The City Council of the City of Waterloo, Iowa, met in Regular Session in
the Council Chambers in the City Hall in said City at 7:00 P.M. on June 9,
1975
Mayor Rooff in the Chair.
Present: Councilmen Berdell, Geiger,
Absent: Councilman Keller.
Getty, Lichty, Roehr and Wilharm.
Councilman Harold E. Getty offered the invocation.
67931 - Moved by Roehr, seconded by Getty that the Agenda, as proposed, for
the Regular Session of June 9, 1975 at 7:00 P.M., be accepted and
approved.
Motion carried.
67932 - Moved by Wilharm, seconded by Getty that the Minutes of the Regular
Session held June 2, 1975 at 7:00 P.M., be approved.
Motion carried.
67933 - Moved by Roehr, seconded by Wilharm that the proof of publication of
the Notice of Public Hearing on Proposal to Sell Real Estate in the
City of Waterloo, Iowa, known as Disposal Parcel No. 35 in the Logan
Avenue Urban Renewal Area, Project Iowa R-2, Northeast corner of
Highway 63 and Newell Street, to Waterloo, Iowa Congregation of
Jehovah's Witnessess, as fully described in the said notice published
in the Waterloo Daily Courier on May 8, 1975, be received and placed
on file.

resolution approving the sale of Disposal Parcel No. 35 in the Logan
Avenue Urban Renewal Area, Project Iowa R-2, and authorizing the ex-
ecution of the necessary contract for sale of land for private re-
development and deed, be adopted.
On roll call, Berdell, Geiger, Getty, Lichty, Roehr and Wilharm voted
Aye. Nay: None. Absent: Keller. Mayor declared the resolution
adopted.
67935 - Moved by Getty, seconded by Wilharm that the twenty (20) applications
for permission to sell cigarettes at various locations in the City of
Waterloo, Iowa, be received, placed on file, approved and the permits
granted.
Motion carried.
67936 - Mayor Rooff reported the contract of sale between Wendell Lockard
Construction, Inc. and the City for construction of 50 units of
housing for the elderly in the Kimball Avenue and Ridgeway Avenue
Area, was signed today and ground breaking would take place at 9:00
A.M. Thursday, of this week.
Housing and Rehabilitation Director Parsons presented a resolution
for adoption, stating this would ratify and confirm the above action.
Moved by Wilharm, seconded by Getty that Resolution No. 23955, a
resolution of the City Council of the City of Waterloo, Iowa, approv-
ing and confirming a contract of sale between Wendell Lockard Con-

struction, Inc. and the City of Waterloo, Iowa, relative, to a
turnkey project known as Iowa 50-3 for low rent housing for the
elderly at Ridgeway and Kimball Avenue, Waterloo, Iowa, be adopted.

Nay: Lichty. Absent: Keller. Mayor declared the resolution
adopted.
67937 Mayor Rooff recognized Park Commissioner Mike Zegarac and Park
Director Leonard Katoski who were in attendance.
67938 - Moved by Roehr, seconded by Geiger that the communication from the
City Engineer, transmitting the request of Josephine Passas, toget-
her with five (5) copies of the Iowa State Highway Commission's
Form #559 with sketch attached, for permission to construct a 35'
Type "B" (Curb Drop) Entrance to U.S. Highway 218 at Sta. 792+31,
southerly side, approximately 186.0' easterly of U.S. Highway 218
and Ohio Street intersection, and recommending approval subject
to the provisions of this letter, be received, placed on file,
recommendations approved, permission granted in accordance there-
with and the Mayor and City Clerk authorized to sign said appli-
cation in behalf of the City of Waterloo.

67939 - Moved by Getty, seconded by Berdell that the communication from the
City Engineer, transmitting (1) a request from Canfield Develop-
ment Corporation for permission to construct a sanitary sewer to
serve their property located between Airline Highway and U.S. High-
way #20 at the Airport Road, (2) construction plans, (3) Iowa State
Highway Commission Form #562 with sketch attached, and (4) Treat-
ment Agreement Form C4/73 with the Department of Environmental Qual-
ity, Water Quality Management Division, and recommending approval with
final acceptance of attached plans subject to review by said Depart-
ment, be received, placed on file, recommendations approved, said re-
quest, construction plans, Iowa State Highway Commission Form #562
and Treatment Agreement. Form C4/73 approved in accordance therewith,
and the Mayor and City Clerk authorized to sign said Form ##562 and
Form C4/73 in behalf of the City of Waterloo.

67940 - Moved by Getty, seconded by Wilharm that the communication from the
City Plan and Zoning Commission, transmitting the request, attached
print and proposed ordinance from the Community Development Admin-
istrator for the vacation of part of excess street right-of-way in
700 block of Falls Avenue in the Westfield -Virden Urban Renewal Pro-
ject Iowa R-7 Area, and recommending approval, be received, placed
on file and Resolution No. 23956, fixing the time and place of hear-
ing and notice to be given relative to said vacation as June 30,
1975 at 7:00 P.M. in the Council Chambers of the City Hall, and in-
structing the Clerk to publish the required notice of hearing,
adopted.
On roll call, Berdell, Geiger, Getty and Wilharm voted Aye. Nay:
Lichty and Roehr. Absent: Keller. Mayor declared the resolution
adopted.
67941 - Councilman Wilharm presented the request of the Church Council of
St. Ansgar's Lutheran Church, 1122 West llth Street, for installa-
tion of storm sewer in Hawthorne Avenue from Ninth Street to Eleventh
Street.
Moved by Wilharm, seconded by Getty that :the above request be re-
ceived, placed on file and referred to the City Engineer.
Motion carried.
67942 - Moved by Wilharm, seconded by Getty that the communication from the
Finance Director transmitting the General Revenue Sharing Planned
Use Report for Sixth Entitlement Period July 1, 1975 through June
30, 1976, be received, placed on file, approved and Resolution No.
23957, directing the City Clerk to publish the notice of Revenue
Sharing Planned Use, be adopted.
On roll call, Berdell, Geiger, Getty, Lichty, Roehr and Wilharm voted
Aye. Nay: None. Absent: Keller. Mayor declared the resolution

Hennessey Bros., Inc., Marion, Iowa, in the amount of $37,396.50 for
the Hollywood Avenue, Hammond Avenue and Colorado Street Sanitary
Sewers and Castle Street Storm Sewer, Contract No. 185, be received,
placed on file and Resolution No. 23958, approving said Contract and
Bond, adopted.

Aye. Nay: None. Absent: Keller. Mayor declared the resolution
adopted.
67945 - Fedon Petrides, Engineer, explained the contract changes were due to
changes in guidelines and regulations, but the contract amount re-
mained the same.
Moved by Getty, seconded by Lichty that the five (5) copies of the
revised Contract with Brice, Petrides & Associates, Inc. for Engi-
neering Services in conjunction with the construction of an inter-
ceptor sewer system along Highway No. 63 and pumping station, be re-
ceived, placed on file and Resolution No. 23959, approving and di-
recting the execution of said Contract by the Mayor and City Clerk
in behalf of the City of Waterloo, Iowa, be adopted.
On roll call, Berdell, Geiger, Getty, Lichty, Roehr and Wilharm
voted Aye. Nay: None. Absent: Keller. Mayor declared the reso-
lution adopted.
67946 - Moved by Roehr, seconded by Getty that the Contract with Wayne
Claassen Engineering & Surveying, Inc. for engineering services for
the 1975 Street Paving Program, Contract No. 135, be received, placed
on file and Resolution No. 23960, approving and directing the execu-
tion of said Contract by the Mayor and City Clerk in behalf of the
City of Waterloo, Iowa, adopted.
On roll call, Berdell, Geiger, Getty, Lichty, Roehr and Wilharm voted
Aye. Nay: None. Absent: Keller. Mayor declared the resolution
adopted.
67947 - Councilman Wilharm questioned the purpose of having a private alley
if a person couldn't park in it; also, if a person had a private
alley what would prevent him from extending the building over the
alley.
City Atty. Smith said there usually was a perpetual easement to the
City, a person could own the alley, but everyone could use it. He
stated the fire zone was on private and public alleys.
Walter Clark informed the Council a car check had been made and en-
forcement of the parking ordinance was not equal.
An Ordinance amending Ordinance No. 2644, known as the Traffic Ord-
inance of the City of Waterloo, Iowa, by, repealing Subsections (14)
and (15) of Section 273 entitled "Stopping, Standing, or Parking",
and enacting in lieu thereof new Subsections (14) and (15) of Sec-
tion 273 entitled "Stopping, Standing, or Parking", was read by the
Clerk.
Moved by Roehr, seconded by Lichty that said Ordinance be recorded as
having passed its second reading (the first having passed under Coun-
cil Action #67903 of 6/2/75).

67948 - An Ordinance creating a Plan and Program Commission in the City of
Waterloo, Iowa, was read by the Clerk.
Moved by Getty, seconded by Wilharm that said Ordinance be recorded
as having passed its second reading (the first having passed under
Council Action #67901 of 6/2/75).
On roll call, Berdell, Geiger, Getty, Lichty, Roehr and Wilharm
voted Aye. Nay: None. Absent: Keller. Mayor declared the
motion carried.
67949 - An Ordinance creating a Zoning Commission in the City of Waterloo,
Iowa, and providing for the appointment of members thereof, was read
by the Clerk.
Moved by Getty, seconded by Berdell that said Ordinance be recorded
as having passed its second reading (the first having passed under
Council Action #67902 of 6/2/75).
On roll call, Berdell, Geiger, Getty, Lichty, Roehr and Wilharm
voted Aye. Nay: None. Absent: Keller. Mayor declared the motion
carried.
67950 - Moved by Wilharm, seconded by Getty that the communication from the
Board of Park Commissioners, transmitting a proposed "Ordinance re-
establishing the Board of Park Commissioners as an administrative
agency under the Code of Ordinances, City of Waterloo", be received
and placed on file.
Motion carried.
67951 - Mike Zegarac, Chairman of the Park Board, reported the proposed ord-
inance would allow the Commissioners to continue to operate as per-
mitted under Home Rule. Mayor Rooff pointed out that the biggest
change was the Commissioner would not be elective office but an ap-
pointive office.
Councilman Wilharm commended the Park Board on the outstanding j'.ob
done on the park system.
An Ordinance re-establishing the Board of Park Commissioners as an
administrative agency under the Code of Ordinances, City of Waterloo,
was read by the Clerk.
Moved by Wilharm, seconded by Lichty that said Ordinance be recorded
as having passed its first reading.
On roll call, Berdell, Geiger, Getty, Lichty, Roehr and Wilharm
voted Aye. Nay: None. Absent: Keller. Mayor declared the motion
carried.
67952 - An Ordinance amending Ordinance No. 2446, as amended, known as the
Milk Ordinance by repealing all of Section 5-A Inspection Fees and
enacting in lieu thereof new Section 5-A Inspection Fees, was read
by the Clerk.
Moved by Wilharm, seconded by Lichty that action be deferred to June
16, 1975.
On roll call, Berdell, Geiger, Getty, Lichty, Roehr and Wilharm
voted Aye. Nay: None. Absent: Keller. Mayor declared the motion
carried.
67953 - Moved by Roehr, seconded by Getty that Resolution No. 23961, a reso-
tion authorizing the transfer of funds in the special assessment funds

lution authorizing the transfer of the funds in the special assess-

of Waterloo, Iowa, be adopted.

sign fee for the West Park Avenue Area Paving, Sewers and Incidentals,
Contract No. 147, and recommending approval, be received, placed on
file and Resolution No. 23965, approving the statement of said firm
and authorizing and certifying payment accordingly, be adopted.

Click Club would be repaired as soon as the roof dried out.

Asst. Building Official, transmitting an Agreement dated 2/14/75 by
Roth Bryant, owner of Big Pete's Click Club, 420 Shilliam Street, in
which he agreed to do certain work by 6/1/75, or beer permit would be
rescinded until such time as the work was completed, and reporting
on 6/2/75 the work had not been done, be received, placed on file
and a time extension of 30 days to July 9, 1975, granted.
