The Council of the City of Waterloo, Iowa, met in Regular Session at City Hall Council
Chambers, Waterloo, Iowa, at 7:00 p.m. on May 2, 1988. Mayor Bernard L. McKinley in the
Chair. Roll Call: Dell, Fox, Angel, Buck, Wright, Budak, Brown.

92010 - Moved by Buck, seconded by Angel
that the Agenda, as amended, for the Regular Session on May 2, 1988, at 7:00
p.m., be accepted and approved. Motion carried.
92011 - Moved by Buck, seconded by Angel
that the Minutes of the Regular Session of April 25, 1988, at 7:00 p.m., be
accepted and approved. Motion carried.
92012 - Mayor McKinley recognized Betty Fortune, of the Waterloo Parks Department, and
Arthur F. Shannon, of the Sewer Department, for thirty years of service to the
City of Waterloo. Mayor McKinley stated it took a certain quality in an
individual to commit thirty years of service to a employer, and that these two
individuals represented a high quality of employee.
Mayor McKinley read a proclamation on behalf of the Black Hawk County YMCA
proclaiming May 1 - May 8, 1988 as YMCA Week.

that proof of publication of notice of public hearing on request of James R.
Nelson, D.D.S.M.S., to vacate, sell and convey the north 30 feet of the San

as published in the Waterloo Courier on April 22, 1988, be received and placed

92014 - HOLD HEARING --This being the time and place for public hearing, the Mayor
called for written and oral objections and there were none.

Agreement with Black Hawk County for construction of the relocated entrance

Prior to the vote, Councilperson Brown, Chairperson of the Public Works

gas plants, transmission, and distribution systems and to furnish gas service
for public and private use within the City of Waterloo, Iowa (herein "The
City") for a term of twenty (20) years, and to establish the conditions
required and manner of use of streets and public grounds of the City in which
said gas works may be located, and to provide for notice of damaged pipelines,
and to confer the power of condemnation of private property, and providing for
the repeal of Ordinance No. 2299", be received, placed on file, passed and
considered for the first time.

Prior to a vote, Tom Watt, representative of IPS, read a letter from the
President of IPS stating the strong lines that IPS had with the City of
Waterloo. Watt stated that he would also like to compliment the Mayor's
Municipal Power Study Committee reviewing the IPS franchise and a special
thanks to the Committee members and Don Hoth, Chairperson.

ORAL PRESENTATIONS
92047 - Reverend George Howard, Pastor of Antioch Baptist Church, stated that he was
extremely concerned about the problem that presently exist at the Chicago
Central railroad crossing on East Fourth Street. Howard continued that this is
a problem that has existed for a number of years and he really hoped that the
Council would show support in that area of town in trying to eliminate this
problem. Howard stated that he is concerned that there could potentially be an
accident with a child trying to crawl through a train that is blocking the
passage of pedestrians.
Mayor McKinley stated that they had talked with the railroad, and that he was
aware that it was a major switching yard for the Chicago Central Railroad.
McKinley continued that his concern was not so much the traffic conjestion
because of the alternative underpass on Logan Avenue, but his concern was the
danger of children crossing the trains while they are standing still at the
crossing. McKinley stated that they recently had a conference with Federal
representatives to help resolve the problem.

Reverend Howard stated that not only is the crossing a problem, but the whole
East Fourth Street area needs the attention of the Council for revitalization.
Councilperson Buck stated that he also was concerned with the area and the
crossing he uses several times a week.
Councilperson Dell stated that the entire East Fourth Street area needs to be
reworked and revitalized.
Ernie Boykin, 530 Hope Avenue, stated that she also was concerned about the
problems with the railroad crossing at East Fourth Street and also echoed the
remarks of Reverend Howard regarding the redevelopment plan for that area.
Boykin continued that the Council needed to find the funding for a underpass or
whatever it took to alleviate the problem in the area.
Boykin presented a petition signed by not only residents in the area but
citizens who use the crossing on a regular basis to have the Council find ways
of eliminating the problem.
Mayor McKinley stated that a large number of houses that were being proposed to
be rehabilitated by Peter Kwett, Des Moines Renovation Company, were located in
the East Fourth Street area. McKinley continued that this was a very exciting
project and to his knowledge the only project of its kind in the nation.
Tom Hall stated that the railroad crossing has been a problem for a number of
years, and that the residents needed to discontinue to put up with the
inconvenience.
Councilperson Wright stated that times are changing, and it is time for a
change in that area to eliminate any problems.
Reverend Howard stated that he also agreed with Councilperson Wright that
changes needed to be made.
