Mayor Rooff in the Chair. On roll call, Present: Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm. Invocation by Councilman Getty. 69029 - Moved by Roehr, seconded by Wilharm that the Agenda, as amended, for the Regular Session of November 17, 1975 at 7:00 P.M., be accepted and approved. Motion carried. 69030 - Moved by Wilharm, seconded by Roehr that the Minutes of the Regular Session held November 10, 1975 at 7:00 P.M., be approved. Motion carried. 69031 - Moved by Getty, seconded by Keller that proof of publication of Notice of Public Hearing on proposal to sell Disposal Parcel No. I-37, Westfield -Virden Urban Renewal Area, Project No. Iowa R-7, 228 Lafayette Street, published in Waterloo Daily Courier on October 16, 1975, to Harold B. Delapp, be received and placed on file. Motion carried. 69032 - Moved by Getty, seconded by Geiger that report of Conu mity Development Administrator on selling of Disposal Parcel I-37, 228 Lafayette Street, to Harold B. DeLapp, be received and placed an file. Motion carried. 69033 - The selling of Community Development properties at public auction was discussed. It was pointed out that federal money was used to acquire the properties, HUD restric- tions would have to be complied with in the sale, Community Development plan superceded the City plan, and the land would have to be used for the purpose for which it was bought. The Mayor announced the time had arrived to bear objections, and called for oral and written objections. No objections were made or filed. Moved by Getty, seconded by None that action on a "Resolution approving the sale of Disposal Parcel No. I-37 in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7 and authorizing the execution of the necessary contract and deed" be deferred to January 19, 1976 at 7:00 P.M. in the Council Chambers in the City Hall, at which time and place the said Resolution shall be presented to the Council for consideration. Motion failed for lack of a second. 69034 -Moved by Roehr, seconded by Wilharm that action on the above Resolution be deferred to December 22, 1975 at 7:OO P.M. in the Council Chambers in the City Hall, at which time and place the said Resolution shall be presented to the Council for consideration. Councilman. Wilharm withdrew his second and Councilman Roehr withdrew his motion. 69035 - Moved by Keller, seconded by Berdell that "Resolution approving the sale of Disposal Parcel No. I-37 in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7 and authorizing the execution of the necessary contract and deed", be adopted. Ayes: Berdell, Geiger, Getty, Keller Roehr, and Wilharm. Nays: Lichty. Resolution adopted and upon approval by Mayor, assigned No. 24320 in official resolution book. 69036 = Moved by Roehr, seconded by Keller that proof of publication of Notice of Public Hearing on proposal to sell Disposal Parcel No. J-12, Westfield -Virden Urban Renewal Area, Project No. Iowa R-7, 302 Columbia Street, published in Waterloo Daily Courier on October 16, 1975, to Willie Outlaw, be received and placed on file. Motion carried. 69037 - Moved by Getty, seconded by Roehr that report of Commmity Development Administrator clarifying address of Willie Outlaw in connection with the proposed sale of Disposal Parcel No. J-12, on corner of Columbia Street and Crescent Place, be received and placed on file. Motion carried. 69038 - The Mayor announced the time had arrived to hear objections, and called for oral and written objections. No objections were made or filed. Moved by Roehr, seconded by Keller that "Resolution approving the sale of Disposal Parcel No. J-12 in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7 and authorizing the execution of the necessary contract and deed", be adopted. Ayes: Berdell, Geiger, Getty, Keller, Roehr, and Wilharm. Nays: Lichty. Resolution adopted and upon approval by Mayor, assigned No. 24321 in official resolution book. 69039 - Moved by Getty, seconded by Geiger that proof of publication of Notice of Public Hearing on proposal to sell Disposal Parcel No. C-20, Westfield -Virden Urban Renewal Area, Project No. Iowa R-7, 200 Lindale Avenue, published in Waterloo Daily Courier on October 16, 1975, to Donald S. Clark and Marie H. Clark, be received and placed on file. Motion carried. -2- 69040 - The Mayor announced the time had arrived to hear objections, and called for oral and written objections. No objections were made or filed. Moved by Roehr, seconded by Getty that "Resolution approving the sale of Disposal Parcel No. C-20 in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7 and authorizing the execution of the necessary contract and deed", be adopted. Ayes: Berdell, Geiger, Getty, Keller, Roehr and Wilharm. Nay: Lichty, Resolution adopted and upon approval by Mayor, assigned No. 24322 in official resolution book. 69041 - Ben Linnenkamp, 635 Wyoming Street, presented a petition with 400 signatures for installation of traffic control lights at the intersection of Ridgeway Avenue and Deere Road, at least between the hours of 3 to 5 P.M., Monday through Friday. Mayor Rooff reported a dollar package was being put together for Council consederation. Moved by Roehr, seconded by Wilharm that the above petition be received and placed on file. Motion carried. 69042 - Jim Porter reported a tree blown down on the Brown Hentz home at 215 Sumner Street last year has not been cleared off the property. Mayor Rooff stated this had been turned over to the Forestry Department and would be checked. 69043 - Moved by Roehr, seconded by Wilharm that communication from Property Administrator stating a request has been received to purchase old #2 Fire Station at 716 Commercial Street, be received, placed on file and "Resolution fixing the time and place of hearing and receiving of bids as December 8, 1975 at 7:00 P.M. in the Council Chambers of City Hall on the proposal to sell and convey old #2 Fire Station at 716 Commercial Street to the highest bidder", adopted and Clerk instructed to publish notice of hearing. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24323 in official resolution book. 69044 - Moved by Roehr, seconded by Lichty that communication from Property Administrator, reporting receipt of an "Offer to Buy" from Hawkeye Steel Products, Inc. for certain real property in Block 29, "Westfield' for the sum of $100.00, be received, placed on file and "Resolution fixing the time and place of hearing as December 8, 1975 on proposal to sell and convey that part of Lots 12,13, 14, 15, 16 and 17 lying North- westerly of the dike and except that part of Lot No. 17 occupied by relocated West- field Avenue, in Block No. 29 in "Westfield" to Hawkeye Steel Products, Inc.", adopted and Clerk instructed to publish notice of hearing. Ayes: Seven. Resolution adopted and upon approval by Mayor, assigned No. 24324 in official resolution book. 69045 - Moved by Lichty, seconded by Wilharm that the Financial Report of the Board of Water- loo Water Works Trustees, for the Quarter ending September 30, 1975, be received and placed on file. Motion carried. 69046 - Moved by Wilharm, seconded by Roehr that co_n=ication from Comrnmity Development Administrator, transmitting a Temporary Easement Agreement between Martin Marietta Aggregates and the City of Waterloo for borrow purposes for Stage 5-A Flood Control Project, and recommending approval, together with City Engineer's concurrence, be received, placed on file, approved and accepted, and the Mayor and City Clerk author- ized and directed to execute same in behalf of the City of Waterloo, Motion carried. 69047 - Moved by Roehr, seconded by Getty that the minutes of the Com unity Development Board for their regular meeting held October 7, 1975, be received, placed on file and approved. Motion carried. 69048 - Moved by Wilharm, seconded by Roehr that City Treasurer Financial Report for October, 1975, showing Balance on Hand 10,1/75 $14,093;334.11, Receipts $3,866,476.74, Dis- bursements $4,100,563.90, Balance on Hand 10/31/75 $13,859,246.95, be received and placed on file. Motion carried. 69049 - Mayor Rooff recommended that action be deferred on the "Ordinance amending Section 550 Taxicab Zones of Ordinance No. 2644, as amended, known as the Traffic Ordinance, by adding Sub -Section 8" for further study of location. Moved by Wilharm, seconded by Lichty that action on the above ordinance be deferred until November 24, 1975. Motion carried. 69050 - Moved by Keller, seconded by Getty that "An Ordinance amending Ordinance No. 2479, as amended, by adding Sub --Section No. 82 to Section 2A-5, rezoning certain property", be considered and passed for the second time (t? -.e first having passed under C.R. 08994 of 11/10/75). Ayes: Berdell, Geiger, Getty, Keller, Roehr and Wilharm. Ab stained: Lichty. Motion carried. 69051 - Mayor Rooff reported a representative of the Iowa Natural Resources Council would be in Waterloo next Monday and Don Pullin asked for a meeting with the affected property owners. November 17, 1975 ^N 69051 - (Continued) -3- Moved by Getty, seconded by Geiger that "An Ordinance amending Ordinance No. 2479, as amended, by adding Sub -Section No. 81 to Section 2A-5, rezoning certain property", be considered and passed for the second time (the first having passed under C.R. #68991 of 11/10/75). Ayes: Berdell, Geiger, Getty, Keller and Wilharm. Nay: Roehr. Abstained: Lichty. Motion carried. 69052 - Mayor Rooff reported a rough figure of about $200,000 to bring Hyperion Drive over the dike, which would include the purchase of four houses at the intersection of Hyperion Drive and Candlewick Road. The question was raised as to the 8' height instead of 3' and it was explained this was the 100 year plan formulated by the Corps of Engineers. Joyce Henry presented a petition "to stop the closing of Hyper- ion and Wagner Road to Highway 20", together with a list of eleven reasons. Moved by Getty, seconded by Wilharm that the above petition and list of reasons be received and placed on file. Motion carried. 69053 - Marlene Kruger, Ken Carson, Albert Spilman and other Greenbrier area residents strenuously opposed the closing of Wagner Road and Hyperion Drive. Mayor Rooff said the Corps of Engineers would be asked to meet with the residents. It was pointed out that answers were needed to whether another access would be provided and if the City would make a commitment. Moved by Roehr, seconded Wilharm that "An Ordinance vacating a section of Wagner Road beginning at intersection of West Donald Street and Wagner Road and proceeding north 2,000 lineal feet for flood control purposes", be considered and passed for the second time (the first having passed under CR #68985 of 11/10/75), with a meeting to be set up with the Corps of Engineers. Ayes: Geiger, Keller, Lichty, Roehr, and Wilharm. Nays: Berdell and Getty. Motion carried. 69054 - Moved by Getty, seconded by Berdell that "An Ordinance vacating All the Alley located between the East line of Oregan Street and the West line of Minnesota Street, between Locke Avenue and Howard Avenue, Pleasant View Addition", be con- sidered and the rules requiring ordinances to be considered and voted on for passage at two prior meetings, suspended, said Ordinance recorded as having been considered and passed for the second and third times (the first having passed under C.R. #68981 of 11/10/75), and now placed an its final adoption. Ayes: Seven. Motion carried. 69055 - Moved by Wilharm, seconded by Lichty that "Ordinance vacating All the Alley located between the East line of Oregon Street and the West line of Minnesota Street, between Locke Avenue and Howard Avenue, Pleasant View Addition", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor, assigned No. 2776 in the official ordinance book. 69056 - Moved by Getty, seconded by Roehr that the Ztain City Fire Insurance Company Auto- mobile Liability Insurance Policy No. 91 NGB 322338 for the period of 11/10/75 to 11/10/76 to Waterloo Yellow Cab Co. Inc., 711 Commercial Street, which replaces Policy No. 91 NGB 322309, be received, placed on file and approved. Motion carried. 69057 - Moved by Roehr, seconded by Getty that communication frim Waterloo Water Works General Manager, transmitting proposed Calendar 1976 Budget for the twelve months of January 1, 1976 through December 31, 1976, be received, placed on file, and the Council having duly considered said Budget and being fully advised, finds that hearing date should be fixed and does hereby set December 8, 1975 at 7:00 P.M. in the Council Chambers, City Hall in said City, as the date, time and place for said hearing, and the City Clerk is hereby instructed to publish the Estimate and Notice of Hearing, which is worded and figures as follows: (See attached page # 4) Ayes: Seven.
