THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, REGULAR SESSION TO BE HELD AT THE HAROLD E. GETTY COUNCIL CHAMBERS Tuesday, September 8, 2015 5:30 PM CITY OF WATERLOO GOALS 1. Support economic development efforts that attract, retain and create quality jobs resulting in a diverse economic base and increased population. 2. Continue to support implementation of the Downtown Master Plan. 3. Facilitate and promote the development of housing options to meet the needs of current and future Waterloo citizens. 4. Develop a customer -centered service delivery approach. 5. Seek additional opportunities to share services and resources with other government entities. 6. Collaborate with statewide elected officials to reduce the burden on local property taxes. 7. Address the changing public workforce needs in Waterloo. 8. Enhance and protect a diverse, family-oriented community where neighborhoods are safe and well maintained. 9. Enhance the quality of place opportunities for the citizens of our community. General Rules for Public Participation 1. At the chair/presider's discretion, you may address an item on the current agenda by stepping to the podium, and after recognition by the chair/presider, state your name, address and group affiliation (if appropriate) and speak clearly into the microphone. 2. You may speak one (1) time per item for a maximum of five (5) minutes as long as you have registered with the City Clerk's office no later than 4:00 p.m. on the day of the Council Meeting. If not registered with the City Clerk's office you may speak one (1) time per item for a maximum of three (3) minutes. 3. If there is a hearing scheduled as part of an agenda item, the chair/presider will allow everyone who wishes to address the council, using the same participation guidelines found in these "general rules". 4. Although not required by city code of ordinances, oral presentations may be allowed at the chair/presider's (usually the Mayor or Mayor Pro Tem) discretion. The "oral presentations" section of the agenda is your opportunity to address items not on the agenda. You may speak one (1) time per item for a maximum of five (5) minutes as long as you have registered with the City Clerk's office no later than 4:00 p.m. on the day of the Council Meeting. If not registered with the City Clerk's office a speaker may speak to one (1) issue per meeting for a maximum of three (3) minutes. Official action cannot be taken by the Council at that time, but may be placed on a future agenda or referred to the appropriate department. 5. Keep comments germane and refrain from personal, impertinent or slanderous remarks. 6. Questions concerning these rules or any agenda item may be directed to the Clerk's Office at 291-4323. 7. Citizens are encouraged to register with the Clerk's Office by 4:00 p.m. on Monday of the day of the City Council meeting to appear before the City Council (may also register by phone). September 8, 2015 The City Council of the City of Waterloo, State of Iowa, met in regular session, in the Council Chambers, City Hall, 715 Mulberry Street, Waterloo, Iowa, at 5:30 P.M., on the above date. There were present Mayor Ernest G. Clark in the chair, and the following named Council Members: Cole, Jones, Schmitt, Lind, Morrissey, Welper and Hart Absent: None. 1 The Mayor announced that this was the time and place for the public hearing and meeting on the matter of the issuance of not to exceed $9,750,000 General Obligation Urban Renewal Bonds, of the City of Waterloo, State of Iowa, in order to provide funds to pay the costs of aiding in the planning, undertaking and carrying out of urban renewal projects under the authority of Iowa Code Chapter 403 and the Downtown Waterloo Urban Renewal and Redevelopment Plan, as amended, including funding an economic development grant in support of the Tech Works Campus project, for essential corporate urban renewal purposes, and that notice of the proposal to issue the Bonds and the right to petition for an election had been published as provided by Sections 384.24(3)(q), 384.25 and 403.12 of the Code of Iowa, and the Mayor then asked the City Clerk whether any petition had been filed in the Clerk's Office, as contemplated in Section 362.4 of the Code of Iowa, and the Clerk reported that no such petition had been filed, requesting that the question of issuing the Bonds be submitted to the qualified electors of the City. The Mayor then asked the Clerk whether any written objections had been filed by any resident or property owner of the City to the issuance of the Bonds. The Clerk advised the Mayor and the Council that no written objections had been filed. The Mayor then called for oral objections to the issuance of the Bonds. Whereupon, the Mayor declared the time for receiving oral and written objections to be closed. David Dryer, 3145 West 4th street, questioned why the City needs the bond money. Michelle Weidner, Chief Financial Officer, explained the money is for the redevelopment of Tech Works. Since tax credit funding was rejected at the federal level, per the development agreement, the City must bond for the funds. David Dryer questioned if the funds will be repaid with property taxes. Councilman Lind questioned if the funds will all go to Speer Financial. Michelle Weidner explained that the additional funds will be used to buy down the interest rate. Whereupon, the Mayor declared the hearing on the issuance of the Bonds to be closed. 2 The Council then considered the proposed action and the extent of objections thereto. RESOLUTION 2015-699 INSTITUTING PROCEEDINGS TO TAKE ADDITIONAL ACTION FOR THE ISSUANCE OF NOT TO EXCEED $9,750,000 GENERAL OBLIGATION URBAN RENEWAL BONDS WHEREAS, pursuant to notice published as required by law, the City Council has held a public meeting and hearing upon the proposal to institute proceedings for the issuance of not to exceed $9,750,000 General Obligation Urban Renewal Bonds, for the essential corporate urban renewal purposes, in order to provide funds to pay the costs of aiding in the planning, undertaking and carrying out of urban renewal projects under the authority of Iowa Code Chapter 403 and the Downtown Waterloo Urban Renewal and Redevelopment Plan, as amended, including funding an economic development grant in support of the Tech Works Campus project, and has considered the extent of objections received from residents or property owners as to the proposed issuance of Bonds; and no petition was filed calling for a referendum thereon. The following action is now considered to be in the best interests of the City and residents thereof NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, STATE OF IOWA: 3 Section 1. Section 2. This Resolution shall serve as a declaration of official intent under Treasury Regulation 1.150-2 and shall be maintained on file as a public record of such intent. It is reasonably expected that the general fund moneys may be advanced from time to time for capital expenditures which are to be paid from the proceeds of the above Bonds. The amounts so advanced shall be reimbursed from the proceeds of the Bonds not later than eighteen months after the initial payment of the capital expenditures or eighteen months after the property is placed in service. Such advancements shall not exceed the amount authorized in this Resolution unless the same are for preliminary expenditures or unless another declaration of intention is adopted. Fire Recruit — Open Exam Approved by Human Resources Committee 4/16/15; approved by Civil Service 5/7/15; advertised extensively — in addition to Courier, website, AA List, cable, sent fliers to 493 paramedics across 9 counties, sent notices to regional fire schools, Fire Department sent letters to a list of recent paramedic graduates, posted it to the WFR website, Twitter, Facebook, the Cedar Valley group page, IEMSA website and firerecruit.com. Received 184 resumes; 109 took written test; top 60 scores with 70% or higher will be invited to physical ability test; if they pass, they will be interviewed. Should have list to certify by end of August. Fire Engineer - Promotional Exam Approved by Civil Service 5/7/15; approved by Human Resources Committee 4/16/15; reading list for the written exam has been out for quite some time. Thirteen signed up for testing; written and street exam will be first week of August and equipment test will be later in August. Should have list for certification end of August. NEW BUSINESS The job description and testing criteria for Capacity Management, Operations & Maintenance (CMOM) Technician — Waste Management Services was presented for approval. The position was approved by the Human Resources Committee on 6/15/15. This is a new position that will assist with satisfying some of the environmental concerns with sanitary sewer lines. Moved by Amos, seconded by Haskins to approve the job description and testing criteria for CMOM Technician — Waste Management Services. Motion carried. The job description and testing criteria for Animal Control Services Officer — Traffic Operations was presented for approval. The position was approved by the Human Resources Committee on 6/15/15. This is an additional full time position. Animal Control currently has 1 full time and 3 part time officers. There have not been any changes in the job description and testing criteria. The position was approved by the Human Resources Committee on 1/12/15 and by Civil Service on 1/27/15. There is a vacancy due to a resignation. This is the second go -round for this position. We re -advertised after not being successful in finding any good candidates the first time. The position was advertised in the Courier, posted on the City website, a notice sent to the agencies and organizations on the Affirmative Action List and posted in all City departments. We received 13 resumes and 4 applicants were invited to interview. Panel members were Larry Burger from Speer Financial, Craig Clark from Building Inspections and Cheryl Huddleston from Human Resources. The list has 4 white females. The Commission originally approved the position quite some time ago but there was no action when the City decided to bid out parking enforcement and maintenance. Bidding was successful so the Clerk II who transferred to another department from the Clerk's Office will not be replaced. But there is one Clerk I in the Clerk's Office who is essentially responsible for the same or the same level of work as the other two Clerk IIs. Consequently, we are going through the promotional process to allow her the opportunity to be promoted. The job description was changed to reflect that the parking enforcement duties are no longer a Clerk's Office responsibility. Moved by Amos, seconded by Culp to approve the promotional job description and testing criteria for Clerk II. Motion carried. Updates Fire Recruit — Open Exam Written exam held 7/9/15. One hundred nine out of 185 applicants took the test, but only 32 scored 70% or higher. We discussed whether our expectations were too high but decided to stay with the initial guidelines for passing since the minorities and females did relatively well. Those 32 candidates have been invited to take the physical ability test on 8/19/15; if they pass, will be interviewed 8-20-21, 24/15. Will certify list end of August. Fire Engineer - Promotional Exam Approved by Civil Service 5/7/15; approved by Human Resources Committee 5/11/15; reading list for the written exam has been out for quite some time. Thirteen signed up for testing but 2 have since been promoted from the current list so only 11 will be testing; written and street ID test is August 4th and equipment test is late in August.
