The City Council of the City of Waterloo, Iowa, met in Regular Session in the Council Chambers in the City Hall in said City at 7:00 P.M. on July 7, 1975. Mayor Rooff in the Chair. Present: Councilmen Berdell, Getty, Keller, Lichty, Roehr and Wilharm. Absent: Councilman Geiger. Councilman Harold E. Getty offered the invocation. 68161 - Moved by Wilharm, seconded by Keller that the Agenda, as proposed, for the Regular Session of July 7, 1975 at 7:00 P.M., be accepted and approved. Motion carried. 68162 - Moved by Roehr, seconded by Wilharm that the Minutes of the Special Session held June 30, 1975 at 7:00 P.M., be approved. Motion carried. 68163 - Moved by Getty, seconded by Wilharm that the proof of publication of Notice of Public Hearing on proposal to sell Disposal Parcel No. I-1 in Westfield -Virden Urban Renewal Area, Project No. Iowa R-7, 43 Franklin Street, as described in said notice published in Water- loo Daily Courier on May 29, 1975, to Donald B. Gardner and Vivian M. Gardner, be received and placed on file. Motion carried. 68164 - The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objection, or if any written objections had been filed with the Clerk. No one appeared to object orally and the Clerk reported no written objections placed on file. Moved by Wilharm, seconded by Berdell that Resolution No. 24038, ap- proving the sale of Disposal Parcel No. I-1 in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7 and authorizing the execu- tion of the necessary contract for sale of land for private redevel- opment and deed, be adopted. On roll call, Berdell, Getty, Keller, Roehr and Wilharm voted Aye. Nay: Lichty. Absent: Geiger. Mayor declared the resolution adopted. 68165 - Mayor Rooff reported he had received an invitation from President Ford to meet on Thursday, July 10, 1975 at 2:00 P.M. on revenue sharing and requested permission to attend. Moved by Roehr, seconded by Lichty that the above request be received, placed on file, approved and permission granted with whatever expenses incurred, allowed. Motion carried. 68166 - Mayor Rooff reported (1) enforcement of the ban on swimming in sand- pits, river and creek was impossible, (2) the Police Chief, to en- force the ban, needed 60 additional policemen, and (3) a portion of the Swimming Ordinance could be unconstitutional; recommending the Council consider taking action next week to repeal the ordinance, or come up with 3/4 million dollars for enforcement; and reminded par- ents there was a curfew at 10:30 P.M. and asked their help with the children. 68167 - Jim Porter reported weeds needed to be cut on the east side and debris removed from 209 Sumner Street. He was referred to Earl Showers, Deputy Weed Commissioner. - 2 - 68168 - Councilman Wilharm presented a petition from Mr. and Mrs. Ward Speicker, 1314 Jersey Lane, and 37 other property owners, for sani- tary sewer in Guernsey Addition -Orange View. James Blough inquired if this would be in the next two year plan and was informed, not this year but could get in at a later date. He invited the Mayor and Council to drive out to this area and inspect the roads. Moved by Wilharm, seconded by Roehr that the above petition be re- ceived, placed on file and referred to the City Engineer. Motion carried. 68169 - Moved by Roehr, seconded by Lichty that the petition of John and Agnes Klinoff, 1054 Kern Street, et al, for asphalt paving of Kern Street from Burton Avenue to Longfellow Avenue, be received, placed on file and referred to the City Engineer. Motion carried. 68170 - Moved by Wilharm, seconded by Roehr that the communication from the Building Official, transmitting request of Waterloo Daily Courier for permission to install a concrete beam construction tying the existing walls under the sidewalk along West 4th Street from Com- mercial Street (former Montgomery Ward Building), and to install sidewalk, together with drawings, be received, placed on file, ap- proved and permission granted. Motion carried. 68171 - Moved by Getty, seconded by Berdell that the request of Merle Glea- son Construction for Wayne and Wanda Boysen, together with Iowa State Highway Commission Form #559 with sketch attached, for per- mission to construct a 30' Type "B" entrance to U.S. 20 at Sta. 271+36, northerly side, approximately 192.4' NWly of intersection of Highway 20 and Courtland Avenue, and City Engineer's recommenda- tion for approval subject to the provisions of his letter, be recei- ved, placed on file, recommendations approved and Mayor and Clerk authorized to sign said application. Motion carried. 68174 - Moved by Wilharm, seconded by Berdell that the communication from the City Engineer, transmitting a request from Bill R. Tatum, 1934 Ansborough Avenue, for permission to construct one (1) temporary concrete driveway at 1934 Ansborough Avenue, as shown on attached plat, together with $3.00 in cash for recording waiver, and recom- mending approval subject to the provisions of his letter, be re- ceived, placed on file, request approved and Resolution No. 24039, granting permission and authorizing construction irrespective of a later official grade, be adopted. Motion carried. 68178 - City Attorney Smith stated the City could give Sunnyside Temple a reasonable length of time to comply with removal of lights and a dust free surface on the parking lot. Councilman Roehr recommended the City Attorney write a letter to this effect and then if neces- sary follow up with legal action. 68179 - Moved by Roehr, seconded by Wilharm that the 1974 Audit Report for Motor Vehicle Parking Facilities Funds as made by Carney, Alexander, Marold and Company, C.P.As., be received and placed on file. Motion carried. 68180 - Under Council Action #68086 of 6/23/75 action on the Junk Dealer License Application of John L. Smith dba Midwest Paper Stock Com- pany at 2724 Lafayette Street was deferred. Mayor Rooff stated Mr. Smith was not opposed to moving and asked for 30 days to work out a plan, location and date. A discussion followed on disposition of property and inclusion in a temporary license a stipulation that yard must be kept clean. Moved by Wilharm, seconded by Roehr that the above application and bond for renewal Junk Dealer License, be received, placed on file and a temporary 30 day license, effective July 8, 1975, granted sub- ject to requirements of ordinance governing same. Motion carried. 68181 - Moved by Roehr, seconded by Getty that the communication from the City Engineer, transmitting Change Order No. 1 for Deere Engine Plant Trunk Extension, Contract No. 184, for additional work per- formed by F. A. Moser & Associates, Inc. at an additional cost of $1,350.00, be received, placed on file, approved and the Mayor and Clerk authorized to sign same. Mayor declared the motion carried. 68182 - Moved by Getty, seconded by Wilharm that the communication from the City Engineer, transmitting Treatment Agreement Form C 4/73 for Department of Environmental Quality, Water Quality Management Div- ision, in connection with Downtown Fourth Street Improvements, Con- tract No. 152, and recommending approval, be received, placed on file and Mayor and City Clerk instructed to execute same. Motion carried. 68183 - Moved by Getty, seconded by Roehr that Construction Permit No. 75- 165-S for Sanitary Sewer Extension, Contract No. 185, from Iowa De- partment of Environmental Quality, subject to certain conditions and requirements, be received and placed on file. City Attorney, transmitting Reimbursement Agreement dated 7/7/75 from Deere & Company for Westfield Avenue -McKinley Street Storm Sewer, Contract No. 92, be received, placed on file and Resolution No. 24042, approving and accepting said Agreement and authorizing the Mayor and City Clerk to execute the same, be adopted. COUNCILPERSON BERDELL NOW ABSENT 68185 - Moved by Roehr, seconded by Getty that communication from Housing and Rehabilitation Administration, transmitting HUD Forms 53105, - Contract of Sale and 5084, Contract for Inspection Services, exe- cuted and approved by Department of Housing and Urban Development, be received and placed on file. 68186 - Motion carried. William Young, 1000 Grant Avenue, was informed the major difference between R-3 and R-4 Multiple Residence Districts was the number of square feet in each apartment, in the area of parcel of ground, and allowance of professional offices. A discussion followed on possi- bility of rents being out of reach of elderly and fixed income people, traffic congestion, objection petition being signed by large majority of property owners in the area, more units would result in more people. Mr. Young stated there was no opposition to R-3 but to R-4. Councilman Wilharm explained the Council was in favor of additional housing for the elderly. An Ordinance amending Ordinance No. 2479, as amended, by adding Sub - Section No. 71, to Section 2A-5, rezoning certain property -in the City of Waterloo, Iowa, was read by the Clerk. Moved by Getty, seconded by Roehr that due to more than 207 objectors to said rezoning, absence of two Council members and the need of three-fourths of the Council, or six, to override the opposition, action be deferred until July 14, 1975. On roll call, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Berdell and Geiger. Mayor declared the motion carried. 68187 - An Ordinance amending Ordinance No. 2644, known as the Traffic Ord- inance of the City of Waterloo, Iowa, by repealing Subsection (2) of Section 543 entitled "Thru Streets" and Subsections (9), (48), (49), (61), (62) (63) and (64) of Section 541 entitled "Increasing speed limits in certain areas", and enacting in lieu thereof new Subsection (2) of Section 543 entitled "Thru Streets" and new Sub- sections (9) , (9a) , (48) , (49) , (61) , (62) and (64) of Section 541 entitled "Increasing Speed Limits in Certain Areas", was read by the Clerk. Moved by Keller, seconded by Getty that rules requiring ordinances to be read in full on three separate days be suspended (first under C.A.#68083 of 6/23/75), and now placed on its final adoption.
