REGULAR SESSION _
September 4, 1973 - 7:30 P.M;
The City Council of the City of Waterloo, Iowa, met in Regular Session in the
Council Chambers in the City Hall in said City at 7:30 P.M on September 4, 1973
Mayor Turner in the Chair.
Present: Councilmen Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey.
Absent: Councilman Keller.
Councilman Glenda Mabrey offered the invocation.
64397 - Moved by Cohea, seconded by Morrissey that the Agenda, as amended, for
the Regular Session of September 4, 1973 at 7:30 P.M:, be accepted and
approved.
Motion carried.
64398 - Moved by Cavanaugh, seconded by Mabrey that the Minutes of the Regular
Session held August 27, 1973 at 7:30 P,M. and the Special Session held
August 29, 1973 at 4:00 P.M., be approved.
Motion carried.
64399 - Mayor Turner reported that the second notice of public hearing on adop-
tion of a complete Plumbing Code was, through inadvertence, not publishes
until Sunday, September 2, 1973, and, therefore, did not comply with the
legal requirement of the last publication being no less than five days
before said hearing.
Moved by Miller, seconded by Dykeman that Resolution No. 22780, fixing
a new date for public hearing on the adoption of a Plumbing Code for the
City of Waterloo, Iowa, be adopted, said date being set as September 17,
1973.
On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey
voted Aye, Nay: None. Absent: Keller. Mayor declared the resolution
adopted.
64400 Moved by Morrissey, seconded by Cohea that the proof of publication of
the Notice of Public Hearing on Adoption of a complete Traffic Ordinance
as published in the Waterloo Daily Courier on August 23 and 30, 1973, be',
received and placed on file.
Motion carried.
64401 - The Mayor announced the time had arrived to hear objections, if any, and
asked if any one present wished to be heard or make objection, or if
there were any written objections filed with the Clerk.
The Clerk reported that no written objections had been filed, and no
one appeared to object orally.
After public hearing, and no objections having been made or filed, it
was moved by Dykeman, seconded by Miller that Resolution No. 22781, ad-
opting a Traffic Ordinance in a bound complete municipal code form for
the purpose of regulating, governing and controlling traffic and use of
the streets, alleys, and driveways of the City of Waterloo, Iowa and
providing penalties for violation of the provisions thereof and repeal-
ing all ordinances inconsistent therewith, be adopted.

adopted.
64402 An Ordinance regulating, governing and controlling traffic and use of
the streets, alleys and driveways of the City of Waterloo and providing
penalties for violation of the provisions thereof and repealing all
ordinances inconsistent therewith, was read by the Clerk,
Moved by Miller, seconded by Cohea that the rules requiring ordinances
to be read in full on three separate days be suspended, and that said
ordinance be now placed on its final adoption.
On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey
voted Aye. Nay: None. Absent: Keller. Mayor declared the motion
carried,
64403 - Moved by Mabrey, sec.nded by Cavanaugh that Ordinance No. 2644, an Ord-
inance regulating, governing and controlling traffic and use of the
streets, alleys and driveways of the City of Waterloo and providing
penalties for violation of the provisions thereof and repealing all
ordinances inconsistent therewith, be adopted.
On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey
voted Aye. Nay, None. Absent: Keller. Mayor declared the ordinance
adopted,
64404 Councilman Miller reported that this salt and sand spreader machine
could be used for shoulder repair on highways so it could be useable
the year around.
Moved by Morrissey, seconded by Cohea that the communication from the
Director of Public Works, transmitting a quotation from Elliott Equip-
ment Company on a Hi -Way Do -Al salt and sand spreader for the sum of
$5,895.00, for use by the Street Department, and recommending approval,
be received, placed on file, recommendation approved and Resolution No.
22782, approving and accepting said quotation and authorizing the City
Clerk to draw a warrant in payment thereof, be adspted,

voted Aye. Nay: None. Absent; Keller. Mayor declared the resolu-
tion adopted.
64405 Councilman Morrissey asked about the ductwork change on the Mechanical
Contract and Robert Broshar, Architect, reported that ductwork change
was suggested by one of the bidders, and after investigation, he felt
this change could be made without any loss of efficiency of the heating
system,
Mayor Turner reported the total money on hand from the bond issue and
the interest earned on investments, stating this contract could be
entered into with the funds available.
Robert Broshar, Architect, asked if the City could give the contractor
a letter of intent to enter into a contract and the Mayor agreed that
such a letter could be issued,
Robert Broshar of Thorson, Brom, Broshar, Snyder, Architects, having
checked the bids submitted for the construction of Conway Square, a
Convention Center, reported that after checking the extensions and tot-
als of the bids, that the bids of

the General Contract,
Young Plumbing & Heating Co., Waterloo, Iowa, in the amount of $963,485
for the Mechanical Contract (including plumbing, heating and air con-
ditioning),
Paulson Electric Co., Waterloo, Iowa, in the amount of $373,988 for the
Electrical Contract
Communications Engineering Co,, Cedar Rapids, Iowa, in the amount of
$120,000 for the Sound System Contract, and
Krensky Fixture Co., Waterlce. I•>wa, in the amount of $98,728 for the
Kitchen Equipment Contract,
were -the lowest legal bids received, and recommended acceptance of same.
Moved by Dykeman, seconded by Cohea that the above recommendations be
received, placed on file and Resolution No. 22783, accepting the bids
for the construction of Conway Square, a Conventi•.n Center, of
0-M Construction Co., Waterloo, Iowa, in the amount of $2,488,500 for
the General Contract,

64406 - Mayor Turner recognized the Junior League members who were in attendance
at the Council meeting.
64407 - Mayor Turner recognized Robert O. Stevenson wh.; was in attendance at the
Council meeting.
64408 Moved by Cavanaugh, seconded. by Morrissey that the communication from
the City Engineer, transmitting five (5) copies of Iowa State Highway
Commission Application Form #559, with sketch attached, from Mr. Quick,
Inc., Moline, Illinois, requesting permission tcconstruct two (2) 27°
commercial entrances to E°.;S,. 218 at Sta. 402+9005 and 403+74.2, and rec-
ommending approval subject to the provisions of his letter, concurred
by the Police Department, be received, placed on file, recommendations
approved, and the Mayor and City Clerk authorized to sign said applica-
tion in behalf of the City of Waterloo.

64409 - Moved by Dykeman, seconded by Cavanaugh that the communication from the
City Engineer, transmitting the request of F. W. Means & Company, 600
Linden Avenue, for permission to pave the alley servicing the parking
area and access to said firm, and recommending approval subject to the
provisions of his letter, be received, placed on file, recommendations
approved and permission granted in accordance therewith at no cost to
the City of Waterloo.

Engineer, transmitting request from Peoples Bank and Trust Company, 3065
Kimball Avenue, for permission to construct curb and gutter, extend
storm sewer and surface one lane width of Kimball Avenue, and recommend-
ing approval subject to the provisions of his letter, be received, place(
on file, recommendations approved and permission granted in accordance
therewith at no cost to the City of Waterloo.

64411 - Moved by Morrissey, seconded by Cavanaugh that the communication from
the City Engineer, transmitting the request of Robert A, Case, LaPorte
City, for permission to construct one 18° curb cut at 3738 West 9th
Street, as shown on the attached plat, and recommending approval subject
to the provisions of his letter, concurred by the Police Department, be
received, placed on file, recommendations approved and permission grante(
in accordance therewith at no cost to the City of Waterloo.

64412 - Moved by Miller, seconded by Dykeman that the communication from the
City Engineer, transmitting request of Fo A. Moser & Associates, Inc.,
540 Ansborough Avenue, for permission to construct one 34° approach on
Ansborough Avenue and one 37' curb cut and apprach on Upton Avenue, as
shown on the attached plat, and recommending approval subject to the pro,
visions of his letter, concurred by the Police Department, be received,
placed on file, recommendations approved and permission granted in accor,
dance therewith at no cost to the City.

64413 Moved by Dykeman, seconded by Morrissey that the communication from the
Community Development Administrator, submitting for Council considera-
tion an offer from Robert A. and Marcella Cooling to sell to the City
of Waterloo their property located at 100 Cedar Bend for the future con-
struction of Unit "C" Waterloo Flood Control Program purposes, and rec-
ommending approval, be received, placed on file, approved and Resolution
No, 22784, a resolution accepting and approving a certain offer to sell
real property to the City and accepting and approving certain deed, be
adopted.

64414 - Moved by Mabrey, seconded by Miller that the communication from the
Black Hawk County Auditor, advising offers have been made for the fol-
lowing properties, in the amounts shown, on which Black Hawk County
holds title, and requesting City Council approval to accept the offers
for less than taxes and special assessments, and the report of the Di-
rector of Public Works, be received, placed on file and sale of said
properties approved subject to the City of Waterloo receiving special
assessment

64415 - Attorney Lybbert asked if the proposed architectural decorative projec-
tion over the windows of the Russell Lamson Building would protrude over
the sidewalk and drip on same. Building Official Tusler reported this
cover wouldbea three foot overhang and would not cover the whole side-
walk and he did not think this would be a problem.
Moved by Dykeman, seconded by Cohea that the communication from the Build
ing Official reporting the new restaurant being located in the L & M Pro-
perties, known as Russell Lamson Building, requests Council approval of
an architectural decorative projection over the windows, be received,
placed on file and approved.

64416 - Moved by Cohea, seconded by Morrissey that the communication from the
City Engineer, transmitting the request from Lawrence D. Simon for per-
mission to construct a temporary asphalt driveway without regard to side-
walk grade at 122 Trible Road, Waterloo, Iowa, together with $3.00 in
cash for recording waiver, and recommending approval subject to the pro-
visions of his letter, be received, placed on file, request approved and
Resolution No. 22785, granting permission and authorizing construction
irrespective of a later official grade, be adopted.

voted Aye. Nay; None. Absent. Keller. Mayor declared the resolution

64417 - Moved by Morrissey, seconded by Miller that the communication from the
City Engineer, transmitting two approved copies of Iowa State Highway
Commission Application Form #562, from the City of Waterloo, Iowa, for
permission to place sanitary sewer along U.S. Highway #63 and Iowa High-
way #57, be received, placed on file and approved.

64418 - Moved by Miller, seconded by Mabrey that the Contract and Bond of Westen-
dorf Construction Co., Waverly, Iowa, for the construction of the Demoli-
tion and Reconstruction of Ranchero Road Bridge, 1973, Bridge Contract
No. 10, in the amount of $28,288035, be received, placed on file and Res-
olution No. 22786, approving said Contract and Bond, be adopted.

voted Aye. Nay. None. Absent: Keller. Mayor declared the resolution
adopted.
64419 - Mayor Turner reported the Iowa Legislators passed a law whereby the City
would have to provide deferred compensation if requested by an employee,
which was the same as the school teachers have been able to purchase for
quite a few years, and that the deferred income deducted from the payroll
would be exempt from state and federal income taxes. He stated there
would be an open enrollment period of ninety (90) days following Septem-
ber 15, 1973, and before an employee could purchase the deferred compen-
sation, the representatives would make a check to see if the employee
could afford to buy such deferred compensation.

tion approving and authorizing deferred compensation programs for City
of Waterloo employees, be adopted.

64420 Moved by Cavanaugh, seconded by Morrissey that the two communications
from the Low Rent Housing Commission submitting the minutes of their
special meeting held on August 6, 1973 and regular meeting held on Aug-
ust 8, 1973, be received, placed on file and Resolution No. 22788, appro-
ving said minutes, be adopted.

voted Aye. Nay. None. Absent: Keller. Mayor declared the resolution
adopted.
64421 - Councilman Mabrey raised the question of the people living in the 200
block of Ash Street and City Engineer King reported that the petitions
for paving only requested the 100 block and this was all that was re-
viewed.
Moved by Cavanaugh, seconded by Cohea that the communication from the
City Engineer, transmitting a Preliminary Plat and Estimated Costs for
concrete paving and for asphalt paving of the 100 block of Ash Street,
from I,C,R:R. to Douglas Street as petitioned by Mr. and Mrs. Lonnie
Moore, 123 Ash Street, et al (see C<R,#54309 of 5/6/68 and C.R,#54450
Of 5/20/68), be received, placed on file asphalt paving approved, and
the City Engineer instructed to include said street in the 1974 Asphalt
Paving Program.

64422 - Moved by Morrissey, seconded by Dykeman that the City Engineer be in-
structed to prepare the plans, specifications, form of contract, form
of proposal, preliminary estimate of cost, etc. for the 1973 Seal Coat
Program, Contract No. 139, in the City of Waterloo, Iowa.
Motion carried.
64423 - Mayor Turner asked City Engineer King the cost of the 1973 Seal Coat Pro-
ject, Contract No. 139, and Dick King reported the cost of $14,598.00,
with the City to be responsible for Section I of the contract in the
amount of $9,168.00 and'the Subdividers to pay the cost of Section II in
the amount of $5,430.00.
Moved by Cohea, seconded by Miller that the City Engineer's plans and
specifications, form of contract and bond, estimate of cost, etc. for
the 1973 Seal Coat Program I, Contract No. 139, in the City of Waterloo,
Iowa, be received and placed on file.

lution preliminarily approving the plans and specifications, form of con-
