The City Council of the City of Waterloo, Iowa, met in Regular Session in the Council Chambers in the City Hall in said City at 7:00 P.M. on June 23, 1975. Mayor Rooff in the Chair. Present: Absent: 68033 - Councilmen Berdell, Getty, Keller, Lichty, Roehr and Wilharm. Councilman Geiger. Moved by Wilharm, seconded by Lichty that due to the large number of people in attendance, the meeting be adjourned to the large courtroom in City Hall. Motion carried. THE COUNCIL NOW PRESENT IN THE LARGE COURTROOM. 68034 - Moved by Wilharm, seconded by Keller that the Agenda, as proposed, for the Regular Session of June 23, 1975 at 7:00 P.M., be accepted and approved. Motion carried. 68035 - Moved by Roehr, seconded by Wilharm that the Minutes of .•the Regular Session held June 16, 1975 at 7:00 P.M., be approved. Motion carried. 68036 - Moved by Roehr, seconded by Lichty that the proof of publication of the Notice of Public Hearing on Plans and Specifications and Pro- posed Form of Contract for the Chautauqua Park Area Paving, Sewer and Incidentals, Westfield -Virden Urban Renewal Project, Stage I, Contract No. 153, in the City of Waterloo, Iowa, be received and placed on file. Motion carried. 68037 - The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objection, or if there were any written objections filed with the Clerk. No one appeared to object orally, and the Clerk reported that no written objections had been filed. Thereupon, it was moved by Wilharm, seconded by Roehr that Resolution No. 23997, approving the plans and specifications, form of contract, etc. for the construction of the Chautauqua Park Area Paving, Sewer and Incidentals, Stage I, Westfield -Virden Urban Renewal Project, Contract No. 153, in the City of Waterloo, Iowa, be adopted. On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the resolution adopted. 68038 - Moved by Getty, seconded by Lichty that Resolution No. 23998, order- ing the construction of the Chautauqua Park Area Paving, Sewers and Incidentals, Stage I, Westfield -Virden Urban Renewal Area, Contract No. 153, in the City of Waterloo, Iowa, be adopted. On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the reso- lution adopted. 68039 - Moved by Wilharm, seconded by Getty that the proof of publication of Notice to Contractors or Invitation for Bids for construction of the Chautauqua Park Area Paving, Sewer and Incidentals, Westfield -Virden Urban Renewal Project, Stage I, Contract No. 153, in the City of Waterloo, Iowa, be received and placed on file. Motion carried. - 2 - 68040 - Rev. Motion carried. 68043 - Moved by Roehr, seconded by Lichty that the proof of publication of the Notice of Hearing on Proposed Resolution of Necessity for Street Improvements, in Waterloo, Iowa, 1975 New Sidewalk Program, Contract No. 42, be received and placed on file. Motion carried. 68044 - The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objection, or if there were any written objections filed with the Clerk. The Clerk reported written objections were filed as follows: 1. Francis J. Phillips, 111 Wallace Place, et al, objecting to Ridge- way Avenue, south side, from Baltimore Street to Edgemont Road; 2. Kathryn Bolt, 336 Monroe Street, et al, objecting to south side of Monroe Street between Arizona Street and Idaho Street; 3. Shirley M. Koslowski, 816 Archer Avenue, et al, objecting to west side of Idaho Street from Independence Avenue to Highway #20; 4. James R. Boyd, 337 Alta Vista Avenue, et al, objecting to Alta Vista Avenue from Arizona Street to Idaho Street; 5. Norbert J. Meyer, 312 Prospect Avenue, et al, objecting to 300 block of Prospect Avenue. Letter of support filed by: Supt. George H. Diestelmeier, Waterloo Community Schools. Moved by Wilharm, seconded by Lichty that the above objections and letter of support be received, placed on file. Motion carried. 68045 - Elda Dolash, 404 Wilshire Avenue, presented a petition of objection to the proposed sidewalk from Ridgeway Avenue to Hoover School. Moved by Getty, seconded by Roehr that the above petition be received and placed on file. Motion carried. 68046 - Mayor Rooff called for objections or support for Independence Avenue from Idaho Street to Hallowell Road. Speaking in support were: 1. Mrs. Robert Condon, 1568 Ruth Street 2. Mrs. PaulJay, PTA representative of the Mayor's Safety Committee. June 23, 1975 3 68046 (Continued) Jim Porter, Community Enabler supported building of sidewalks, but questioned there being no sidewalk in the opposite direction. Mayor Rooff briefly outlinedthe purpose of the Mayor's Safety Com- mittee, stressed the many long hours spent by the Committee in bring- ing the program to the Council for action, and thanked the members for a fine job done. Moved by Roehr, seconded by Lichty that Indpendence Avenue from Idaho Street to Hallowell Road be retained in the 1975 New Sidewalk Program, Contract No. 42 On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the motion carried. 68047 - Mayor Rooff called for objections or support for Idaho Street, from Independence Avenue going North. James Boyd, 337 Alta Vista Avenue, objected to Alta Vista Avenue from Arizona to Idaho. City Engineer Radue stated the written objections to Alta Vista Ave- nue represented 81% of assessable cost and on the west side of Idaho Street 48.2%. Speaking in support were: 1. William O'Connor, Waterloo Public School Administration; 2. Mrs. Robert Condon, School PTA President; 3. Russell Burt, Chairman of Mayor's Safety Committee. Jim Porter, Community Enabler, questioned sidewalk on both sides of the street and supported sidewalk on one side twice the length pro- posed. A discussion followed on extending the Idaho Street sidewalk under the viaduct and joiningthe existing sidewalk; also Alta Vista Avenue and Prospect Avenue were taken into consideration. Moved by Wilharm, seconded by Roehr that the above objections be re- ceived, placed on file, and action on Idaho Street, Alta Vista Avenue and Prospect Avenue deferred to June 30, 1975, for meeting with the Safety Committee. On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the motion carried. 68048 - The Engineers, having checked the bids submitted for the Chautauqua Park Area Paving, Sewer and Incidentals, Westfield -Virden Urban Re- newal Project, Stage I, Contract No. 153, reported that after check- in the extensions and totals of the bids, the bid of Cedar Falls Construction Co. of Cedar Falls, Iowa, in the amount of $299,945.31 was the lowest legal bid received. Moved by Keller, seconded by Wilharm that Resolution No. 23999, ac- cepting the bid of Cedar Falls Construction Co. of Cedar Falls, Iowa in the amount of $299,945.31 for the construction of the Chau- tauqua Park Area Paving, Sewers and Incidentals, Westfield -Virden Urban Renewal Project, Stage I, Contract No. 153, in the City of Waterloo, Iowa, be adopted, subject to the appoval of the Department of Housing and Urban Development. On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the reso- lution adopted. June 23, 1975 - 4 - 68049 - Objections or support were called for Madison Street, Monroe Street and Idaho Street from Independence Avenue south. City Engineer reported as follows: 1. On Idaho Street from Independence Avenue to Highway #20, no ob- jections on east side, and objections on west side between Monroe Street and Highway represented 53.6%; 2. Monroe Street, none; 3. Madison Street and Polk, 100% 4. French and Archer, 34.9% (six lots belong to the City). Oral objections were made by: 1. Violet Utsler, 316 French Street; 2. Shirley Koslowski, 816 Archer Avenue; 3. James Reidy, 318 Arizona Street. Speaking in support were: 1. Mrs. PaulJay, PTA representative on Mayor's Safety Committee; 2. Mrs. Robert Condon, School PTA President. Moved by Roehr, seconded by Lichty that the above objections be re- ceived, placed on file, and action deferred until June 30, 1975, for further study. On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the motion carried. 68050 - Objections or support were called for Rainbow Drive from Hackett Road east to existing north side; Oral objections were made by: 1. Rev. C. H. Pettersen, 1712 Rainbow Drive; 2. Mrs. Cora Podhaski, 1726 Rainbow Drive; 3. Mrs. Barton Cobie, 1720 Rainbow Drive; 4. Arthur Weiland, 103 De Sota Avenue. A discussion followed, which included the crossing signal at Spieker Road and Rainbow Drive. Moved by Lichty, seconded by Getty that the above objections be re- ceived, placed on file and sustained. On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the motion car- ried. 68051 - Objections or support were called for Ninth Street from Ridgeway Avenue to St. Francis Drive. Oral objection was made by: 1. Francis Cox, 3037 W. Ninth Street, if water flow was restricted. City Engineer Radue reported this would be taken care of. Moved by Roehr, seconded by Berdell that the above objections, be re- ceived, placed on file and Ninth Street from Ridgeway Avenue to St. Francis Drive retained in the 1975 New Sidewalk Program, Contract No. 42 On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the motion carried. June 23, 1975 - 5 - 68052 Objections and support were called for Hillcrest Road from Hoover School to Ridgeway Avenue: Oral objections were made by: 1. Mary Jane Sevatson, 407 Hillcrest Road, spokesman for 53 signers of objection petition; 2. James Salz, 506 Hillcrest Road. City Engineer Radue reported objections on west side represented 7370 and east side 887. Moved by Keller, seconded by Lichty that the above objections be re- ceived, placed on file, and sustained. On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the motion carried. 68053 - Next was, Ridgeway Avenue on both sides of Baltimore Avenue, Edgemont Road and Kimball Avenue, and south side of Kimball Avenue to Hill- crest Road. Oral objection was made by: Francis Phillips, 111 Wallace Place City Engineer reported objections between Baltimore Street and Edge- mont Road represented 63%, to Kimball Avenue 37.67, south side 22%, with no objections on north side. Moved by Getty, seconded by Keller that the above objections be re- ceived, placed on file, objections sustained for Ridgeway Avenue from Baltimore Avenue to Edgemont Road on the south side only, and the rest of Ridgeway Avenue from Baltimore Avenue to west edge of Lot 181, Crestview Second Addition on south side retained in the 1975 New Sidewalk Program. On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the motion carried. 68054 Kimball Avenue from Ridgeway Avenue to Mitchell Avenue on east side only was considered. Moved by Getty, seconded by 14.cht.y that Kimball Avenue from Ridgeway Avenue to Mitchell Avenue on east side only be included in the 1975 New Sidewalk Program, Contract No. 42. On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the motion carried. 68055 - Moved- by Roehr, seconded by Lichty that the hearing on the 1975 New Sidewalk Program, Contract No. 42, be closed to futher objections and adjourned to June 30, 1975 at 7:00 P.M. in the Council Chambers in City Hall in the City of Waterloo, Iowa, at which time action will be taken on (1) streets -tabled (2) resolution overruling and/or sus- taining objections, (3) and resolution adopting resolution of neces- sity, as proposed or as amended. On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared motion carried. 68056 - Moved by Roehr, seconded by Getty that the proof of publication of the notice of public hearing to vacate an unopened alley lying north of West Wellington Street between relocated Randall Street and U.S. Highway No. 63, being all the alley lying south of Lots 1 and 2 and north of Lots 19, 20 and 21 in Block 3, West Park Addition, as fully described in the Waterloo Daily Courier published on May 29 and June 5, 1975, be received and placed on file. Thereupon, it was moved by Getty, seconded by Roehr that an Ordinance be drawn and submitted vacating an unopened alley lying north of West Wellington Street between relocated Randall Street and U.S Highway No. 63, being all the alley lying south of Lots 1 and 2 and north of Lots 19, 20 and 21 in Block 3, West Park Addition, in the City of Waterloo, Iowa, as described in the published notice in the Waterloo Daily Courier on May 29 and June 5, 1975. Motion carried. 68058 - An Ordinance vacating an unopened alley lying north ton Street between relocated Randall Street and U.S. being all the alley lying south of Lots 1 and 2 and 19, 20 and 21 in Block 3, West Park Addition in the Iowa, was read by the City Clerk. Moved by Roehr, seconded by Lichty that said Ordinance be recorded as having passed its first reading. On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Mayor declared the motion carried. of West Welling - Highway No. 63, north of Lots City of Waterloo, 68059 - Moved by Getty, seconded by Roehr that the proof of publication of the Notice of Public Hearing to vacate a certain easement south 100' of NE4 of SE4 of Section 12 -88N -13W, lying east of U.S. Highway No. 218, east of LaPorte Road and SWly of Cedar Terrace Drive, as fully described in the publication in the Waterloo Daily Courier on May 29 and June 5, 1975, be received and placed on file. Motion carried. 68061 - An Ordinance vacating a certain easement south 100' of NE4 of SE4 of Section 12 -88N -13W, lying east of U.S. Highway No. 218, east of La- Porte Road and SWly of Cedar Terrace Drive, was read by the City Clerk. Moved by Lichty, seconded by Roehr that the rules requiring ordinan- ces to be read in full on three separate days be suspended, said Ordinance be recorded as having passed its first, second and third readings, and now placed on its final adoption. June 23, 1975 - 7 - 68062 - Moved by Wilharm, seconded by Roehr that Ordinance No. 2747, an Ord_ inance vacating a certain easement south. 100' of NE% of SE4 of Sec- tion 12 -88N -13W, lying east of U.S. Highway No. 218, east of LaPorte Road and SWly of Cedar Terrace Drive, be adopted. On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the ord-, inance adopted. 68063 - Moved by Getty, seconded by Keller that the communication from the City Plan and Zoning Commission, transmitting Final Plat of Cedar Crest, Waterloo, Iowa, a copy of Resolution adopted by said Com- mission approving the Plat, Engineer's Certificate of Survey, Deed of Dedication, Report of City Engineer, Waiver of Assessment, and Contract for installation of sewers and street improvements, and recommending approval, be received, placed on file and Resolution No. 24000,approving said Final Plat, adopted. Mayor declared the resolution adopted. 68064 - Moved by Keller, seconded by Getty that the proof of publication of the Notice of Public Hearing on Proposal to Sell Real Estate in the City of Waterloo, Iowa, known as Disposal Parcel No. I -2(p) in the Westfield -Virden Urban Renewal Area, Project No. Iowa R-7, 135 Argyle Street, to Wayne Michael Jamieson and Dorothy Ann Jamieson, as fully described in the said notice published in the Waterloo Daily Courier on May 22, 1975, be received and placed on file. Motion carried. 68065 - The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objection, or if any written objections had been filed with the Clerk. No one appeared to object orally, and the City Clerk reported there had been no written objections placed on file. Moved by Getty, seconded by Berdell that Resolution No. 24001, a res- olution approving the sale of Disposal Parcel No. I -2(p) in the West- field -Virden Urban Renewal Area, Project Iowa R-7, and authorizing the execution of the necessary contract for sale of land for private redevelopment and deed, be adopted. Mayor declared the reso- lution adopted. 68066 - Moved by Getty, seconded by Berdell that the proof of publication of the Notice of Hearing on Proposed Amended Budget 1974-1975 Fiscal Year, as published in the Waterloo Daily Courier on June 11, 1975, be received and placed on file. Motion carried. 68067 - The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objection, or if there were any written objections filed with the Clerk. Mayor declared the motion carried. 68068 Moved by Getty, seconded by Lichty that the communication from the Building Official, transmitting the following bids for the demolition of the dwelling at 914 Logan Avenue, and recommending the acceptance of the bid of Earl Hanson Excavating, Evansdale, Iowa, in the amount of $930.00, be received, placed on file and Resolution No. 24002, ac- cepting the bid of Earl Hanson Excavating, Evansdale, Iowa, in the amount of $930.00 for the demolition of the dwelling at 914 Logan Avenue, in the City of Waterloo, Iowa, adopted. Mayor declared the resolution adopted. 68069 - Jay Roberts, Atty. in behalf of property owners on Monticello Ave- nue, Ridgemont Road and Ansborough Avenue, presented a petition ob- jecting to Sunnyside Temple's bus parking as a nuisance and eyesore and requested, (1) The Council investigate; (2) If in violation, Council do something about it and direct the City Attorney; (3) Check plans to see if complied with; (4) There be better supervision to make sure rules and regulations are complied with. He reported a legitimate effort has been made to contact Rev. Polston, who has not returned the calls, and the attitude of the Assistant was "Haven't you ever gone back on your word". He stated the people re- lied on the plans being adhered to or they would have objected. City Plan and Zoning Director Gunderson reported at the time of ap- plication, the original church plans were twice as large, they assu- red the Commission there would be no parking of buses at the church and the buses would be parked at a location on the south side of Highway #412. Moved by Getty, seconded by Berdell that the petition be received, placed on file and referred to the City Attorney and to the Plan and Zoning Commission to be brought back in two weeks. June 23, 1975 - 9 - 68070 - Street repairs of East Shaulis Road and Cedar Terrace Drive were brough up and Mayor Rooff .reported action would be taken further on in the agenda. 68071 - Susannah Hoag spoke in support of the petition to rezone from C-2 Commercial District to R-1 One and Two Family Residence District the area abutting Littlefield Road, Sheerer Avenue and Flower Street. Mayor Rooff stated he and the Council was sympathetic to her cause but did not know the ramifications and would need legal opinion. Moved by Roehr, seconded by Lichty that the petition of Susannah J. Hoag, 1001 Sheerer Avenue, et al, for rezone of a portion of Lots 6, 7, 8, 9, 10, 11, 12 and 13, abutting Littlefield Road on the east, Sheerer Avenue on the west, and Flower Street on the south, from "C-2" Commercial District to "R-1" Residence District, be received, placed on file and referred to the City Zoning Commission. Motion carried. 68072 - Moved by Keller, seconded 1y Lichty that the communication from the City Plan and Zoning Commission, transmitting the request from Frank Zubak and James Kirsch for the Council on its own motion to rezone Lots 357, 358, 359 and 360, Pleasantview Addition (north of Plymouth Avenue and west of LaPorte Road (U.S. Hwy. #218) from "R-2" One and Two Family Residence District to "C-2" Commercial District, as shown on the attached plat, and recommending approval subject to 17' of right-of-way being obtained on LaPorte Road for necessary widening of that major thoroughfare, be received, placed on file, recommenda- tions approved, date of hearing set as July 14, 1975 at 7:00 P.M. and the Clerk instructed to publish the necessary notice. Motion carried. 68073 - Moved by Keller, seconded by Lichty that the communication from the City Plan and Zoning Commission, transmitting the request of P. H. Petersen to vacate a dead end and unopened alley lying NWly of West 17th Street between Jefferson Street and Bluff Street, as shown on the attached plat, and recommending vacation, but not sold as alley is in the proposed right-of-way of the future inter -city freeway, be received, placed on file and Resolution No. 24003, fixing the time and place of hearing and notice to be given relative to the vacation of said dead end and unopened alley as July 21, 1975 at 7:00 P.M. in the Council Chambers of the City Hall, and instructing the Clerk to publish the notice of hearing, adopted. On roll call, Berdell, Getty, Keller, Lichty, Roehr .and Wilharm voted Aye. Nay: None. Absent: Geiger.
