REGULAR SESSION
September 24, 1973 - 7::30 P -M:
The City Council of the City of Waterloo, Iowa, met in Regular Session in the
Council Chambers in the City Hall in said City at 7.30 P . on September 24,
1973.
Mayor Turner in the Chair.
Present Councilmen Cavanaugh, Dykeman, Keller, Mabrey, Miller and Morrissey.
Absent, Councilman Cohea,
Councilman Charles Dykeman offered the invocation.
64515 - Moved by Miller, seconded by Morrissey that the Agenda, as amended, for
the Regular Session of September 24, 1973 at 7.30 P_M.. be accepted and
approved.

64516 - Moved by Mabrey, seconded by Keller that the Minutes of the Regular Ses-
sion held September 17, 1973 at 730 P,M,, be approved

64517 - Moved by Cavanaugh, seconded by Miller that the proof of publication of
Notice of Hearing on proposed plan and specifications and proposed form
of contract for the 1973 Seal Coat Program 1 and the taking of bids for
said improvement, Contract No; 139, be received and placed on file.

64518 - The Mayor announced the time had arrived to near objections, if any, and
asked if anyone present wished to be heard or make objection, or if
there were any written objections filled with the Clerk.
No one appeared to object orally, and the Clerk reported that no written
objections had been filed.,
Thereupon, it was moved by Morrissey, seconded by Mabrey that Resolution
No. 22823, confirming the approval of the plans, specifications, form of
contract, etc, for the 1973 Seal Coat Program 1, Contract No. 139, in
City of Waterloo, Iowa, be adopted.

voted Aye Nay; None. Absent: Cohea, Mayor declared the resolution
adopted.

64527 - Moved by Morrissey, seconded by Cavanaugh that the proof of publication
of the Notice of Public Hearing on Re -zoning, upon the request of Occi-
dental Development, Ltd., upon the recommendation of the City Plan and
Zoning Commission and the City Council's own motion, to rezone certain
real property located in part of Section 2 -88N -13W (approximately 1,000
feet south of East Ridgeway Avenue between Hammond Avenue and proposed

Wisconsin Street extended), as fully described in said Notice published
in the Waterloo Daily Courier on September 6, 1973, from "A-1" Agricult-
ural District and "R-2" One and Two Family Residence District to "R-4"

64528 - The Mayor announced the time had arrived to hear objections,, if any, and
asked if anyone present wished to be heard or make objections, or if
there were any written objections filed with the Clerk.
The Clerk reported there were no written objections, and no one appeared
to object orally.
Larry Rust explained the proposed rezoning. These would be all private
streets and sewers except Bethel Street. Leonard Levene, representative
of Occidental Development, Ltd., explained the proposed conventional
multi -family units. There would be 1032 units, with 150 to 200 units in
the first construction phase and 35 apartments per unit. There will be
a live-in resident manager.
The Mayor asked about right -of -access on private streets for fire and
police protection. Dykeman asked what type of smoke detector there would,
be, or whether they would have a sprinkler system. Mr. Levene stated
there would be a smoke detector and they were investigating a sprinkler
system. The Mayor reported the need of the City Attorney to make sure
Bethel Street is not used to funnel all the traffic from this developmen'
i.e, if it is half completed and this is the only access, this could caus
a traffic problem.
After public hearing and no objections having been made or filed, it was
moved by Dykeman, seconded by Miller that an Ordinance be drawn and sub-
mitted for said re -zoning.
On roll call, Cavanaugh, Dykeman, Keller, Mabrey, Miller and Morrissey
voted Aye. Nay: None. Absent: Cohea. Mayor declared the motion
carried.
64529 - The Mayor recommended that because of the private street problem, this
ordinance pass its first reading, to give the City Attorney time to work
out details on the street, fire and police protection and sewer problems.
An Ordinance amending Ordinance No: 2479, as amended, by adding Sub -Sec-
tion No. 55 to Section 2A-5, rezoning certain property in the City of
Waterloo, Iowa, was read by the Clerk.
Moved by Miller, seconded by Cavanaugh that said Ordinance be recorded
as having passed its first reading.
On roll call, Cavanaugh, Dykeman, Keller, Mabrey, Miller and Morrissey
voted Aye. Nay; None. Absent: Cohea. Mayor declared the motion
carried
64530 - Moved by Cavanaugh, seconded by Morrissey that the proof of publication
of the Notice of Public Hearing on Proposal to Sell Real Estate in the
City of Waterloo, Iowa, known as Disposal Parcel No. 97A in the Westfield
Virden Urban Renewal Area, Project No. Iowa R-7, for side yard purposes,
to Johnny C. Rice, R.. R. No.. 5, as fully described in the said notice
published in the Waterloo Daily Courier on August 23, 1973, be received
and placed on file.

64531 - The Mayor announced the time had arrived to hear objections, if any, and
asked if anyone present wished to be heard or make objection, or if any
written objections had been filed with the Clerk,
No one appeared to object orally, and the City Clerk reported there had
been no written objections placed on file.
After public hearing and no objections having been made or filed, it was
moved by Cavanaugh, seconded by Mabrey that Resolution No. 22827, a reso-
lution approving the sale of Disposal Parcel Noo 97A in the Westfield -
Virden Urban Renewal Area, Project No. Iowa R-7, and authorizing the ex-
ecution of the necessary contract for sale of land for private redevelop-
ment and deed, be adopted.
On roll call, Cavanaugh, Dykeman, Keller, Mabrey, Miller and Morrissey
voted Aye. Nay: None. Absent: Cohea. Mayor declared the resolution
adopted.
64532 - Moved by Keller, seconded by Dykeman that the acceptance of the bid of
Cedar Valley Corporation of Waterloo, Iowa for the 1973 Seal Coat Program
1, Contract Noo 139, in the City of Waterloo, Iowa be deferred for one
week for the City Engineer and City Attorney to study deviation on the
maintenance Bond.

64533 - The City Engineer, having checked the bids submitted for the 1973 Resur-
facing Program II, Contract Noo 140, in the City of Waterloo, Iowa, re-
ported that after checking the extensions and totals of the bids, the
bid of Denamn Phillips Construction Co., Inc., of Waterloo, Iowa in the
amount of $44,292,00, was the lowest legal bid received.
Moved by Morrissey, seconded by Miller that Resolution Noo 22828, accept-
ing the bid of Denman Phillips Const. Company, Inc. of Waterloo, Iowa in
the amount of $44,292.00 for the construction of the 1973 Resurfacing Pro
gram II, Contract Noo 140, in the City of Waterloo, Iowa, be adopted.
On roll call, Cavanaugh, Dykeman, Keller, Mabrey, Miller and Morrissey
voted Aye. Nay: None. Absent: Cohea. Mayor declared the resolution
adopted.
64534 - Mayor Turner recognized the students from Central High and also members
of the Junior League, who were in attendance at the Council Meeting.
64535 - Dan Beuhler, 1524 Black Hawk Road, requested that the speed limit on
Black Hawk Road between Deere Road and Ansborough, be reduced to 30
miles per hour. Mr. Beuhler also told of drainage problems in this area.
Moved by Miller, seconded by Mabrey that the oral requests of Dan Beuhler
1524 Black Hawk Road, that the speed limit on Black Hawk Road between
Deere Road and Ansborough, be reduced to 30 miles per hour, and the drain!,
age problem in this area corrected, be received, placed on file and re-
ferred to the Traffic and City Engineer's department respectively for
study and report back to the Council.

64536 - Moved by Dykeman, seconded by Miller that the communication from the City
Engineer, transmitting the request from Northwestern Bell Telephone Com-
pany for permission to rebuild one manhole on Logan Avenue, south of
Argyle Street, as shown on the attached plat, and recommending approval,
be received, placed on file and request granted.

64537 Moved by Miller, seconded by Morrissey that the communication from the
City Engineer, transmitting five (5) copies of Iowa State Highway Com-
mission Application Form #559 from Wendell Lockard Construction, Inc.,
Waterloo, Iowa, requesting permission to construct two 31' B -B Paved
Type "B" Street connections to Iowa Highway #57 (Airline Highway) at
Station 76+62.5 and 87+12.5, as shown on the attached print, and recom-
mending approval subject to Highway concurrence, be received, placed on
file, recommendations approved and the Mayor and City Clerk authorized
to sign said application in behalf of the City of Waterloo, Iowa.

64538 Moved by Dykeman, seconded by Keller that the communication from the City
Plan and Zoning Commission, transmitting the request of William and Peggy
Rolison for the City of Waterloo to vacate, sell and convey a 20' platted
alley running NWly from Wyoming Street and parallel with Lafayette Street
known as the E -W alley in Block 5, Cotton's Addition, as shown on the
attached print, for the sum of $135.00 plus costs, together with offers
to purchase the entire alley, if vacated, and a letter from the Waterloo
Water Works, and recommending approval subject to the City retaining
easement rights over and across the full width of the Ely 120' of said
alley, be received, placed on file, recommendations approved and Resolu-
tion No. 22829, fixing the time and place of hearing on a proposal to
vacate, sell and convey the E -W alley in Block 5, Cotton's Addition,
adopted, same being October 22, 1973 at 7:30 P,M.. in the Council Chambers
in City Hall, and the City Clerk instructed to publish the Notice of
hearing as provided by law.

64539 - The City Engineer recommended denial unless the City changes its policy
on limited access on Ridgeway. Ridgeway at this location has only two-
lane traffic, Councilman Dykeman asked if we could approve this request
for additional curb cut even though the Planning Commission and City En-
gineer recommend denial. The Mayor reported that the Council had the
prerogative, even though there is a deviation from the limited access
policy, it could be approved if it would help move the traffic from this
church parking lot.
Moved by Mabrey, seconded by Dykeman that the communication from the City
Plan and Zoning Commission, transmittiugti-e request from the Walnut Ridge Bhp
List Church for an additional curb cut to West Ridgeway Avenue in con-
junction with enlarging the off-street parking lot, as shown on the at-
tached plat, and recommending denial, be received, placed on file, and
said request be approved.

64540 - Moved by Miller, seconded by Dykeman that the communication from the Com-
munity Development Administrator, submitting for Council consideration
an offer from Northland Products Company, Inc. to sell to the City of
Waterloo their property located at 1000 Rainbow Drive for Unit LA of the
Waterloo Flood Protection Project purposes, and recommending approval,
be received, placed on file, approved and Resolution No. 22830, a resolu-
tion accepting and approving a certain offer to sell real property to
the City and accepting and approving certain deed, be adopted.

City Engineer, transmitting the request of F. A, Moser & Associates, Inc,
Contractors, Waterloo, Iowa, for a time extension to December 1, 1973,
for the Huntington Road Storm Sewer Phase "A" Army Corps of Engineers°
Flood Control Dike, Contract No. 88, and recommending approval, be recei-
ved, placed on file and request granted.

64542 - Moved by Cavanaugh, seconded by Morrissey that the communication from
the City Engineer, transmitting request from Richard Street for permis-
sion to repair one concrete approach with temporary asphalt without re-
gard to sidewalk grade at 434 Carolina Avenue, Waterloo, Iowa, together
with $3.00 check for recording waiver, and recommending approval subject
to provisions of this letter, be received, placed on file, request ap-
proved and Resolution Wo, 22831, granting permission and authorizing con-
struction irrespective of later official grade, be adopted.

Use Report Entitlement Period 4, July 1, 1973 - June 30, 1974, be re-

the City Cleric to publish the notice of Revenue Sharing Planned Use, be
adopted.

nue), Contract No. 91, in conjunction with the development of Greenway,
in the City of Waterloo, Iowa, reporting said firm will be reimbursed by
the Iowa State Highway Commission, and recommending approval, be recei-
ved, placed on file, approved and Resolution No, 22833, approving and

amending the Plumbing Code of the City of Waterloo, Iowa, by amending,
deleting and modifying certain sections of the Iowa State Plumbing Code
(1973), be adopted.

Community Development Administrator, submitting a statement from Brice,
Petrides & Associates, Inc. dated 9/10/73 for engineering services in
connection with the right-of-way required for Section IA of Flood Control
(Forrester Avenue area), and recommending approval, be received, placed
on file and Resolution No. 22837, approving the statement of said firm
and authorizing payment accordingly, be adopted.

64555 Mayor Turner reported that Councilman Cohea will not move until November
10th and under Iowa law a successful candidate could be sworn in to fill
out the unexpired term.
Moved by Dykeman, seconded by Miller that the communication of Norman F.
Cohea, submitting his resignation as Councilman of the Third Ward of the
City of Waterloo, Iowa, due to moving outside the Third Ward boundaries,
to become effective on November 10, 1973, be received, placed on file,
accepted with regret and Mr. Cohea thanked for his faithful efforts dur-
ing the time he served as Councilman of the Third Ward in the City of
Waterloo, Iowa.

64556 - Mayor Turner reported this budget is for the 18 -month period of January
1, 1974 through June 30, 1975. We are limited to 30 mills for functional
funds. This budget is estimated at 28:03 mills for functional funds.
Dykeman asked if the local government could be financed in another way.
Mayor Turner reported there was a bill filed in the legislature for local
option taxes, Thisfailed to pass, but at another session they may have
a chance to pass it. We find ourselves being forced by state and federal
governments to do things we might not do otherwise, such as the police
and fire pension funds_ The legislature decides what pensions we will

pay the police and firemen and the actuary will decide what contribution
by the City will be necessary in order to pay these pensions:

Council having duly considered said Budget and being fully advised, finds
that hearing date should be fixed and does hereby set October 8, 1973 at
7:30 P,M. in the Council Chambers, City Hall in said City, as the date,
time and place for said hearing, and the City Clerk is hereby instructed
to publish the Estimate and Notice of hearing, which is worded and fig-
ures as shown on the following page .

as shown on the attached sheet for various Beer Permit and/or Beer and
Liquor Licenses as designated, at the locations shown, in the City of
Waterloo, Iowa, be, and the same are hereby approved for the issuance of
said Permits and/or Licenses, that the approval be endorsed on the appli-
cations and forwarded with fees and/or certified fee receipts to the Iowa
Beer and Liquor Control Department, and duplicate copies of applications,
be received, placed on file, and Resolution No. 22839, approving the ap-
plications, be adopted.

be completed before transferring details to this shee (Form 631). Schedule 631-A* must be prepared for any interested tax-
payer and for attachment to the certified budget copies. (*Home Rule Cities may provide complete working budget in lieu
of Supplemental Detail.)
Round all figures to the nearest dollar. Data will be keypunched for computer processing Inclusion of cents could
shift decimals two places, thereby distorting computations and analysis.
Expenditures for Debt Service must conform to resolutions on file with the County Auditor.
Columns A -F must be completed for a tax levy. Columns A-E are to be completed if an expenditure is proposed not re-
quiring a tax levy. This includes municipally -owned utilities. The amounts published in column C control expenditures
and represent maximum expenditures authorized by law.

ffic Division of the Waterloo Police Department, transmitting the appli-
cation of Mack Eugene Harkrider, 806 Logan Avenue, together with doctor's

received, placed on file and license denied.
