City Hall, Waterloo, Iowa REGULAR SESSION February 3, 1975 - 7:00 P.M. Iowa, met in Regular Session in the City at 7:00 P.M. on February 3, Present: Councilmen Getty, Keller, Lichty, Roehr and Wilharm. Absent: Councilmen Berdell and Geiger. Councilman Robert R. Wilharm offered the invocation. 67218 - Moved by Keller, seconded by Wilharm that the Agenda, as amended, for the Regular Session of February 3, 1975 at 7:00 P.M., be accepted and approved. Motion carried. 67219 - Moved by Wilharm, seconded by Getty that the Minutes of the Regular Session held January 27, 1975 at 7:00 P.M., be approved. Motion carried. 67220 - Moved by Roehr, seconded by Wilharm that the proof of publication of Notice of Hearing on Proposed Specifications and Proposed Form of Contract for the manufacture and delivery of Deere Engine Plant Trunk Sewer Lift Station City of Waterloo, Iowa, and the Taking of Bids for the Improvement, Contract No. 184A, be received and placed on file. Motion carried. 67221 - The Mayor announced the time had arrived to hear objections, if any, to the proposed specifications, etc. for the construction of the Deere Engine Plant Trunk Sewer Lift Station, Contract No. 184A, and asked if anyone present wished to be heard or make objection, or if there were any written objections filed with the Clerk. The Clerk reported there were no written objections, and no one ap- peared to object orally. After public hearing and no objections hav- ing been made or filed, it was moved by Getty, seconded by Wilharm that Resolution No. 23706, confirming the approval of specifications, etc. for the construction of the Deere Engine Plant Trunk Sewer Lift Station, Contract No. 184A, in the City of Waterloo, Iowa, be adopted. On roll call, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Berdell and Geiger. Mayor declared the reso- lution adopted. 67222 Moved by Roehr, seconded by Lichty that Resolution No. 23707, order- ing the construction of the Deere Engine Plant Trunk Sewer Lift Station, Contract No. 184A, in the City of Waterloo, Iowa, be adopted. On roll call, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Berdell and Geiger. Mayor declared the resolu- tion adopted. Motion carried. 67225 Moved by Roehr, seconded by Lichty that Resolution No. 23708, order- ing the installation of plumbing system and connecting to City sewer and water at 603 Martin Road and 725 Bishop Avenue, be adopted. On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the resolution adopted. 67226 - Moved by Wilharm, seconded by Roehr that the two communications from the Building Official, submitting the following bids for installation of plumbing system and connecting City sewer and City water at 603 Martin Road, Birthel E. Skinner and Betty A. Skinner, Owners, and 725 Bisphop Avenue, Anita Derifield, Owner, and recommending accept- ance of the low bids, be received, placed on file and Resolution No. 23709, accepting the low bids of Carpenter's Plumbing, Inc. in the amounts of $1,504.00$for 603 Martin Road and $2,481.00 for 725 Bishop Avenue for said installations, adopted: BIDDER AMOUNT 603 Martin Road Carpenter's Plumbing, Inc. Mayor declared the reso- lution adopted. 67227 Moved by Roehr, seconded by Wilharm that the communication from the City Engineer, transmitting a petition from Mrs. Alvina Kepler, 134 Crestview Avenue, et al, representing 61% of the property owners on one side of street, the other side being City Park property, for con- crete paving of Johnson Street from West Ninth Street to Williston Avenue, together with sketch, be received and placed on file. Motion carried. 67228 - Councilman Wilharm pointed out the proposed "R-4" Multiple Residence District would be across the street from single dwellings, that "R-4" would permit motels, and asked why "R-4" was requested when "R-3" would cover multiple dwellings. Rick Young stated only multi- ple dwellings would be constructed. Moved by Getty, seconded by Berdell that the communication from the City Plan and Zoning Commission, transmitting the request of Young Plumbing and Heating Company for the Council on its own motion to rezone from "A-1" Agricultural District to "R-4" Multiple Residence District part of Section 5-88-13, located West side of West Fourth Street and South of Iowa State Highway Commission property on West Ridgeway Avenue, as shown on the attached plat and legally described in attached Exhibit "A", and :recommending approval, be received, placed on file, recommendations approved, date of hearing set as February 24, 1975 at 7:00 P.M. and the Clerk instructed to publish the necessary notice. On roll call, Berdell, Getty and Keller voted Aye. Nay: Lichty, Roehr and Wilharm. Absent: Geiger. Mayor Rooff broke the tie by casting an Aye vote. Mayor declared the motion carried. February 3, 1975 - 3 - 67229 - Mayor Rooff reported he had met with the Chairman of the Board of Supervisors on the sale of Black Hawk County property and asked that the properties not approved under Council Action #67095 of 1/6/75 be reconsidered at this time. After discussion, it was moved by Roehr, seconded by Wilharm that the rules that a motion cannot be revoted after a week be suspended and Council Action #67095 of 1/6/75 be reconsidered. On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the motion carried. 67230 - Moved by Roehr, seconded by Wilharm, that the following offers on properties on which Black Hawk County holds title be approved for acceptance for less than taxes specified and with the provision that Howry & McWilliams Addition, Lot 9, Block 5,(506 Sumner Street) and Peeks 2nd Addition, Lot 9, Block 5 (518 Gable Street)be sold subject to the City of Waterloo waiving all special assessments and the City to receive all proceeds from sale of these two properties; Property Description Total Assessments Total Special Assessments Total Special Assessments to be Waived Bid Howrey & McWilliams Add. Mayor declared the motion carried. 67231 - Moved by Wilharm, seconded by Roehr that the communication from the City Plan and Zoning Commission, transmitting the request of K -Line Farms, Inc. for the Council on its own motion to rezone from "A-1" Agricultural District to "R-3, R -P" Planned Residence District and "C-2" Commercial District part of NE4 of Section 7 -88N -13W, located south of Iowa Highway 412 between U.S. Highway #63 and West Fourth Street, as shown on the attached plat and legally described in at- tached Exhibits A and B, and recommending approval of this revised plan, be received, placed on file, recommendations approved, date of hearing set as February 24, 1975 at 7:00 P.M. and the Clerk in- structed to publish the necessary notice. Motion carried. 67232 - Moved by Getty, seconded by Wilharm that the communication from the City Engineer, transmitting five (5) copies of Iowa State Highway Commission Application for Use of Highway Right of Way for Utilities Accommodation, Form #562, requesting Right -of -Way for Sanitary Sewer line at Highway Station 856+77.8, as shown on the attached sketch, from the City of Waterloo, Iowa, and requesting approval, be re- ceived, placed on file, approved and the Mayor authorized to sign said application in behalf of the City of Waterloo, Iowa. Motion carried. February 3, 1975 - 4 - 67233 - Moved by Wilharm, seconded by Roehr that the communication from the City Attorney, transmitting a Warranty Deed dated 1/23/75 from Rhey N. Cowin, Jr., individually and as executor of the estate of Esther Cowin, and Marian T. Cowin, his wife, conveying unto the Waterloo Riverfront Improvement Commission certain real property in Section 15 -89N -13W under a contract dated 8/22/60 and recorded 4/6/71 in Book 131 at Page 465 of Miscellaneous Records of the Recorder of Black Hawk County, Iowa, and recommending acceptance, be received, placed on file, and Resolution No. 23710, approving and accepting said deed and directing the recording of same, be adopted. On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the resolution adopted. 67234 - Councilman Berdell inquired if a taxicab driver making a delivery for a drug store would be in violation of the proposed ordinance amending Section 36-42 and 36-45 and was informed this was not the intent. After discussion, it was moved by Wilharm, seconded by Roehr that the words "excepting prescription deliveries" be inserted in proposed ordinance amendment to Section 36-42 (e) after the words "controlled substances." On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the motion carried. 67235 An Ordinance amending Section 36-42, Subsections (d) and (e), quali- fications for obtaining a license to drive ataxicab, and repealing Section 36-45(a) Issuance of a license, and enacting a new Section 36-45(a), was read by the Clerk. Moved by Wilharm, seconded by Roehr that the rules requiring ordin- ances to be read in full on three separate days be suspended, that said ordinance be recorded as having passed its first, second and third readings and now placed on its final adoption. On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the motion carried. 67236 - Moved by Getty, seconded by Roehr that Ordinance No. 2730, an Ord- inance amending Section 36-42, Subsections (d) and (e), Qualifica- tions for obtaining a license to drive a taxi cab, and repealing Section 36-45 (a), Issuance of a license, and enacting a New Section 36-45 (a), be adopted, with the words "excepting prescription de- liveries" inserted in Section 36-42 (e) after the words "controlled substances." On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the ord- inance adopted. 67237 - Moved by Roehr, seconded by Getty that Resolution No. 23711, making assessment for the removal of a Dutch Elm diseased tree on the prem- ises known as 655 Summit Avenue and instructing the City Clerk to certify said assessment to the Black Hawk County Auditor, be adopted. On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the reso- lution adopted. 67238 - Moved by Getty, seconded by Berdell that Resolution No. 23712, making assessment for the removal of a Dutch Elm diseased tree on the prem- ises known as 626 Riehl Street and instructing the City Clerk to certify said assessment to the Black Hawk County Auditor, be adopted. On roll call, Berdell, Getty, Keller, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Geiger. Mayor declared the reso- lution adopted. Mayor declared the motion carried. 67240 Moved by Wilharm, seconded by Roehr that the applications and fees as shown on the attached sheet for various Beer Permits and/or Beer and Liquor Licenses as designated, at the locations shown, in the City of Waterloo, Iowa, be, and the same are hereby approved for the issuance of said Permits and/or Licenses, that the approval be en- dorsed on the applications and forwarded with fees and/or certified fee receipts to the Iowa Beer and Liquor Control Department, and dup- licate copies of applications, be received, placed on file, and Reso- lution No. 23713 approving the applications, be adopted.
