Mayor Bowers in the Chair. Roll call: Klinger, Lichty, Getty, Seeber. Absent: Penaluna, Dowie, Wright. Invocation by Seeber. 87656 - Moved by Klinger, seconded by Seeber that the Agenda, as amended for the Regular Session of July 1, 1985, at 7:00 p.m., be accepted and approved. Motion carried. 87657 - Moved by Seeber, seconded by Getty that the minutes of the Regular Session held June 24, 1985, at 7:00 p.m., be approved. Motion carried. HEARINGS AND BID 87658 - Moved by Klinger, seconded by Seeber that proof of publication of notice of public hearing and taking of bids on the F.Y. 1986 Paving Program, Contract No. 288, as published in the Waterloo Courier on June 14, 1985, be received and placed on file. Motion carried. 87659 - HOLD HEARING --This being the time and place for public hearing the Mayor called for written and oral objections and there were none. Moved by Getty, seconded by Seeber that "Resolution adopting plans, specifications, form of contract, and estimate of cost for the F.Y. 1986 Paving Program, Contract No. 288", be adopted. Ayes: Four. Absent: Dowie, Penaluna, Wright. Resolution adopted and upon approval by Mayor assigned No. 1985-335. 87660 - Moved by Seeber, seconded by Klinger to receive, file, instruct Clerk to open and read bids, and refer to City Engineer for recommendation: (see CR87676 for award of contract) Bidder Bid Bond Bid Amount Cedar Falls Construction 5% $419,596.10 Cedar Valley Corporation 5% $454,079.82 Youngblut Contracting, Inc. 5% $448,208.07 Motion carried. HEARING 87661 - Moved by Seeber, seconded by Lichty that proof of publication of notice of public hearing for Special Permit Request of Iowa Department of Safety to install a 500' Dispatch Tager at Hess Road and Relocated Highway 20 as published in the Waterloo Courier on June 14, 1985, be received and placed on file. Moved by Klinger, seconded by Lichty that recommendation of approval of Planning, Programming and Zoning Commission, be received and placed on file. Motion carried. 87663 -Moved by Getty, seconded by Seeber that "Resolution authorizing Special Permit Request of Iowa Department of Safety to install a 500' Dispatch Tower at Hess Road and Relocated Highway 20", be adopted. Ayes: Four. Absent: Dowie, Penaluna, Wright. Resolution adopted and upon approval by Mayor assigned No. 1985-336. ORAL PRESENTATIONS 87664 - Darlene Sherwood, 1224 Howrey Avenue, complained about the One Stop Convenience Store located at the intersection of Highway 218 and Cleveland Street. She stated that excessive noise at night has caused a disturbance to her and her neighbors. She said that there is shouting at all hours of the night, profanity is used, bottles are broken against the building and in the street, persons urinating, horns blasting and tires squealing. She asked that the car wash also located at this location be closed between 9:00 p.m. and 8:00 a.m. She also reported that her family and others had damage done to their cars when they are parked in the area. She presented a petition of area residents opposing the One Stop Convenience Center. Moved by Getty, seconded by Lichty that the above petition and remarks be received, placed on file and referred to the City Attorney and Police Department for review. Motion carried. Councilperson Getty thanked Sheldon Ripson, who is a reporter with KWWL TV, for his coverage of City events during the past 2-1/2 years. (Mr. Ripson is leaving this station to take a new position in the Davenport market). DOCUMEN'T'S 87665 - Moved by Klinger, seconded by Seeber that communication frau City Engineer transmitting improvements required as a condition precedent to final approval of the Crossroads Plat No. 2 have been completed in substantial conformance with construction plans, standards and requirements of Engineering Office; submitting four-year street and two-year sewer maintenance bonds, and recommending acceptance, be received, placed on file, approved and bonds accepted with effective date on bonds being that of final Council approval. Motion carried. 87666 -Moved by Klinger, seconded by Seeber that communication from City Engineer transmitting Change Order No. 1 for FY 1985 Street Reconstruction Program, Contract No. 283 for increase of $3,658.57 from Cedar Valley Corporation, together with recommendation of approval be received, placed on file and approved and Mayor and Clerk/Auditor instructed to execute same. Davis, M.A.I. of Sandage Company for review appraisor for Interstate Substitution Project on San Marnan Drive, Project No. IX 6498-(1)--79-07 not to exceed $1,100 together with recommendation of approval be received, placed on file and "Resolution approving said contract", be adopted and Mayor and Clerk/Auditor instructed to execute same. Ayes: Four. Absent: Bowie, Penaluna, Wright. Resolution adopted and upon approval by Mayor assigned No. 1985-337. RESOLUTIONS TO BE ADOPTED 87668 - Moved by Klinger, seconded by Seeber that "Resolution accepting and approving a temporary easement frau Richard and Constance Miller, 2450 Maynard Avenue in conjunction with Hackett Road ByPass (Parcel No. Al)", be adopted. Ayes: Four. Absent: bowie, Penaluna, Wright. Resolution adopted and upon approval by Mayor assigned No. 1985-338. 87669 -Moved by Klinger, seconded by Seeber that "Resolution setting date of hearing on sale of property to Thompson's Used Cars, Inc., and L.C. Strohm and Alice Strohm -Blowers Creek as July 15, 1985 at 7:00 p.m. in the City Hall Council Chambers", be adopted and Clerk/Auditor instructed to publish notice of same. Ayes: bowie, Penaluna, Wright. Resolution adopted and upon approval by Mayor assigned No. 1985-339. ORDINANCES TO BE ADOPTED 87670 - Moved by Seeber, seconded by Getty that "an Ordinance establishing grades for F.Y. 1986 Paving Program, Contract No. 288", be received, filed, considered and passed for the first time. Ayes: Four. Absent: bowie, Penaluna, Wright. Motion carried. 87671 - Moved by Getty, seconded by Lichty that "an Ordinance vacating an alley located between Roosevelt and Ann Streets and east of Gilbert Street", be received, filed, considered and passed for the second time. NEW BUSINESS 87672 -Moved by Seeber, seconded by Klinger that communication from Community Development Administrator transmitting the resignation of Christopher Dunn and entitlement to vacation and sick pay in the amount of $3,249.29 be received, placed on file, approved, and "Resolution approving said payment", be adopted.
