The Council of City of Waterloo, Iowa, met in Regular Session in the Council
Chambers in City Hall at 7:00 P.M. on July 14, 1975. Mayor Rooff in the
Chair. On roll call, Present: Geiger, Getty, Lichty, Roehr and Wilharm.
Absent: Berdell and Keller. Invocation offered by Councilman Geiger.
68213 - Moved by Roehr, seconded by Wilharm, Agenda as proposed, for Regular
Session of July 14, 1975 at 7:00 P.M., be accepted and approved.

68214 - Moved by Wilharm, seconded by Roehr, Minutes of Regular Session held
July 7, 1975 at 7:00 P.M., be approved. Motion carried.
68215 - Moved by Roehr, seconded by Wilharm proof of publication of Notice
of Hearing on proposed plans and specifications and form of contract,
etc. for 1975 Street Repair and Resurfacing Program and taking of
bids, Contract No. 155, be received and placed on file. Motion
carried.
68215A- Mayor announced the time had arrived to hear objections, and called
for oral and written objections. No objections were made or filed.

firming approval of plans, specifications, form of contract, esti-
mated cost, etc. for 1975 Street Repair and Resurfacing Program,

adopted.

ing the construction of 1975 Street Repair and Resurfacing Program,

notice of public hearing on rezoning from R-2, One and Two Family
Residence District to C-2, Commercial District, Lots 357, 358, 359
and 360, Pleasantview Addition (N of Plymouth Ave. & W of LaPorte
Road), as requested by Frank Zubak and James Kirsch, recommended by
City Plan and Zoning Commission and on Council's own motion, be re-
ceived and placed on file. Motion carried.

Ordinance No. 2479, as amended, by adding Sub -section No. 72 to
Section 2A-5, rezoning certain property, be received and placed on
file for the first time, subject to 17' of right-of-way being ob-
tained on LaPorte Road.. Ayes: Geiger, Getty, Lichty, Roehr and
Wilharm. Nay: None. Absent: Berdell and Keller. Motion carried.
68221 - Mrs. Perry Miller, 4742 Hammond Avenue, and other area residents,
reported litter was strewed by uncovered trucks on the landfill
road, trash was dumped in their yards, road was congested with
traffic due to people stopping to ask direction, and the dust was
very dense.

Mayor Rooff stated when the oil shipment arrives, Hammond Avenue
would be the first street oiled, and starting immediately there
would be a hard crackdown on dumping litter within city limits.
He asked the residents to notify the City immediately of any dump-
ing in the roads and yards, and on Highway 21 to call the Highway
Maintenance Engineer.
68222 - Dewey Hundley inquired as to what was happening on West Fourth
Street parking and Mayor Rooff reported recommendations were made
to WIDA but nothing was finalized as he was not in favor of moving
out ten or more businesses.
68223 - Doris Fraser complained of the poor plumbing workmanship and inspec-
tions on the Cedar Terrace sanitary sewer installations, and Mayor
Rooff arranged a meeting with her and other concerned persons and
the plumbing inspector.
68224 - The Engineers recommended acceptance of the low bid of Washburn
Asphalt Co., Inc. of Cedar Rapids, Iowa in amount of $143,786.06,
for 1975 Street Repair and Resurfacing Program, Contract No. 155.

received, placed on file and Resolution No. 24052, accepting bid of
Washburn Asphalt Co., Inc. in amount of $143,786.06, for 1975
Street Repair and Resurfacing Program, Contract No. 155, adopted.

68225 - Moved by Getty, seconded by Wilharm that the Contract and Bond with
Radio Communications Co., Waterloo, Iowa, in amount of $27,366.00
for 250 foot self-supporting tower for Police Department, be re-
ceived, placed on file and Resolution No. 24053, approving same,
adopted. Ayes: Geiger, Getty, Lichty, Roehr and Wilharm. Nay:
None. Absent: Berdell and Keller. Resolution adopted.
68226 - Councilman Getty recommended that Councilman Lichty, as representa-
tive of the east side, and Councilman Roehr for the west side, be
appointed as members to the Plan and Program Commission.
Moved by Getty, seconded by Geiger that Councilman Mary J. Lichty
and Councilman Jack L. Roehr be appointed members of the Plan and
Program Commission, effective immediately. Motion carried.
68227 - Moved by Getty, seconded by Wilharm that request from Schenk Engi-
neering Company for Hanover Waterloo, Inc. with construction plans
for sanitary sewer facilities to serve Sambo's Restaurant on new
K -Mart site and Treatment Agreement Form C 4/73 with Department of
Environmental Quality, and City Engineer's recommendation for ap-
proval at no cost to City, with final acceptance of attached plans
subject to review by said Department, be received, placed on file,
recommendations approved and Mayor and Clerk authorized to execute
said Form C4/73. Motion carried.
68228 - Moved by Getty, seconded by Roehr that request from Claude Gardner
Construction Co. for "Taco Johns", with Iowa State Highway Commis-
sion Form #559 and sketch, for permission to construct a 28' Type
B entrance to U.S. 20 at Sta. 202+22.5, Ely side, approximately 68.5'
N of Broadway and Center Street intersection, and City Engineer's
recommendation for approval subject to provisions of his letter,
be received, placed on file and action deferred until July 21, 1975.

for permission to construct a temporary asphalt driveway at 1817

24057, granting permission and authorizing construction irrespective

of Waterloo for storm sewer installation as part of Downtown Fourth

and request granted in accordance therewith. Motion carried.

Avenue to Empire Realty, Inc. pending vacation of street.

proving the sale of Disposal Parcel No. F-8 in the Westfield -Virden
Urban Renewal Area, Project No. Iowa R-7, and authorizing the exe-
cution of the necessary contract for sale of land for private rede-
velopment and deed, be adopted. Ayes: Geiger, Getty, Lichty, Roehr
and Wilharm. Nay: None. Absent: Berdell and Keller. Resolution
adopted.

Engineer, transmitting construction plans for Central Heights II
Addition, and recommending approval with stipulation that base rock,
if needed, will be constructed at no cost to City, be received,

Road, Stage II, Contract #150, for additional work performed by
Irving F. Jensen Co., Inc. for an increase of $9,989.00, payable

Waterloo Railroad Company for Stage 5-A of Local Flood Protection

enter into an agreement with the Waterloo Railroad Company whereby
the City is granted a permanent easement for the installation and
maintenance of flood control structures on and across land of the
