The City Council of the City of Waterloo, Iowa, met in Regular Session in the Council Chambers in the City Hall in said City at 7:00 P.M. on June 2, 1975. Mayor Rooff in the Chair. Present: Councilmen Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm. Absent: None. Councilman Robert R. Wilharm offered the invocation. 67867 - Moved by Roehr, seconded by Getty that the Agenda, as amended, for the Regular Session of June -2, 1975 at 7:00 P.M., be accepted and approved. Motion carried. 67868 Moved by Geiger, seconded by Lichty that the Minutes of the Regular Session held May 27, 1975 at 7:00 P.M., be approved. Motion carried. 67869 Moved by Roehr, seconded by Lichty that the proof of publication of the Notice of Public Hearing to vacate the unopened alley lying par- allel to and NWly of C.N.W.R.R. right-of-way between Ansborough Ave- nue and Home Park Boulevard, as fully described in the publication in the Waterloo Daily Courier on May 8 and 15, 1975, be received and placed on file. Motion carried. 67870 - The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objection, or if any written objections had been filed with the Clerk. No one appeared to object orally, and the Clerk reported no written objections had been filed. Thereupon, it was moved by Getty, seconded by Geiger that an Ordin- ance be drawn and submitted vacating the unopened alley lying par- allel to and NWly of C.N.W.R.R. right-of-way between Ansborough Avenue and Home Park Boulevard, as fully described in the published notice in the Waterloo Daily Courier on May 8 and 15, 1975. Motion carried. 67871 - An Ordinance vacating the unopened alley lying parallel to and North- westerly of C.N.W.R.R. right-of-way between Ansborough Avenue and Home Park Boulevard, in the City of Waterloo, Iowa, was read by the Clerk. Moved by Roehr, seconded by Lichty that the rules requiring ordin- ances to be read in full on three separate days be suspended, said Ordinance be recorded as having passed its first, second and third readings, and be now placed on its final adoption. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 67872 - Moved by Getty, seconded by Keller that Ordinance No. 2740, an Ord- inance vacating the unopened alley lying parallel to and Northwesterly of C.N.W.R.R. right-of-way between Ansborough Avenue and Home Park Boulevard, in the City of Waterloo, Iowa, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 67876 - Moved by Wilharm, seconded by Lichty that Ordinance No. 2741, an Ordinance vacating an easement on the Northwesterly 6' of Lot 45, Waterloo Country Club Addition, located West of Inverness Road near its intersection with Ridgemont Road, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the ordinance adopted. 67877 - Moved by Roehr, seconded by Lichty that the communication from the Building Official recommending approval of the bid of J. L. Rooff, Jr. in the total amount of $1,275.00 for the demolition of the Dwelling only at 2532 West Third Street and Dwelling and Accessory Buildings including Garages at 2580 West Third Street, in connec- tion with the Black Hawk Creek Flood Dike, be received, placed on file and Resolution No. 23938, accepting the bid of J. L. Rooff, Jr., Waterloo, Iowa, in the total amount of $1,275.00 for the above demolition of buildings in the City of Waterloo, Iowa, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67878 - Mayor Rooff reported that emergency replacement of the police com- munications tower and antennaes was necessary due to the collapse of existing tower and antennaes. Moved by Keller, seconded by Getty that Resolution No. 23939, a Resolution of Necessity to institute emergency proceedings for the replacement of the police communications tower and antennaes, be adopted. Mayor declared the resolution adopted. 67879 - Moved by Wilharm, seconded by Roehr that the Certificate certifying the necessity of emergency replacement of the police communication tower and antennas, dated 5/30/75, from James V. Lyson, Registered Professional Engineer, be received and placed on file. Motion carried. 67880 - Moved by Wilharm, seconded by Keller that the following bids for the purchase of police communications tower and antennaes, be received, placed on file and Resolution No. 23940, approving the acceptance of the bid of Radio Communications Company, Waterloo, Iowa, in the amount of $27,366.00 for the police communications tower and anten- naes, and authorizing the Finance Director to draw a warrant in pay- ment therefor, be adopted: Bidder Amount Advance Industries, Sioux City, Iowa Motorola Communications & Electronics, Inc., Schaumberg, Illinois Radio Communications Co., Waterloo, Iowa Pi -Rod Tower, Plymouth, Indiana Rohn Communication Facilities Co., Inc., Peoria, Illinois $45,863.00 $39,983.00 $27,366.00 $28,996.00 $32,080.00 On roll call, Berdell, Geiger, Getty, Keller,Lichty, Roehr and Wilharm voted Aye. Mayor declared the resolution adopted. 67881 - Mayor Rooff recognized Mr. and Mrs. Peter Livesey, in-laws of Councilman Getty, visiting from London, England. 67882 Mayor Rooff recognized Bobby Stultz, student from Irving School, who was in attendance at the Council meeting. 67883 A petition, containing 81 signatures, requesting an embargo be pla- ced on heavy truck traffic on Louise Street between Logan Avenue and East Fourth Street was presented, with the information that Trucks were tearing up Louise Street. Mayor Rooff said this would be checked by the City Engineer. Moved by Getty, seconded by Lichty that the above petition be re- ceived and placed on file. Motion carried. 67884 Councilman Wilharm presented the petition of James Potter, 2140 Ansborough Avenue, and 61 others, residents of Parkview Gardens plot area, requesting installation of either four way stop signs or two way stop signs or yield signs on Westview Avenue due to num- erous accidents at the intersection of Upland Avenue and Westview Avenue, together with traffic count showing 163 vehicles, 16 child- ren and 4 trucks on Tuesday between 3:20 P.M. and 5:30 P.M., 55 vehicles, 20 children and 3 trucks on Thursday between 3:25 P.M. and 4:10 P.M., and 54 vehicles, 11 children and 2 trucks on Friday between 4:45 P.M. and 6:35 P.M. Moved by Roehr, seconded by Geiger that above petition be received and placed on file. Motion carried. June 2, 1975 - 4 - 67885 - Harland Cook, New York Life representative, asked reconsideration of the acceptance of the Blue Cross -Blue Shield proposal to provide health insurance for city employees, supported by Roger Svatos of NYL's Des Moines office, who reported on the computation of rates used. Councilman Keller stated the Finance Committee took the recommenda- tion of the consultant, F.A. Borawaski of Associated Advisors, Inc., and Mayor Rooff read the recommendation for renewal with Blue Cross - Blue Shield and substantiating reasons for same. Councilman Wilharm pointed out the Finance Committee went by the Consultant's recommendation as the members were not insurance oriented, and felt the City should honor the commitment to Blue Cross -Blue Shield which has given good service. Councilman Berdell stated there was more to consider than just the figures, such as the quality of service, the experience, the consul- tant's recommendation, etc. New York Life Representative Svatos stated if there was a change in the number of employees, his firm's proposal was not valid and would have to be requoted. A discussion followed on the employees census figures used by New York Life and Blue Cross -Blue Shield in their proposals and resub- mission of new porposals. Paul Rose, Blue Cross -Blue Shield representative, spoke on BC -BS proposal. Moved by Getty, seconded by Keller that the Council concur with the Finance Committee in accepting Blue Cross -Blue Shield proposal. Motion carried. 67886 - Building Official Tusler presented a petition from Jean Heckenlively, 214 East 10th Street, etal, residents of East 10th Street and Syca- more Street, that the buildings on the corner of East 10th Street and Sycamore Street are dangerous to the neighborhood and children and are a fire hazard. Moved by Roehr, seconded by Lichty that the above petition be re- ceived and placed on file. Motion carried. 67887 - Councilman Getty request that Council Action #67858 of 5/27/75 be reconsidered and the application of Roy Reynolds dba Roy's Rib House for a beer and liquor license at 1400 East Fourth Street, be approved. Moved by Getty, seconded by Wilharm that the above request be recei- ved, placed on file and Council Action #67858 of 5/27/75 rescinded. On roll call, Getty, Lichty, Roehr and Wilharm voted Aye. Nay: Berdell, Geiger and Keller. Absent: None. Mayor declared the motion carried. 67888 - Mildred and Kenison Hayes, 227 Adams Street, and other area resi- dents protested, citing parking and traffic problems, additional liter and rowdiness in Sullivan Park, and beer and liquor already being available on another corner. John Walker, Atty. for Roy Reynolds, stated the establishment would not have a bar ox entertainment, would not detract from the neighbor- hood or cause problems, and would be the best alternate for use of the building. A discussion followed on parking requirements and Sullivan Park. June 2, 1975 5 67888 - (Continued) Moved by Roehr, seconded by Wilharm that the application of Roy Reynolds dba Roy's Rib House for a Class "C" Beer and Liquor Lic- ense for 1400 East Fourth Street, in the City of Waterloo, Iowa, be received, placed on file and permission granted subject to the building being approved by the various inspectors, and Resolution No. 23941, approving said application, adopted. On roll call, Getty, Lichty, Roehr and Wilharm voted Aye. Nay: Berdell, Geiger and Keller. Absent: None. Mayor declared the resolution adopted. 67889 - Moved by Roehr, seconded by Lichty that the report of the City Engineer, on the petition of Norwin Freudenberg, 2321 Idaho Street, etal, for the paving of Anthony Street from Idaho Street to Neville Street, representing 51% of the total frontage, referred to him under Council Action #67710 of 5/12/75, be received and placed on file, and the City Engineer instructed to consider this petition in the 1976 paving program. Motion carried. 67890 - Under Council Action #67837 of 5/27/75 action was deferred on the request of W. Louis Beecher, Atty. for Jack Jacobs & Company, for a commercial access off of East Ridgeway Avenue near Fire Station No. 8 to serve the K -Mart site, and was now presented for consideration. Mayor Rooff reported on a meeting between W. Louis Beecher, Fred Debe, City Engineer and himself, a workable compromise was reached and the recommendation was to allow this curb cut. Fred Debe briefly reported on past happenings and pointed out the access being requested, stating there would be no additional curb cut requests in the foreseeable future. Moved by Keller, seconded by Wilharm that above request of W. Louis Beecher, Atty. for Jack Jacobs & Company, for a commercial access off of East Ridgeway Avenue near Fire Station No. 8 to serve the K -Mart site.be approved and the Mayor and City Clerk authorized to sign Iowa State Highway Commission Form #473 "Application for Ap- proval to do Grading and Build Drainage Structures Incidental There- to Within the State Road Right of Way" in behalf of the City of Waterloo, Iowa. On roll call, Berdell, Geiger, Getty, Keller, Roehr and Wilharm voted Aye. Nay: None. Abstained: Lichty. Absent: None. Mayor declared the motion carried. 67891 - Moved by Getty, seconded by Wilharm that the communication from the Community Development Administrator, transmitting Contract and Bond with Cedar Valley Corporation, Waterloo, Iowa, in the amount of $812,324.83 for the West Park Avenue Area, Westfield -Virden Urban Renewal Project R-2, Contract No. 147, be received, placed on file and Resolution No. 23942, approving said Contract and Bond, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67892 - Moved by Roher, seconded Watco Construction, Inc. Sewer District, Contract received, placed on file Contract and Bond, be ad by Lichty that the Contract and Bond with , Waterloo, Iowa, for the Wren Road Storm No. 89, in the amount of $78,949.98, be , and Resolution No. 23943, approving said opted. June 2, 1975 - 6 - 67893 Moved by Wilharm, seconded by Roehr that the communication from the City Engineer, transmitting construction plans for sanitary sewer facilities to serve Cedar Terrace Fourth Addition, Lots 2, 3, 21, 22 and 23, and Treatment Agreement Form C 4/73 with the Department of Environmental Quality, Water Quality Management Division, and recommending approval with final acceptance of attached plans sub- ject to review by said Department, be received, placed on file, recommendations approved and the Mayor and City Clerk authorized to execute said Agreement Form in behalf of the City of Waterloo, Iowa. Motion carried. 67894 - Moved by Roehr, seconded by Lichty that the communication from the City Engineer, transmitting Storm Sewer Construction and Mainten- ance Easements dated 6/2/75 from Deere & Company for Westfield Ave- nue-Mckinley Storm Sewer, Contract No. 92, and recommending approval, be received, placed on file, approved and accepted, and the Mayor and City Clerk authorized and directed to execute same in behalf of the City of Waterloo, Iowa. Motion carried. 67895 Moved by Wilharm, seconded by Lichty that the communication from the City Engineer, transmitting a Warranty Deed dated 5/23/75 from K -Line Farms, Inc. conveying unto the City of Waterloo, Iowa,17 feet in width of additional right-of-way on Fourth Street as a con- dition of acceptance of the Final Plat of Timberline Patio Homes and recommending acceptance, be received, placed on file and Reso- lution No. 23944, approving and accepting said deed and directing the recording of same, be adopted. Motion carried. 67899 - Moved by Getty, seconded by Berdell that the communication from the City Plan and Zoning Commission Administrator, reporting said Com- mission by unanimous vote of members present at their December 9, 1974 meeting, recommend the City Council repeal Ordinance No. 1619 and Ordinance No. 1711, and transmitting two proposed Ordinances, (1) An Ordinance creating a Plan and Program Commission in the City of Waterloo, Iowa, and (2) An Ordinance creating a Zoning Com- mission in the City of Waterloo, Iowa and providing for the ap- pointment of members threof, be received and placed on file. Mayor declared the motion carried. 67903 - Walter Clark, 1401 Mulberry Street, strongly protested the issuance of parking violation tickets for parking in the alley lying between Jefferson Street and intersecting an alley between West 4th Street and West Park Avenue, being in Block 16, Original Plat West Water- loo, Bickley b Subdivision of Lots 1 and 2, and the adoption of an amendment to the Traffic Ordinance. Asst. City Attorney Kennedy explained the necessity for the amend- ment, which would correct in a technical manner the fire zones 1 and 2. in the City of Waterloo, members thereof, was read said Ordinance be recorded A discussion followed on restrictions on unloading, delivery, etc. Under Council Action #67847 of 5/27/75 action was deferred on an Ordinance amending Ordinance No. 2644, known as the Traffic Ordin- ance, and was now presented for consideration. An Ordinance amending Ordinance No. 2644, known as the Traffic Ord- inance of the City of Waterloo, Iowa, by repealing Subsections (14) and (15) of Section 273 entitled "Stopping, Standing, or Parking", and enacting in lieu thereof new Subsections (14) and (15) of Sec- tion 273 entitled "Stopping, Standing, or Parking", was read by the Clerk. Moved by Roehr, seconded by Getty that said Ordinance be recorded as having passed its first reading. On roll call, Berdell, Geiger, Getty, Keller, Roehr and Wilharm voted Aye. Nay: None.
