REGULAR SESSION
January 6, 1975 - 7:00 P.M.
The City Council of the City of Waterloo, Iowa, met in Regular Session in
the Council Chambers in the City Hall in said City at 7:00 P.M. on January
6, 1975.
Mayor Rooff in the Chair.
Present: Councilmen Berdell, Geiger, Getty, Keller, Lichty, Roehr and
Wilharm.
Absent: None.
Councilman Robert R. Wilharm offered the invocation.
67091 - Moved by Getty, seconded by Wilharm that the Agenda, as amended, for
the Regular Session of January 6, 1975 at 7:00 P.M., be accepted and
approved.
Motion carried.
67092 Moved by Roehr, seconded by Getty that the Minutes of the Regular
Session held December 23, 1974 at 7:30 P.M., be approved.
Motion carried.
67093 - Moved by Roehr, seconded by Wilharm that the communication from Mrs.
Paul M. Jay, Safety Chairperson of Waterloo P.T.A. Council and mem-
ber of Mayor's Safety Committee, transmitting (1) a report from Paul
H. Riggert, Principal Kingsley School, of 66 instances since 8/26/74
of cars not stopping for stop sign in front of Kingsley School by
the Prospect Blvd. crossing and if stop sign is to remain, a better
record of enforcement will need to be attained, and (2) the request
of Donald Ticknor, President of P.T.A. Board, Frances Grout School,
for sidewalks from Vine Street south to Highway 20 along Idaho
Street, and, also, south from Highway 20 to Lafayette Street along
Adrian Street, and on Independence Avenue from Idaho Street, east
to Bishop Avenue, and requesting solutions, be received, placed on
file and the report of Paul H. Riggert, Principal Kingsley School,
referred to the Police Department, and the request of Donald Ticknor,
President of P.T.A. Board referred to the Safety Committee, with
a report back to the Council.
Motion carried.
67094 Councilman Berdell stated that the report back to the Council should
be in two weeks.
Mrs. Paul M. Jay was concerned with the safety of the school children,
stating there was a need for better enforcement of stopping for the
school stop sign at Kingsley School, and for sidewalk installation
in the Frances Grout area. She read a letter of support from George
H. Diestelmeier, Supt. of the Waterloo Community Schools, and pre-
sented a petition containing 377 signatures of residents in the
Frances Grout School atttendance area. Mrs. Jay, then, invited the
Council to travel the Frances Grout and McKinstry School attendance
area, preferably when the children were going to and from school,
stating the speed limit was 45 mph, starting at the east corner of
McKinstry Junior High School, and should be reduced to 35 mph.
Councilman Wilharm asked if the Kingsley school patrol took the
license numbers of the violators and was informed that some violators
contended they didn't drive this street so it couldn't be them, how-
ever, the children did observe the rules, with the small children
standing for long periods waiting for the traffic to pass, many
times in rain and bad weather.
Mayor Rooff stated he was familiar with the stop sign and felt a
better sign was needed as the present one was difficult to see.
Councilman Keller said he had observed what Mrs. Jay reported and
suggested an older person be the attendant at this crossing.
Moved by Getty, seconded by Geiger that the petitions be received
and placed on file.

67095 - Moved by Getty, seconded by Keller that the communication from the
Black Hawk County Auditor, advising offers have been made for the
following properties, in the amounts shown, on which Black Hawk
County hold title, and requesting City Council approval to accept
these offers for less than taxes specified and with the provision
that Howry & McWilliam Addition, Lot 9, Block 5, (506 Sumner Street)
and Peeks 2nd Addition, Lot 9, Block 5, (518 Gable Street) be sold
subject to the City of Waterloo waiving all special assessments and
the City to receive all proceeds from the sale of these two proper-
ties, together with reports of Building Official and Property Ad-
ministrator, be received, placed on file and sale of said properties
approved subject to the above provisions.

67096 Jim Porter, Community Enabler, suggested consistency in Council ac-
tion in getting property back on the tax rolls and that some kind of
ground rules should be set up.
Councilman Roehr stated both County properties should be posted when
advertised for sale.
Mayor Rooff said he would meet with the County officials about making
the sales more knowledgeable to the public.
67097 Moved by Wilharm, seconded by Reohr that Construction Permit No.
74-393-S for Sanitary Sewer Extension for Southbrooke Addition in
the City of Waterloo, Iowa, from Iowa Department of Environmental
Quality, subject to certain conditions and reqirements, be received
and placed on file.
Motion carried.
67098 - Moved by Roehr, seconded by Lichty that the following three (3)
polices for renewal of insurance for the City of Waterloo, Iowa,
for the period of January 1, 1975 to January 1, 1976 for premiums as
shown, be received, placed on file and Resolution No. 23666, accept-
ing said policies and directing and authorizing issuance of warrant
in payment for same, be adopted.

67099 - Moved by Wilharm, seconded by Getty that Policy No. MN -8320384-00
from The Hartford Steam Boiler Inspection and Insurance Company for
renewal of Boiler and Machinery Insurance for the City of Waterloo,
Iowa, for the period 1-12-75 to 1-12-78, payable on an annual in-
stallment basis with premium of $2,450.00 for the first year, be
received, placed on file and Resolution No. 23667, accepting said
policy and directing and authorizing the issuance of a warrant in
payment for same, be adopted.

67100 An Ordinance amending Ordinance No
Ordinance of the City of Waterloo,
thereof entitled "Delinquency" and

Iowa, by repealing Section 7-41
by enacting new Section 7-41
the City Clerk.
Moved by Getty, seconded by Lichty that the rules requiring ordin-
ances to be read in full on three separate days be suspended, that
said ordinance be recorded as having passed its first, second and
third readings, and be now placed on its final adoption.
On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and
Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the
motion carried.
67101 - Moved by Wilahrm, seconded by Roehr that Ordinance No. 2727, an Ord-
inance amending Ordinance No. 2684, known as Animal Control Ordinance
of the City of Waterloo, Iowa, by repealing Section 7-41 thereof en-
titled "Delinquency" and by enacting new Section 7-41 entitled
"Delinquency", be adopted.
On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and
Wilharm voted Aye. Nay: None. Absent: None. Mayor declared
the ordinance adopted.
67102 - Mayor Rooff stated the salary resolution was not the final job class-
ification, but was only the first step; there were about 200 employ-
ees who had never been classified, questionaires would be sent to
the employees and there would be meetings with Department heads to
decide on the job classification. He emphasized that work would be
continued to arrive at the proper classification and could not be
finalized until July 1, when the new fiscal year would begin.
Moved by Roehr, seconded by Wilharm that Resolution No. 23668, fixing
the compensation of City officials and employees in the City of
Waterloo, Iowa, for January 3, 1975 through June 30, 1975, be adopted.
On roll call, Berdell, Geiger, Getty, Lichty, Roehr and Wilharm
voted Aye. Nay: None. Keller abstained. Absent: None. Council-
man Lichty qualified her aye vote with to do better in July. Mayor
declared the resolution adopted.
67103 - Moved by Roehr, seconded by Wilharm that the communication from Mayor
Rooff, submitting for Council approval the reappointment of Fred
Loomer, Jr., J. D. Knight, Francis Halbmaier and Robert Van Duyn to
the Board of Heating for two year terms to expire December 31, 1976,
be received, placed on file and reappointment approved.

Rooff, submitting for Council approval the reappointment of Oswald H.
Thorson to the Board of Adjustment for a five year term to expire on
December 8, 1979, be received, placed on file and said reappointment
approved.

67105 Moved by Wilharm, seconded by Getty that the plans and specifications,
form of contract, estimate of cost, bidding documents, etc. as pre-
pared by Thorson-Brom-Broshar-Snyder, Architects, Waterloo, Iowa, for
the construction of Conway Civic Center -Site Work on the site bounded
by West Fourth Street, West Park Avenue, Commercial Street and Jeff-
erson Street, in the City of Waterloo, Iowa, be received, placed on
file and Resolution No. 23669, preliminarily approving said plans
and specifications, form of contract, estimate of cost, bidding docu-
ments, etc. , be adopted.
On roll call, Berdell, Geiger, Getty, Keller, Lichty, Roehr and
Wilharm voted Aye. Nay: None. Absent: None. Mayor declared the
resolution adopted.
67106 - Moved by Wilharm, seconded by Roehr that the City Clerk be instructed
to publish the Notice of Public Hearing on Plans and Specifications,
Proposed Form of Contract, Estimate of Cost, etc. for the construc-
tion of the Conway Civic Center/Site Work, in the block bounded by
West Fourth Street, West Park Avenue, Commercial Street and Jeffer-
son Street;: in the City of Waterloo, Iowa, as shown on the plans. and
as specified in the specification therefor, and said date of hearing
being fixed as January 27, 1975 at 7:00 P.M. C.T.

67107 - Moved by Roehr, seconded by Wilharm that the City Clerk be instructed
to publish the notice for Advertisement for Bids for the construction
of Conway Civic Center/Site Work, in the block bounded by West Fourth
Street, West Park Avenue, Commercial Street and Jefferson Street, in
the City of Waterloo, Iowa, said date for receiving and opening of
bids being fixed as January 27, 1975 at 7:00 P.M. in the Council
Chambers.

67109 - Councilman Keller asked if all mobile homes had to have tie downs
and if the city could make this a requirement in the renewal appli-
cation and this safety factor placed in an ordinance.
Mayor Rooff said he would look into this.
Moved by Wilharm, seconded by Roehr that the application, together
with bond and fee, of Kathryn B. Kunz dba Falls Mobile Home Park
for renewal of City Permit to operate a Mobile Home Park at 2530
Falls Avenue, be received, placed on file and approved.

67110 - Moved by Geiger, seconded by Wilharm that the applications and fees
as shown on the attached sheeet for various Beer Permits and/orBeer
and Liquor Licenses as designated, at the locations shown, in the
City of Waterloo, Iowa, be, and the same are hereby approved for
the issuance of said Permits and/or Licenses, that the approval be
endorsed on the applications and forwarded with fees and/or certi-
fied fee receipts to the Iowa Beer and Liquor Control Department, and
duplicate copies of applications, be received, placed on file, and
Resolution No. 23670 approving the applications, be adopted.

file, and the report and bonds approved.

67114 - Reginald Fox asked for an explanation of the revocation of his taxi-
cab drivers license.

Mayor Rooff read the Asst. City Attorney's recommendation for denial
because of a felony conviction.
A discussion followed on the procedure in issuing licenses and re-
jection of the application before presented to Council. City Attorney
Smith stated the recommendation was based on the criminal record.
Councilman Keller suggested action be deferred for one week for a
study by the Public Safety Committee.
Councilman Berdell stated that the fact that Reginald Fox had not
ween in trouble-for_nearly four years should mean as much as the
felony conviction.
Moved by Berdell, seconded by Getty that the taxicab driver's license
of Reginald Fox be reinstated for one week and a study made.
On roll call, Berdell, Geiger, Getty and Keller voted Aye. Nay:
Lichty, Roehr and Wilharm. Absent: None. Mayor declared the motion
carried.
Councilman Keller stated whatever decision the Public Safety Committee
made, Reginald Fox must abide.
