BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: DIVISION I FIREWORKS REGULATION Section 1. Section 100.1, subsection 4, paragraph b, Code 2017, is amended to read as follows: b. The storage, transportation, handling, and use of flammable liquids, combustibles, fireworks, and explosives; Sec. 2. Section 100.1, Code 2017, is amended by adding the following new subsection: NEW SUBSECTION. 8. To order the suspension of the use of consumer fireworks, display fireworks, or novelties, as described in section 727.2, if the fire marshal determines that the use of such devices would constitute a threat to public safety. Senate File 489, p. 2 Sec. 3. NEW SECTION. 100.19 Consumer fireworks seller licensing — penalty — fund. 1. As used in this section: a, "APA 87-1' means the American pyrotechnics association standard 87-1, as published in December 2001. b. "Community group" means a nonprofit entity that is open for membership to the general public which is exempt from federal income taxation pursuant to section 501(c)(3) of the Internal Revenue Code or a fraternal benefit society, as that term is defined in section 512B.3. c. "First-class consumer fireworks" mdans the following consumer fireworks, as described in APA 87-1, chapter 3: (1) Aerial shell kits and reloadable tubes. (2) Chasers. (3) Helicopter and aerial spinners. (4) Firecrackers. (5) Mine and shell devices. (6) Missile -type rockets. (7) Roman candles. (8) Sky rockets and bottle rockets. (9) Multiple tube devices under this paragraph "c"" that are manufactured in accordance with APA 87-1, section 3.5. d, 'Retailer" means as defined in section 423.1. e. "Second-class consumer fireworks" means the following consumer fireworks, as described in APA 87-1, chapter 3: (1) Cone fountains. (2) Cylindrical fountains. (3) Flitter sparklers. (4) Ground and hand-held sparkling devices, including multiple tube ground and hand-held sparkling devices that are manufactured in accordance with APA 87-1, section 3.5. (5) Ground spinners. (6) Illuminating torches. (7) Toy smoke devices that are not classified as novelties pursuant to APA 87-1, section 3.2. (8) Wheels. (9) Wire or dipped sparklers that are not classified as novelties pursuant to APA 87-1, section 3.2. 2. a. The state fire marshal shall establish a consumer Senate File 489, p. 3 fireworks seller license. An application for a consumer fireworks seller license shall be made on a form provided by the state fire marshal. The state fire marshal shall adopt rules consistent with this section establishing minimum requirements for a retailer or community group to be issued a consumer fireworks seller license. b. A person shall possess a consumer fireworks seller license under this section in order to sell consumer fireworks. 3. a. The state fire marshal shall establish a fee schedule for consumer fireworks seller licenses as follows: (1) For a retailer at a permanent building who devotes fifty percent or more of the retailer's retail floor space to the sale or display of first-class consumer fireworks, an annual fee of one thousand dollars. (2) For a retailer at a temporary structure whd devotes fifty percent or more of the retailer's retail floor space to the sale or display of first-class consumer fireworks, an annual fee of five hundred dollars. (3) For a retailer who devotes less than fifty percent of the retailer's retail floor space to the sale or display of first-class consumer fireworks, an annual fee of four hundred dollars. (4) For a community group that offers for sale, exposes for sale, or sells first-class consumer fireworks, an annual fee of four hundred dollars. (5) For retailer or community group that offers for sale, exposes for sale, or sells second-class consumer fireworks, but not first-class consumer fireworks, an annual fee of one hundred dollars. b. A license issued to a retailer or community group pursuant to paragraph v.43", subparagraph (1), (2), (3), or (4), shall allow the licensee to sell both first-class consumer fireworks and second-class consumer fireworks. 4. The state fire marshal shall adopt rules to: a, Require that any retailer or community group offering for sale at retail any consumer fireworks, as described in APA 87-1, chapter 3, shall do so in accordance with the national fire protection association standard 1124, published in the code for the manufacture, transportation, storage, and retail Senate File 489, p. 4 sales of fireworks and pyrotechnic articles, 2006 edition. b. Require that a retailer or community group to be issued a license pursuant to this section provide proof of and maintain commercial general liability insurance with minimum per occurrence coverage of at least one million dollars and aggregate coverage of at least two million dollars. c. Permit a retailer or community group issued a license pursuant to this section to sell consumer fireworks, as described in APA 87-1, chapter 3, at the following locations as specified: (1) At a permanent building that meets the requirements of paragraph "a", between June 1 and July 8 and between December 10 and January 3 each year, all dates inclusive. (2) At a temporary structure that meets the requirements of paragraph "..3" between June 13 and July 8 each year, both dates inclusive. d. A retailer or community group shall not transfer consumer fireworks, as described in APA 87-1, chapter 3, to a person who is under eighteen years of age. 5. a. The state fire marshal shall adopt rules to provide that a person's consumer fireworks seller license may be revoked for the intentional violation of this section. The proceedings for revocation shall be held before the division of the state fire marshal, which may revoke the license or licenses involved as provided in paragraph "b"". b. (1) If, upon the hearing of the order to show cause, the division of the state fire marshal finds that the licensee intentionally violated this section, then the license or licenses under which the licensed retailer or community group sells first-class consumer fireworks or second-class consumer fireworks, shall be revoked. (2) Judicial review of actions of the division of the state fire marshal may be sought in accordance with the terms of the Iowa administrative procedure Act, chapter 17A. If the licensee has not filed a petition for judicial review in district court, revocation shall date from the thirty-first day following the date of the order of the division of the state fire marshal. If the licensee has filed a petition for judicial review, revocation shall date from the thirty-first Senate File 489, p. 5 day following entry of the order of the district court, if action by the district court is adverse to the licensee. (3) A new license shall not be issued to a person whose license has been revoked, or to the business in control of the premises on which the violation occurred if it is established that the owner of the business had actual knowledge of the violation resulting in the license revocation, for the period of one year following the date of revocation. 6. a. A consumer fireworks fee fund is created in the state treasury under the control of the state fire marshal. Notwithstanding section 12C.7, interest or earnings on moneys in the consumer fireworks fee fund shall be credited to the consumer fireworks fee fund. Moneys in the fund are appropriated to the state fire marshal to be used to fulfill the responsibilities of the state fire marshal for the administration and enforcement of this section and section 100.19A and to provide grants pursuant to paragraph 'b". The fund shall include the fees collected by the state fire marshal under the fee schedule established pursuant to subsection 3 and the fees collected by the state fire marshal under section 100.19A for wholesaler registration. b. The state fire marshal shall establish a local fire protection and emergency medical service providers grant program to provide grants to local fire protection service providers and local emergency medical service providers to establish or provide fireworks safety education programming to members of the public. The state fire marshal may also provide grants to local fire protection service providers and local emergency medical service providers for the purchase of necessary enforcement, protection, or emergency response equipment related to the sale and use of consumer fireworks in this state. 7. The state fire marshal shall adopt rules for the administration of this section. 8. A person who violates a provision of this section or a rule adopted pursuant to this section is guilty of a simple misdemeanor. Sec. 4. NEW SECTION. 100.19A Consumer fireworks wholesaler — registration — penalty. Senate File 489, p. 6 1. For purposes of this section: a, "Consumer fireworks'' means first-class consumer fireworks and second-class consumer fireworks, as those terms are defined in section 100.19. b. -Wholesaler' means a person who engages in the business of selling or distributing consumer fireworks for the purpose of resale in this state. 2. The state fire marshal shall adopt rules to require all wholesalers to annually register with the state fire marshal. The state fire marshal may also adopt rules to regulate the storage or transfer of consumer fireworks by wholesalers and to require wholesalers to maintain insurance. 3. The state fire marshal shall establish an annual registration fee of one thousand dollars for wholesalers of consumer fireworks within the state. Registration fees collected pursuant to this section shall be deposited in the consumer fireworks fee fund created in section 100.19. 4. A person who violates a provision of this section or a rule adopted pursuant to this section is guilty of a simple misdemeanor. Sec. 5. Section 101A.1, subsection 3, Code 2017, is amended to read as follows: 3. Explosive"" means any chemical compound, mixture or device, the primary or common purpose of which is to function by explosion with substantially instantaneous release of gas and heat, unless such compound, mixture, or device is otherwise specifically classified by the United States department of transportation. The term "explosive" includes all materials which are classified as a class 1, division 1.1, 1.2, 1.3, or 1.4 explosive by the United States department of transportation, under 49 C.F.R. 5173.50, and all materials classified as explosive materials under 18 U.S.C. §841, and includes, but is not limited to, dynamite, black powder, pellet powders, initiating explosives, blasting caps, electric blasting caps, safety fuse, fuse lighters, fuse igniters, squibs, cordeau detonative fuse, instantaneous fuse, igniter cord, igniters, smokeless propellant, cartridges for propellant -actuated power devices, cartridges for industrial guns, and overpressure devices, but does not include "fireworks"" Senate File 489, p. 7 as "consumer fireworks-, "display fireworks-, or -novelties- as those terms are defined in section 727.2 or ammunition or small arms primers manufactured for use in shotguns, rifles, and pistols. Commercial explosives are those explosives which are intended to be used in commercial or industrial. operations. Sec. 6. Section 331.301, Code 2017, is amended by adding the following new subsection: NEW SUBSECTION. 17. The board of supervisors may by ordinance or resolution prohibit or limit the use of consumer fireworks or display fireworks, as described in section 727.2, if the board determines that the use of such devices would constitute a threat to public safety or private property, or if the board determines that the use of such devices would constitute a nuisance to neighboring landowners. Sec. 7. Section 331.304, subsection 8, Code 2017, is amended to read as follows: 8. The board, upon application, may grant permits for the display use of display fireworks as provided in section 727.2. Sec. 8. Section 364.2, Code 2017, is amended by adding the following new subsection: NEW SUBSECTION. 6. A city council may by ordinance or resolution prohibit or limit the use of consumer fireworks, display fireworks, or novelties, as described in section 727.2. Sec. 9. Section 461A.42, subsection 2, Code 2017, is amended to read as follows:. 2. The use of consumer fireworks or display fireworks, as defined in section 727.2, in state parks and preserves is prohibited except as authorized by a permit issued by the department. The commission shall establish, by rule adopted pursuant to chapter 17A, a fireworks permit system which authorizes the issuance of a limited number of permits to qualified persons to use or display fireworks in selected state parks and preserves. Sec. 10. Section 727.2, Code 2017, is amended to read as follows: 727.2 Fireworks. 1. Definitions. For purposes of this section: a. "Consumer fireworks" includes first-class consumer fireworks and second-class consumer fireworks as those terms Senate File 489, P. 8 are defined in section 100.19, subsection 1. "Consumer fireworks"` does not include novelties enumerated in chapter 3 of the American pyrotechnics association's standard 87-1 or display fireworks enumerated in chapter 4 of the American pyrotechnics association's standard 87-1. b. Tho term -fireworks"" 'Display fireworks'" includes any explosive composition, or combination of explosive substances, or article prepared for the purpose of producing a visible or audible effect by combustion, explosion, deflagration, or detonation, and includes blank cartridges, firecrackers, torpedoes, skyrockets, roman candle -s, or other fireworks of like construction and fireworks containing any explosive or flammable compound, or other device containing any explosive substance. The term "fireworks" Display fireworks"" does not include goldstar producing sparklcr3 on wires which contain no magnesium or chlorate or perchloratc, flitter s-parklers in paper tubc3 that do not exceed one eighth of an inch in diameter, toy snakes which contain no mercury, or cap used in cap pistols novelties or consumer fireworks enumerated in chapter 3 of the American pyrotechnics association's standard 87-1. c. "Novelties"" includes all novelties enumerated in chapter 3 of the American pyrotechnics association's standard 87-1, and that comply with the labeling regulations promulgated by the United States consumer product safety commission. 2. Display fireworks. a. A person, firm, partnership, or corporation who offers for sale, exposes for sale, sells at retail, or uses or explodes any display fireworks, commits a simple misdemeanor In addition to any other penalties, thc puni3hment imposed of, punishable by a fine of not less than two hundred fifty dollars. However, thc a city council of a city or a county board of supervisors may, upon application in writing, grant a permit for the display of display fireworks by municipalities, fair associations, amusement parks, and other organizations or groups of individuals approved by the city or the county board of supervisors when the display fireworks display will be handled by a competent operator, but no such permit shall Senate File 489, p. 9 be required for the display of display fireworks at the Iowa state fairgrounds by the Iowa state fair board, at incorporated county fairs, or at district fairs receiving state aid. Sales of display fireworks for such display may be made for that purpose only. b. (1) A person who uses or explodes display fireworks while the use of such devices is prohibited or limited by an ordinance or resolution adopted by the county or city in which the firework is used commits a simple misdemeanor, punishable by a fine of not less than two hundred fifty dollars. (2) A person who uses or explodes display fireworks while the use of such devices is suspended by an order of the state fire marshal commits a simple misdemeanor, punishable by a fine of not less than two hundred fifty dollars. 3. Consumer fireworks and novelties. a. A person or a firm, partnership, or corporation may possess, use, or explode consumer fireworks in accordance with this subsection and subsection 4. b. A person, firm, partnership, or corporation who sells consumer fireworks to a person who is less than eighteen years of age commits a simple misdemeanor, punishable by a fine of not less than two hundred fifty dollars. A person who is less than eighteen years of age who purchases consumer fireworks commits a simple misdemeanor, punishable by a fine of not less than two hundred fifty dollars. c. (1) A person who uses or explodes consumer fireworks or novelties while the use of such devices is prohibited or limited by an ordinance adopted by the county or city in which the fireworks are used commits a simple misdemeanor, punishable by a fine of not less than two hundred fifty dollars. (2) A person who uses or explodes consumer fireworks or novelties while the use of such devices is suspended by an order of the state fire marshal commits a simple misdemeanor, punishable by a fine of not less than two hundred fifty dollars. 4. Limitations. a. A person shall not use or explode consumer fireworks on days other than June 1 through July 8 and December 10 through January 3 of each year, all dates inclusive. Senate File 489, p. 10 b. A person shall not use or explode consumer fireworks at times other than between the hours of 9:00 a.m. and 10:00 p.m., except that on the following dates consumer fireworks shall not be used at times other than between the hours specified: (1) Between the hours of 9:00 a.m. and 11:00 p.m. on July 4 and the Saturdays and Sundays immediately preceding and following July 4. (2) Between the hours of 9:00 a.m. on December 31 and 12:30 a.m. on the immediately following day. (3) Between the hours of 9:00 a.m. and 11:00 p.m. on the Saturdays and Sundays immediately preceding and following December 31. c. A person shall not use consumer fireworks on real property other than that person's real property or on the real property of a person who has consented to the use of consumer fireworks on that property. d. A person who violates this subsection commits a simple misdemeanor. A court shall not order imprisonment for violation of this subsection. 5. Applicability. a. This section does not prohibit the sale by a resident, dealer, manufacturer, or jobber of such fireworks as are not prohibited by this section, or the sale of any kind of fireworks if they are to be shipped out of the state, or the sale or use of blank cartridges for a show or the theater, or for signal purposes in athletic sports or by railroads or trucks, for signal purposes, or by a recognized military organization. b. This section does not apply to any substance or composition prepared and sold for medicinal or fumigation purposes. c. Unless specifically provided otherwise, this section does not apply to novelties. DIVISION II RULEMAKING Sec. 11. EMERGENCY RULES. The state fire marshal shall adopt emergency rules under section 17A.4, subsection 3, and section 17A.5, subsection 2, paragraph "b", to implement the provisions of this Act and the rules shall be effective Senate File 489, p. 11 immediately upon filing unless a later date is specified in the rules. Any rules adopted in accordance with this section shall also be published as a notice of intended action as provided in section 17A.4. DIVISION III EFFECTIVE DATE Sec. 12. EFFECTIVE UPON ENACTMENT. This Act, being deemed of immediate importance, takes effect upon enactment. Getty Council Chambers Members present: Morrissey, Powers, Amos, Schmitt, and Welper. Absent: Jacobs and Lind. Moved by Morrissey seconded by Powers that the Agenda, as proposed, be approved. Objective: Discussion of changes to State of Iowa fireworks laws Pat Treloar, Fire Chief, provided an overview of the changes to state law regarding the sale of fireworks as outlined by Senate File 489. Mayor Hart questioned if other municipalities have been contacted and if other municipalities have taken a look at use on public property. Pat Treloar explained that he has contacted to other cities within the state and they have not decided what they are doing. Some are looking at banning the use while others like Marion are voting this week to restrict the use over June 24 to July 8. He further explained that Cedar Falls is looking to approve the use of fireworks on private property but not on public property or city parks. Mr. Schmitt questioned the ability of non-profit organizations to sell fireworks. Pat Treloar explained that the law allows non -profits a discounted fee of $100 if the proper insurance documentation is filed, the permit fee would be $100. Mr. Schmitt asked for clarification on what the city can control. Pat Treloar explained that the city cannot ban the sale but can restrict the location of where fireworks are sold. Mr. Schmitt questioned the restrictions. Pat Treloar clarified the recommendation would be to follow the states guidelines on restriction of dates and times. Mr. Schmitt questioned if other cities are working to prohibit the use of fireworks. Pat Treloar confirmed other cities are looking at restricting the use of fireworks. He further commented that it is frustrating that cities have to work on a tight timeline. Mr. Schmitt commented that Waterloo, Cedar Falls and Evansdale should probably be on the same page with regard to restrictions. Pat Treloar explained that his recommendation is to go with the modified use as a test to see how it would go. Mr. Morrissey questioned if the modified time frame would include New Year's. Pat Treloar confirmed. Mr. Morrissey questioned if the restricted area referenced in the current city ordinance (7-8-5) applies to just parks or all publicly owned property. Pat Treloar explained he understands it is just public parks. Mr. Morrissey questioned if they are looking at aerial fireworks or other types of fireworks. Pat Treloar explained that it does not specifically list the product but the type of firework and that the state law could be clearer. Page 2 Mr. Morrissey asked how it would be handled when the seller sells a certain type of firework that the city restricts the use of. Pat Treloar explained that he does not believe the sellers are going to be looking to sell too many of the large explosive products. Mr. Amos questioned how often citations are issued for fireworks. Pat Treloar explained that they do not get many fireworks complaints. Dan Trelka, Chief of Police, explained that they show a vast amount of forgiveness for fireworks around July 4th. Mayor Hart commented that he is hearing a lot of Option 2 (local modification) from council. Mr. Morrissey questioned to the process going forward. Pat Treloar explained the issue has been discussed a few times and believes there is a consensus but wanted to allow council to give feedback. Kelley Felchle, City Clerk, identified a few areas of the current code that will need to be amended due to the new law. Kelley further explained the need to have a clear understanding by way of resolution, on what council wishes to allow with regard to fireworks within the city. Pat Treloar explained that the State Fire Marshal is planning to issue licenses next week and that the city needs to be prepared with phone calls coming next week. He further explained that M80s and Cherry Bombs were restricted under the Child Safety Act of 1966. Mr. Morrissey questioned if overlay district wording could apply. Noel Anderson, Community Planning and Development Director, overlay districts could be looked at in the future. In the short term, Zoning will need to look at available parking and ensuring that they would be in compliance with zoning ordinances in order to allow an additional business in the space. Mayor Hart questioned Chief Treloar on the local modifications of Option 2. Pat Treloar explained that if the city went with Option 2 his recommendation would be to prohibit use on public property. Mr. Morrissey questioned when sales would be allowed to take place. Pat Treloar explained the sale dates. Mr. Morrissey questioned if any information is available on reports of trouble surrounding the sites where sales are taking place. Dan Trelka explained that information is not available until the sale sites are identified, but will look into that. Mayor Hart commented that this is uncharted territory for all cities and if things like personal injury and property damage take place we can adjust and modify. Pat Treloar explained that he believes it would be best to go middle of the road with Option 2 and adjust in the future. Mr. Schmitt questioned if data exists with firework use in other states. Pat Treloar explained that they do not have the data but the bigger operators have great success but that his concern is for smaller operations and consumer fireworks. Page 3 Mr. Schmitt questioned if there is an age restriction on sales. Pat Treloar explained that the legal age to sell is 18. With no further business before the Council, it was moved by Schmitt seconded by Morrissey that the meeting be adjourned at 4:33 p.m. Ayes: Five. Motion carried. Roll call vote -Ayes: Five. Nays: Two (Jacobs and Lind). Motion carried. Myke Goings, 1203 W. 2nd Street, commented that fireworks are a trigger for many people with PTSD, autism, and other health issues. He expressed concern for property damage with allowing the use of fireworks. He questioned if the council could look at limiting the time frame to July 4th and restricting the time of day that fireworks could be used. He further stated that his preference would be to see fireworks banned in Waterloo. Mayor Hart commented that this was a situation where it was talked about at the state for many years and was swiftly passed and is leaving cities trying to figure out what would be best. He further explained that the resolution proposed would be a compromise for all the voices for or against fireworks in Waterloo. Pat Treloar, Fire Chief, provided an overview the bill that the state passed and the public safety risks of having fireworks usage within the city. He explained that other large cities are proposing banning or restricting the use of fireworks. He further explained that the administrative rules for the law have not been written yet but plan to be done in four weeks; the state is not yet taking license applications. Mayor Hart questioned if the cities were given resources to deal with the change. Pat Treloar explained that the city will see little financial gain from the law change and that it will be a tax on the police department and fire department. Phil Krogh, 535 Alpine Drive, explained that he suffers from PTSD and that banning fireworks would be the best approach. Mr. Welper commented that people have expressed opinions to him on both sides of the issue and is willing to support the compromise the first year. Mr. Schmitt questioned what Cedar Falls and Evansdale plan to do. Pat Treloar stated he was unaware of what Evansdale is choosing to do, however Cedar Falls has passed a resolution following the state law guidelines. Mr. Schmitt questioned if the city will face additional challenges if this resolution passes while neighboring communities do not chose to approve the same schedule. Pat Treloar commented that Waterloo is different from Cedar Falls and that Waterloo should make decisions that fit the community. Excerpt of Regular Session Minutes of 5/22/17. Mr. Schmitt questioned why the regulation of sale is included in the resolution. Pat Treloar explained that sale would be restricted by zoning. Mr. Schmitt commented that trash is an issue for discharging fireworks. Pat Treloar commented that that would be a legitimate concern. Dan Trelka, Police Chief, commented that they will need to re-evaluate after the dates. Mr. Morrissey requested examples on where sales would be allowed. Noel Anderson explained the locations where sales will be allowed and that parking would be looked at as well. Mr. Morrissey questioned sales out of vehicles. Noel Anderson commented that those types of sales would not be allowed. Mr. Morrissey questioned if fireworks are sold locally that use will increase. Dan Trelka explained that he anticipates that use will increase regardless of what is approved. Pat Treloar explained that he believes it would increase the use. Mr. Morrissey commented that it seems contrarily that the sale would be allowed but that the use would be limited. Mr. Jacobs questioned why an all-out ban would not take place. Pat Treloar commented that there is a lot of unknown and that he believes that a compromise would be best but council could ban them too. 145481 - Lind/Schmitt To amend the resolution by limiting the use of fireworks to July 4, 2017. Roll call vote -Ayes: One. Nays: Six (Jacobs, Morrissey, Powers, Amos, Schmitt and Welper). Motion failed. Mr. Welper commented that he would like to see a reassessment of fireworks use in August. Pat Treloar commented that the city would need to revisit this as they will need to make a decision on what happens for the December 10 through January 3, part of the law. Mr. Powers questioned what happens if it rains on the 4th and are not able to shoot off fireworks and people will be storing fireworks. Pat Treloar commented that other communities have looked into having some use of fireworks past the 4th, so that people will use them rather than store them. Mr. Schmitt commented why the state and other communities went with July 8th. Pat Treloar commented that it could be possible; however he explained that most people he has spoken with have stated they'd likely celebrate the weekend prior. 145482 - Powers/Amos To amend the resolution dates of use from June 30th through July 8th. In my neighborhood the fireworks began in the early morning on day one and continued off and on through the evening for five days—exploding often past the curfew hour. Here is what I experienced. My nephew who lives across the street was born with cerebral palsy. With this condition comes very very sensitive hearing. He is startled when someone raises his voice and he quickly covers his ears. With these loud powerful explosions happening right outside his bedroom window, he could not get to sleep until the wee hours of each morning. My back neighbor went outdoors to ask one of our other neighbors to stop shooting fireworks over his house. As he walked over, one rocket shot over his head—not the direction it was aimed, by the by. He also tried to talk to his neighbor across his street but they almost carne to blows so he went back indoors. My husband has a heart condition and was agitated by these explosions too. After another M-150 exploded, a neighbor paced her living room floor trying to compose herself as she relived the recent Toss of a family member. My 13 -year old Scottie was beside himself with fear. Why do I have to sedate my dog just so someone can fire off rockets? I called the non -emergency number twice after 10:30 pm to report explosions that did not quit as decreed. After this mayhem began, I picked up the debris from the fireworks in my neighborhood on my morning walks. The streets and sidewalks are still littered with exploded remnants and there are powder scars on the asphalt streets as well. I picked up what I could until the morning of July 5 when there was just too much trash. That morning, I walked passed a box about 8"x8"x12" in size that was labeled "King Kong." Inside were three used canisters. The box was on the sidewalk in front of a house in the 2600 block of W 4th Street across from the pond at the golf course. Litter was strewn down to the neighbor's driveway on either side and also in the street. The next day, I walked on this same sidewalk, the box had been removed but all the exploded remnants still remained. 1 Today we live in established neighborhoods with our houses built about 10 feet apart from each other. I am dumbfounded that this council thinks it is ok to disrupt the peace and tranquility of everyone because people are now allowed to buy and fire essentially a missile loaded with a variation of gun powder all day and into the late night for five days. How much did your action cost the fire department? The police? Do you know? Will you tell us? get that it is a tradition here in America to celebrate the 4th with fireworks— organized and choreographed shows have delighted people for decades. Typically these shows last maybe 45 minutes. This is celebrating—the coming together in commemoration of the birth of our nation. The Mayor had a super show downtown on July 1, Sunnyside Golf Course on July 4 and I am sure there were others throughout our city. Why aren't organized collective fireworks shows enough? Abiding by this half-baked idea foisted on us by our state lawmakers, justified by either an increase of state revenues or a misplacement of individual freedom is crazy making. I plead with you to listen to our fire and police chiefs. Consider the number of complaints received. I bet the number received to date represent more citizen resistance on this issue than any other in recent memory. Rescind this ordinance now. Save us from another round of this hell for 25 days this winter (December 10 to January 3.) During the five days and nights when they were legal, we felt like we were in the middle of a war zone with them being shot off from every direction of our home. Trying to sleep before midnight was impossible. Can you imagine needing to get up at 4:00 to prepare for dialysis after a night when they went on until 2:15? (That did happen.) Why should we have to stay up until people decide to stop shooting them off even though the time has expired? It's difficult to phone the police since you can't always tell the location they are being shot from. It was like everyone was trying to outdo each other. In addition, I now must tranqualize my old dog who was never afraid of sounds similar to storms. Trying to get her to go outside is next to impossible and she just pants and paces. When picking up the medicine at the veterinarian's office, I found out that we were definitely not alone with this problem. On Friday, July 14, I had not tranqualized my dog, and guess what -at 9:30 fireworks started up in a couple of different directions and she would not go outside, shook, etc. There is definitely a lack of respect for the dates and times that were set. Please consider following Dubuque and other major cities by not allowing people to shoot off fireworks in an uncontrolled environment. It is obvious that a big mistake was made in allowing this to go on. We have a fireworks festival to celebrate in downtown Waterloo and that should be enough. Starting right around June 1 the fireworks started and it increasingly got worse week by week. Multiple nights a week they were going off until 1:30am even on week nights (VERY often in the Ravenwood Apt area or off of Hammond.) By the last couple weeks of June they were starting by noon sometimes. Several of us in the neighborhood have pets. Our animals became absolutely terrified. Some were running away. I had to put my dog on a prescription from the vet. It's one thing to enjoy a few nights right around the fourth but this went on far too long! Neighbors including myself would call non emergency once it would get after midnight. But to hear there was something like an overall less then 10 citations given is ridiculous!!! We still continue to hear them at least once a week in this area. Why are they allowed to be sold prior to and after the date range the city approved them for? Tents and stores were up long before it was legal to be setting them off and the sales continued after. That did NOTHING but encourage the people who weren't going to follow the ordinance anyway to continue to purchase them and continue to set them off as long as they could buy them. Debris — 1 had a little in my yard, saw lots of it in parks -- Riverview recreation Area, Exchange park — city property... not legal there either, but not enough cops to enforce. Fire risk — I do have insurance, but shouldn't have to worry about something landing on my roof starting a fire. What about dry years, when there is a burn ban? Grass fires will be rampant — people will not observe rules regarding a burn ban, just as they didn't observe the dates fireworks were allowed. Winter— will be even louder. Sound travels further with no leaves on the trees blocking any of it. Who does fireworks on New years anyway? It's not an outdoor holiday. One last item — distinguishing between fireworks and gunshots. Unfortunately gunshots are common these days — in some neighborhoods more than others, but how many times have you heard people on the news say that it "sounded like fireworks". I hope some kid doesn't end up shot because they kept playing out in the yard because they thought it was fireworks. The citizens of Waterloo deserve the right to have peace and quiet in their own homes. This whole thing is not about freedom as the politicians are telling us, it is a money grab for sale tax, period. I have never been a fan of fireworks but was open to the idea of the possible revenue to our State. I am an employee of an agency that is heavily funded by the State budget and with recent cuts I am all for legislation that could increase our revenues. With that said, fireworks are not the answer. I live on Huntington Rd. Fireworks are still happening in my neighborhood occasionally. The week of legal use was a nightmare. All day and night long and use outside of the allotted time frame. The type of fireworks are what I find disturbing. The cannon explosions are so intrusive. I found myself anxious by day three. I can only imagine the impact on individuals with PTSD, Autism, sensory issues, small children and individuals that work 2nd and 3rd shift positions. The impact on pets and the wildlife is appaling to me. Numerous people have lost their pets during this time frame. Dog and cats run away at a higher rate during fireworks than any other time. My dogs were Definately impacted. Fireworks have been known to have an adverse effect on wildlife. The environmental impact is a shame as well. I know individuals who cleaned up five gallon buckets of firework debris from their properties and had burn marks on their driveways. Why Mr. Brandstad ever thought that ALL individuals would be respectful of others property is beyond me. Some use the convoluted "celebration of freedom" argument. Freedom for who? Not all individuals. I choose NOT to participate in fireworks yet I was FORCED TO by my intrusive neighbors. Any other Holiday I have a choice to participate or not. I don't have to answer my door at Halloween, I don't have to put a Christmas tree, the Easter Bunny is not coming to my house univitied..but fireworks, I have no escape. NONE. I can't get away from the sound. PERIOD. I have a 12 X 8 dog door and had sulfer smoke coming in through my door. No CHOICE. Fireworks should not be allowed in city limits. They should be a professionally run event where individuals can choose to participate or not. Professionally run shows are time limited, planned, and offer choice of participation. There are several communities that celebrate 4th of July without fireworks. They care about all citizens, environment and wildlife and pets not just FUN...which has been the only argument FOR fireworks. My animals were safe in the house and couldn't run away and also people could leave a T.V. or radio on for them. It has happened two more nights since the time frame is over. 1 don't know why we can't just go and enjoy them at the ball parks or downtown when professionals do it. Don't get me wrong, I love fireworks, just not every night for weeks and beyond. Plus I don't think we need to use our police officer for this and there will always be those who break the time frames. It's understandable that this first year would be "loud' and fireworks plentiful. My neighbors and I heard booms before July lst, near the end of June. During the legal period there was one night when I was awoken at 12:30 a.m. by booms; nothing lit the sky. There were loud voices, too, which suggested the people were nearby in the Hoover middle school area. Then just last week, either Wed or Thur evening, I saw red,white, and blue sparkle bursts (not sparklers). These were fired off behind Hoover school, somewhat out of site of many but not those of us sharing a property line with the school district. How can city officials/police truly locate these individuals? They were in a dark area, seemingly secluded, and fired off perhaps 2-5 pieces. I suspect these kinds of violationsare the basis of common concerns, yet nearly unenforcable. Perhaps a shorter time span might help as well as reconsideration of permiting fireworks over the winter holidays. Thanks for sharing my email with the appropriate people. Allowing fireworks was by far the worse decision our council has ever made. My #1 concern from the beginning was the Veterans from all generations. Doesn't matter if you're 90 or 19 war zone memories last a lifetime. How rude to treat our veterans in that manner. Why allow them at all since there are many illegally used anyway during the year and police response has to be used. Anymore not sure if they're gunshots or fireworks. Our city cannot afford to respond when there are more important issues to decd with. The smoke, fumes, debris and filth left in our city was enormous because of unconcerned citizens that believe someone else should pick up their debris. We have the right to a dean, litter free community without FIREWORKS. The ugly tents set up all over Waterloo were an eyesore. Friends of ours that live in neighborhoods said their closed windows shook and rattled. THINK ABOUT IT! This is your home and you can't even enjoy your own peace and quiet. The Council thinks it's OK to disrupt the peace & tranquility by shooting off a missile loaded with gunpowder all day and into Tate night. They are very disturbing in neighborhood settings. 1 heard them from time to time before June 30 and when it was finally legal I felt like 1 was in a war zone. Going inside and turning on the air conditioner and the TV did not help in reducing the sound. The remnants from the fireworks themselves were in my yard and the street . A neighbor was setting them off in the street and I don't know how we are supposed to use the street when that happens. I was worried about a fire starting in my yard or garage. I would recommend banning them totally and only permitting professional fireworks specialists to run large event firework displays. SHORTLY AFTER THERE WAS A FIRE AND POLICE CALL TO THE 700 BLOCK OF JOHNSON STREET FOR AN EXPLOSION. WHEN I GOT THERE THERE WERE SIX (6) POLICE OFFICERS, WATERLOO FIRE RESCUE'S BATTALION CHIEF, AN AMBULANCE, THE AERIAL TRUCK AND FOUR (4) ENGINES. I TALKED TO A NEIGHBOR THAT LIVES NEAR THE JOHNSON STREET ADDRESS WHO SAID HE HEARD TWO SMALLER FIREWORKS AND THEN THE BIG ONE. THE BATTALION CHIEF CONFIRMED THAT THE CALL WAS "UNFOUNDED." THE MAP SHOWS IT WAS ALL MOST 7/10 OF A MILE FROM MY HOUSE AND IT WOULD HAVE BEEN HEARD FARTHER AWAY.
