Mayor Bowers in the chair. Roll call: Wright, Davie, Seeber, Getty, Lichty, Penaluna, Klinger. Invocation by Seeber. 88139 - Moved by Wright, seconded by Dowie that the Agenda as amended for the Special Session of September 30, 1985, at 4:00 p.m., be accepted and approved. Motion carried. 88140 - Moved by Klinger, seconded by Lichty to receive and file the call. Motion carried. HEARING 88141 - Moved by Wright, seconded by Dowie that proof of publication of notice of public hearing on proposal to sell and convey real property generally located northeast of intersection of Airline Blvd., and West Airline Highway--Control-O-Fax, as published in the Waterloo Courier on September 24, 1985, be received and placed on file. Motion carried. 88142 - HOLD HEARING --This being the time and place of public hearing the Mayor called for written and oral objections and there were none. Moved by Seeber, seconded by Wright that "Resolution authorizing sale and conveyance", be adopted. Ayes: Six. Abstain: Getty (possible conflict of interest per Iowa Code 362.5). Resolution adopted and upon approval by Mayor assigned No. 1985-572. 88143 - Moved by Penaluna, seconded by Lichty that "Resolution authorizing rescinding private restriction on property generally located NE of the Intersection of Airline Highway and Airport Blvd., which prohibited the construction of any building within 100' of the westerly line of the property awned by Control -o -Fax Telemarketing Center", be adopted and Clerk instructed to record same. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1985-573. DOCUMENTS 88144 - Moved by Dowie, seconded by Getty that communication from Engineering Department transmitting Utility Agreement with Northwestern Bell Telephone Company for West Fourth Street, IX -6583(1)--79-07 together with recommendation of approval be received, placed on file and "Resolution approving said agreement", be adopted and Mayor and Clerk/Auditor authorized to execute same. Ayes: Seven.
