REGULAR SESSION
January 13, 1975 - 7:00 P.M.
The City Council of the City of Waterloo, Iowa, met in Regular Session in
the Council Chambers in the City Hall in said City at 7:00 P.M. on January
13, 1975
Mayor Rooff in the Chair.
Present: Councilmen Berdell, Geiger, Getty, Keller, Lichty and Roehr.
Absent: Councilman Wilharm.
Councilman Harold E. Getty offered the invocation.
67116 - Moved by Keller, seconded by Lichty that the Agenda, as amended, for
the Regular Session of January 13, 1975 at 7:00 P.M., be accepted
and approved.
Motion carried.
67117 - Moved by Geiger, seconded by Getty that the Minutes of the Regular
Session held January 6, 1975 at 7:00 P.M., be approved.
Motion carried.
67118 - Mayor Rooff reported the sanitary conditions at this property were
hazardous as the drain fields have been completely cut off from the
septic tank.
Moved by Getty, seconded by Roehr that Resolution No. 23671, order-
ing the installation of sanitary sewer and plumbing facilities at
2732 Independence Avenue, be adopted.
On roll call, Berdell, Geiger, Getty, Keller, Lichty and Roehr
voted Aye. Nay: None. Absent: Wilharm. Mayor declared the
resolution adopted.
67119- Moved by Roehr, seconded by Getty that the communication from the
Building Official, submitting the following two bids for installa-
tion of sanitary sewer and plumbing facilities at 2732 Independence
Avenue for Russel G. and Harriet B. Martin, Owner of Record, and
Robert L. and Janice A. Potter, Contract Purchaser, and recommend-
ing acceptance of the low bid, be received, placed on file and
Resolution No. 23672, accepting the low bid of Carpenter's Plumbing,
Inc. in the amount of $4,653.00 for the said installation, adopted:
Carpenter's Plumbing, Inc. . . .$4,653.00
John W. Koch & Sons, Inc. . . . 5,166.00

voted Aye. Nay: None. Absent: Wilharm. Mayor declared the
resolution adopted.
67120 - Leon Risse, 733 Reber Avenue, reported the Quik Shop at Fletcher
Avenue and Reber Avenue, previously was turned down for installation
of gas pumps but was now circulating a petition in favor, and he was
circulating a petition of objection which contained 34 names and he
would like more time to obtain additional names.
Mayor Rooff said there was a variance to the zoning of the adopted
plan, to rezone would require a hearing which would allow more time
and recommended staying in the immediate vicinity with the petition.
67121 - Moved by Getty, seconded by Berdell that the Financial Report of
the Waterloo Municipal Airport Commission for the 1974 Fourth Quar-
ter, be received and placed on file.
Motion carried.
67122 - Under Council Action #67114 of 1/6/75 the taxicab driver's license
of Reginald Fox was reinstated for one week, and was presented at
this time for consideration.

Councilman Roehr asked the City Attorney to recollect the recommend-
ation of the Asst. City Attorney and was informed it was the nature
of convictions, a felony and a misdemeanor, and one of the require-
ments was to be of good morale character.
A discussion followed and it was mentioned that Captain Dolan fav-
ored Reginald Fox be given a chance. William Lemke, owner of taxi-
-cab company, supported approval. City Atty. Smith stated testimon-
ials could be required.
Moved by Getty, seconded by Berdell that the taxicab driver's
license of Reginald Fox be approved.
On roll call, Berdell, Geiger, Getty and Keller voted Aye. Lichty
and Roehr voted Nay: Absent: Wilharm. Mayor declared the motion
carried.
67123 - Mayor Rooff stated there may be a basic injustice in the ordinance
which allowed the Clerk to issue a license on Police Department ap-
proval and then submitted to the Council for approval, and recommend-
ed the ordinance be changed to read that the Council approve the ap-
plication before issuance of license and the application be rewritten
so the Council could give a real hard look before taking action.
67124 - Under Council Action #66976 of 12/9/74 action was tabled on the re-
quest of AMOCO Oil Company, together with Iowa State Highway Com-
mission's Form 559, for permission to construct a 30' commercial
entrance to U.S. 218, approximately 194' south of centerline of
Plymouth Avenue, and a 28' drive entrance on Plymouth Avenue.
Moved by Keller, seconded by Getty that the recommendation of the
City Engineer that the above request be approved subject to AMOCO
Oil Company deeding to the City of Waterloo 50' right-of-way on
LaPorte Road at U.S. Highway Station 738+14 to Station 735+24, from
center line of highway easterly, be received, placed on file, rec-
ommendations approved and the Mayor and City Clerk authorized to
sign said application in behalf of the City of Waterloo, Iowa.

67125 - Moved by Roehr, seconded by Lichty that the agreement between the
City of Waterloo, Iowa and the International Association of Fire
Fighters, Local 66, A.F.L., C.I.O. and C.L.C., and the Memorandum of
Working Agreement between the City of Waterloo, Iowa and the Munici-
pal Employee's Local Union No.1127, affiliated with Laborers Inter-
national Union of North America A.F.L.-C.I.O., be received, placed
on file and referred to the City Attorney for checking and report
back to the Council.

67126 - Moved by Getty, seconded by Berdell that Resolution No. 23673, ap-
proving the minutes of Waterloo Community Development Board for
their regular meeting held November 12, 1974, in the City of Water-
loo, Iowa, be adopted.
On roll call, Berdell, Geiger, Getty, Keller, Lichty and Roehr
voted Aye. Nay: None. Absent: Wilharm. Mayor declared the
resolution adopted.
67127 - Moved by Getty, seconded by Berdell that the communication from the
Low Rent Housing Commission, submitting minutes of their regular
meeting held on December 4, 1974, be received and placed on file.

67128 - Moved by Getty, seconded by Berdell that the statement dated 12/19/74
from Brice, Petrides & Associates, Inc. for construction staking,
resident inspection and testing services during the month of Novem-
ber, 1974, for the Demolition and Reconstruction of Fourth Street

Bridge, Bridge Contract No. 9, be received, placed on file and Reso-
lution No. 23674, approving the statement of said firm and authoriz-
ing payment accordingly, be adopted.

67129 - Moved by Roehr, seconded by Getty that the statement dated 12/19/74
from Brice, Petrides & Associates, Inc., Engineers, for construction
staking, resident inspection and testing services for the Construc-
tion of Fourth Street Approaches, Paving, Sewers and Incidentals,
Contract No. 148, be received, placed on file and Resolution No.
23675, approving the statement of said firm and authorizing payment
accordingly, be adopted.

voted Aye. Nay: None. Absent: Wilharm. Mayor declared the
resolution adopted.
67130 - Moved by Getty, seconded by Geiger that the Completion Report of
the City Engineer as to work performed and materials furnished by
Montgomery Ward, Cedar Falls, Iowa, for the 1973 Fence Program I,
Minor Contract No. 88, in the City of Waterloo, Iowa, and recommend-
ing approval, be received, placed on file and Resolution No. 23676,
approving the report, accepting the work and authorizing payment
in full accordingly, be adopted.

voted Aye. Nay: None. Absent: Wilharm. Mayor declared the
resolution adopted.
67131 - Moved by Roehr, seconded by Lichty that the communication from the
Community Development Administrator, transmitting a statement dated
12/19/74 from Brice, Petrides & Associates, Inc., Engineers, for
engineering services for the month of November, 1974., for the con-
struction of River Road, Stage I, Westfield -Virden Urban Renewal
Project Iowa R-7, Contract No. 142, and requesting approval and
payment, be received, placed on file and Resolution No. 23677, ap-
proving the statement and authorizing and certifying payment accord-
ingly, be adopted.

67132 - Moved by Getty, seconded by Geiger that the Completion Report of the
City Engineer as to work performed and materials furnished by Ernster
and Company, Inc., Contractors, Waterloo, Iowa, for the Dry Run,
Ridgeway Avenue, and Helen Road Storm Sewer Repairs, Contract No.
93, in the City of Waterloo, Iowa, and reconmending approval, be re-
ceived, placed on file and Resolution No. 23678, approving the re-
port, accepting the work and authorizing payment in full according-
ly, be adopted.

voted Aye. Nay: None. Absent: Wilharm. Mayor declared the
resolution adopted.
67133 - Moved by Roehr, seconded by Lichty that the Completion Report of the
Building Official as to work performed and materials furnished by
Jens Olesen & Sons, Contractors, for the Demolition of Old Buildings
at 218-220 East 5th Street (see Council Action #66872 of 11/4/74),
and recommending approval, be received, placed on file and Resolu-
tion No. 23679, approving the report, accepting the work and author-
izing payment in full accordingly, be adopted.

67136 - Moved by Roehr, seconded by Getty that the communication from the
Community Development Administrator, transmitting a statement dated
11/13/74 from Brice, Petrides & Associates, Inc. for engineering
services for Bus Shelter, be received, placed on file and Resolution
No. 23682, approving the statement of said firm and authorizing pay-
ment accordingly, be adopted.

67137 - Moved by Getty, seconded by Lichty that Resolution No. 23683, a
Resolution accepting work and ordering preparation of plat and
scheduleof assessments for the, 1973 Sanitary Sewer Program I
(Cedar Terrace), Contract No. 175, be adopted.
On roll call, Berdell, Geiger, Getty, Keller, Lichty and Roehr
voted Aye. Nay: None. Absent: Wilharm. Mayor declared the
resolution adopted.
67138 - Moved by Roehr, seconded by Lichty that the Engineers' Final Plat
and Schedule of Assessments, Breakdown of Project Costs, etc. for
the 1973 Sanitary Sewer Program I (Cedar Terrace), Contract No. 175,
be received and placed on file.
Motion carried.
67139 - Moved by Getty, seconded by Geiger that Resolution No. 23684, adopt-
ing and levying final schedule of assessments, and providing for the
payment thereof, be adopted, for the 1973 Sanitary Sewer Program #1,
Contract No. 175,.

voted Aye. Nay: None. Absent: Wilharm. Mayor declared the
resolution adopted.
67140 - Moved by Roehr, seconded by Getty that the City Engineer be instructed
to prepare the specifications, form of contract,,form of proposal,
preliminary estimate of cost, etc. for the Deere Engine Plant Trunk
Sewer Lift Station Contract No. 184A, in the City of Waterloo, Iowa.
Motion carried.
67141 - Moved by Getty, seconded by Lichty that the City Engineer's specifi-
cations, form of contract and bond, estimate of cost, etc. for the
Deere Engine PlantTrunk Sewer Lift Station, Contract No. 184A, in
the City of Waterloo, Iowa, be received and placed on file.

67142 - Moved by Geiger, seconded by Getty that Resolution No. 23685, a reso-
lution preliminarily approving the specifications, form of contract
and bond, estimate of cost, etc. for the Deere Engine PlantTrunk
Sewer Lift Station, Contract No. 184A, be adopted.

67143 - Moved by Getty, seconded by Geiger that the City Clerk be instructed
to publish the Notice of Public Hearing on specifications and pro-
posed form of contract for the Deere Engine Plant Trunk Sewer Lift
Station, Contract No. 184A, and the taking of bids for such improve-
ments, said date being set as February 3, 1975 at 7:00 P.M.

67144 - Moved by Roehr, seconded by Lichty that the communication from the
Fire Chief, reporting Robert Barnes has retired from the Waterloo
Fire Department of the City of Waterloo, Iowa, as of January 14,
1975, and is entitled to 60 working days of sick leave, based on 120
days of accumulation, for a total sum of $2,755.14, and five weeks
vacation for an amount of $1,232.98, be received, placed on file,
approved and Resolution No. 23686, authorizing payment accordingly,
be adopted.

67146 - Moved by Roehr, seconded by Lichty that the Refuse Disposal Bond in
the amount of $1,000 from Mid States Construction, Inc. for operation
of a private landfill (dump) on S 80 acres of W 100 acres of NW4
of Section 11 -89N -13W, in accordance with the bond,be received,
placed on file, approved and permission granted to operate said
private landfill.

of Waterloo, Iowa, be, and the same are hereby approved for the
issuance of said Permits and/or Licenses, that the approval be en-

duplicate copies of applications, be received, placed on file, and

67150 - City Attorney Smith reported on mobile home tie downs, stating
there were no regulations in the State Law or in the City Ordin-
ances but the Department of Health could make this a condition, and
the City could make this a requirement before issuance of renewal
of a license.
Councilman Keller recommended this be done as a safety factor and
City Attorney Smith agreed to submit regulations to the Council.
67151 - Moved by Geiger, seconded by Getty that the report of the City At-
torney, advising that the bonds filed with the City Clerk up to the
close of business on January 13, 1975, as shown on the list attached
to said report, have been approved by him, be received, placed on
file, and the report and bonds approved.

67152 Mayor Rooff told the Council to be prepared to consider an ordinance
to control the activities of massage parlors.
Councilman Berdell stated any attempt to regulate the morality
standards should be extended to cover all establishmentsand a gen-
eral ordinance be written rather than specifics.
Mayor Rooff stated any place of business where there was a morality
factor could be included.
