Mayor Bernard L. McKinley in the Chair. Roll Call: Dell, Fox, Angel, Wright, Budak, Brown. Absent: Buck. Invocation by: Councilperson Bob Brown Pledge of Allegiance: Police Chief Roger Shook 93509 - Moved by Dell, seconded by Brown that the Agenda, as proposed, for the Regular Session on March 6, 1989 at 7:00 p.m. and the Minutes of the Regular Session, as amended, on February 27, 1989 at 7:00 p.m., be accepted and approved. Motion carried. HEARINGS 93510 - Moved by Fox, seconded by Brown that proof of publication of notice of public hearing on request to sell and convey 321 Gable Street to Bartow and Mary E. Campbell, as published in the Waterloo Courier on February 24, 1989, be received and placed on file. Motion carried. 93511 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Moved by Brown, seconded by Budak that the hearing be closed and the recommendation of approval of the Community Development Board, be received and placed on file. Motion carried. 93512 - Moved by Wright, seconded by Angel that "Resolution authorizing sale and conveyance of 321 Gable Street to Bartow and Mary E. Campbell for $1,001.00", be adopted and City Attorney instructed to prepare and deliver a deed accordingly. Ayes: Six. Absent: Buck. Resolution adopted and upon approval by Mayor assigned No. 1989-92. DOCUMENTS 93513 - Moved by Fox, seconded by Angel that communication from Transportation Program Manager transmitting Supplemental Contract, Application of Supplemental Contract and Consent of Bondsmen and Bond with Cedar Valley Corporation in conjunction with Katoski Drive, M-6585(3)--81-07, be received, placed on file and "Resolution approving said contracts", be adopted and Mayor authorized to execute same. Resolution adopted and upon approval by Mayor assigned No. 1989-95. 93516 - Moved by Fox, seconded by Angel that communication from Transportation Program Manager transmitting Certificate of Completion and Final Acceptance of Agreement Work for Independence Avenue, IX -6600(2)--79-07, for work completed by WestMarc Cable Group, be received, placed on file and "Resolution approving said document", be adopted and Mayor authorized to execute same. ORDINANCES TO BE ADOPTED 93517 - Bill Lemke, 149 Madison, stated that the sidewalks should remain the responsibility of all citizens just like streets have been determined to be. Discussion was heard on the possibility of assessing property owners across the street from a sidewalk. Such a situation exists on Rainbow Drive. It was explained that historically the responsibility and benefit derived from a sidewalk has been with the adjacent property owner. It would be very difficult to determine the liability of a property owner across the street or down the block. Moved by Angel, seconded by Brown that "an ordinance amending the 1988 Code of Ordinances of the City of Waterloo, Iowa by repealing Sections 33-52, 33-53, 33-60, 33-62, 33-63, 33-64, 33-65, 33-66, 33-67, 33-68, of Article IV, Sidewalks, of Chapter 33, Streets and Sidewalks; and by enacting in lieu thereof new Sections 33-52, 33-53, 33-54, 33-6D, 33-62, 33-66, 33-67, 33-68, of Article IV, Sidewalks, of Chapter 33, Streets and Sidewalks; and by adding Division 3, Sidewalk Inspection and Repair, to Chapter 33, Streets and Sidewalks; and by repealing the title "Division 3. Bus Stop Benches"; and enacting in lieu thereof a new title "Division 4. Bus Stop Benches"; and by repealing Subsection (b) of Section 33-80, Period of Amortization for Public Improvements, of Article V, Excavations, of Chapter 33, Streets and Sidewalks; and by enacting in lieu thereof a new Subsection (b) of Section 33-80, Period of Amortization for Public Improvements, of Article V, Excavations, of Chapter 33, Streets and Sidewalks (sidewalk inspection and repair)", be received, placed on file, considered and passed for the second time. BILLS PAYMENT 93519 - Moved by Angel, seconded by Wright that "Resolution approving Schedule A918, pp. 1-41, in the amount of $203,624.21, and Schedule W900, pp. 1-2, in the amount of $60,399.15, copies of which are on file in the Clerk Auditor's Office", be adopted. Hennessey, 319 Belmont, reported on a junk car situation in the front yard of 407 Randall Street. It was explained by Mayor McKinley that this car is operable and is not considered a junk car; therefore, the City ordinance pertaining to junk cars does not apply. Councilperson Wright commended the Personnel Department and the Affirmative Action Officer on the recently issued Affirmative Action Report. Moved by Wright, seconded by Angel that the above oral comments be received and placed on file. Motion carried. 93523 - Hugh Field, City Attorney, stated that the purpose of the Executive Session was to discuss labor strategy, a topic of Executive Session per Iowa Code, Chapter 20.16. Moved by Dell, seconded by Angel that the Council adjourn to Executive Session. Ayes: Six. Absent: Buck. Motion carried. EXECUTIVESESSION 93524 - Moved by Fox, seconded by Wright that the Council adjourn Executive Session. Ayes: Six. Absent: Buck.
