RESOLUTION NO. 2017-859 RESOLUTION AUTHORIZING THE SALE AND CONVEYANCE OF CERTAIN TRACTS OF LAND, KNOWN AS LOTS 12 & 13 IN BLOCK 1 OF MANSON'S SECOND ADDITION IN ACCORDANCE WITH A PROJECT ADDENDUM TO THE AGREEMENT FOR RESIDENTIAL HOUSING CONSTRUCTION WITH HAWKEYE COMMUNITY COLLEGE, AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE NECESSARY DOCUMENTS. WHEREAS, the City of Waterloo, Iowa is the owner lots in the City of Waterloo, Iowa, as describe below, and WHEREAS, a 28E Agreement exists between Hawkeye Community College and the city of Waterloo, Iowa providing for student constructed housing, and WHEREAS, an addendum to the 28E Agreement with Hawkeye Community College, provides for the conveyance of lotsl2 & 13 in Block 1 of Manson's Second Addition to allow student constructed housing on the lots, with the lots being conveyed back to the city after construction is complete, in exchange for the cost of materials actually incurred by the college, and WHEREAS, a public hearing was held on October 16, 2017 at 5:30 p.m. in the Harold E. Getty Council Chambers, City Hall, Waterloo, Iowa, as provided by law, by the Council of the City of Waterloo, Iowa, on the proposal for the sale and conveyance of certain tracts of land, known as lots 12 & 13 in Block 1 of Manson's Second Addition in accordance with a Project Addendum to the Agreement for Residential Housing Construction with Hawkeye Community College, and WHEREAS, it is the opinion of this council that said sale and conveyance should be made as proposed. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF WATERLOO, IOWA, AS FOLLOWS: 1. The tracts of land, known as lots 12 & 13 in Block 1 of Manson's Second Addition, as fully described in the published notice in the Waterloo Courier on October 6, 2017, are not presently needed for municipal purposes. 2. That the addendum to the 28E Agreement with Hawkeye Community College, to provide the conveyance of two lots in the 200 block of Newell Street to allow student constructed housing on the lots, with the lots being conveyed back to the city after construction is complete, in exchange for the cost of materials actually incurred by the college is hereby accepted for the real property described as follows: LOTS 12 AND 13, BLOCK 1, MANSON'S SECOND ADDITION, CITY OF WATERLOO, IOWA 3. That the City of Waterloo, Iowa conveys said parcels of real property described above to Hawkeye Community College of Waterloo, Iowa by general warranty deed. Resolution 2017-859 Page 2 4. That the Mayor and City Clerk are authorized and directed to execute said general warranty deed. 5. That the original of said general warranty deed, fully executed and acknowledged, is hereby approved and confirmed by this Council. 6. That the City Attorney is authorized and directed to deliver said general warranty deed to Hawkeye Community College. PASSED AND ADOPTED this 16th day of October 2017.
