City Hall, Waterloo, Iota REGULAR SESSION January 27, 1975 - 7:00 P.M. Iowa, met in Regular Session in the City at 7:00 P.M. on January 27, Present: Councilmen Berdell, Geiger, Getty, Lichty, Roehr and Wilharm. Absent: Councilman Keller. Councilman Harold E. Getty offered the invocation. 67182 - Moved by Wilharm, seconded by Roehr that the Agenda, as amended, for the Regular Session of January 27, 1975 at 7:00 P.M., be accepted and approved. Motion carried. 67183 - Moved by Geiger, seconded by Wilharm that the Minutes of the Regular Session held January 20, 1975 at 7:00 P.M., be approved. Motion carried. 67184 - Moved by Wilharm, seconded by Getty that the proof of publication of the Notice of Hearing on proposed plans and specifications, proposed form of contract, estimated costs, etc. for the construction of Con- way Civic Center/Site Work, be received and placed on file. Motion carried. 67185 - The Mayor announced the time had arrived to hear objections, if any, to the proposed plans, specifications, form of contract, estimated cost, etc. for the construction of Conway Civic Center/Site Work, in the City of Waterloo, Iowa, and asked if any one present wished to be heard or make objection, or if there were any written objections filed with the Clerk. No one appeared to object orally, and the Clerk reported no written objections had been filed. There being no objections made or filed, it was moved by Getty, seconded by Wilharm that Resolution No. 23697, confirming the approval of the plans, specifications, form of contract, estimated cost, etc. for the construction of the Conway Civic Center/ Site Work, in the City of Waterloo, Iowa, be adopted. On roll call, Berdell, Geiger, Getty, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Keller. Mayor declared the resolution adopted. 67186 - Moved by Roehr, seconded by Getty that Resolution No. 23698, ordering the construction of Conway Civic Center/Site Work, in the City of Waterloo, Iowa, be adopted. On roll call, Berdell, Geiger, Getty, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Keller. Mayor declared the resolution adopted. 67187 - Moved by Roehr, seconded by Wilharm that the proof of publication of the Notice of Advertisement for Bids for the construction of Conway Civic Center/Site Work, in the City of Waterloo, Iowa, be received and placed on file. Motion carried. 67190 - Black Hawk County Supervisor Carol Hayes asked the Council members to reconsider their vote of 1/6/75 (Council Action #67095) on the sale of four real properties (506 Sumner Street, 306 Indiana Street, 712 Beech Street and 518 Gable Street), on which Black Hawk County holds title and has received offers to purchase, for less than taxes with the provision that 506 Sumner Street and 518 Gable Street be sold subject to the City waiving all special assessments and the City to receive all proceeds from the sale of these two properties. He stated the Board would try to get more publicity on future sales. Mayor Rooff stated a meeting would be set up with the Board of Super- visors. Moved by Wilharm, seconded by Roehr that the above request of Black Hawk County Supervisor Carol Hayes be received and placed on file. Motion carried. January 27, 19 75 - 3 - 67191 - Moved by Getty, seconded by Berdell that the 1974 Annual Financial Report of the Waterloo Airport Commission, be received and placed on file. Motion carried. 67192 - Councilman Roehr asked who held the deeds for the properties purchased by Urban Renewal and Community Development. Community Development Administrator Mercer stated the deeds were in the name of the City of Waterloo and the deeds with the abstracts were held in the Community Development files. Moved by Roehr, seconded by Wilharm that the 1974 Financial Report for the Urban Renewal Project Iowa R-7 and Urban Renewal Project Iowa R-2, as submitted by the Community Development Board, be received and pla- ced on file. Motion carried. 67193 - Moved by Getty, seconded by Berdell that the communication from the Community Development Administrator, transmitting an Audit Report for Project Iowa R-7 and the Revolving Fund for the period from February 1, 1970 through September 30, 1974, as submitted by Dee Gosling and Company of Cedar Rapids, Iowa, be received and placed on file. Motion carried. 67194 - Councilman Berdell asked if four firemen would be transferred from the Fire Department to the Airport and was told these would be four new positions. Mayor Rooff stated there would be four hired in the Utility Department. Moved by Wilharm, seconded by Roehr that the communication from the Personnel Director, transmitting a Public Service Employment Sub- contract dated 1/27/75 between the City of Waterloo and Black Hawk County Board of Supervisors as developed by the Manpower Planning and Programs Board in connection with Department of Labor grant, and recommending approval, be received, placed on file, approved and ac- cepted and the Mayor and City Clerk authorized and directed to exe- cute same in behalf of the City of Waterloo, Iowa. Motion carried. 67195 - Under Council Action #67167 of 1/20/75 the request for additional financial assistance of 5Q per capita per year, with Waterloo's Assessment to be $3,800, for the Northeast Iowa Health Planning Council, was referred to the Finance Committee, and was now presented for consideration. A discussion followed and it was determined the Finance Committee had made no recommendation. Moved by Roehr, seconded by Wilharm that the above request for addi- tional financial assistance of 5G per capita per year for the North- east Iowa Health Planning Council be denied. On roll call, Lichty, Roehr and Wilharm voted Aye. Nay: Berdell, Geiger and Getty. Absent: Keller. Mayor Rooff broke the tie by casting a Nay vote. Mayor declared the motion not carried. 67196 - Moved by Getty, seconded by Berdell that the request for additional financial assistance of 50 per capita per year for the Northeast Iowa Health Planning Council be approved. Moved by Roehr, seconded by Wilharm that the above motion be amended by adding the words "subject to the rest of the area participating in this program". On roll call, Lichty, Roehr and Wilharm voted Aye. Nay: Berdell, Geiger and Getty. Absent: Keller. Mayor Rooff broke the tie by casting a Nay vote. Mayor declared the amendment not carried. January 27, 1975 - 4 - 67197 - The roll was then called on the motion that the request be approved and vote was as follows: On roll call, Berdell, Geiger, and Getty voted Aye. Nay: Lichty, Roehr and Wilharm. Absent: Keller. Mayor broke the tie by casting an Aye vote. The Mayor declared the motion carried. 67198 - Under Council Action #67168 of 1/20/75 the request from Maynard Reynolds, together with Iowa State Highway Commission Form #559, for permission to construct an 18' Type "C" entrance to U.S. 218 at Sta. 816+75, Sly side, at S.E. quadrant of Highway U.S. 218 and llth Street intersection 1316 Washington Street, was referred to the Pub- lic Safety Committee, and was now presented for consideration. Councilman Wilharm reported this could be a very hazardous driveway as cars would have to back out onto the Highway. Moved by Wilharm, seconded by Roehr that the above request be denied. Motion carried. 67199 - Moved by Roehr, seconded by Lichty that the communication from the City Attorney, transmitting proposed "Ordinance amending Section 36-42, Subsections (d) and (e), Qualifications for Obtaining a Lic- ense to Drive a Taxicab, and repealing Section 36-45 (a), Issuance of a License, and enacting a new Section 36-45(a)", be received and placed on file. Motion carried. 67200 - An Ordinance amending Section 36-42, Subsections (d) and (e), Quali- fications for obtaining a license to drive a taxi cab, and repealing Section 36-45 (a), Issuance of a license, and enacting a New Section 36-45 (a), was read by the City Clerk. Moved by Wilharm, seconded by Roehr that the rules requiring ordin- ances to be read in full on three separate days be suspended, that said ordinance be recorded as having passed its first, second and third readings, and be now placed on its final adoption. On roll call, Geiger, Lichty, Roehr and Wilharm voted Aye. Nay: Berdell and Getty. Absent: Keller. Mayor declared the motion not carried for lack of 3/4th vote. 67201 - Councilman Roehr asked for a recount of the roll call. On roll call, Geiger, Lichty, Roehr and Wilharm voted Aye. Nay: Berdell and Getty. Absent: Keller. Mayor declared the motion not carried for lack of 3/4ths vote.. 67202 - Moved by Roehr, seconded by Getty that the said Ordinance be recorded as having passed its first reading. On roll call, Geiger, Getty, Lichty, Roehr and Wilharm voted Aye. Nay: Berdell. Absent: Keller. Mayor declared the motion carried. 67203 Moved by Roehr, seconded by Lichty that Resolution No. 23699, A reso- lution of the City Council of the City of Waterloo, Iowa, approving and confirming Resolution No. 1974-51 of the Low Rent Housing Commis- sion of the City of Waterloo, Iowa, relative to an operating budget for said Low Rent Housing Commission for the period from January 1, 1975 to June 30, 1976, in connection with IA -50-1 and IA -50-2, be adopted. On roll call, Berdell, Geiger, Getty, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Keller. Mayor declared the resolution adopted. 67204 - Moved by Wilharm, seconded by Roehr that the communication from the Community Development Administrator, transmitting Estimate #5 Report as submitted by Brice, Petrides & Associates, Engineers, as to work and materials furnished by Cedar Valley Corporation, Waterloo,Iowa, January 27, 1975 5 67204 - (Continued) for the construction of Paving, Sanitary Sewers, Storm Sewers and Incidentals, Randall -Wellington Area, Rock Island Avenue and Franklin - Mulberry Crossover, Westfield -Virden Urban Renewal Project R-7 in the City of Waterloo, Iowa, known as Contract No. 145, and recommending approval, be received, placed on file, and Resolution No. 23700, ap- proving the report and authorizing and certifying payment accordingly be adopted. Goerdt Construc- tion Co., Contractors, Dubuque, Iowa, for the Westfield Avenue Paving, Sewer and Incidentals, Westfield -Virden Urban Renewal Project R-7, Contract No. 143, and recommending approval, be received, placed on file and Resolution No. 23701, approving Estimate No. 8 Report, and certifying payments accordingly, be adopted. Mayor declared the reso- lution adopted. 67206 Councilman Roehr asked if the Library in its wage schedule was using the same job description as the rest of the City and was informed it was not, but this was not a major problem. Moved by Berdell, seconded by Getty that the communication from the Waterloo Public Library submitting revised budget estimates for the period January 1, 1975 through June 30, 1975, for $39,421.00 more than originally allocated, be received, placed on file, and $30,000.00 approved to be included in next budget amendment hearing. On roll call, Berdell, Geiger, Getty, Lichty, Roehr and Wilharm voted Aye. Nay: None. Absent: Keller. Mayor declared the motion carried. 67207 - Moved by Roehr, seconded by Wilharm that the communication from the Police Chief, reporting Harold Stiles, has retired from the Waterloo Police Department, effective January 17, 1975, and is entitled to payment of 54 working days sick leave for the sum of $2,453.22 and five weeks vacation time for $1,135.75, or a total amount of $3,588.97, be received, placed on file, approved and Resolution No. 23702, authorizing payment accordingly, be adopted. On roll call, Berdell, Geiger, Getty, Lichty, Roehr, Wilharm voted Aye. Nay: None. Absent: Keller. Motion carried. 67209 - Moved by Wilharm, seconded by Roehr that the City Engineer's speci- fications, form of contract and bond, estimate of cost, etc. for the Deere Engine Plant Trunk Extension, Contract No. 184, in the City of Waterloo, Iowa, be received and placed on file. Motion carried. 67210 - Moved by Geiger, seconded by Berdell that Resolution No. 23703, a resolution preliminarily approving the specifications, form of con- tract and bond, estimate of cost, etc. for the Deere Engine Plant Trunk Extension, Contract No. 184, be adopted.
