The Council of the City of Waterloo, Iowa, met in Regular Session at City Hall Council
Chambers, Waterloo, Iowa, at 7:00 p.m. on January 25, 1988. Mayor Pro -Tem Robert Brown
in the Chair. Roll Call: Dell, Fox, Angel, Buck, Wright, Budak, Brown.

that the Agenda, as proposed, for the Regular Session on January 25, 1988, at
7:00 p.m., be approved.

91500 - Moved by Angel, seconded by Buck
that the Minutes of the Regular Session held on January 18, 1988, at 7:00 p.m.
be approved.

HEARING
91501 - Moved by Angel, seconded by Fox
that proof of publication of notice of public hearing on sale of City -owned
land generally located on the east side of Ansborough Avenue between Downing
Avenue and University Avenue (Parcel D) in conjunction with Ansborough Avenue,
IX -6615(3)--79-07, as published in the Waterloo Courier on January 8, 1988, be
received and placed on file.
Motion carried.
91502 - HOLD HEARING --This being the time and place of public hearing, the Mayor
called for written and oral objections and there were none.
Moved by Wright, seconded by Budak
to receive and place on file bids received from Peggy M. Winninger and
Theodore R. Winninger in the amount of $56,000 and James Larry Jones and
Richard D. Flynn in the amount of $54,800.

91503 - Moved by Buck, seconded by Fox
that "Resolution authorizing sale and conveyance of City -owned land generally
located on the east side of Ansborough Avenue between Downing Avenue and
University Avenue (Parcel D) in conjunction with Ansborough Avenue,
IX -6615(3)--79-07, to Peggy M. Winninger and Theodore R. Winninger", be
adopted. Ayes: Seven.
Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1988-22.
ORAL PRESENTATIONS
91504 - Greg Beaver, representative of HUD, presented a certificate to the Council for
the Community Development Board's participation in recognizing the minority
business enterprises for 1987.
Councilperson Buck stated that he was honored to be serving with Mayor Pro -Tem
Brown.

Oral Presentations - continued
Daryl Smith, a UNI Professor of Biology, addressed the Council on the
potential harm that could take place if a road from the proposed rock quarry
north of Waterloo were to be left in the proposed location. (See CR 91482 of
January 18, 1988). Smith stated that there was approximately 28,000,000 acres
of natural prairie and now it is down to one tenth of one percent of that. He
stated that this was the only black soil prairie in the county, it contained
uncommon species to other prairies in the county, and it potentially could go
from a "C" to a "B" rating in the near future. Professor Smith urged the
Council to take action to relocate the road leading from Big Rock Road to the
proposed site for the new rock quarry.
Paul Whitson, Professor at UNI in Biology, stated that the present Stiles'
prairie is the location for a very rare orchid called the White Lady Slipper.
Whitson continued that Stiles' prairie is the only one of six sites where the
flower now exists in Iowa. Whitson recommended to the Council that they
reconsider their motion of last week and relocate the proposed road from the
quarry to Big Rock Road so that no harm will come to the Stiles' prairie.
Moved by Dell, seconded by Angel
to receive and file the above comments and to place on the Council Agenda for
Monday, February 1, 1988, a motion to reconsider the action of January 18
regarding the location of the rock quarry and the location of the road running
next to Stiles' prairie.
Motion carried.
91505 - Tom Hall, address not given, stated that he had listened to the editorial
given by Grant Price the other night and he would ask the Council to please
consider other alternatives to cutting the F.Y. 1989 budget instead of cutting
the Police and Fire Departments.

to receive and file the above comment.

that the Waterloo Housing Authority Ridgeway Towers and Section 8 Existing
Housing Certificate Program Report dated January 8, 1988, be received and
placed on file.

that communication from Clerk/Auditor requesting authorization to publish the
1987 salaries of all City employees as required by the State Code of Iowa and
audit compliance be received, placed on file, approved and Clerk/Auditor
instructed to publish same.

approval, be received, placed on file and Mayor Pro -Tem and Clerk/Auditor
authorized to execute same.

that communication from City Engineer transmitting recommendation to set April
1, 1988 as the last day for accepting oiling petitions from property owners
for oiling of streets and alleys in the City of Waterloo during the Summer of
1988 in conjunction with F.Y. 1989 Oiling Program, Contract No. 349, be
received, placed on file, approved and April 1, 1988 be established as the
last day for acceptance of said petitions.

RESOLUTIONS TO BE ADOPTED
91516 - Moved by Fox, seconded by Wright
that "Resolution reauthorizing a request for an appeal to the Iowa Department
of Management to exceed General Levy Limit for F.Y. 1989 Budget", be adopted.
Mayor Pro -Tem Brown stated that he had received a call from a Don Palmer
objecting to the levy increase.
Ayes: Seven.
Resolution adopted and upon approval by Mayor Pro -Tem assigned No. 1988-27.
91517 - Moved by Wright, seconded by Angel
that "Resolution setting date of hearing as February 15, 1988 at 7:00 p.m. in
the City Hall Council Chambers on an offer from Richard H. Morris to buy a
portion of City -owned land generally located north of Ivanhoe Road along the
east side of the Waterloo Water Works site", be adopted and Clerk/Auditor
instructed to publish notice of hearing accordingly. Ayes: Seven.

ORDINANCES
91518 - Moved by Wright, seconded by Budak
that "an Ordinance amending the Code of Ordinances of the City of Waterloo,
Iowa, by adding a new Article II, Municipal Infractions, to Chapter 1, General
Provisions", be received, placed on file, passed and considered for the first
time.
Prior to a vote, Hugh Field, City Attorney, explained the various sections of
the Ordinance that will be changed.
Ayes: Seven.

that rules requiring ordinances to be considered and voted for passage at two
prior meetings, be suspended, and that the following ordinance be recorded as
having been considered and passed for the second and third times and now
placed on its final adoption. Ayes: Seven.

91520 - Moved by Buck, seconded by Fox
that "an Ordinance amending the Code of Ordinances of the City of Waterloo,
Iowa, by adding a new Article II, Municipal Infractions, to Chapter 1, General
Provisions", be adopted. Ayes: Seven.

that "Resolution approving Schedule A918, pp. 1-61, in the amount of
$464,266.69 and Schedule W900, pp. 1-4, in the amount of $12,138.91, copies of
which are on file in the Clerk/Auditor's Office", be adopted. Ayes: Seven.

shown, be received, placed on file and approved:
1. Eric Thorson, City Engineer, and Al Weisert, Senior Inspector, to attend
24th Annual Iowa Concrete Paving Association Concrete Paving Workshop on
February 10-12, 1988 in Des Moines, Iowa, with costs not to exceed
$360.00, including use of City vehicle.
2. Jim Knavel, Street Foreman, and A. L. Brown, Equipment Operator I, to
attend Asphalt Paving Workshop on March 3 and 4, 1988 in Des Moines,
Iowa, with costs not to exceed $181.00, including the use of City
vehicle.
3. Councilperson Tony Budak to attend 1988 Congressional -City Conference on
March 18-23, 1988 in Washington, D.C., with costs not to exceed
$1,203.00.
