The City Council of the City of Waterloo, Iowa, met in Regular Session in The Council Chambers in the City Hall in said City at 7:00 P.M. on March 10, 1975. Mayor Rooff in the Chair. Present: Councilmen Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm. Absent: None. Councilman Harold E. Getty offered the invocation. 67386 - Moved by Roehr, seconded by Wilharm that the Agenda, as proposed, for the Regular Session of March 10, 1975 at 7:00 P.M., be ac- cepted and approved. Motion carried. 67387 - Moved by Wilharm, seconded by Roehr that the Minutes of the Regular Session held March 3, 1975 at 7:00 P.M., be approved. Motion carried. 67388 Moved by Getty, seconded by Roehr that the communication from the City Engineer, transmitting the construction plans for concrete paving, storm sewer, and sanitary sewer facilities to serve the Ridgeway Addition and Treatment Agreement Form for the Department of Environmental Quality, Water Quality Management Division, and recommending acceptance of said plans subject to review and ac- ceptance by said Department, be received, placed on file, recom- mendations approved and the Mayor and City Clerk authorized to execute said Agreement Form in behalf of the City of Waterloo, Iowa. Motion carried. 67389 - Mayor Rooff recognized Boy Scout Troop 3 of Irving School who were in attendance at the Council Meeting, 67390 Moved by Getty, seconded by Lichty that the communication from the Community Development Administrator, transmitting an Offer of Sale dated 3/4/75 from Rhey N. Cowin, Jr. to the City of Waterloo of certain real property being Parcel No. 67+00, Vacant Lot on Cedar Bend, for the sum of $4,450.00 for Stage 5A of the Waterloo Flood Control Project, be received, placed on file, Offer of Sale ap- proved, Mayor and City Clerk authorized and directed to execute same in behalf of the City of Waterloo, the City Clerk instructed to issue a warrant accordingly in payment therefor, and Resolution No. 23770, accepting and approving certain offers to sell real property to the City and accepting and approving certain deeds, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67391 - Moved by Roehr, seconded by Wilharm that Construction Permit No. 75-51-S for Sanitary Sewer Extension, Deere Engine Plant Trunk Sewer, Contract No. 184, in the City of Waterloo, Iowa, from the Iowa Department of Environmental Quality, subject to certain conditions and requirements, be received and placed on file. Motion carried. 67392 - Mayor Rooff stated there has been some criticism of the City for spending money on the exterior of Conway Civic Center, but this was part of the bond sale and original plan. Ales 2 67392 - (Continued) Moved by Wilharm, seconded by Roehr that the Contract and Bond of Platt's Inc. for the Conway Civic Center/Site Work in the amount of $11,798.35, be received, placed on file and Resolution No. 23771, approving said Contract and Bond, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67393 Asst. City Attorney Kennedy explained the Massage Ordinance was revised by (1) removing the "Whereas" paragraphs, (2) clearing up some of the language in Section 5 providing for the City to in- vestigate, and (3) Section 11, Penalty Provision, setting viola- tion as a misdemeanor. Councilman Berdell questioned the liability of the owner if a technician violated the ordinance and was informed the technician would pay the fine,his violation conviction didn't automatically suspend or revoke the license of the owner, however it could be taken into consideration. The 60 day compliance requirement was discussed and the Council's authority to approve or disapprove an application. An Ordinance regulating massage establishments, massage techicians, and prohibiting massage at other than massage establishments and providing penalties for violations thereof, was read by the City Clerk. Moved by Getty, seconded by Wilharm that the rules requiring ord- inances to be read in full on three separate days be suspended, that said ordinance be recorded as having passed its first, second and third readings, and now placed on its final adoption. On roll call, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: Berdell. Absent: None. Mayor declared the motion carried. 67394 - Moved by Wilharm, seconded by Roehr that Ordinance No. 2733, ordinance regulating massage establishments, massage technicians, and prohibiting massage at other than massage establishments and providing penalties for violations thereof, be adopted. On roll call, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: Berdell. Absent: None. Mayor declared the ordinance adopted. 67395 Moved by Getty, seconded by Wilharm that Resolution No. 23772, a resolution designating authority to sign financial reports of the Department of Housing and Rehabilitation, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67396 - Moved by Roehr, seconded by Wilharm that the communication from the City Attorney, transmitting a resolution for "Transfer of Funds from Special Assessment Sinking Funds to General Fund", be received, placed on file and Resolution No. 23773, Transfer of said Funds,be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67397 - Moved by Wilharm, seconded by Getty that the communication from the City Engineer, transmitting a statement dated 2/25/75 from Brice, Petrides & Associates, Inc. for resident inspection and testing services during the month of January, 1975 for the Demolition and March 10, 1975 3 67397 - (Continued) Reconstruction of Fourth Street Bridge, Bridge Contract No. 9, and recommending approval, be received, placed on file and Resolution No. 23774, approving the statement of said firm and authorizing payment accordingly, be adopted. Mayor declared the resolution adopted. 67398 - Moved by Getty, seconded by Geiger that the communication from the Community Development Administrator, transmitting a statement dated 2/25/75 from Brice, Petrides & Associates, Inc., Engineers, for engineering services for construction of River Road, Stage I, West- field -Virden Urban Renewal Project Iowa R-7, Contract No. 142, be received, placed on file and Resolution No. 23775, approving the statement and authorizing and certifying payments accordingly, be adopted. Mayor declared the resolution adopted. 67399 —Moved by Roehr, seconded by Getty that the communication from the Community Development Administrator, transmitting Estimate No. 9 Report as to work and materials furnished by J. F. Brennan Co., Inc. and M. F. Goerdt Construction Co., Contractors, Joint Venture, Dubuque, Iowa, for construction of River Road, Stage I, Westfield - Virden Urban Renewal Project Iowa R-7, Contract No. 142, and rec- ommending approval, be received, placed on file and Resolution No. 23776, approving the report and authorizing and certifying payment accordingly, be adopted. Mayor declared the resolution adopted. 67400 - Moved by Roehr, seconded by Wilharm that the communication from the Community Development Administrator, transmitting two appraisal statements, one from Iowa Appraisal & Research Corp. dated 2/11/75 in the amount of $1,000 and the other from S. DeWayne Guernsey dated 2/27/75 for $1,000, for appraisals on properties at 230 Sycamore Street and 200 Sycamore Street, be received, placed on file and Resolution No. 23777, approving the statements and auth- orizing payments accordingly, be adopted. Councilman Getty stated this was very, very expensive. 67401 - Moved by Wilharm, seconded by Roehr that the communication from the Community Development Administrator, transmitting a statement dated 2/25/75 from Brice, Petrides & Associates, Inc., Engineers, for engineering services in connection with survey of levee right-of- way parcels for Stage 5-A, Local Flood Control Project in Cedar Bend area, approved by Council Action #67081 of 12/23/74, be re- ceived, placed on file and Resolution No. 23778, approving the statement and authorizing the payment accordingly, be adopted. March 10, 1975 - 5 - 67407 Moved by Geiger, seconded by Getty that the applications and fees as shown on the attached sheet for various Beer Permits and/or Beer and Liquor Licenses as designated, at the locations shown, in the City of Waterloo, Iowa, be, and the same are hereby approved for the issuance of said Permits and/or Licenses, that the approval be endorsed on the applications and forwarded with fees and/or certified fee receipts to the Iowa Beer and Liquor Control Depart- ment, and duplicate copies of applications, be received, placed on file, and Resolution No. 23781 approving the applications, be adopted. Motion carried. 67409 Mayor Rooff asked the members of the Safety Committee to stay after the Council Meeting as Civil Defense Director Rogers wanted to dis- cuss the possibility of a flood in the next few weeks and necessary preparations to control same. 67410 - Moved by Geiger, seconded by Getty that the Council adjourn.
