Present: Councilmen Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey. Absent: Councilman Keller. Councilman Glenda Mabrey offered the invocation. 64470 - Moved by Cohea, seconded by Miller that the Agenda, as proposed, for the Regular Session of September 17, 1973 at 7:30 P.M„ be accepted and ap- proved. Motion carried. 64471 - Moved by Morrissey, seconded by Cavanaugh that the Minutes of the Regular Session held September 10, 1973 at 7:30 P.M,, be approved. Motion carried. 64472 - Moved by Miller, seconded by Dykeman that the proof of publication of the Notice of Public Hearing on the Adoption of a Plumbing Code, as pub- lished in the Waterloo Daily Courier on September 5 and 12, 1973, be re- ceived and placed on file. Motion carried. 64473 - The Mayor then announced the time had arrived to hear objections, if any, and asked if any one present wished to be heard or make objection, or if there were any written objections filed with the Clerk. The Clerk reported that no written objections had been filed, and no one appeared to object orally. After public hearing, and no objections having been made or filed, it was moved by Mabrey, seconded by Miller that Resolution No. 22808, adopt- ing a Plumbing Code in a bound form, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: Keller. Mayor declared the resolution adopted. 64474 - An Ordinance of the City of Waterloo, Iowa, adopting the 1973 State Plumbing Code governing the installation of Plumbing, and repealing Ord- inance No. 2234 of the City of Waterloo, Iowa, except Sections 1, 19 and 20 of Article XIV, and all of Article XV, XVI, XVII, XVIII, and XX there- of pertaining to persons authorized to do plumbing, inspection fees, ap- plication and examination for licenses, Board of Plumbers Examiners, and Plumbing Inspector, was read by the Clerk. Moved by Dykeman, seconded by Miller that the rules requiring ordinances to be read in full on three separate days be suspended, and that said ordinance be now placed on its final adoption. On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: Keller. Mayor declared the motion carried. - 2 - 64475 Moved by Cohea, seconded by Morrissey that Ordinance No. 2646, An Ordin- ance of the City of Waterloo, Iowa, adopting the 1973 State Plumbing Code governing the installation of Plumbing, and repealing Ordinance No. 2234 of the City of Waterloo, Iowa except Sections 1, 19 and 20 of Art- icle XIV, and all of Articles XV, XVI, XVII, XVIII, and XX thereof per- taining to persons authorized to do plumbing, inspection fees, applica- tion and examination for licenses, Board of Plumbers Examiners, and Plumbing Inspector, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: Keller. Mayor declared the ordinance adopted. 64476 - Moved by Cavanaugh, seconded by Morrissey that the proof of publication of the Notice of Public Hearing on Proposal to Sell Real Estate in the City of Waterloo, Iowa, known as Disposal Parcel No. 23 in the Westfield - Virden Urban Renewal Area, Project No. Iowa R-7, to Iowa Public Service Company, 420 Commercial Street, as fully described in the said notice published in the Waterloo Daily Courier on August 16, 1973, be received and placed on file. Motion carried. 64477 - The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objection, or if any written objections had been filed with the Clerk. No one appeared to object orally, and the City Clerk reported there had been no written objections placed on file. After public hearing no objections having been made or filed, it was moved by Dykeman, seconded by Miller that Resolution No. 22809, a reso- lution approving the sale of Disposal Parcel No. 23 in the Westfield - Virden Urban Renewal Area, Project No. Iowa R-7, and authorizing the ex- ecution of the necessary contract for sale of land for private redevelop- ment and deed, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: Keller. Mayor declared the resolution adopted. 64478 - Moved by Cavanaugh, seconded by Mabrey that the proof of publication of the Notice of Public Hearing on Proposal to Sell Real Estate in the City of Waterloo, Iowa, known as Disposal Parcel designated as Block 22 con- sisting of Parcels 34, 37, 39b, 39c, 42, 42a, 42b, 42c and all alleys therein in the Logan Avenue Urban Renewal Area, Project No, Iowa R-2 (block bounded by Argyle Street, East Fourth Street, Almond Street and Iowa Street) to Leslie Nelson and Ruth Nelson, Clear Lake, Iowa, as full described in the said notice published in the Waterloo Daily Courier on August 16, 1973, be received and placed on file. Motion carried. 64479 - The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objection, or if any written objections had been filed with the Clerk. After public hearing and no objections having been made or filed, it was moved by Cohea, seconded by Morrissey that Resolution No. 22810, a reso- lution approving the sale of Disposal Parcel designated as Block No. 22 September 17, 1973 - 3 64479 - (Continued) in the Logan Avenue Urban Renewal Area, Project No. Iowa R-2, and auth- orizing the execution of the necessary contract for sale of land for private redevelopment and deed, be adopted. Mayor declared the resolution adopted. 64480 - Moved by Morrissey, seconded by Mabrey that the proof of publication of the Notice of Public Hearing on Re -zoning, upon the request of Young Development Company, upon the recommendation of the City Plan and Zoning Commission and the City Council's own motion, to rezone part of Tract C, Southridge (south of Rachael Street and west of Colby Road extended soutl of Hoover Junior High School), as fully described in said Notice pub- lished in the Waterloo Daily Courier on August 30, 1973, from "A-1" Ag- ricultural District to "R-2" One and Two Family Residence District, be received and placed on file. Motion carried. 64481 - The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objections, or if there were any written objections filed with the Clerk. Mayor declared the motion carried. 64482 An Ordinance amending Ordinance No. 2479, as amended, by adding Sub -Sec- tion No. 52 to Section 2A-5, rezoning certain property in the City of Waterloo, Iowa, was read by the Clerk. Moved by Dykeman, seconded by Mabrey that the rules requiring ordinances to be read in full on three separate days be suspended, that said ordin- ance be recorded as having passed its first, second and third readings, and be now placed on its final adoption. On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: Keller. Mayor declared the motion carried. 64483 - Moved by Cohea, seconded by Morrissey that Ordinance No. 2647, an Ordin- ance amending Ordinance No. 2479, as amended, by adding Sub -Section No. 52 to Section 2A-5, rezoning certain property in the City of Waterloo, Iowa, be adopted. Absent: Keller, Mayor declared the motion carried, 64486 An Ordinance amending Ordinance Noo 2479, as amended, by adding Sub -Sec- tion No. 53 to Section 2A-5, rezoning certain property in the City of Waterloo, Iowa, was read by the Clerk. Moved by Miller, seconded by Cohea that the rules requiring ordinances to be read in full on three separate days be suspended, that said ordin- ance be recorded as having passed its first, second and third readings, and be now placed on its final adoption. Mayor declared the motion carried, 64487 - Moved by Morrissey, seconded by Cohea that Ordinance No. 2648, an Ordin- ance amending Ordinance Noo 2479, as amended, by adding Sub -Section No. 53 to Section 2A-5, rezoning certain property in the City of Waterloo, Iowa, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: Keller. Mayor declared the ordinance adopted. 64488 - Moved by Cohea, seconded by Cavanaugh that the proof of publication of the Notice of Public Hearing on Re -zoning, upon the request of John Beekman, Attorney, in behalf of Granger and Associates, Inc., upon the recommendation of the City Plan and Zoning Commission and the City Coun- cil's own motion, to rezone Tract F of proposed Southbrooke located in S2 of SW4 of Section 3-88-13 (between East San Marnan Drive and South- brooke Drive west of West Ninth Street), as fully described in said Notice published in the Waterloo Daily Courier on August 30, 1973, from "A-1" Agricultural District to "C-1" Commercial District, be received and placed on file. Councilman Mabrey asked why this area was not originally rezoned with the rest of the subdivision. Fred Debe explained the subdividers were not positive what they were going to ask for this area and now were asking for "C-1" Commercial District, After public hearing and no objections having been made or filed, it was moved by Morrissey, seconded by Cavanaugh that an Ordinance be drawn and submitted for said re -zoning. On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: Keller. Mayor declared the motion carried, 64490 - An Ordinance amending Ordinance No. 2479, as amended, by adding Sub -Sec- tion No. 54 to Section 2A-5, rezoning certain property in the City of Waterloo, Iowa, was read by the Clerk. Moved by Cohea, seconded by Mabrey that the rules requiring ordinances tc be read in full on three separate days be suspended, that said ordinance be recorded as having passed its first, second and third readings, and be now placed on its final adoption. Mayor declared the motion carried. 64491 - Moved by Cavanaugh, seconded by Morrissey that Ordinance No. 2649, an Ordinance amending Ordinance No. 2479, as amended, by adding Sub -Section No. 54 to Section 2A-5, rezoning certain property in the City of Waterloo Iowa, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent. Keller. Mayor declared the ordinance adopted. 64492 - Moved by Mabrey, seconded by Dykeman that the communication from the Cit: Engineer, transmitting a request from Foster's, Inc. for permission to black top the parking area on West Sixth Street adjoining their retail store, be received, placed on file and approved at no cost to the City of Waterloo. Motion carried. 64493 - Moved by Cohea, seconded by Morrissey that the communication from the City Engineer, transmitting five (5) copies of Iowa State Highway Com- mission Application Form #559 from the City of Waterloo, Iowa, request- ing permission to construct one (1) 18' commercial entranceto U.S. High- way 20 at Sta. 108+00, left side 2248.0' east of NE Cor Section 4, T89N-R13W, as shown on the attached print, and recommending approval subject to the provisions of his letter, be received, placed on file, recommendations approved and the Mayor and City Clerk authorized to sign said application in behalf of the City of Waterloo, Iowa. Mayor declared the resolution adopted. 64495 - Moved by Morrissey, seconded by Dykeman that the communication from the City Engineer, transmitting a request from George C. Pates for permis- sion to construct a temporary asphalt driveway without regard to side- walk grade at 927 Alabar Avenue, Waterloo, Iowa, together with $3.00 in cash for recording waiver, and recommending approval subject to the pro- visions of his letter, be received, placed on file, request approved and Resolution No. 22812, granting permission and authorizing construction irrespective of a later official grade, be adopted. Absent: Keller, Mayor declared the resolutior adopted. 64496 - Community Development Administrator Mercer explained, the property to be acquired from Deere & Company contains six acres previously sold to them by the City, and now the City was buying back the six acres at about one-third the price that Deere & Company paid originally, plus twenty- six acres of land Deere & Company originally owned; stating further, that additional right-of-way was needed and additional land purchases would be coming to the Council shortly. Moved by Miller, seconded by Cohea that the communication from the Com- munity Development Administrator, transmitting an Agreement for Sale of Land between Deere & Company and the City of Waterloo, Iowa, whereby the City will purchase approximately 1,472,328 square feet, or 33.8 acres, of land for use to construct the levees from Conger Street to Mullan Ave- nue and to construct the River Road on the crown of the levee and other provisions contained therein necessary to properly construct the dikes and/or said River Road, be received, placed on file and Resolution No. 22813, accepting and approving certain offers to sell real properties to the City and accepting and approving certain deeds, be adopted. Mayor declared the resolution adopted. 64497 - Mayor Turner reported that the Weekley Auto Salvage operation would be fenced in and all the operation would be confined to this fenced in area. Jack Weekley said he would erect a fence but wanted some time to do the work. Moved by Dykeman, seconded by Miller that the communication from the Asst. City Attorney, transmitting a Lease Agreement with Jack and Carol Weekley for Lots 1, 2,3,4,5,6,7 and 8 in Block 17, Lots 1, 2, 18, 19, 20, 21, 22, 24, 25, 26, 27 and 28 in Block 16, Lots 17, 25, 26, 27, and 28 in Block 2, Lot 11 in Block 1, all the vacated alley in Block 16 and all of vacated Clinton Street between Blocks 16 and 17, all in Riverview Addition, in the City of Waterloo, Iowa, for auto salvage and junk yard purposes, for six months beginning October 1, 1973 and ending March 31, September 17, 1973 - 7 64497 - (Continued) 1974, for rental sum of $75.00 for six months, and reporting said Lease should be renewed April 1, 1974 and every year thereafter for one year at a rental of$150.00 per year, be received, placed on file and Resolu- tion No. 22814, approving a Lease Agreement with the stipulation that the auto salvage operation be fenced in, and authorizing the Mayor and City Clerk to sign same in behalf of the City of Waterloo, Iowa, be adopted, subject to the City Attorney drawing up a Lease Agreement con- taining said stipulation. Moved by Mabrey, seconded by Cohea that the communication from the Ad- ministrative Assistant, submitting General Conditions and Guidelines for the City of Waterloo, Iowa, Deferred Compensation Plan, be received and placed on file. Motion carried. 64499 Moved by Cavanaugh, seconded by Morrissey that the communication from the City Engineer, transmitting Contract and Bond of M. F. Goerdt Con- struction Company, Dubuque, Iowa, for construction of the 1973 Sanitary Sewer Program II, Contract No. 178, Alternate, in the amount of $284,348.45, be received, placed on file and Resolution No. 22815, ap- proving said Contract and Bond, be adopted. On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: Keller. Mayor declared the resolution adopted. 64500 - Moved by Dykeman, seconded by Miller that the communication from the City Engineer, transmitting Change Order No. 3, for the 1973 Concrete Paving and Repair Program I, Contract No. 136, for additional work per- formed by Cedar Valley Corporation, Waterloo, Iowa, Contractors, at an additional cost of $3,998.40, and recommending approval, be received, placed on file, approved and the Mayor and City Clerk authorized to sign same in behalf of the City of Waterloo, Iowa. On roll call, Cavanaugh, Cohea, Dykeman, Mabrey, Miller and Morrissey voted Aye. Nay: None. Absent: Keller. Mayor declared the motion carried. 64501 - Moved by Miller, seconded by Dykeman that the communication from the Director of Public Works, transmitting "Offer to Buy" contract by the City of Waterloo, Iowa, excess Iowa State Highway Commission properties,' Project No. (U-62) UN -20-6(16)--41-07, as shown on the attached plat, and recommending an offer be made in the amount of $1.00 to the said Commission, be received, placed on file, approved and the Mayor and City Clerk authorized and directed to execute same in behalf of the City of Waterloo, Iowa, and the City Clerk instructed to issue a warrant for $1.00 in payment therefor. September 17, 1973 - 8 - 64502 Moved by Morrissey, seconded by Cohea that the communication from the Community Development Administrator, transmitting proposed "Resolution establishing fair market value for certain properties to be acquired in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7" and re- questing adoption, be received, placed on file and Resolution No. 22816, establishing said fair market value, be adopted. Mayor declared the resolution adopted. 64503 - Moved by Miller, seconded by Mabrey that the communication from the Com- munity Development Administrator, transmitting proposed "Resolution aut- horizing the advertising of the sale of Project Loan Notes in connection with the financing of Project Iowa R-7" ($5,875,000), be received, placed on file and Resolution No. 22817, authorizing the advertising of the sale of said Project Loan Notes, be adopted. Mayor declared the resolution adopted. 64504 - Moved by Cavanaugh, seconded by Cohea that the communication from the Community Development Administrator, transmitting a proposed "Resolution authorizing the City Clerk or Deputy City Clerk of the City of Waterloo, Iowa, to open the bids received for project loan notes (first series 1973) and to send a telegram of acceptance to the successful bidder or bidders", be received, placed on file and Resolution No. 22818, author- izing the City Clerk or Deputy City Clerk to open said bids and send said telegram, be adopted. Mayor declared the resolution adopted. 64506 - Moved by Mabrey, seconded by Miller that Resolution No. 22820, a resolu- tion of the Waterloo City Council approving the resolution of the Water- loo Low Rent Housing Commission adopting the statement of travel policy for actual.. expenses of the Low Rent Housing Commission of the City of Waterloo, Iowa, as suggested by the Department of Housing and Urban De- velopment, be adopted. Motion carried. 64510 - Moved by Cohea, seconded by Morrissey that the application of the Water- loo Yellow Cab Co., for one (1) auxiliary taxicab license, together with insurance coverage and required fee, effective September 18, 1973 and ex- piring October 18, 1973, be received, placed on file and license granted.
