The Council of City of Waterloo, Iowa, met in Regular Session in the
Council Chambers in City Hall at 7:00 P.M. on August 11, 1975. Mayor
Rooff in the Chair. On roll call, Present: Berdell, Geiger, Getty,
Keller, Lichty, Roehr, Wilharm. Absent: None. Invocation offered by
Councilman Getty.
68424 - Moved by Roehr, Seconded by Wilharm that the Agenda,
for the Regular Session of August 11, 1975 at 7:00 P.

68427 - The Mayor announced the time had arrived to hear objections,
and called for oral and written objections. No objections were
made or filed. Moved by Getty, Seconded by Keller that Resolu-
tions. No. 24120, confirming approval of plans, specifications,
form of contract, estimated cost, etc. for Fourth Street Bridge
Lighting, Contract No. 28, be adopted. Ayes: Berdell, Geiger,
Getty, Keller, Lichty, Roehr and Wilharm. Nays: None. Absent:
None. Mayor declared resolution adopted.
68428 - Moved by Roehr, Seconded by Wilharm that Resolution No. 24121,
ordering the construction of the Fourth Street Bridge Lighting,
Contract No. 28, be adopted. Ayes: Berdell, Geiger, Getty,
Keller, Lichty, Roehr and Wilharm. Nays: None. Absent: None.

68430 - Moved by Keller, Seconded by Roehr that the recommendation of
Associated Insurance Advisors, Inc., Insurance Consultants, that
the City of Waterloo place its insurance on real and personal
properties, boiler and machinery, exhibition art object floater
and dishonesty, with Home Insurance Co. through Nelson Insurance
Agency, couiuiencing August 15, 1975 and continuing through Sept-
ember 1, 1978, be received, placed on file, recommendations ap-
proved and said insurance placed in accordance therewith. Ayes:
Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm. Nays:
None. Absent: None. Mayor declared the motion carried.
68431 - James Cole, 3517 Monticello Avenue, reported Sunnyside Temple has
done nothing about the bus and parking lot situation and asked what
steps were being taken to make Sunnyside comply. He was asked
to contact on Wednesday Asst. City Attorney Kennedy who has been
handling this complaint. Mayor Rooff stated if he couldn't reach
Kennedy, to call the Mayor's office.
68432 - A petition from Frank A. Van Kerckhove, 701 Newton Street, and
39 others, reporting the oiled parts of Grandview Avenue and
surrounding streets were inadequately completed and requesting
a satisfactory job be done, was presented. Mayor Rooff reported
he had inspected the streets, they were unsatisfactory and would
be done properly. Moved by Getty, Seconded by Keller that the
above petition be received and placed on file. Motion carried.

68433 Councilman Getty asked the Mayor for a report on the six points
presented by Councilperson Berdell, Community Enabler Jim Porter
and Ace Redd.
Mayor Rooff reported as follows:
1 - "Hiring of Park staff, effective immediately to October 1,
1975". This apparently would be for policing Sullivan Park
and would be a Park Board decision. He recommended the Coun-
cil concur and uphold the Park Board.
2 - "Immediate Alternate Facilities: African Place Neighborhood
Youth Center including staff and equipment - $10,000.00".
He could not recommend City funding.
3 - "Long Range Plan development of community facilities, including
recreation area on East 4th Street Urban Renewal Land"
This was pretty much covered in the Five Year Capital Improve-
ments program as $300,000 was allocated for east side park and
recreation facilities; also the Recreation Center has facilities
and programs for the young people.
4 - "A more rapid implementation of EEO including formal and infor-
mal contracts departmental hiring and promotion".
Mayor Rooff asked Karl Hollingsworth to report on his activities.
He reported since 10/17/74 he has developed a personnel policy,
he was working on a position classification and a salary schedule,
and an analysis on minorities employed. In answer to whether
anyone had not co-operated, he stated he has received tremendous
co-operation, has not received any real opposition, and his
emphasis has been on personnel, employment and contract compli-
ance.
5 - "Involvement of busir..ess and industry in job finding."
Mayor Rooff stated this should be done by business, industry and
the Chamber of Commerce.
6 - "Formation of Mayor's Youth Planning Committee"
Mayor Rooff Supported setting up a youth group so they would be
'involved.
Councilperson Berdell stated this was not the proper way to present
this, she needed to know if this was the final decision as if it was,
she would need to try another approach, and this was a breach of faith
Mayor Rooff responded a Council member had asked for the report,
and the Council had a right to this report. Moved by Roehr, Sec-
onded by Wilharm that the report of Mayor Rooff, be received and
placed on file. Motion carried.
68434 - Mayor Rooff reported John Smith gave reasons he couldn't relo-
cate at the various sites offered him. He recommended the license
for the junk yard be denied and cited the city ordinance and fire
calls in the last five years. John Smith stated the sites offered
didn't fit the needs, he has not had an offer for his present prop-
erty, and asked for renewal of his license. Moved by Getty, Sec-
onded by Berdell that the application, bond and fee of John Smith
dba Midwest Paper & Metals, 2724 Lafayette Street, for renewal Junk
Dealer License, be received, placed on file, and denied. Ayes:
Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm. Nays:
None: Absent: None. Mayor declared the motion carried.
68435 John Smith asked what he needed to do to get his license back and
City Attorney Smith stated his lawyer should contact him. A heated
discussion followed between John Smith and Jerry Boyd, 69 Zuma
Street, Dorothy Neidert, 332 California Street, and other neighbors,
who asked that Jerry Boyd and Their attorney also be present at the
meeting.
68436 - The Engineers recommended acceptance of the low bid of See Electric,
Inc. of Waterloo, Iowa in the amount of $12,780.00 for the Fourth
Street Bridge Lighting, Contract No. 28. Moved by Wilharm, Sec-
onded by Roehr that the above recommendation be received, placed
on file and Resolution No. 24122, accepting bid of See Electric, Inc.
in the amount of $12,780.00, for Fourth Street Bridge Lighting,
Contract No. 28, adopted. Ayes: Berdell, Geiger, Getty, Keller,
Lichty, Roehr and Wilharm. Nays: None. Absent: None. Mayor de-
clared resolution adopted.

68437 - Moved by Roehr, seconded by Getty that request from Robert J. Schad-
ler for permission to construct one 30' commercial curb cut in 900
block of Black Hawk Road, as shown on attached plat, and City Eng-
ineer's recommendation for approval subject to provisions of his
letter, be received, placed on file, recommendations approved and
permission granted in accordance therewith. Motion carried.
68438 - Moved by Keller, seconded by Getty that request from Mepco, Inc. for
Matt Parrott & Sons, Inc., 514 Bratnober Street, to asphalt an alley,
as shown on attached plat, and City Engineer's recommendations, be
received, placed on file and approved in accordance with said rec-
ommendations. Motion carried.
68439 - Moved by Roehr, seconded by Geiger that request of Westminster Pres-
byterian Church, 1301 Kimball Avenue, for permission to widen ex-
isting driveway by 16', as shown on attached plat, and City Engi-
neer's recommendations for approval subject to the provisions of his
letter, be received, placed on file, recommendations approved and
permission granted in accordance therewith at no cost to the City.

68440 - Moved by Wilharm, seconded by Keller that the communication from the
Property Administrator, transmitting an offer from Southtown Devel-
opment Co. to purchase Tract A, being portions of NW-NW of Section
11-88-13 and SW-SW 2-88-13, known as Murphy Road Vacated, for the
amount of $5,000, together with Warranty Deed unto the City for
certain real property and an Easement unto Southtown Development Co.
for part of SW-SW and SE-SW Section 2-88-13, and requesting a date
of hearing be set, be received, placed on file and Resolution No.
24123, fixing the time and place of hearing as August 25, 1975 at
7:00 P.M. in the Council Chambers of the City Hall, adopted. Ayes:
Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm. Nays:
None. Absent: None. Mayor declared the resolution adopted.
68441 - Moved by Getty, seconded by Lichty that communication from City
Plan and Zoning Commission, transmitting the request of George D.
Keith, Atty. for Family Service League, for vacation of All of Saxon
Street lying East of East line of Iowa Street and West of West line
of East Fourth Street; All East-West alley lying between Iowa Street
and East Fourth Street in Block 28, Railroad Addition; All East-
West alley lying between Iowa Street and East Fourth Street in
Block 21, except the West 120 felt, All in Railroad Addition, in the
Logan Avenue Urban Renewal Project Iowa R-2, together with letter
from the Community Development Administrator, be received, placed on
file and action deferred until August 18, 1975 for further study
of portion of Saxon Street to be vacated. Motion carried.
68442 - Moved by Roehr, seconded by Getty that request from Emmett Glenn
Stephens for permission to construct a temporary concrete driveway
at 2224 West 7th Street, without regard to sidewalk grade, together
with $3.00 for recording waiver and City Engineer's recommendation
for approval subject to the provisions of his letter, be received,
placed on file, approved and Resolution No. 24124, granting per-
mission and authorizing construction irrespective of a later official
grade, adopted. Ayes: Berdell, Geiger, Getty, Keller, Lichty, Roehr
and Wilharm. Nays: None. Absent: None. Mayor declared the res-
olution adopted.
68443 - The Technical Committee reported on their findings in reviewing the
construction plans for sanitary sewer facilities to serve the Cedar
Knolls Mobile Home Park, referred to them under C.R. h68399 of 8/4/75.
Moved by Keller, seconded by Wilharm that the above report be re-
ceived, placed on file, said report and said construction plans ap-
proved, with final acceptance subject to review by the Department
of Environmental Quality, and the Mayor and Clerk authorized to
execute Treatment Form C 4/73 with said Department in behalf of the
City of Waterloo, Motion carried.
68444 - Moved by Wilharm, seconded by Roehr that the report of the City At-
torney that the "Ordinance fixing the Compensation of the Councilmen
per annum" considered and passed for the first time on 8/4/75, must
fail because Chapter 380.4 of the Iowa Code requires an affirmative
vote of not less than a majority of the Council members, and the vote
was three in affirmative and two against, be received and placed
on file. Motion carried

68445 - Moved by Getty, seconded by Roehr that the Contract and Bond of
Washburn Asphalt Co. Inc., Cedar Rapids, Iowa, and Blacktop Con-
struction of Shakoppe, Minnesota, joint venture, for the 1975 Street
Repair and Resurfacing Program, Contract No. 155 in the amount of
$143,786.06, be received, placed on file and Resolution No. 24125,

file, approved and Mayor and Clerk authorized to execute same.

68448 - Jim Porter introduced Rev. Eugene Williams, Pastor of the Antioch
Baptist church and Rev. Thad Thomas, Pastor of Mt. Carmal Baptist
church. Rev. Williams stated C:ouncilperson Berdell was the voice for
the black community, they supported the presentation she made, their
problems were not solved, and offered his and Rev. Thomas' services
to help solve the problems and to start a youth council. Mayor
Rooff responded there should be a group of young people as voting
members from the four high schools to represent the four areas;
this' was a positive step; and the Recreation Center Director Fors-
berg had informed him there were many things that could involve
the young people.

Development Block Grant Urgent Need Contract No. B -75 -UR -19-0002
between the City of Waterloo, Iowa and the U.S. Department of
Housing and Urban Development in the amount of $2,400.000, and
Community Development Administrator's recommendation for approval,
be received, placed on file and Resolution No. 24126, approving and
providing for the execution of said Contract, adopted. Ayes:

ity, subject to certain conditions and requirements, be received
and placed on file. Motion carried.
68451 - An Ordinance establishing the salary of the Mayor of the City of
Waterloo, Iowa beginning January 2, 1976, and repealing Ordinance
No. 2579, was presented for consideration for passage for the second
time. Moved by Keller, seconded by none that said ordinance be con-
sidered for the second time (the first having passed under C.R.
#68414 of 8/4/75). Moved by Roehr, seconded by Getty that the motion
be amended to read suspend the rules on the requirements for pass-
age of the ordinance. Ayes: Geiger, Getty, Keller, Lichty, Roehr and
Wilharm. Nays: Berdell, Absent: None. Mayor declared the motion
carried.
68452 - Moved by Roehr, seconded by Getty that the rules requiring ordinances
to be considered and voted on for passage at two council meetings
prior to the meeting at which it is to be finally passed, be sus-
pended, said Ordinance recorded as having been considered and passed
for the second and third times (the first having passed under C.R.
#68414 of 8/4/75), and now placed on its final adoption. Ayes:

dinance establishing the salary of the Mayor of the City of Waterloo,
Iowa, beginning January 2, 1976, and repealing Ordinance No. 2579,
