Invocation by: Councilperson Tony Budak Pledge of Allegiance: Jeff Murphy 94451 - Moved by Angel, seconded by Dell that the Agenda, as amended, for the Regular Session on September 5, 1989, at 7:00 p.m., and the Minutes of the Regular Session on August 28, 1989, at 7:00 p.m., be accepted and approved. Motion carried. HEARINGS 94552 - Moved by Buck, seconded by Wright that proof of publication of notice of public hearing on sale and conveyance of real property located at 121-1211 Quincy Street to Rose Properties, Inc., as published in the Waterloo Courier on August 29, 1989, be received and placed on file. Motion carried. 94453 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Moved by Brown, seconded by Wright that the hearing be closed and oral and written comments be received and placed on file. Motion carried. 94454 - Moved by Dell, seconded by Angel that "Resolution authorizing sale and conveyance of real property located at 121 -1211 -Quincy Street to Rose Properties, Inc. in the amount of $11,500.00", be adopted and City Attorney instructed to prepare and deliver a deed accordingly. Resolution adopted and upon approval by Mayor assigned No. 1989-475. 94455 - Moved by Fox, seconded by Buck that proof of publication of notice of public hearing on F.Y. 1990 Sidewalk Repair Assessment Program --Zone 1, Contract No. 382, as published in the Waterloo Courier on August 25, 1989, be received and placed on file. Motion carried. 94456 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections. Al Manning, 919 Fairview Avenue, questioned the City's institution of a sidewalk repair program. He indicated that the standards were too stringent and unreasonably taxed property owners. He presented pictures of badly damaged sidewalks in the City that were not included in Zone 1. He asked what the City intends to do with these sidewalks since many of them are in worse condition than those being required to be repaired this year. Molly Frazer, Assistant City Attorney, stated that the City's institution of a sidewalk repair program is necessary due to a recent Supreme Court ruling stemming from a law suit in Dubuque, as well as Chapter 613 of the State Code of Iowa. Mr. Manning also questioned the short time frame that property owners have to complete the necessary sidewalk repairs. He also indicated that in reviewing law suits against the City, there have been only five within the last few years concerning sidewalk injuries.
