Iowa, met in Regular Session in the City at 7:00 P.M. on May 12, 1975. Mayor Rooff in the Chair. Present: Councilmen Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm. Absent: None. Councilman Calvin J. Geiger offered the invocation. 67699 - Moved by Roehr, seconded by Wilharm that the Agenda, as proposed,f6r the Regular Session of May 12, 1975 at 7:00 P.M., be accepted and approved. Motion carried. 67700 - Moved by Wilharm, seconded by Roehr that the Minutes of the Regular Session held May 5, 1975 at 7:00 P.M., be approved. Motion carried. 67701 - Moved by Wilharm, seconded by Getty that the proof of publication of the Notice of Public Hearing on Plans, Specifications and proposed form of contract for the Westfield -Virden Urban Renewal Project for the construction of West Park Avenue Area Paving, Sewers and Inci- dentals, in the City of Waterloo, Iowa, Contract, No. 147, be re- ceived and placed on file. Motion carried. 67702 - The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objection, or if there were any written objections filed with the Clerk. No one appeared to object orally, and the Clerk reported that no writ- ten objections had been filed. Thereupon, it was moved by Roehr, seconded by Lichty that Resolution No. 23884, approving the plans and specifications, form of contract, etc. for the construction of West Park Avenue Area Paving, Sewers and Incidentals, Contract No. 147, in the City of Waterloo, Iowa, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67703 - Moved by Wilharm, seconded by Roehr that Resolution No. 23885, order- ing the construction of the West Park Avenue Area Paving, Sewers and Incidentals, Contract No. 147, in the City of Waterloo, Iowa, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67704 - Moved by Getty, seconded by Geiger that the proof of publication of Notice to Contractors or Invitation for Bids for the construction of West Park Avenue Area Paving, Sewers and Incidentals, Contract No. 147, in the City of Waterloo, Iowa, be received and placed on file. Motion carried. 67707 - Moved by Wilharm, seconded by Roehr that the proof of publication of the Notice of Proposed Resolution of Necessity for Oiling Program - Year 1975, being a Proposed Resolution of Necessity (No. 23852) for the improvement of streets, avenues, drives, roads, boulevards and alleys, or portions thereof, by oiling the same in the City of Waterloo, Iowa, as published in the Waterloo Daily Courier on April 24, and May 1, 1975, be received and placed on file. Motion carried. 67708 - A petition from Mr. and Mrs. Werner Wittmann, 330 Indiana Street, et al, requesting oiling of the 300 and 400 blocks of Indiana Street was presented and Supt. of Streets Massina said this need not be in- cluded in the assessment program, that arrangements would be made with the property owners for payment at the time the work was done. Moved by Roehr, seconded by Getty that the above petition be received and placed on file. Motion carried. 67709 - The Mayor announced the time had arrived for the hearing of objec- tions to the oiling of certain streets, avenues, drives, roads, boulevards and alleys, or portions thereof, under the Oiling Program of Year 1975, and asked if anyone present wished to be heard or if any written objections had been filed. The Clerk reported that written objection had been filed by: 1. Robert A. Joder, 600 Hanna Road to Stratford Avenue from Hanna Boulevard to Stephan Street Oral objections were made by: 1. Ida Tillman, 328 Anthony Street, objecting to Anthony Street, from the west corner of Idaho Street to Neville Street, 2. Norwin Freudenburg, 2321 Idaho Street, objecting to Anthony Street, from west corner of Idaho Street to Neville Street. Moved by Getty, seconded by Berdell that the above objections be received and placed on file. Motion carried. 67710 - Norwin Freudenburg, 2321 Idaho Street, presented a petition request- ing paving of Anthony Street, Neville Street, adjacent to Idaho Street, commencing from west of Idaho Street, Country Club Acres. Moved by Roehr, seconded by Getty that the above petition be re- ceived, placed on file and referred to the City Engineer. Mangin 1016 Newton Street, et al objecting to the oiling of the 1000 block of Newton Street as past oilings had been unsatisfactory. Motion carried. 67712 - After due consideration, it was moved by Wilharm, seconded by Roehr that Resolution No. 23886, sustaining the objections of Robert J. Joder to Stratford Avenue from Hanna Boulevard to Stephen Street; Ida Tillman and Norwin Freudenburg to Anthony Street from west cor- ner of Idaho Street to Neville Street; and Robert J. Mangin, et al, to 1000 block of Newton Street, in the 1975 Oiling Program, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67713 - Moved by Roher. seconded by Getty that Resolution No. 23887, amending the Proposed Resolution of Necessity by deleting (1) Stratford Avenue from Hanna Boulevard to Stephan Street, (2) Anthony Street from west corner of Idaho Street to Neville Street, and (3) 1000 block of Newton Street, from the 1975 Oiling Program, be adopted. Mayor declared the resolution adopted. 67714 - Moved by Wilharm, seconded by Getty that Resolution No. 23888, being a Resolution of Necessity, as amended, for oiling various streets, avenues, drives, roads, boulevards and alleys, or portions thereof, in the City of Waterloo, Iowa, under the Oiling Program for the Year 19 75 , be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67715 - Moved by Getty, seconded by Wilharm that Resolution No. 23889, di- recting the oiling of various streets, avenues, drives, roads, boule- vards and alleys, or portions thereof, in the City of Waterloo, Iowa, as designated in Resolution No. 23888 being the Resolution of Neces- sity, as proposed or as amended, adopted April 21, 1975, be adopted. Mayor declared the resolution adopted. 67716 - Moved by Roehr, seconded by Lichty that the proof of publication of the Notice of Proposal to Remove a Diseased Dutch Elm Tree and Levy- ing Assessment for cost thereof on premises of 520 Elm Street and 404 Fowler Street, owned by Meryl and Ruth Ogg and by John M. and Ione W. Hill, respectively, be received and placed on file. Motion carried. 67717 - The Mayor announced the time had arrived for the hearing of objec- tions to removal of a diseased Dutch Elm Tree and levying assessments for the cost thereof on the premises of 520 Elm Street and 404 Fowler Street owned by Meryl and Ruth Ogg and by John M. and Ione W. Hill, respectively, and asked if anyone present wished to be hear or if any written objections had been filed. Motion carried. 67718 - City Attorney Smith advised that 257 of costs should be assessed against 520 Elm Street and 75% against 404 Fowler Street. Mayor Rooff stated the tree had to come down as it was diseased. Moved by Roehr, seconded by Wilharm that Resolution No. 23890, over- ruling the objections of Meryl and Ruth Ogg, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Roehr and Wilharm voted Aye. Nay: Lichty. Absent: None. Mayor declared the resolution adopted. 67719 - Moved by Roehr, seconded by Wilharm that Resolution No. 23891, di- recting the Removal of a Diseased Dutch Elm Tree on the premises at 520 Elm Street and 404 Fowler Street owned by Meryl and Ruth Ogg and by John M. and Ione W. Mayor declared the resolution adopted. 67720 - Moved by Getty, seconded by Roehr that Resolution No. 23892, making assessments for the removal of a Diseased Dutch Elm Tree of 257 of cost on the premises known as 520 Elm Street and 75% of cost on 404 Fowler Street and instructing the City Clerk to certify said asses- sment to the Black Hawk County Auditor, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Roehr and Wilharm voted Aye. Nay: Lichty. Absent: None. Mayor declared the reso- lution adopted. 67721 - Moved by Keller, seconded by Roehr that the proof of publication of the Notice of Proposal to Dispose of Real Estate in South Waterloo Addition, in the Arbor Street and Commercial Streeet area, as fully described in the said notice published in the Waterloo Daily Courier on April 21 and 28, 1975, to the highest bidder, subject to reserva- tion, be received and placed on file. Motion carried. 67722 - The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objections, or if any written objections had been filed with the Clerk. No one appeared to object orally and the Clerk reported there had been no written objections placed on file. Motion carried. 67725 - The Mayor announced the time had arrived to hear objections, if any, and asked if anyone present wished to be heard or make objections, or if any written objections had been filed with the Clerk. No one appeared to object orally and the Clerk reported no written objections had been filed. Community Development Administrator Mercer briefly explained the amendment. Moved by Wilharm, seconded by Roehr that Resolution No. 23894, a res- olution approviing the amending of the Westfield -Virden Urban Renewal Project, Iowa R-7, in the City of Waterloo, Iowa, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67726 The Engineers, having checked the bids for the West Park Avenue Area Paving, Sewers and Incidentals, Contract No. 147, reported that after checking the extensions and totals of the bids submitted, the bid of Cedar Valley Corp. of Waterloo, Iowa, in the amount of $812,324.82, is the lowest legal bid received. Moved by Getty, seconded by Roehr that Resolution No. 23895, accept- ing the bid of Cedar Valley Corp. in the amount of $812,324.82 for the West Park Avenue Area Paving, Sewers and Incidentals, Contract No. 147, be adopted, subject to HUD approval. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67727 - Moved by Getty, seconded by Keller that the bid of Young Coal Com- pany for Road Oil to be used by the Street Department in the 1975 Street Oiling Program in the amount of 38.9c per gallon in 2200 gal. lots, F.O.B. Waterloo, Iowa, subject to change both as to freight rates and refinery cost, be received, placed on file, accepted and the Finance Director instructed and authorized to issue purchase order and warrant in payment for same accordingly. Thomas Glidewell, 925 Leavitt Street, et al, objecting to the plan or use of the property known as the Woodlawn Convalescent Home on Leavitt Street between West Eighth Street and West Ninth Street, for low rent apartments, be received, placed on file and referred to the City Plan and Zoning Commission. Mayor Rooff stated there appeared to be a misunderstanding of the use planned for the Woodlawn Convalescent Home building, that it was not a low rent project but was to be an efficiency apartment project. Ken Bukatz informed the Council that this was not government sub- sidized, would be efficiency apartments for probably older people, retired people, they would be low cost, not low rent income, he was proposing to install new kitchens, carpeting, parking area, and felt if the people objecting understood what was being proposed, they would not object. Mayor Rooff pointed out that no application was being made to the government, it was a private development with private funds 67729 - Moved by Roehr, seconded by Getty that the petition from Irene K. Moore, 1035 Wilbur Avenue, et al, objecting to paving of Janney Avenue from Wilbur Avenue to Ansborough Avenue, be received, placed on file and referred to the City Engineer. Motion carried. 67730 - Moved by Roehr, seconded by Lichty that the petition from Irene K. Moore, 1035 Avenue, et al, objecting to paving of Wilbur Avenue from Janney Avenue to Hartman Avenue, be received, placed on file and referred to the City Engineer. Motion carried. 67731 - Moved by Getty, seconded by Roehr that the communication from the City Engineer, transmitting a request from Peterson Soybean Seed Division, Pioneer Hi -Bred Internationals, Inc., for permission to construct a rock driveway at 3261 West Airline Highway, as shown on the attached plat, and recommending approval subject to the provis- ions of his letter, be received, placed on file, recommendations approved and permission granted in accordance therewith at no cost to the City. Moved by Wilharm, seconded by Roehr that Resolution No. 23896, ap- proving the Final Plat of "R-3, R -P" Planned Residence District known as Timberline Patio Homes, Inc., be adopted, subject to 17' of land being dedicated to the City of Waterloo as recommended by the City Engineer and City Plan and Zoning Commission. Mayor declared the Reso- lution adopted subject to the dedication of 17' of land. 67735 Moved by Getty, seconded by Keller that the Contract and Bond with F. A. Moser & Associates, Inc., Waterloo, Iowa, in the amount of $297,225.25 for the Westfield Avenue -McKinley Street Storm Sewer, in the City of Waterloo, Iowa, Contract No. 92, be received, placed on file and Resolution No. 23897, approving said Contract and Bond, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67736 - Moved by Wilharm, seconded by Getty that the communication from the City Engineer, transmitting construction plans for sanitary sewer facilities to serve the Cedar Terrace Fifth Addition and Lots 1, 2, 22, 23, 24, 25, 26, 27 and 28 of Cedar Terrace Fourth Addition and Treatment Agreement Form C 4/73 with the Department of Environmental Quality, Water Quality Management Division, and recommending approval with final acceptance of attached plans subject to review by said Department, be received, placed on file, recommendations approved and the Mayor and City Clerk authorized to execute said Agreement Form in behalf of the City of Waterloo, Iowa. Motion carried. 67737 - Elmer Lorenz of Porky's Red Carpet strongly objected to the proposed Swimming Pool Ordinance, raised various questions on regulations, - fees, inspections, etc which were answered by Mayor Rooff, Health & Sanitation Director Hoffman and City Attorney Smith. An Ordinance regulating the design, construction, operation and maintenances of public swimming pools including all necessary ap- purtenances, was read by the Clerk. Moved by Getty, seconded by none that the rules requiring ordinances to be read in full on three separate days be suspended, that said ordinance be recorded as having passed its second and third readings (the first having passed under C.R. #67681 of 5/5/75), and be now placed on its final adoption. Mayor declared the motion died for lack of a second. Moved by Roehr, seconded by Lichty that said Ordinance be recorded as having passed its second reading (the first having passed under C.R. #67681 of 5/5/75). Mayor declared the motion carried. 67738 - Under Council Action #67599 of 4/21/75, action was deferred on the "Libraries" Ordinance until the Mayor and City Attorney could further study same, and was now presented for consideration. Mayor Rooff stated some changes had been suggested and asked City Attorney Smith to briefly explain the various sections of the new proposed ordinance. May 12, 1975 8 67738 - (Continued) City Attorney Smith cited Home Rule, Section 392.5 of 1975 Code of Iowa, that if the City wanted a Library Board it most comply with what has been the state statutes, it was mandatory, the proposed ordinance brought the City up to Home Rule, and explained the var- ious sections. He stated the City Council controls the budget al- location, if substantial changes are desired, they must be submit- ted to the voters. The question was raised that if the Board wanted a new building, would the Board come to the City and Mayor Rooff stated if they had private funds, "No", but if they wanted to sell general obli- gation bonds, it must be submitted to the voters. He recommended the ordinance be adopted. An Ordinance repealing Chapter 22 "Libraries", and enacting a new Chapter 22 "Libraries", establishing a public library and to pro- vide for the appointment, powers and duties of a Board of Library Trustees, was read by the Clerk. Moved by Getty, seconded by Keller that said Ordinance be recorded as having passed its first reading. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 67739 - An Ordinance amending Ordinance No. 2446, as amended, known as the Milk Ordinance by repealing all of Section 5-A Inspection Fees and enacting in lieu thereof new Section 5-A Inspection Fees was read by the Clerk. City Sanitarian Schafroth explained the proposed fee schedule, and procedure followed in obtaining samples and inspection. Moved by Wilharm, seconded by Berdell that the rules requring ordin- ances to be read in full on three separate days be suspended, that said ordinance be recorded as having passed its first, second and third readings, and be now placed on its final adoption. On roll call, Berdell and Wilharm voted Aye. Nay: Geiger, Getty, Keller, Lichty and Roehr. Absent: None. Mayor declared the motion lost. Absent: None. Mayor declared the motion carried. 67740 - Community Development Administrator Mercer briefly explained the right of way needed for Stage 5 of the flood control project. Moved by Getty, seconded by Roehr that Resolution No. 23898, a reso- lution authorizing the condemnation of a certain parcel of real prop- erty for the Flood Control Project, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67741 - Moved by Roehr, seconded by Wilharm that the communication from the Community Development Administrator, transmitting Estimate #9 Report as to work and materials furnished by M. F. Goerdt Construction Co., Contractors, Dubuque, Iowa, for the Westfield Avenue Paving, Sewer and Incidentals, Westfield -Virden Urban Renewal Project R-7, Contract No. 143, and recommending approval, be received, placed on file and Resolution No. 23899, approving Estimate #9 Report, and certifying payment accordingly, be adopted.
