Mayor Pro Tem Wilharm in the Chair On roll call, Present: Berdell, Geiger, Getty, Lichty, Roehr and Wilharm. Ab- sent: Keller. Invocation by Councilman Geiger. 68951 - Moved by Roehr, seconded by Getty that the Agenda, as proposed, for the Regular Session of November 3, 1975 at 7:00 P.M., be accepted and ap- proved. Motion carried. 68952 - Moved by Geiger, seconded by Getty that the Minutes of the Regular Ses- sion held October 27, 1975 at 7:00 P.M., be approved. Motion carried. 68953 - Moved by Roehr, seconded by Berdell that proof of publication of Notice of Public Hearing on plans and specifications for the construction of Fourth Street Bridge Walkway Canopy, Minor Contract No. 91, and the tak- ing of bids, Contract No. 91, be received and placed on file. Motion carried. 68954 - The Mayor Pro Tem announced the time had arrived to hear objections and called for oral and written objections. No objections were made or filed. Moved by Geiger, seconded by Getty that "Resolution confirming approval of plans, specifications, form of contract, estimated cost, etc. for Fourth Street Bridge Walkway Canopy, Minor Contract No. 91", be adopted. Ayes: Six. Absent: Keller. Resolution adopted and upon approval by Mayor Pro Tem, assigned No. 24295 in official resolution book. 68955 - Moved by Getty, seconded by Roehr that "Resolution ordering the construc- tion of Fourth Street Bridge Walkway Canopy, Minor Contract No. 91", be Adopted. Ayes: Six. Absent: Keller. Resolution adopted and upon approval by Mayor Pro Tem, assigned No. 24296 in official resolution book. 68956 - Moved by Roehr, seconded by Lichty that following bids be received, placed on file, Clerk instructed to open same and referred to the Engineers for checking and report back: Jens Olesen & Sons Construction Co. Waterloo, Iowa, $513,400.00; John G. Miller Construction Co. Waterloo, Iowa, $499.250.00. Motion carried. 68957 - City Engineerreported the above bids were over the estimated cost and recommended the Engineers be allowed to further study same. Moved by Roehr, seconded by Lichty that above recommendation be received, placed on file, and -action deferred until November 10, 1975 for Engineers' fur- ther review and report back. Motion carried. 68958 - City Engineer Radue recommended that his request for establishment of the requirement and location of a frontage road between Penney's Drive and Sears Drive north of Iowa Highway #412 be referred to the Plan and Program Commission for review, as construction of this frontage road would allow proper access as future development occurs in the area but no provision was made in the Highway Commission sale of this property for future access road right-of-way. Moved by Roehr, seconded by Lichty that the above request and recommendation of the City Engineer, be re- ceived, placed on file, recommendation approved and referred to the Plan and Program Commission. Motion carried. 68959 - Moved by Roehr, seconded by Lichty that request from George Lindeman, Atty. for Dale Murphy and Paul Kurtz, for permission to construct a 35' commercial curb cut to serve land NE of Penney's Drive and Iowa Highway #412, and City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, and action deferred pending Plan and Program Commission's review of a frontage road for said area. Motion carried. 68960 - Moved by Geiger, seconded by Getty that request from Gilbert R. Kent for permission to construct a temporary concrete driveway at 1642 Locke Ave- nue, without regard to sidewalk grade, together with $3.00 for recording waiver, and City Engineer's recommendation for approval subject to the provisions of his letter, be received, placed on file, approved and "Res- olution granting permission tc Silbert R. Kent and authorizing construc- tion of a temporary concrete driveway at 1642 Locke Avenue irrespective of a later official grade", adopted. Ayes: Six. Absent: Keller. Moser & Associates, Waterloo, Iowa, for Orange Township Sanitary Sewer Improvement Project, Contract No. 181", adopted. Ayes: Six. Ab- sent: Keller. Resolution adopted and upon approval by Mayor Pro Tem, assigned No. 24298 in official resolution book. 68963 - Moved by Roehr, seconded by Getty that Contract and Bond with Irving F. Jensen Co., Inc. in amount of $436,489.72, for Contract No. 154, be re- ceived, placed on file and "Resolution approving the Contract and Bond of Irving F. Jensen Co., Inc., Sioux City, Iowa, for the Chautauqua Park Area, Stage II, Westfield -Virden Urban Renewal Project R-7, Contract No. 154", adopted. Ayes: Six. Absent: Keller. Resolution adopted and upon approval by Mayor Pro Tem, assigned No. 24299 in official resolution book. 68964 - Moved by Lichty, seconded by Getty that an Agreement for Easement dated 11/3/75 between Orville L. and Reba Tannreuther and the City of Waterloo for Orange Township Sanitary Sewer and Outfall, Contracts #177 and #188, and recommendation of Property Administrator, be received, placed on file, recommendations approved and Mayor and Clerk authorized and direct- ed to sign said Agreement in behalf of the City. Motion carried. 68965 - Moved by Getty, seconded by Geiger that the following Permanent and Tem- porary Easements in connection with Orange Township Sanitary Sewer and Out -fall, Contracts #177 and #188, be received, placed on file and Clerk instructed to record Permanent Easements: Permanent Easements: Robert Tannreuther; Orville Tannreuther; Orville Tannreuther; Otto Jessen and Marion J. Jessen; Faye Martin Anderson; Everett Snavely; Paul Snavely and Edna Snavely. Temporary Easements: Orville Tannreuther; Orville Tann- reuther; Faye Martin Anderson. Motion carried. 68966 - Moved by Roehr, seconded by Geiger that construction plans for sanitary sewer facilities serving Tract A, C and D, H. Ray Hughes Addition, toget- her with Treatment Agreement Form C with the Department of Environmental Quality, and City Engineer's recommendation for approval with final ac- ceptance of plans subject to review by said Department, be received, placed on file, recommendations approved and Mayor and Clerk authorized to execute said Agreement Form in behalf of the City. Motion carried. 68967 - City Engineer Radue presented a Warranty Deed from Black Hawk Development Corp. and it was pointed out that all items to be brought to the Council must be in the Mayor's office not later than 4:00 P.M. Thursday to be placed on the upcoming agenda. Moved by Getty, seconded by Berdell that Warranty Deed dated 10/23/75 from Black Hawk Development Corp., be re- ceived, placed on file and "Resolution approving and accepting a Warranty Deed from Black Hawk Development Corp. Conveying unto the City of Water- loo Tract B in H. Ray Hughes Addition and directing the recording of same", adopted. Ayes: Six. Absent: Keller. Resolution adopted and upon approval by Mayor Pro Tem, assigned No. 24300 in official resolution book. 68968 - Moved by Roehr, seconded by Getty that Change Order No. 2 for River Road, Stage II, Contract #150, for additional work performed by Irving F. Jen- sen Co., Inc., for an increase of $12,339.00, payable from Urban Renewal Funds, be received, placed on file, approved and Mayor authorized to execute same. Ayes: Six. Absent: Keller. Motion carried. 68969 - Moved by Roehr, seconded by Lichty that recommendation of Sign & Traffic Maintenance Department that speed limit on West Ridgeway Avenue from the west city limits to Deere Road be reduced from 45 MPH to 35 MPH, be re- ceived, placed on file, referred back to the Sign and Traffic Maintenance Department, and action deferred pending a report on clarification of streets and installation of traffic control lights at Deere Road and Highway #63. Motion carried. -3- 68970 - Moved by Getty, seconded by Roehr that report of Sign & Traffic Mainten- ance Department on request from Mayor's Safety Committee that speed limit on Ansborough Avenue near Westridge School be reduced from 35 MPH to 25 MPH, and recommendation that speed limit be reduced to 25 MPH from Olym- pic Drive to Meadow Lane, be received, placed on file and referred back to the Sign & Traffic Maintenance Department for clarification with a report back on November 10, 1975. Motion carried. 68971 - Moved by Roehr, seconded by Getty that recommendation from Sign & Traffic Maintenance Department that no truck traffic be allowed on East Fourth Street from Franklin Street to Cedar Street, be received, placed on file, approved and the City Attorney instructed to submit a resolution accord- ingly. Motion carried. 68972 - Moved by Roehr, seconded by Lichty that communication from Mayor Rooff submitting recommendations from Black Hawk County -Waterloo Governmental Data Processing Policy Committee that the data processing function be- come an entity of Black Hawk County with services provided to the City of Waterloo on a contract basis, effective January 1, 1976, and concur- ring with same, be received, placed on file, approved and the City Attor- ney instruct to proceed in accordance therewith. Motion carried. 68973 - Moved by Getty, seconded by Lichty that the following request for permis- sion to attend a function, with expenses allowed not to exceed amount shown, be received, placed on file and approved: Property Administrator to Housing Conference of Iowa Chapter of the National Association of Housing & Redevelopment Officials, Ames, Iowa, November 13 and 14, 1975, $78.50. Ayes: Six. Absent: Keller. Motion carried. 68974 - Moved by Geiger, seconded by Berdell that the application of Ronald S. Smith, 508 Belle Avenue, for taxicab driver's permit, be received, placed on file and granted.
