September 22, 1975
The Council of City of Waterloo, Iowa, met in Regular Session in Council Cham-
bers in City Hall at 7:00 P.M. on September 22, 1975. Mayor Rooff in the
Chair. On roll call, Present: Berdell, Geiger, Getty, Keller, Lichty, Roehr
and Wilharm. Absent: None. Invocation offered by Councilman Getty.
68698 - Moved by Wilharm, seconded by Roehr that the Agenda, as amended, for
the Regular Session of September 22, 1975 at 7:00 P.M., be accepted
and approved. Motion carried.
68699 - Moved by Geiger, seconded by Getty that the Minutes of the Regular
Session held September 15, 1975 at 7:00 P.M., be approved. Motion
carried.
68700 - Moved by Roehr, seconded by Wilharm that proof of publication of Notice
of Proposal to Dispose of Real Estate known as portion of alley abutt-
ing Lots 10, 11, 12 and 13, 14, 15, Block 22, Auditor Rainbow's Plat
of Maywood Second Filing, 105 Bishop Avenue, as published in the Wat-
erloo Daily Courier on September 11, 1975, to Lillian Skalsky, for the
sum of $50.00 plus costs, be received and placed on file. Motion car-
ried.

for oral and written objections. No objections were made or filed.

thorizing sale and conveyance of that portion of alley abutting Lots 10
11, 12 and 13, 14, 15, Block 22, Auditor Rainbow's Plat of Maywood Sec-
ond Filing, 105 Bishop Avenue, as published in the Courier on 9/11/75,
to Lillian Skalsky for $50.00 plus costs, and directing and authorizing
the Mayor and City Clerk to execute and deliver a deed for said prop-
erty", be adopted. Ayes: Berdell, Geiger, Getty, Keller, Lichty,
Roehr and Wilharm. Nays: None. Resolution adopted and upon approval

Williams, be received and placed on file. Motion carried.
68703 - The Mayor announced the time had arrived to hear objections, and
called for oral and written objections. No objections were made or
filed. Mayor declared the hearing closed. Moved by Wilharm, seconded
by Roehr that action on the proposal to sell Disposal Parcel No. J-12,
Westfield -Virden Urban Renewal Area, Project Iowa R-7, 302 Columbia
Street, be deferred to October 6, 1975 at 7:00 P.M. in the Council
Chambers in City Hall. Motion carried.

ban Renewal Area, Project No, Iowa R-7 and authorizing the execution
of the necessary contract for sale of land for private redevelopment
and deed", be adopted. Ayes: Berdell, Geiger, Getty, Keller, Lichty,
Roehr and Wilharm. Nays: None, Resolution adopted and upon approval

for Granger and Associates, Inc. for the Council on its own motion to
rezone Lots 48, 51, 52 and 53 in Brookeridge First Addition, located
on both sides of Brookeridge Drive and East of Kimball Avenue, from
"R-3" Multiple Residence District to "R-4" Multiple Residence District,
as shown on attached plat, and City Zoning Commission recommendation
for approval, be received, placed on file, recommendations approved,
date of hearing set as October 6, 1975 at 7:00 P.M. and Clerk instructed

68710 - Moved by Roehr, seconded by Wilharm that request from Dr. Paul Strayer
for the Council on its own motion to rezone a parcel of land located
in SW4 of Section 1 -89N -13W on East side of Logan Avenue (U.S.Hwy. #63)
about 1,200' North of East Airline Hiway, from "R-1" One and Two Family
Residence District to "C-1" Commercial District, as shown on attached
plat, and City Zoning Commission recommendation for approval, be re-
ceived, placed on file, recommendations approved, date of hearing set
as October 6, 1975 at 7:00 P.M. and Clerk instructed to publish notice.

68711 - Moved by Wilharm, seconded by Getty that request from Ray Larson et al
for the Council on_its own motion to rezone Lots 9, 10, 11, 12, 13 and
14, Block 4, Cowin's 2nd Addition, located on South side of Franklin
Street (U.S. Hwy. #20) and West of Nevada Street, from "R-2" One and
Two Family Residence District to "C-2" Commercial District, together
with consent petition from adjoining property owners on Mulberry Street,
and City Zoning Commission's recommendation for approval, be received,
placed on file, recommendations approved, date of hearing set as Octob-
er 6, 1975 at 7:00 P.M. and Clerk instructed to publish notice. Motion
carried.
68712 - Mayor Rooff stated that, together with Community Development Administra-
tor Mercer, he checked the Conway Civic Center area for availability
of more parking space and asked for permission to negotiate with the
people in the area of the Alley South of Jefferson Street to Bluff
Street to West Fourth Street to Park Avenue. Councilman Getty said that
the letter from Robert Sackett had merit and should be checked out.
Mayor Rooff agreed and said he would check out the sites. Moved by
Roehr, seconded by Getty that Mayor Rooff be granted permission to ne-
gotiate with the people in the area of the Alley South of Jefferson
Street to Bluff Street to West Fourth Street to Park Avenue. Motion
carried.
68713 - Councilman Getty suggested a letter be written to the Commander of the
Iowa National Guard based at the Airport thanking them for giving the
Council members a ride over the City to view the flood control program,
the dikes, the River Road construction, etc. Moved by Getty, seconded
by Geiger that the Mayor be instructed to send a letter of thanks to
the Iowa National Guard and commending the personnel and pilots for the
courteous treatment extended to the Council members. Motion carried.

68714 - Moved by Roehr, seconded by Geiger that request of Thorson-Brom-Bros-
har-Snyder, Architects, for Internal Medicine Associates, 622 West
Fourth Street, for permission to widen existing curb cut to 35°, as
shown on attached plat, and City Engineer's recommendations for approv-
al subject to the provisions of his letter, be received, placed on file,
recommendations approved and permission granted in accordance therewith
at no cost to the City. Motion carried.
68715 - Moved by Wilharm, seconded by Geiger that request from St. John's
Church, 1701 Mulberry Street, for permission to asphalt the parking
area on Mulberry Street, for beautification purposes only, and to con-
struct a temporary asphalt driveway, without regard to sidewalk grade,
together with $3.00 for recording waiver, and City Engineer's recommen-
dation for approval subject to the provisions of his letter, be re-
ceived, place on file, approved and "Resolution granting permission to
St. John's Church and authorizing construction of a temporary asphalt
driveway at 1701 Mulberry Street irrespective of a later official grade,'
adopted. Ayes: Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wil -
harm. Nays: None. Resolution adopted and upon approval by the Mayor,
it was assigned a number and appears as Resolution 24208 in the official
resolution book.
68716 - Moved by Roehr, seconded by Getty that request from Richard A. Ackerman
for permission to construct a temporary asphalt driveway at 1121 Mid-
land Street, without regard to sidewalk grade, together with $3.00 for
recording waiver, and City Engineer's recommendation for approval sub-
ject to the provisions of his letter, be received, placed on file, app-
roved and "Resolution granting permission to Richard A. Ackerman and
authorizing construction of a temporary asphalt driveway at 1121 Midland
Street irrespective of a later official grade", adopted. Ayes: Ber-
dell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm. Nays: None.

68717 - Moved by Getty, seconded by Wilharm that communication from Iowa Public
Service Company reporting an application has been filed for an electric
rate increase, be received and placed on file. Motion carried.
68718 Moved by Wilharm, seconded by Lichty that the City Treasurer Financial
Report for August, 1975, showing Balance on Hand 8/1/75 $13,958,936.60,
Receipts $2,811,063.66, Disbursements $2,686,484.54, Balance on Hand
8/31/75 $14,083,515.72, be received and placed on file. Motion carried.
68719 - Moved by Roehr, seconded by Geiger that the Minutes of the Community
Development Board for their Regular Meeting Held on August 12, 1975, be
received and placed on file. Motion carried.
68720 - Moved by Getty, seconded by Geiger that Construction Permit No. 76-84-S
for Sanitary Sewer Extension, Cedar Crest Addition, from Iowa Dept. of
Environmental Quality, subject to certain conditions and requirements,
be received and placed on file. Motion carried.
68721 - Moved by Roehr, seconded by Lichty that Contract and Bond with Service
Construction Co. in the amount of $242,789,60 for Retaining Wall and
Dike Modifications in Liberty Park, Contract No. 94, be received, placed
on file and "Resolution approving the Contract and Bond of Service Con-
struction Co., Waterloo, Iowa, for Dry Run Creek Retaining Wall and
Dike Modifications in Liberty Park, Contract No. 94", adopted. Ayes:
Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm. Nays: None.
Resolution adopted and upon approval by the Mayor, it was assigned a
number and appears as Resolution 24210 in the official resolution book.
68722 - Moved by Wilharm, seconded by Roehr that the site development plan from
Jack Page for 1st Assembly of God Church located East of Ansborough
Avenue on Lot 9 of Ridgeway Heights Addition, as shown on attached plat,
and Plan and Program Commission's recommendation for approval, be re-
ceived, placed on file and approved. Motion carried.
68723 - Moved by Wilharm, seconded by Roehr that the site development plan from
Charles F. Hinton, Atty. for Quik -Trip, in a "S-1" District located
East of Edgemont Avenue between Cataract Avenue and East Ridgeway Avenue,
as shown on attached plat, and Plan and Program Commission's recommend-
ation for approval, be received, placed on file and approved. Motion
carried.

68724 - Plan and Program Director Rust briefly reported on the site development
plan for 2228 LaPorte Road. A discussion followed on future frontage
roads in the Crossroads area, traffic pattern, and future land needs
of the Iowa State Highway Commission. Two different opinions were
presented, one by Fred Debe for Crossroads and the other by Les Timmer-
man. Les Timmerman agreed if the site development plan for 2228 La-
Porte Road was approved, he would deed another ten feet for street pur-
poses. Moved by Wilharm, seconded by Geiger that the site development
plan from Les Timmerman for 2228 LaPorte Road, a "S-1" District, lo-
cated on SW side of LaPorte Road between Bopp Street and Grimm Street,
as shown on attached plat, together with City Engineer's letter regard-
ing a frontage road, and Plan and Program Commission's recommendation
for approval, be received, placed on file and approved with the qualifi-
cation there is enough land in width for adding one additional traffic
lane to U.S. 218. Ayes: Berdell, Geiger, Getty, Keller, Lichty, Roehr
and Wilharm. Nays: None. Motion carried.
68725 - Mayor Rooff reported that Quintin Parker of the Sign and Traffic Depart-
ment, after checking the land parcel in Block 3, Shuler's Subdivision
of Block 21, Linden Place, stated there would be no problem with trail-
ers parked on the land. Moved by Keller, seconded by Lichty that "An
Ordinance amending Ordinance No. 2479, as amended, by adding Sub -Sec-
tion No. 75 to Section 2A-5, rezoning certain property", be considered
and passed for the second time, with a restriction to be placed in the
deed that no building be placed on this land (the first having passed
under C.R. 68671 of 9/15/75). Ayes: Berdell, Geiger, Getty, Keller,
Lichty, Roehr and Wilharm. Nays: None. Motion carried.
68726 - Moved by Roehr, seconded by Lichty that "An Ordinance amending Ordinance
No. 2479, as amended, by adding Sub -Section No. 73 to Section 2A-5, re-
zoning certain property, be considered and passed for the second time
(the first having passed under C.R. #68673 of 9/15/75). Ayes: Berdell,
Geiger, Getty, Keller, Lichty, Roehr and Wilharm. Nays: None. Motion
carried.
68727 - Moved by Roehr, seconded by Lichty that communication from the Asst.
City Attorney, transmitting a proposed ordinance adopting Chapters
44 and 45 of the 1975 Code of Iowa to comply with Home Rule require-
ments and recommending suspension of rules, be received, placed on file
and "An Ordinance designating the method by which candidates for elect-
ive municipal offices shall be nominated" considered and the rules re-
quiring ordinances to be considered and voted on for passage at two
prior meetings, suspended, said Ordinance recorded as having been con-
sidered and passed for the first, second and third times, and now placed
on its final adoption.' Ayes: Berdell, Geiger, Getty, Keller, Lichty,
Roehr and Wilharm. Nays: None. Motion carried.
68728 - Moved by Getty, seconded by Lichty that "An Ordinance designating the
method by which candidates for elective municipal offices shall be nom-
inated", be adopted. Ayes: Berdell, Geiger, Getty, Keller, Lichty,
Roehr and Wilharm. Nays: None. Ordinance adopted and upon its approv-
al by the Mayor, it was assigned a number and appears as Ordinance 2768
in the official ordinance book.
68729 - Moved by Getty, seconded by Roehr that communication from Community
Development Administrator, transmitting a proposed resolution approving
Proclaimer Certificate on Chautauqua Park, Phase II, be received, placed
on file and "Resolution approving the Proclaimer Certificate relative
to technical specifications conformance with local standards or stand-
ards necessary to support urban renewal objectives for project improve-
ments", adopted. Ayes: Berdell, Geiger, Getty, Keller, Lichty, Roehr
and Wilharm. Nays: None. Resolution adopted and upon its approval

Irving F. Jensen Co., Inc., Contractors, for the River Road, Stage II,
Westfield -Virden Urban Renewal Project Iowa R-7, Contract No. 150, and

73 Lafayette Street, Lester B. Phillips, 222-24 Randolph Street, Museum
of History & Science, Park Side, and Quality Inn Motel, 226 West Fifth
Street, together with preliminary assessment schedule, cost estimate
and plats, and recommending authorization be granted to proceed with
repair and/or reconstruction of said sidewalks with cost to be assessed

said date being set as October 13, 1975 at 7:00 P.M. in the City Hall
in said City. Motion carried.
