178, in the City of Waterloo, Iowa, be adopted. On roll call, Cavanaugh,Cohea, Dykeman,Keller,Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent; None. Mayor declared the resolution adopted. 64351 - Moved by Cavanaugh, seconded by Morrissey that Resolution No. 22765, ordering the construction of the 1973 Sanitary Sewer Program II, Con- tract No. 178, in the City of Waterloo, Iowa, be adopted. Mayor declared the resolution adopted. 64353 - The Engineers, having checked the bids for the Demolition and Reconstruc. tion of Ranchero Road Bridge, 1973, known as Bridge Contract No. 10, re- ported that after checking the extensions and totals of the bids submit- ted, the bid of Westendorf Construction Co., of Waverly, Iowa in the amount of $28,288.35, is the lowest legal bid received. Moved by Dykeman, seconded by Keller that Resolution No. 22767, accept- ing the bid of Westendorf Construction Co. of Waverly, Iowa in the amou- nt of $28,288.35, for the Demolition and Reconstruction of the Ranchero Road Bridge, known as Bridge Contract No. 10, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent, None. Mayor declared the resolution adopted. 64354 - Moved by Morrissey, seconded by Cavanaugh that the proof of publication of the Notice of Public Hearing on Proposal to sell real estate in the City of Waterloo, Iowa, known as Disposal Parcel No. 31a in the Logan Avenue Urban Renewal Area, Project No. Iowa R-2, for use as a side yard, as fully described in the said notice published in the Waterloo Daily Courier on July 26, 1973, be received and placed on file. Motion carried. 64355 - The Mayor announced the time had arrived to hear objections, if any; and asked if anyone present wished to be heard or make objection, or if any written objections had been filed with the Clerk. August 27, 1973 - 4 - 64357 - The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objection, or if any written objections had been filed with the Clerk. No one appeared to object orally, and the City Clerk reported there had been no written objections placed on file. After public hearing and no objections having been made or filed, it was moved by Cohea, seconded by Keller that Resolution No. 22769, a resolu- tion approving the sale of Disposal Parcel No. 9 and 9a in the Logan Ave- nue Urban Renewal Area, Project No. Iowa R-2, and authorizing the execu- tion of the necessary contract for sale of land for private redevelop- ment and deed, be adopted. Mayor declared the resolution adopted, 64358 - Mayor Turner presented to City Clerk Andrew A. Blomberg a Certificate of Completion of Three Year Annual Seminar for Professional Municipal Clerks conducted under the auspices of the Certification Board of International Institute of Municipal Clerks and Syracuse University. 64359 - Councilman Miller orally requested reconsideration of the application of James R. Williams dba Metropolitan Patient Transfer, 4304 Rownd Street, Cedar Falls, Iowa for an Ambulance License, denied under Council Action #64295 of 8/13/73, reporting that there was some indication that if the City went to a public hearing, it would cost the taxpayer money, and then the court would probably allow this person a license. City Attorney Lybbert advised that this was a new application because the first time it was submitted it was not complete with the proper in- surance clause, so, therefore, it could be taken up at this time. Mayor Turner stated that the previous denial was because the application was not complete. Moved by Miller, seconded by Cohea that Council Action #64295 of 8/13/73 be rescinded and the application of James R. Williams dba Metropolitan Patient Transfer, 4304 Rownd Street, Cedar Falls, Iowa, for an Ambulance License be brought up for reconsideration. On roll call, Cavanaugh, Cohea, Dykeman, Keller and Miller voted Aye. Mabrey and Morrissey voted Aye with prejudice. Nay: None. Absent: None. Mayor declared the motion carried. 64360 - Moved by Cohea, seconded by Keller that the application of James R. Williams dba Metropolitan Patient Transfer, 4304 Rownd Street, Cedar Falls, Iowa, for an Ambulance License be approved and said license granted. Motion carried with Councilman Mabrey voting Aye with prejudice. 64361 - Ray Mount of the Waterloo Ambulance Company reported that the James R. Williams ambulance service was owned by someone else. Mayor Turner reported the City did not have good cause for denial of this Ambulance License in the Court of Law so, therefore, due to this reason the License was granted. August 27, 1973 - 5 - 64362 - Moved by Morrissey, seconded by Cohea that the communication from the Director of Public Works, transmitting a request from the Chicago, Rock Island and Pacific Railroad Company for permission to do necessary cros- sing work on their tracks which cross Cleveland Street, as shown on the attached print, and recommending approval subject to a run around be made available with completion of work by 9/15/73, be received, placed on file and granted. Motion carried. 64363 - Moved by Miller, seconded by Keller that the communication from the City Plan and Zoning Commission, transmitting the request from Young Develop- ment Company for the Council on its own motion to rezone from "A-1" Ag- ricultural District to "R-2" One and Two Family Residence District, part of Tract C, Southridge, (south of Rachael Street and west of Colby Road extended south of Hoover Junior High School), as shown on the attached plat, in the City of Waterloo, Iowa, and recommending approval, be re- ceived, placed on file, recommendations approved, date of hearing set as September 17, 1973 at 7:30 P.M, and the Clerk instructed to publish the necessary notice. Motion carried, 64364 - Moved by Keller, seconded by Cohea that the communication from the City Plan and Zoning Commission, transmitting the request from General Lease - ways, Inc. for the Council on its own motion to rezone Lots 1, 2 and 3 in Gronberg Addition (south side of Highway #57, Airline Hiway, and east side of Burton Avenue), in the City of Waterloo, Iowa, from "A-1" Agric- ultural District to "M-1" Light Industrial District, as shown on the attached print, and recommending approval, be received, placed on file, recommendations approved, date of hearing set as September 17, 1973, at 7:30 P.M, and the Clerk instructed to publish the necessary notice. Motion carried. 64365 Moved by Miller, seconded by Cohea that the communication from the City Plan and Zoning Commission, transmitting the request of Occidental De- velopment, Ltd. for the Council on its own motion to rezone from "A-1" Agricultural District and "R-2" One and Two Family Residence District to"R-4" Multiple Residence District certain real property located in part of Section 2 -88N -13W (approximately 1,000 feet south of East Ridge- way Avenue between Hammond Avenue and proposed Wisconsin Street extended) as shown on the attached plat, in the City of Waterloo, Iowa, and recom- mending approval, be received, placed on file, recommendations approved, date of hearing set as September 24, 1973 at 7:30 P,M,and the Clerk in- structed to publish the necessary notice. Motion carried. 64366 - Moved by Mabrey, seconded by Morrissey that the communication from the City Plan and Zoning Commission, transmitting the request of John Beek- man, Attorney in behalf of Granger and Associates, Inc., for the Council on its own motion to rezone from "A-1" Agricultural District to "C-1" Commercial District, Tract F of proposed Southbrooke located in S2 of SW4 of Section 3-88-13 (between East San Marnan Drive and Southbrooke Drive west of West Ninth Street), as shown on the attached print, in the City of Waterloo, Iowa, and recommending approval, be received, placed on file, recommendations approved, date of hearing set as Septem- ber 17, 1973 at 7.30 P,M and the Clerk instructed to publish the neces- say notice. August 27, 1973 - 6 - 64367 - Moved by Cohea, seconded by Cavanaugh that the Revenue Sharing Actual Use Report, January 1 thru June 30, 1973, be received, placed on file, approved and Resolution No. 22770, directing the City Clerk to publish the notice of Revenue Sharing Actual Use, be adopted. Mayor declared the resolution adopted. 64368 - Moved by Morrissey, seconded by Miller that the communication from the City Plan and Zoning Administrator, transmitting revised Preliminary Plat of Southbrooke in the City of Waterloo, Iowa, report of the City Engineer Deed of Dedication, City Plan and Zoning Commission Resolution of Appro- val, and recommending approval, be received, placed on file and Resolu- tion No. 22771, approving said revised Preliminary Plat, be adopted. "Hap" Rooff Construc- tion & Demolition Co., Inc., Waterloo, Iowa, for the Demolition of Old Buildings, Contract No. B-30, in the amount of $4,875.00, be received, placed on file and Resolution No. 22772, approving said Contract and Bond, be adopted. Mayor declared the resolution adopted. 64370 - An Ordinance vacating all the alley in Block 16, all of Clinton Street between Blocks 16 and 17, and all of Clinton Street between Blocks 1 and 2, Riverview Addition, in the City of Waterloo, Iowa, was read by the Clerk. Two interested property owners of this area wanted to know why Kenyon Avenue was not kept open, there were cars parked on both sides of Kenyon Avenue at certain times and no one could get through, when was Jack Weekley planning on getting rid of some of these cars as some have been there over two and three years, and why didn't he move further down in Riverview where there was a wide open space and would not bother anyone. Mayor Turner stated the City needed to establish the boundaries of Kenyon Avenue and make sure that Mr. Weekley put up a fence and contained his operation within this fence, and that the City would have to survey and find out the exact location of Kenyon Avenue. He further stated that there was an anti -burning ordinance, that cars had to be stripped before they were disposed of, and this cost more than the car bodies were worth. Moved by Mabrey, seconded by Dykeman that the rules requiring ordinances to be read in full on three separate days be suspended, that said ordin- ance be recorded as having passed its second and third readings (the first having passed under C #64307 of 8/20/73) and be now placed on its final adoption. Mayor declared the ordinance adopted. 64372 - An Ordinance vacating a portion of unopened Kingsley Avenue lying east of the east line of Ansborough Avenue and west of the Northwesterly line of the alley which parallels the C.N.W.R.R., being all that part lying South of Lots 16, 17 and 18 in Lewis Miller's Small Farms, in the City of Waterloo, Iowa, was read by the Clerk, Moved by Dykeman, seconded by Miller that the rules requiring ordinances to be read in full on three separate days be suspended, that said ordin- ance be recorded as having passed its second and third readings (the first having passed under C.R,#64304 of 8/20/73) and be now placed on its final adopteion. Moved by Keller, seconded by Dykeman that said Ordinance be recorded as having passed its third reading (the first having passed under C. R. # 64286 of 8/13/73, the second under C.R.#64323 of 8/20/73), and now placed on its final adoption° On roll call, Cavanaugh, Cohea, Dykeman, Keller, Mabrey, Miller and Morrissey voted Aye. Mayor declared the Ordinance adopted. 64376 - Moved by Miller, seconded by Mabrey thatt the communication from the City Engineer, transmitting Final Pay Statement for the Demolition of Struct- ures at 500502-504 Commercial Street, 209-13 Park Avenue, 505 Jefferson Street, 216-218-220-222-224-226-228 West Fourth Street, Municipal Parking Lots on Jefferson and Commercial Street, Alley between Park Avenue and West Fourth Street, Alley from Jefferson Street to East and West Alley in the City of Waterloo, Iowa, known as 1973 Conway Square Civic Center Demolition Contract No. 2, as to work performed and materials furnished by J. L. Mayor declared the resolution adopted. 64378 - Moved by Cohea, seconded by Dykeman that the communication from the City Engineer, transmitting the Final Pay Statement as to work performed and materials furnished by Don Gardner Construction Company, Contractors, Waterloo, Iowa, for the construction of the Municipal Service Station, Contract No. B-26, in the City of Waterloo, Iowa, together with Mainten- ance Bond, and recommending approval, be received, placed on file, Main- tenance Bond approved and accepted, and Resolution No. 22775, approving the Final Pay Statement, accepting the work and authorizing payment in full accordingly, be adopted. Mayor declared the resolution adopted. 64379 - The final location of the F A designated road was explained by Mayor Turner, same being the new Hackett Road from Viking Road to U,S.. Highway #63, and he stated this was necessary to receive federal aid for this road. Councilman Keller asked why the City had to go through the Highway Com- mission for approval. Mayor Turner reported all major federal roads had to go through the Iowa State Highway Commission. Councilman Keller asked what the financing would be. City Engineer King reported 70% federal and 30% local. Moved by Dykeman, seconded by Miller that the communication from the City Engineer, referring to Resolution No. 21428 of 8/23/71, Minutes of the Policy Board Meeting of Waterloo Metropolitan Area Transportation Study of 1/18/73, and Minutes of Technical Committee Meeting of Waterloo Metropolitan Area Transportation Study of 1/18/73, and recommending adop- tion of a resolution including Hackett Road from Viking Road to U.S. Highway #63 as a FAM designated road, be received, placed on file and Resolution No. 22776, authorizing the submission to the Iowa State High- way Commission of a listing and a map indicating proposed additional street selected as forming the Federal -Aid Metropolitan System in Water- loo, Iowa, in connection with the Federal -Aid Highway Act of 1970, be adopted.
