Mayor Bowers in the Chair. Roll call: Wright, Dawie, Seeber, Getty, Lichty, Penaluna, Klinger. Invocation by Lichty. 88312 - Moved by Wright, seconded by Seeber that the Agenda, as proposed for the Regular Session of November 4, 1985, at 7:00 p.m., be accepted and approved. Motion carried. 88313 - Moved by Seeber, seconded by Wright that the Minutes of the Regular Session held October 28, 1985, at 7:00 p.m., be approved. Motion carried. 88314 - Moved by Dowie, seconded by Lichty that proof of publication of notice of public hearing on the 1986 Budget of the Waterloo Water Works, as published in the Waterloo Courier on Ocotober 18, 1985, be received and placed on file. Motion carried. 88315 - HOLD HEARING --This being the time and place for public hearing the Mayor called for written and oral objections and there were none. Moved by Dowie, seconded by Lichty that "Resolution adopting 1986 Waterloo Water Works Budget", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1985-639. 88316 - Moved by Penaluna, seconded by Klinger that proof of publication of notice of public hearing on Hackett Road ByPass Bridges, Culverts and Incidentals, Project No. IX -6585(4)--79-07 as published in the Waterloo Courier on October 22, 1985, be received and placed on file. Motion carried. 88317 - HOLD HEARING --This being the time and place of public hearing the Mayor called for written and oral objections and there were none. Moved by Seeber, seconded by Wright that "Resolution authorizing Iowa Department of Transportation to proceed with the Hackett Road ByPass Bridges, Culverts and Incidentals, Project No. IX -6585(4)--79-07", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1985-640. Motion carried. 88319 - HOLD HEARING --'This being the time and place for public hearing the Mayor called for written and oral objections and there were none. Moved by Wright, seconded by Seeber that "Resolution authorizing Iowa Department of Transportation to proceed with Wagner Road Grading, Paving and Drainage Improvements, Project No. IX -6589(1)--79-07", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1985-641. ORAL PRESENTATIONS 88320 - Mr. Steve Brustkern, a former employee of Rath Packing Company, stated that the plan presented to the Waterloo City Council on October 11, 1985, in Special Session requesting 2.5 million dollars from the City for new meat processing plant has been dropped. Only 4 of the 10 requirements of the City (prior to the City's committment to the project) could be met. He thanked the City Council for their participation in this project. Ardith Shaw, 218 Elm Street, reported that patrons of the Loading Dock Inn, 1435 Sycamore Street have been parking on her terrace in front of her residence and are knocking down the posted No Parking Sign. The Police Department has been alerted to this situation, but will not ticket the vehicles. Police Chief Shook stated that he will check into the situation. Ms. Shaw also requested that a street light be installed in the area. Moved by Klinger, seconded by Wright that the above remarks be received, placed on file and referred to the Police Department and Traffic Operations for further review and recommendation. Motion carried. PETITIONS FROM PUBLIC 88321 - Moved by Dowie, seconded by Wright that request of Kasbohm Custom Drilling Intercity Interceptor, Stage V, Fifth together with recommendation of approval file and approved. Motion carried. for blasting permit for the and Sixth Crossings, Contact of City Engineer be received, F.Y. 1985 No. 282, placed on 88322 - Moved by Dowie, seconded by Wright that communication from City Engineer transmitting the request of Doris M. Gulsvig, 606 Maxwell Street for temporary concrete driveway together with recommendation of approval be received, placed on file and "Resolution approving said request", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1985-642. 88323 - Moved by Daaie, seconded by Wright that communication from City Engineer transmitting the request of William C. Kline, 2200 West Sixth Street for temporary concrete driveway together with recommendation of approval be received, placed on file and 'Resolution approving said request", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1985-643. REPORTS 88325 - Moved by Penaluna, seconded by Wright that the Minutes of the Board of Adjustment of September 24, 1985 be received and placed on file. Motion carried. 88326 - Moved by Penaluna, seconded by Wright that the Semi -Annual Affirmative Action Status Report for January 1, 1985 through June 30, 1985, and Quarterly Affirmative Action Status Report for July 1, 1985, through September 30, 1985, Report of the Affirmative Action Officer, be received and placed on file. Motion carried. 88327 - Moved by Dowie, seconded by Wright that the City Council reconsider action taken on October 28, 1985, (see CR88309) relating to the decision of the Civil Service Commission regarding Piper -Coffin hearing. Ayes: Six. Nays: Lichty. Motion carried. 88328 - Moved by Dowie, seconded by Klinger that the first item under CR88309 referenced above authorizing the City Attorney to file a motion for summary judgement on the above matter be received, placed on file and approved. Ayes: Five. Nays: Lichty. Abstain: Seeber. (possible conflict of interest) Motion carried. 88329 - Moved by Dowie, seconded by Penaluna that the second item under CR88309 referenced above authorizing the City Attorney to file a notice of appeal on Kariene Piper on the above matter be received, placed on file and approved. Ayes: Five. Nays: Lichty. Abstain: Seeber (possible conflict of interest) . Motion carried. 88330 - Moved by Dowie, seconded by Klinger that the fourth item under CR88309 referenced above accepting the ruling of the Civil Service Commission on the Barb Coffin ruling be received, placed on file and approved. November 4, 1985 Page Four DOCUMENTS 88331 - Moved by Klinger, seconded by Wright that communication from City Planner transmitting Agreement for Easement for Storm Sewer across Gates Park to Virden Creek in conjunction with Donald Street, Project No. IX -6662(1)--79-07 together with recommendation of approval from City Planner be received, placed on file and "Resolution approving said agreement", be adopted and Mayor and Clerk/Auditor instructed to execute same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1985-645. ORDINANCES TO BE ADOPTED 88332 - Moved by Seeber, seconded by Dowie that rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended, and that below ordinance be recorded as having been considered and passed for the second and third times and now placed on its final adoption. Ayes: Seven. Motion carried. 88333 - Moved by Seeber, seconded by Dowie that "an Ordinance vacating the easterly 17' of Allen Street between Pleasant Street and Williston Avenue", be received, filed, considered and passed for the third time. Ayes: Seven. Motion carried. 88334 - Moved by Klinger, seconded by Wright that "an Ordinance vacating the easterly 17' of Allen Street between Pleasant Street and Williston Avenue", be adopted. Ordinance adopted and upon approval by Mayor assigned No. 3412. 88335 - Moved by Wright, seconded by Seeber that "Resolution authorizing sale and conveyance of a portion of the above generally described portion of Allen Street to each of the following property owners: Edwin J. Buzzard, Richard D. and Carol M. Acker, Ronnie G. and Sharon Welper, Fred and Dorthea I. Kuhnle, Perpetual Savings & than Assn., Larry and Kathy J. Nicholson, Michael and Kathryn M.
