STATEMENT OF PARKING EASEMENT TERMINATION
This Statement of Parking Easement Termination is made as of the date set forth below
by the City of Waterloo, Iowa (the "City").
Whereas, City and U.S. Bank National Association (the "Bank") are parties to that certain
Master Easement Agreement dated March 2, 2009 (the "Agreement"), filed March 5, 2009 as
Doc, No. 2009-16447; and
Whereas, Section 2.d of the Agreement provides that the covered parking lot easement
established therein for the benefit of the Bank may be terminated in connection with construction
of a "Mixed -Use Building" as defined in the Agreement; and
Whereas, the City has entered into a certain Development Agreement with Grand
Investments, LLC, dated December 19, 2016 and filed January 24, 2017 as Doc. No. 2017-
13397, concerning the construction of a Mixed -Use Building.
NOW, THEREFORE, the undersigned hereby certifies that a notice of termination was
mailed to the Bank by certified mail on August 10, 2017. A true and correct copy of said notice
is attached hereto. The covered parking lot easement established by Section 2.d of the
Agreement is therefore terminated pursuant to the terms of said Section and the Agreement.
