RESOLUTION SETTING DATE OF PUBLIC HEARING AS
OCTOBER 2, 2017 TO APPROVE THE REQUEST BY
MARCUS PRATT AND THE BOSNIAN ISLAMIC
ASSOCIATION OF WATERLOO TO VACATE, SELL AND
CONVEY A 60 FOOT X 197 FOOT PORTION OF MARIGOLD
DRIVE, LOCATED TO THE SOUTH OF ITS INTERSECTION
WITH AFTON DRIVE, WITH THE RETENTION OF A
UTILITY EASEMENT OVER, UNDER AND ACROSS THE
PROPERTY IN QUESTION, AND TO SELL THE
NORTHEASTERLY PORTION OF SAID PROPERTY TO
MARCUS PRATT FOR $1.00 AND THE SOUTHWESTERLY
PORTION OF SAID PROPERTY TO THE BOSNIAN ISLAMIC
ASSOCIATION OF WATERLOO FOR $770.00, AND
INSTRUCT CITY CLERK TO PUBLISH NOTICE.
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF WATERLOO, IOWA, AS
FOLLOWS:
Section 1. That the Council of the City of Waterloo, Iowa shall meet in the Harold E.
Getty Council Chambers at City Hall, Waterloo, Iowa at 5:30 p.m. on the 2"a day of October
2017, for the purpose of considering and acting upon the sale and conveyance of a 60 foot x 197
foot portion of Marigold Drive, located to the south of its intersection with Afton Drive, with the
retention of a utility easement over, under and across the property in question, and to sell the
northeasterly portion of said property to Marcus Pratt for $1.00 and the southwesterly portion of
said property to the Bosnian Islamic Association of Waterloo for $770.00, and legally described
as follows:
DESCRIPTION—VACATE:
THAT PORTION OF MARIGOLD DRIVE LYING SOUTHERLY OF A LINE
DRAWN BETWEEN THE MOST NORTHERLY CORNER OF LOT 19 OF
THAT PART OF CEDAR HILLS NOW VACATED AND THE
NORTHWESTERLY CORNER OF TRACT S CEDAR HILLS, AND LYING
NORTH OF A LINE DRAWN BETWEEN THE SOUTHWESTERLY CORNER
OF TRACT S CEDAR HILLS AND THE MOST EASTERLY CORNER OF
LOT 19 OF THAT PART OF CEDAR HILLS NOW VACATED, SUBJECT TO
THE RETENTION OF AN UTILITY EASEMENT OVER UNDER AND
ACROSS THE ABOVE DESCRIBED PROPERTY.
DESCRIPTION—CONVEYANCE TO PRATT:
THE NORTHEASTERLY 1/2 OF THAT PORTION OF MARIGOLD DRIVE
LYING SOUTHERLY OF A LINE DRAWN BETWEEN THE MOST

MOST EASTERLY CORNER OF LOT 19 OF THAT PART OF CEDAR HILLS
NOW VACATED, SUBJECT TO THE RETENTION OF AN UTILITY

Section 2. That the City Clerk is hereby directed to publish notice of the time and place
of said hearing in the Waterloo Courier.
