The Council of City of Waterloo, Iowa, met in Regular Session in the Council
Chambers in City Hall at 7:00 P. M. on August 4,1975. Mayor Rooffin the
Chair. On roll call, Present: Berdell, Getty, Keller, Lichty, Roehr.
Absent: Geiger and Wilharm. Invocation offered by Councilman Getty.
68371 - Moved by Roehr, Seconded by Getty that the Agenda, as proposed for the
Regular Session of August 4, 1975 at 7:00 P. M., be accepted and
approved. Motion carried.
68372 - Moved by Roehr, Seconded by Keller that the Minutes of the Regular
Session held July 31, 1975 at 7:00 P.M. be approved. Motion carried.
68373 - Moved by Getty, seconded by Keller that proof of publication of
Notice of Hearing on proposed plans and specifications and proposed
form of contract, etc. and taking of bids for the 1975 New Sidewalk
Program, Contract No. 42, be received and placed on file. Motion
carried.
68374 The Mayor announced the time had arrived to hear objections, and
called for oral and written objections. No objections were made or
filed.

firming approval of plans, specifications, form of contract, etc.
for the 1975 New Sidewalk Program, Contract No. 42, be adopted.

Geiger and Wilharm. Mayor declared the resolution adopted.

68382 - Property Admr. Parsons reported on the development of the Hammond
Avenue and Murphy Road area by the Southtown Development Co; Who
needed Tracts A and D but could not deal directly with the Iowa
State Highway Commission, which the City could do. Jon Fister, Atty.
for said company. presented an offer with documents to purchase
Tract A from the City. Moved by Getty, seconded by Roehr that the
above offer be received and placed on file. Motion carried.
68382 A -Moved by Roehr, seconded by Keller that the two Offers to Buy Con-
tracts from the Iowa State Highway Commission wherein the City of
Waterloo offers to purchase tract A and tract D in Sections 2 and
11-88-13 in the location of Hammond Avenue and Murphy Road along
Primary Road No. 412, for relocation of vacated Murphy Road, for
the sums of $5,000 and $1.00 respectively, and request that said
Commission be given access to 4.4 acres more or less as shown on
attached plat, be received, placed on file, approved and the Mayor
and Clerk authorized to execute said Contracts in behalf of the City.
Ayes: Berdell, Getty, Keller, Lichty, and Roehr. Nays: None.
Absent: Geiger and Wilharm. Mayor declared motion carried.
68383 - The Engineers recommended acceptance of the low bids of Frank
Curran, Waterloo, Iowa in the amount of $11,154.96 for Component
I, and Gregg & Enos, Hudson, Iowa in the amount of $26,584.52 for
Component II for the 1975 New Sidewalk Program, Contract No. 42.
Moved by Keller, seconded by Roehr that the above recommendation
be received, placed on file and Resolution No. 24110, making award
of contract, or accepting the bids of Frank Curran, Waterloo, Iowa
in the amount of $11,154.96 for Component I and Gregg & Enos,
Hudson, Iowa, in the amount of $26, 584.52 for Component II for
1975 New Sidewalk Program, Contract No. 42, adopted. Ayes: Berdell,
Getty, Keller, Lichty, and Roehr. Nays: None. Absent: Geiger
and Wilharm. Mayor declared resolution adopted.
68384 - Moved by Getty , seconded by Berdell that City Engineer be instructed
to prepare plans, specifications, form of contract, form of proposal,
preliminary estimated cost, etc. for the Orange Township Sanitary
Sewer outfall, Contract No. 177. Motion carried.
68385 - Moved by Roehr, seconded by Getty that the plans, specifications,
form of contract, etc. for the Orange Township Sanitary Sewer
Outfall, Contract No. 177, be received and placed on file. Motion
carried.
68385 A -Moved by Keller, seconded by Getty that Resolution No. 24111,
provisionally approving plans, specifications, form of contract,
etc. for the Orange Township Sanitary Sewer Outfall, Contract No.
177, and directing publication of notice of Hearing on plans,
specifications, etc. and taking of bids, be adopted with hearing
set for August 25, 1975 at 7:00 P.M. in City Hall. Ayes: Berdell,
Getty, Keller, Lichty, and Roehr. Nays: None. Absent: Geiger
and Wilharm. Mayor declared resolution adopted.
68386 - Mayor Rooff:briefly reported on the happenings on last Monday night
on East Fourth Street in the vicinity of Sullivan Park and stated
the Police Department, today, was arresting 26 persons; the lights
have been turned on in the Park; the Park Director and Commissioners
were meeting and would come to the Council. He commended the Police
Department for doing their work well and staying within the system
and stated he supported them and would continue to support them.

68387 - Mayor Rooff reported four locations have been found for consider-
ation for relocation of the Midwest Paper Stock Company and stated
he would not recommend the temporary license be renewed, however,
time would be needed for the relocation.
68388 - Jim Porter, Community Enabler, praised Councilperson Berdell for
her efforts last Monday night in the East Fourth Street incident
and the role she played. Mayor Rooff responded that she did do a
fine job, as did the other Council persons.
68389 - Roger Bradley, 1223 Bertch Avenue, reported a dead elm tree at the
corner of Bertch Avenue and Randolph Street.
68390 - Moved by Roehr, seconded by Lichty that request of Marvin F. Rees
and Helen E. Rees, 1705 Black Hawk Street, to purchase All the alley
lying south of Lots 1 and 2 and north of Lots 19, 20 and 21, Block 3,
West Park Addition, (a vacated unopened alley lying north of West
Wellington Street between relocated Randall Street and U.S. Highway
#63), and Property Administrator's recommendation that minimum of
five cents (.05) per square foot or total price of $100.00 plus
cost be established be received, placed on file, recommendations
approved and Resolution No. 24112, fixing the time and place of
hearing and receiving of bids as Aug. 25, 1975 at 7:00 P.M. in City
Hall on the proposal to sell and convey said property to the high-
est bidder, adopted, and the Clerk instructed to publish the
notice of hearing as provided by law. Ayes: Berdell, Getty,
Keller, Lichty, and Roehr. Nays: None. Absent: Geiger and Wilharm.
Mayor declared the resolution adopted.
68391 - Moved by Getty, seconded by Berdell that request of Youngblut
Construction Co., Inc. for St. Edward's Catholic Church for per-
mission to repair and widen the existing curb cut and driveway
approach 6', as shown on attached plat, and City Engineer's reco-
mmendations for approval subject to the provisions of his letter,
be received, placed on file, recommendations approved and permission
granted in accordance there -with at no cost to the City. Motion
carried.
68392 - Moved by Roehr, seconded by Lichty that the request of Dick H. Young
for permission to use exposed aggregate on two drives at 3538
Inverness Road, together with City Engineer's recommendation for
denial, be received, placed on file, and request denied. Ayes:
Lichty and Roehr. Nays: Berdell, Getty and Keller. Absent:
Geiger and Wilharm. Mayor declared the motion not carried.
68393 - City Engineer Radue, at the request of Councilman Roehr, repeated
his recommendation for denial with reasons. City Attorney Smith
said the City was liable for streets and sidewalks. It was brought
out that no other driveway in the City has been authorized for ex-
posed aggregate. Moved by Roehr, seconded by Lichty that the previous
motion be reconsidered. Ayes: Lichty and Roehr. Nays: Berdell,
Getty and Keller, Absent: Geiger and Wilharm. Mayor declared
the motion not carried.
68394 - Moved by Berdell, seconded by Keller that the request of Dick H.
Young for permission to use exposed aggregate on two drives at 3538
Inverness Road, be approved. Ayes: Berdell, Getty, and Keller.
Nays: Lichty and Roehr. Absent: Geiger and Wilharm. Mayor
declared the motion carried.
68395 - Moved by Roehr, seconded by Getty that request from Dallas E.
Hillyard for permission to construct two temporary concrete drive-
ways at 4125 Kimball Avenue, without regard to sidewalk grade,
together with $3.00 for recording waiver, and City Engineer's re-
commendation for approval subject to provisions of his letter,
be received, placed on file, approved and Resolution No. 24113,
granting permission and authorizing construction irrespective of a
later official grade, adopted. Ayes: Berdell, Getty, Keller,
Lichty and Roehr. Nays: None. Absent: Geiger and Wilharm.

68396 - Moved by Keller, seconded by Berdell that the Contract and Bond
of Mepco, Inc., Waterloo, Iowa, for the West Ridgeway Avenue
Widening, Contract No. 151, be received, placed on file and Resolu-
tion No. 24114, approving said Contract and Bond, adopted. Ayes:
Berdell, Getty, Keller, Lichty and Roehr. Nays: None. Absent:
Geiger and Wilharm. Mayor declared resolution adopted.
68397 - Moved by Roehr, seconded by Getty that construction plans for san-
itary sewer facilities, storm sewer and concrete paving of Lack -
land Drive for the Cedar Crest Addition, together with Treatment
Agreement Form C 4/73 with the Department of Environmental Quality,
and City Engineer's recommendation for approval with final acceptance
of plans subject to review by said Department, be received, placed
on file, recommendations approved, and the Mayor and City Clerk
authorized to execute said Agreement Form in behalf of the City of
Waterloo. Motion carried.
68398 - Moved by Getty, seconded by Berdell that construction plans for
sanitary sewer faciltites serving Southtown Development Company
in NA NW, Section 11-88-13, together with Treatment Agreement
Form C 4/73 with the Department of Environmental Quality, and the
City Engineer's recommendation for approval with final acceptance
of plans subject to review by said Department, be received, placed
on file, recommendations approved, and the Mayor and City Clerk
authorized to execute said Agreement Form in behalf of the City
of Waterloo. Motion carried.
68399 - Moved by Roehr, seconded by Lichty that construction plans for
sanitary sewer facilities to serve the Cedar Knolls Mobile Home
Park and Treatment Agreement Form C 4/73 for the Department of
Environmental Quality, together with City Engineer's recommend-
ation that action be deferred until reviewed by Technical Committee,
be received, placed on file, recommendations approved and action
deferred until Aug. 11, 1975. Motion carried.
68400 - Moved by Roehr, seconded by Getty that An ordinance repealing
Chapter 15 of the Municipal Code of Waterloo, Iowa, in its
entirety and enacting a new Chapter establishing regulations and
restrictions of food and food handlers, be received, placed on
file, considered and passed for the second time. Ayes: Berdell,
Getty, Keller, Lichty, and Roehr. Nays: None. Absent: Geiger and
Wilharm. Mayor declared motion carried.
68401 - Moved by Keller, seconded by Berdell that An Ordinance vacating
a dead end and unopened alley lying NWly of West 17th Street
between Jefferson Street and Bluff Street, in the City of Waterloo,
Iowa, be received, placed on file, considered and passed for the
third time, and now placed on its final adoption. Ayes: Berdell,
Getty, Keller, Lichty, and Roehr. Nays: None. Absent: Geiger
and Wilharm. Mayor declared motion carried.
68402 - Moved by Getty, seconded by Berdell that Ordinance No. 7.5f -:`An
Ordinance vacating a dead end and unopened alley lying y of West
17th Street between Jefferson Street and Bluff Street, in the City
of Waterloo, Iowa, be adopted.
Ayes: Berdell, Getty, Keller, Lichty, and Roehr. Nays: None.
Absent: Geiger and Wilharm. Ordinance adopted.

the use of vehicles on flood control levees, be received, placed

the motion carried.

the Riverfront Improvement Commission as an Administrative Agency
under the Code of Ordinances, City of Waterloo, be received,
placed on file, considered and passed for the third time, and now

Ordinance No. 2644, known as the Traffic Ordinance, by repealing
Section 501 entitled "Projecting Loads on Passenger Vehicles",
Section 502 entitled "Loading Beyond Front", and Section 502 en-
titled "Spilling Loads on Streets or Alleys", and enacting in lieu
thereof new Section 501 entitled "Projecting Loads on Passenger
Vehicles" and new Section 502 entitled "Spilling Loads on Streets
or Alleys", be received, placed on file, considered and passed for
the third time, and now placed on its final adoption. Ayes: Ber-

Ordinance amending Ordinance No. 2644, known as the Traffic Ordinance,
by repealing Section 501 entitled "Projecting Loads on Passenger
Vehicles", Section 502 entitled "Loading Beyond Front", and Sec-
tion 502 entitled "Spilling Loads on Streets or Alleys", and
enacting in lieu thereof new Section 501 entitled "Projecting Loads
on Passenger Vehicles" and new Section 502 entitled "Spilling Loads

Development Administrator, transmitting a proposed "Resolution
rescinding Resolution No. 23075 adopted March 16, 1970 and Reso-
lution No. 20444 adopted April 20, 1970 pertaining to Disposal
Parcel No. 35 in the Logan Avenue Urban Renewal Area, Project Iowa
R-2," be received, placed on file and Resolution No. 24115, rescind-
ing said resolutions, adopted. Ayes: Berdell, Getty, Keller, Lichty,
and Roehr. Nays: None. Absent: Geiger and Wilharm. Mayor de-
clared resolution adopted.
68410 - Community Development Administrator Mercer briefly outlined the
loan program. Councilman Keller raised questions as to qualific-
ations to administer the program, the needy people being able to
get the loans, rules and regulations be spelled out and guidelines
set, Jim Porter stated he would like to have some i.annvt. Moved
by Getty, seconded by Roehr that communication from votmmunity
Development Administrator, transmitting a proposed "Resolution
approving a program for City Wide Housing Rehabilitation under the
City �f Waterloo Community Development Block Grant Program as
required by the Federal Government under the Housing and Community
Development Act of 1974", and recommending approval, be received,
placed on file and Resolution No. 24116, approving said program,
adopted. Ayes: Getty, Keller and Roehr. Nays: Berdell and
Lichty. Absent: Geiger and Wilharm. Mayor declared resolution
adopted.
68411 - Moved by Getty, seconded by Berdell that the Council go into a
closed executive session to discuss personnel and salaries. Ayes:

THE COUNCIL MET IN A FORTY MINUTE CLOSED EXECUTIVE SESSION AND RECONVENED.
68412 Moved by Getty, seconded by Roehr that Resolution No. 24117, a
resolution fixing the compensation of the City Officials and Em-
ployees in the City of Waterloo, Iowa, be adopted as corrected.
Ayes: Berdell, Getty, Keller, Lichty and Roehr. Nays: None.
Absent: Geiger and Wilharm. Mayor declared the resolution adopted.
68413 - Mayor Rooff reported the Council in closed Executive session agreed
to approve an increase in the Library budget in the amount of
$9,181.00.
68414 - Moved by Getty, seconded by Keller that An Ordinance establishing
the salary of the Mayor of the City of Waterloo, Iowa, beginning
January 2, 1976, and repealing Ordinance No. 2579, be considered
and passed for the first time. Ayes: Berdell, Getty, Keller,
Lichty and Roehr. Nays: None. Absent: Geiger and Wilharm.
Mayor declared the motion carried. Keller stated several Department
Heads draw more than the Mayor who has one of the largest personnel
and budgets to administer, he was unpaid, the salary should have
been set at $25,000 years ago and should be brought in line.
68415 - Moved by Getty, seconded by Berdell that An Ordinance fixing the
Compensation of Councilmen per annum, be considered and passed
for the first time. Ayes: Berdell, Getty and Lichty. Nays:
Keller and Roehr. Absent: Geiger and Wilharm. Mayor declared the
motion not carried.
68416 - Moved by Roehr, seconded by Getty that City Engineer's detailed
plans, specifications, form of contract, form of proposal, prelim-
inary estimate of cost, etc. for the 1975 Paving Program, Contract
No. 135, be received, placed on file and Resolution No. 24118,
ordering construction, approving plans, specifications and form of
contract and notice to bidders, fixing amount of bidder's check,
and ordering City Clerk to publish notice to bidders and fixing a
date for receiving same, and for a public hearing on plans, spec-
ifications and form of contract, adopted, with date set as August
25, 1975. Ayes: Berdell, Getty, Keller, Lichty and Roehr. Nays:
None. Absent: Geiger and Wilharm. Mayor declared resolution adop-
ted.
68417 - Moved by Roehr, seconded by Lichty that the communication from the
Police Chief reporting Captain Kenneth Finch has retired from the
Police Department, effective July 18, 1975, and is entitled to 60
working days of sick leave pay, for a total sum of $3,179.28, be
received, placed on file, approved and Resolution No. 24119, au-
thorizing payment accordingly, adopted. Ayes: Berdell, Getty,
Keller, Lichty and Roehr. Nays: None. Absent: Geiger and Wil -
harm. Mayor declared the resolution adopted.
68418 - Moved by Getty, seconded by Lichty that the following applications
for Beer Permits and Beer and Liquor License, be received, placed
on file, approved, the approval endorsed on applications and same

Rita K. Pothast, 140 Linwood Drive, for a Massage Technician Permit
(action deferred under C. A. # 68365 of 7/28/75), be denied.
