87810 - Moved by Dowie, seconded by Wright
that communication from City Engineer transmitting contract, bonds and
certificate of insurance from Youngblut Construction Company, Inc., for the F.Y.
1985 Highway 63 Pumping Station Storage Units, Contract No. 255, Intercity
Interceptor, Stage IV be received, placed on file and 'Resolution approving
said documents", be adopted and Mayor and Clerk/Auditor authorized to execute
same. Ayes: Six. Absent: Lichty.

87811 - Don Temeyer, Planning and Development Director, reported that following
negotiations with all property owners along Wagner Road, eleven property owners
have failed to accept the City's offer, therefore, he was requesting
authorization to proceed with condemnation proceedings. This will allow a
condemnation jury to determine the value of the taking and make a decision on
the compensation to the property owner. He indicated that the City will
negotiate with all property owners to reach a settlement prior to the
condemnation proceedings.
Jim Sage, 830 W. Big Rock Road, read a letter to the Council indicating his.
concerns about the proposed drainage in the No Name Creek Area. He reported that
the proposed project did not adequately address the problem of flooding in the
area. He stated that appropriate legal action would be taken if his farm and
crops are damaged as result of the Wagner Road Project.
Bill Claassen, Engineer with Claassen Engineering and Consultant Engineers for
said project stated, that adequate provisions have been made to accomodate
drainage in the area. The improvements that are being proposed will decrease the
flooding in the area over what currently exists.
Moved by Penaluna, seconded by Dowie
that "Resolution authorizing to proceed with condemnation of Parcel Nos.
2,3,5,8,9,12,13,21,22,23, and 36 for Wagner Road Project", be adopted. Ayes:
Six. Absent: Lichty.
Resolution adopted and upon approval by.Mayor assigned No. 1985-423.

that communication from City Engineer transmitting Agreement No. A 12901 with
Illinois Central Gulf Railroad Company for the widening and relocation of signals
on Wagner Road Project No. IX -6589(1)--79-07 be received, placed on file and
"Resolution approving said documents", be adopted and Mayor and Clerk/Auditor
authorized to execute same. Ayes: Six. Absent: Lichty.
