Mayor Rooff in the Chair. On roll call, Present: Geiger, Getty, Roehr and Wilharm. Ab- sent: Berdell and Lichty. Invocation offered by Councilman Getty. 68745 Moved by Roehr, seconded by Wilharm that the Agenda, as pro- posed, for the Regular Session of October 6, 1975 at 7:00 P.M., be accepted and approved. Motion carried. 68746 - Moved by Wilharm, seconded by Roehr that the Minutes of the Regular Session held September 22, 1975 at 7:00 P.M., be approved. Motion carried. 68747 - Moved by Roehr, seconded by Wilharm that proof of publication of No- tice of Public Hearing on Re -zoning, upon the request of Dr. Paul Strayer, upon recommendation of Zoning Commission and Council's own mo- tion, to rezone from "R-1" One and Two Family Residence District to "C-1" Commercial District, a parcel of land located in SW14 of Section 1 -89N -13W on East side of Logan Avenue (U.S. Hwy. #63) about 1,200' North of East Airline Hiway, as published in the Waterloo Daily Cour- ier on September 25, 1975, be received and placed on file. Motion carried. 68755 - Moved by Roehr, seconded by Wilharm that proof of publication of No- tice of Public Hearing on proposal to sell Disposal Parcel No. J-22, Westfield -Virden Urban Renewal Area, Project No. Iowa R-7, 128 and 130 St. Albans Street, published in Waterloo Daily Courier on August 28, 1975, to Richard Paul Anderson, be received and placed on file. Mo- tion carried. 68756 - The Mayor announced the time had arrived to hear objections, and called for oral and written objections. No objections were made or filed. Moved by Wilharm, seconded by Roehr that "Resolution approving the sale of Disposal Parcel No. J-22 in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7 and authorizing the execution of the nece- ssary contract and deed", be adopted. Ayes: Geiger, Getty, Keller, Roehr and Wilharm. Nays: None. Absent: Berdell and Lichty. Reso- lution adopted and upon its approval by the Mayor, it was assigned a number and appears as Resolution 24216 in the official resolution book. 68757 - Gene Yagla, Atty. in behalf of the residents of West High and Carriage hill Apartments area, presented a petition requesting the Council to rescind its action of 9/22/75, which approved the site development plan for Quik -Trip located East of Edgemont Avenue between Cataract Avenue and East Ridgeway Avenue, and that Quik -Trip not be allowed to sell gasoline on these premises. He stated they objected to the nui- sances of increased noise, bright lights and cars coming and going un- til 2:00 A.M. Moved by Roehr, seconded by Wilharm that the above pe- tition be received and placed on file. Motion carried. 68758 - A discussion followed on the area being zoned "C-1" Commercial Dis- trict, regulation of business hours, and possibility of rezoning to a residential district. Mayor Rooff reported he had visited with the area residents, their opposition was to the hours of the filling sta- tion and noise, and he would visit with the City Attorney to see what could be done. 68759 Forrest Bentley, 549 East Airline Hiway, asked for a specific date to be set for cleaning of a culvert on said street and Mayor Rooff re- plied he would get with the City Engineer in the morning to try to find equipment to get this job done. 68760 Moved by Wilharm, seconded by Geiger that request from Wm. F. Mclntee & Sons, Inc. for permission to construct a 16' commercial curb cut at 3217 Darlene Court, as shown on attached plat, and City Engineer's recommendations for approval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith at no cost to the City. Motion carried. 68761 - Moved by Roehr, seconded by Wilharm that request from Peoples Bank and Trust Company in behalf of McGuire property located at 1221 West Fifth Street, for permission to asphalt the parking area and to con- struct a 22' commercial curb cut on Johnson Street, as shown on at- tached plat, and City Engineer's recommendations for approval subject to the provisions of his letter, be received, placed on file, rec- ommendations approved and permission granted in accordance therewith at no cost to the City Motion carried. 68762 - Moved by Getty, seconded by Geiger that request from Wm. F. Mclntee & Sons, Inc. for permission to construct three 16' commercial curbs, one each at 1621, 1637 and 1653 Carriage Hill, as shown on attached plat, and City Engineer's recommendations for approval subject to the provisions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith at no cost to the City. October 6, 1975 -3- 68763 - Moved by Roehr, seconded by Wilharm that request of Black Hawk County Board of Supervisors for cancellation of weed assessments in the a- mounts of $21.90 against the E 85' of Lot 31, Maywood Third Addition, and $17.15 against Lot 36, Auditor Barnes Plat of Maywood sold at public auctions held 10/21/75 and 3/24/75, respectively, be received, placed on file and said weed assessments cancelled. West Ninth Street from Ridgeway Avenue to Byron Avenue Motion carried. 68765 Jack Springer of Northeast Council on Alcoholism gave a progress re- port on the activities of the Council, stating for a number of years the City has funded the Council but no program has been implemented for the City. He briefly described the procedures. Moved by Getty, seconded by Geiger that request from Northeast Council of Alcoholism to present a proposal for a Troubled Employees Assistance Program to all city employees, be received, placed on file and request approved. Motion carried. 68766 - Moved by Roehr, seconded by Wilharm that request from Lutheran Church of the Good Shepherd for permission to construct a temporary asphalt driveway at 517 East Donald Street, without regard to sidewalk grade, together with $3.00 for recording waiver, and City Engineer's recomm- endation for approval subject to the provisions of his letter, be re- ceived, placed on file, approved and "Resolution granting permission to Lutheran Church of the Good Shepherd and authorizing construction of a temporary asphalt driveway at 517 East Donald Street irrespective of a later official grade", adopted. Ayes: Geiger, Getty, Keller, Roehr and Wilharm. Nays: None. Absent: Berdell and Lichty. Resolution adopted and upon approval by the Mayor, it was assigned a number and appears as Resolution 24217 in the official resolution book. 68767 Under Council Action #68693 of 9/15/75 action was tabled until 10/6/75 on the request from the Property Administrator for permission to pro- ceed with the sale of 39.5 acres of land known as W2 NW4 NE 4 and Ek NE 4 NWS of Section 29-89-13, owned by the City of Waterloo, and was now presented for consideration. Moved by Roehr, seconded by Wilharm that the communication from the Property Administrator, clarifying the above request for permission to negotiate and advertise for the sale of said 39.5 acres of land, be received, placed on file and permission granted, with the sale to be submitted to the Council to fix a time and place for hearing. Motion carried. 68768 - Under Council Action #68703 of 9/22/75, action was deferred on the proposal to sell Disposal Parcel No. J-12, Westifeld-Virden Urban Re- newal Area, Project Iowa R-7, 302 Columbia Street, and was presented for consideration. Moved by Wilharm, seconded by Roehr that the com- munication from the Community Development Administrator requesting no further action be taken on the above proposal, be received, placed on file and approved. Motion carried. 68769 - Moved by Roehr. seconded by Getty that communication from Property Ad- ministrator, transmitting an "Offer to Buy" Contract dated 10/6/75 between the City of Waterloo, Iowa and Raymond L. and Wilma G. Miller wherein the City offers to purchase a Part of Lot 63, Meadowdale Sec- ond Filing for the sum of $4,300 for Wren Road Storm Sewer purposes, together with City Attorney's opinion, and recommending approval, be received, placed on file, approved and accepted, and Mayor and City Clerk authorized and directed to execute same in behalf of the City of Waterloo and Finance Director instructed to issue a warrant for said amount in payment therefor. Motion carried. 68771 - Moved by Getty, seconded by Wilharm that Change Order No. 1 for West Park Avenue Area Paving, Sewers and Incidentals, Contract No. 147, for additional work performed by Cedar Valley Corporation for an in- creased cost of $11,600, be received, placed on file, approved and Mayor and Clerk authorized to execute same. Ayes: Geiger, Getty, Keller, Roehr and Wilharm. Nays: None. Absent: Berdell and Lichty. Motion carried. 68772 - Moved by Keller, seconded by Roehr that communication from Community Development Administrator, transmitting Supplemental Agreement No. 1 to the Contract for engineering services for Highway No. 63 Intercep- tor Sewer and Pumping Station and updating areawide comprehensive sanitary sewer study for the Metropolitan Area of Black Hawk County, Iowa, be received, placed on file and "A resolution approving Supple- mental Agreement No. 1 to the Contract for engineering services for Highway No. 63 Interceptor Sewer and Pumping Station and updating areawide comprehensive sanitary sewer study for the Metropolitan Area of Black Hawk County, Iowa", adopted. Motion carried. 68775 - Moved by Wilharm, seconded by Roehr that communication from City Engineer, transmitting an Application for Sidewalk Paving and Waiver from Alstores Realty Corporation dated 9/22/75 for 201-209 East Fourth Street, and recommending approval with work and assessment to be done in conjunction with the Downtown Fourth Street Improvements program, Contract No. 152, be received, placed on file, recommendations approved and "Resolution accepting and approving an Application for "Sidewalk Paving and Waiver of All Legal Proceedings Relative Thereto" dated 9/22/75 from Alstores Realty Corporation", adopted. Moved by Wil - harm, seconded by Geiger that communication from Supt. of Motor Vehi- cle Parking Facilities reporting that Frank B. Trask has retired from said Department, effective September 30, 1975, and is entitled to 60 days of sick leave, for a total sum of $2,078.40, be received, placed on file and "Resolution approving payment of $2,078.40 for 60 working days of sick leave to Frank B. Trask, who retired from the Motor Ve- hicle Parking Facilities Department as of September 30, 1975, and au- thorizing the Finance Director to draw a warrant in payment therefor", adopted.
