Request by LuAnn and Richard Stoakes to purchase a city owned lot
generally located at 120 Smith Street for the assessed value of $850.00, with
no development agreement.

Approval of the request as submitted.
The property was acquired through Iowa Code 657A in 2013 and
demolished in 2014. The applicant has been using the property for gardening
since 2014 through the city's Garden Plot Program and would now like to
purchase the property for the assessed value of $850.00.
The dimensions of the property are 36' x 104' or 3,744 square feet which
does not meet the minimum lot with of 50' nor the minimum lot size of 6,000
square feet. However, it is a lot of record as the lot appears to have been
platted prior to the adoption of the ordinance in 1969; and therefore could
legally be built upon, but the narrow lot width would only allow for a 26'
wide home. It would not appear to be marketable as a buildable lot.
The applicant lives at 319 Independence Avenue which is directly to the
south of the lot in question. The applicant also owns a parcel adjacent to the
city owned lot directly to the west along Smith Street and a lot directly to the
east adjacent to their home at 319 Independence Avenue.

Council. Any such applicant shall need to request review to Building and Grounds through a City Council member.
