The City Council of the City of Waterloo, Iowa, met in Regulaf Session in the Council Chambers in the City Hall in said City at 7:00 P.M. on March 3, 1975. Mayor Rooff in the Chair. Present: Councilmen Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm. Absent: None. Councilman Harold E. Getty offered the invocation. 67364 - Moved by Roehr, for the Regular and approved. Motion carried. seconded by Wilharm that the Agenda, as amended, Session of March 3, 1975 at 7:00 P.M., be accepted 67365 - Moved by Wilharm, seconded by Geiger that the Minutes of the Regular Session held February 24, 1975 at 7:00 P.M. and the Special Session of February 25, 1975 at 7:00 P.M., be approved. Motion carried. 67366 Moved by Roehr, seconded by Wilharm that the 1974 Annual Report for the Department of Health, Sanitation, and Cat and Dog Control, be received and placed on file. Motion carried. 67367 Under Council Action 67311 of 2/24/75 action was deferred on ap- proving the submission of an application to the Department of Hous- ing and Urban Development for federal assistance under Title I of the Housing and Community Act of 1974. After due consideration, it was moved by Getty, seconded by Berdell that Resolution No. 23763, approving the submission of an applica- tion to the Department of Housing and Urban Development for federal assistance under Title I of the Housing and Community Development Act of 1974, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm. voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67368 - Moved by Getty, seconded by Wilharm that the Contract and Bond of 0-M Construction Co. for the the Conway Civic Center/Site Work in the amount of $93,579.00, be received, placed on file and Reso- lution No. 23764, approving said Contract and Bond, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67369 - Moved by Roehr, seconded by Wilharm that the Contract and Bond of Wells Electric Inc. for the Conway Civic Center/Site Work in the amount of $17,084.00, be received, placed on file and Resolution No. 23765, approving said Contract and Bond, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67370 - Moved by Roehr, seconded by Lichty that the communication from the City Engineer, transmitting four (4) copies of Contract for Engineer- ing Services dated 3/3/75 with Brice, Petrides & Associates, Inc. for a preliminary design study on Ridgeway Avenue from U.S. 63 to the westerly City limits, for the total sum of $8,000.00, and rec- ommending approval, be received, placed on file, and Resolution No. 2 67370 - (Continued) 23766, approving and directing execution of said contract by the Mayor and City Clerk in behalf of the City of Waterloo, Iowa, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67371 - Moved by Wilharm, seconded by Roehr that the communication from the Property Administrator, transmitting five (5) copies of Agreement dated 3/3/75 between the Chicago and North Western Transportation Company and the City of Waterloo, Iowa, in connection with the Deere Engine Plant Trunk Extension, Contract No. 184, and request- ing acceptance, be received, placed on file, approved and accepted and Resolution No. 23767, approving and accepting said Agreement with Chicago and North Western Transportation Company and author- izing the Mayor and City Clerk to execute same in behalf of the City of Waterloo, Iowa, adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67372 - An Ordinance amending Ordinance No. 2479, as amended, by adding Sub -Section No. 67 to Section 2A-5, rezoning certain property in the City of Waterloo, Iowa, was read by the City Clerk. Moved by Getty, seconded by Wilharm that the rules requiring ordin- ances to be read in full on three separate days be suspended, that said ordinance be recorded as having passed its second and third readings (the first having passed under Council Action #67317 of 2/24/75), and now placed on its final adoption. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the motion carried. 67373 - Moved by Getty, seconded by Lichty that Ordinance N Ordinance amending Ordinance No. 2479, as amended, _ ub- Section No. 67 to Section 2A-5, rezoning certain prop y in the City of Waterloo, Iowa, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the ordinance adopted. 67374 - An Ordinance amending Ordinance No. 2479, as amended, by adding Sub -Section No. 68 to Section 2A-5, rezoning certain property in the City of Waterloo, Iowa, was read by the City Clerk. Moved by Wilharm, seconded by Getty that the rules requiring ordin- ances to be read in full on three separate days be suspended, that said ordinance be recorded as having passed its second and third readings (the first having passed under Council Action #67320 of 2/24/75), and now placed on its final adoption. Mayor declared the motion carried. 67375 - Moved by Getty, seconded by Wilharm that Ordinance No. 2732, an Ordinance amending Ordinance No. 2479, as amended, by adding Sub - Section No. 68 to Section 2A-5, rezoning certain property in the City of Waterloo, Iowa, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the ordinance adopted. 2731, y addi March 3, 1975 - 3 - 67376 - Moved by Roehr, seconded by Wilharm that the Site Development Plan for that portion of part of NE4 of Section 7 -88N -13W, located south of Iowa Highway 412 between U.S. Highway #63 and West Fourth Street, rezoned "R -3,R -P" Planned Residence District by Ordinance No. 2732, be received, placed on file and approved. Motion carried. 67377 An Ordinance regulating massage establishments, massage technicians, and prohibiting massage at other than massage establishments, was read by the City Clerk. Moved by Wilharm, seconded by Roehr that said ordinance be recorded as having passed its first reading. On roll call, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Abstained: Berdell. Absent: None. Mayor declared the motion carried° 67378 - Moved by Roehr, seconded by Wilharm that Resolution No. 23768, ap- proving the minutes of the Community Development Board for their regular meetings held December 10, 1974 and January 14, 1975, be adopted. On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the resolution adopted. 67379 Moved by Geiger, seconded by Getty that the application, together with necessary fee, from J. R. Williams dba Metropolitan Patient Transfer, 4304 Rownd Street, Cedar Falls, for one Ambulance License, be received, placed on file and License granted. Motion carried. 67380 Moved by Wilharm, seconded by Roehr that the following application and bond for Automobile Salvage Yard License, together with neces- sary fee, be received, placed on file, approved and license granted, subject to the requirements of the ordinance governing same: Keith Shepard dba Shep's Auto Salvage and Used Car Sales, 1501 Grandview Avenue Motion carried. 67381 Moved by Getty, seconded by Lichty that the applications and fees as shown on the attached sheet for various Beer Permits and/or Beer and Liquor Licenses as designated, at the locations shown, in the City of Waterloo, Iowa, be, and the same are hereby approved for the issuance of said Permits and/or Licenses, that the approval be en- dorsed on the applications and forwarded with fees and/or certified fee receipts to the Iowa Beer and Liquor Control Department, and duplicate copies of applications, be received, placed on file, and Resolution No. 23769 approving the applications, be adopted. Motion carried. 67383 Moved by Geiger, seconded by Getty that the report of the City At- torney, advising that the bonds filed with the City Clerk up to the close of business on March 3, 1975, as shown on the list at- tached to said report, have been approved by him, be received, placed on file, and the report and bonds approved.
