RESOLUTION NO. 2017-611 REQUEST FROM DENISE THEDE FOR A WAIVER FOR A CONCRETE DRIVEWAY LOCATED AT 205 MARYLAND AVENUE AND AUTHORIZING THE CONSTRUCTION OF A CONCRETE DRIVEWAY AND PLACING A DRIVEWAY OR SIDEWALK ON CITY RIGHT-OF-WAY ON AN UNIMPROVED STREET. WHEREAS, the City Engineer has made written application to the City Council asking that Denise Thede be authorized and permitted to construct a concrete driveway and place a driveway or sidewalk on the city right-of-way on an unimproved street, to be Located at 205 Maryland Avenue, and legally described as follows: PROSPECT PLACE LOT 156 AND SELY 1/2 ALLEY ADJ LOT 156 ON W EXC THAT PART DESC AS COM AT SELY COR LOT 134 TH ELY ALONG NLY LINE OF MARYLAND AVE TO PT LOC ON CENTER LINE SAID VAC ALLEY WHICH IS ALSO THE PT OF BEG TH NLY ALONG SAID CENTERLINE TO PT WHICH IS INTER SAID CENTER LINE AND NLY LINE SAID LOT 134 EXTENDED TH ELY ALONG SAID NLY LINE EXTENDED DIST OF 6 FT TH SLY TO PT OF BEG, IN THE CITY OF WATERLOO, BLACK HAWK COUNTY, IOWA. WHEREAS, it is the sense of the Council of the City of Waterloo, Iowa, that said request should be granted. NOW, THEREFORE, BE IT FURTHER RESOLVED that permission is hereby granted to Denise Thede to construct a driveway and place a driveway or sidewalk on the city right-of- way on an unimproved street, to be located at 205 Maryland Avenue, subject to the following conditions: 1. Work is to be performed by an approved and bonded contractor. 2. A permit is to be obtained form the office of the City Engineer prior to construction. 3. All work shall be under the supervision of the City Engineer and at no cost to the City of Waterloo. BE IT FURTHER RESOLVED, that the City Clerk is authorized and directed to forward a certified copy of this resolution to the Black Hawk County Recorder for recording and the Black Hawk County Auditor for filing in order that this said action may become a matter of official County record.
