Mayor Bernard L. McKinley in the Chair. Roll Call: Fox, Angel, Buck, Budak, Brown. Absent: Dell, Wright. Invocation by: Councilperson Fox Pledge of Allegiance: L. C. Hennessey 94581 - Moved by Buck, seconded by Brown that the Agenda, as amended, for the Regular Session on October 2, 1989, at 7:00 p.m., and the Minutes of the Regular Session on September 25, 1989, at 7:00 p.m., be accepted and approved. Motion carried. HEARINGS 94582 - Moved by Fox, seconded by Angel that proof of publication of notice of public hearing on request of Iowa Public Service for a waiver of the building moratorium on Relocated U.S. 218 Corridor to construct electrical overhead transmission lines across Relocated U.S. 218 at Duryea Street, as published in the Waterloo Courier on September 26, 1989, be received and placed on file. Motion carried. 94583 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Moved by Brown, seconded by Fox that the hearing be closed and the recommendation of approval of the Gateway Committee and the Planning, Programming and Zoning Commission, be received and placed on file. Motion carried. 94584 - Moved by Fox, seconded by Angel that "Resolution authorizing waiver of building moratorium on Relocated U.S. 218 Corridor for Iowa Public Service", be adopted. Ayes: Five. Absent: Dell, Wright. Resolution adopted and upon approval by Mayor assigned No. 1989-532. 94585 - Moved by Buck, seconded by Brown that proof of publication of notice of public hearing on request of Lewis Systems of Iowa, Inc. to vacate City sidewalk in the vicinity of West Parker and David Streets, as published in the Waterloo Courier on September 22, 1989, be received and placed on file. Motion carried. 94586 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Moved by Angel, seconded by Budak that the hearing be closed and the recommendation of approval of the Planning, Programming and Zoning Commission, be received and placed on file. Motion carried. 94587 - Moved by Fox, seconded by Brown that "an ordinance vacating City sidewalk in the vicinity of West Parker and David Streets", be received, placed on file, considered and passed for the first time. Ayes: Five. Absent: Dell, Wright. Motion carried. 94588 - Moved by Budak, seconded by Fox that proof of publication of notice of public hearing on request of John Todalen to vacate a portion of the sidewalk adjoining property at 1230 Avon Avenue, as published in the Waterloo Courier on September 22, 1989, be received and placed on file. Motion carried. October 2, 1989 Page 2 Hearings - continued 94589 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections. Councilperson Angel stated that the City should be responsible for continuing the sidewalk north of the property. Eric Thorson, City Engineer, stated that it has always been the property owner's responsibility to install sidewalk the first time. Since sidewalk has not ever been constructed in the area, it is the City's policy that it would be the property owner's responsibility. Councilperson Angel stated that she was in favor of vacating the sidewalk as requested. Moved by Budak, seconded by Buck that the hearing be closed and the recommendation of denial of the Planning, Programming and Zoning Commission and oral comments, be received and placed on file. Motion carried. 94590 - Moved by Budak, seconded by Buck that "an ordinance vacating a portion of the sidewalk adjoining property at 1230 Avon Avenue", be received, placed on file, considered and passed for the first time. Motion carried. 94591 - Moved by Buck, seconded by Angel that proof of publication of notice of public hearing on request of Flowerama to install a post sign to be located at the northwest corner of the intersection of Kimball Avenue and Ridgeway Avenue, as published in the Waterloo Courier on September 26, 1989, be received and placed on file. Motion carried. 94592 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Don Temeyer, Planning and Development Director, stated that it was the staff's recommendation that the sign be denied based upon the Council's denial of the site plan on September 18, 1989 Moved by Brown, seconded by Angel that the hearing be closed and the recommendation of denial of the Planning, Programming and Zoning Commission and oral comments, be received and placed on file. Motion carried. 94593 - Moved by Buck, seconded by Angel that the request of Flowerama to locate a post sign at the northwest corner of the intersection of Kimball Avenue and Ridgeway Avenue be denied. Ayes: Five. Absent: Dell, Wright. Motion carried. Resolution adopted and upon approval by Mayor assigned No. 1989-535. 94597 - Moved by Fox, seconded by Brown that communication from Transportation Program Manager transmitting utility agreement with the Iowa Department of Transportation for the reconstruction of a 21" sanitary sewer from West Mullan Avenue to the pump station at University Avenue and U.S. Highway 63 in conjunction with Relocated U.S. Highway 218, IX -218-7(60)--3P-07, together with recommendation of approval, be received, placed on file and "Resolution approving said agreement", be adopted and Mayor and Clerk/Auditor authorized to execute same.
