Mayor Pro Tem Robert Brown in the Chair. Roll Call: Brown, Dell, Fox, Buck, Wright, Budak. Absent: Angel. Invocation by: Councilperson Sammie Dell Pledge of Allegiance: Councilperson Dave Buck 96470 - Moved by Buck, seconded by Fox that the Agenda, as amended, for the Regular Session on October 8, 1990, at 7:00 p.m., and the Minutes of the Regular Session on October 1, 1990, at 7:00 p.m., be accepted and approved. Motion carried. HEARINGS AND BIDS 96471 - Moved by Wright, seconded by Dell that proof of publication of notice of public hearing on plans, specifications, form of contract, etc., for Cedar River/Exchange Park Boat Ramp Reconstruction, as published in the Waterloo Courier on September 21, 1990, be received and placed on file. Motion carried. 96472 - HOLD HEARING --This being the time and place of public hearing, the Mayor Pro Tem called for written and oral objections and there were none. Moved by Fox, seconded by Budak that "Resolution confirming the approval of plans, specifications, form of contract, etc., in conjunction with said project", be adopted. Ayes: Six. Absent: Angel. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 1990-582. 96473 - Moved by Budak, seconded by Wright that "Resolution ordering construction", be adopted. Ayes: Six. Absent: Angel. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 1990-583. 96474 - Moved by Buck, seconded by Fox to receive, file and instruct Clerk/Auditor to open and read bids and refer to Director of Parks and Forestry for review and recommendation (award delayed): Bidder Bid Bond Bid Amount Rampart Corporation of Waterloo, IA 5% $36,820.00 Motion carried. HEARINGS 96475 - Moved by Fox, seconded by Buck that proof of publication of notice of public hearing on request of POS/LDI to rezone from "M -2,P" Planned Industrial District to "M-1" Light Industrial District property generally located east of Burton Avenue approximately 500 feet south of Airline Highway, as published in the Waterloo Courier on September 21, 1990, be received and placed on file. Motion carried. 96476 - HOLD HEARING --This being the time and place of public hearing, the Mayor Pro Tem called for written and oral objections and there were none. Moved by Wright, seconded by Budak that the hearing be closed and the recommendation of approval of the Planning, Programming and Zoning Commission, be received and placed on file. Motion carried. Ayes: Six. Absent: Angel. Motion carried. 96478 - Moved by Dell, seconded by Fox that rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended. Ayes: Six. Absent: Angel. Motion carried. 96479 - Moved by Buck, seconded by Wright that the following ordinance be recorded as having been considered and passed for the second and third times and now placed on its final adoption. Ayes: Six. Absent: Angel. Motion carried. 96480 - Moved by Fox, seconded by Wright that "an Ordinance amending Ordinance No. 2479, as amended, City Zoning Ordinance by adding Subsection No. 259 to Section 2A-5, Rezoning Certain Property", be adopted. October 8, 1990 UNFINISHED BUSINESS 96487 - Moved by Fox, seconded by Buck Page 3 that communication from City Planner transmitting request for authorization to proceed with improvements to Fereday Curve to install a 42 -inch concrete median barrier on Broadway Street between Parker and Kern Streets by the Iowa Department of Transportation, together with recommendation of approval, be received, placed on file and approved. Motion carried. PETITIONS FROM PUBLIC 96488 - Moved by Dell, seconded by Buck that communication from City Engineer transmitting request of Gordon Lauterbach for a temporary concrete driveway to be located at 259 Meadowbrook Lane, together with recommendation of approval, be received, placed on file and "Resolution approving said request", be adopted. Ayes: Six. Absent: Angel. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 1990-584. DOCUMENTS 96489 - Moved by Fox, seconded by Buck that communication from Clerk/Auditor transmitting six month lease agreement with National Dairy Cattle Congress for use of McElroy Auditorium beginning October 1, 1990, be received, placed on file and "Resolution approving said agreement", be adopted and Mayor Pro Tem and Clerk/Auditor authorized to execute same. Ayes: Six. Absent: Angel. Resolution adopted and upon approval by Mayor Pro Tem assigned No. 1990-585. 96490 - Moved by Fox, seconded by Buck that communication from City Engineer transmitting Change Order No. 1 for work to be performed by E. B. Spencer Engineering Company for F.Y. 1990 Water Pollution Control Plant Improvements --Phase I, Step 2, Contract No. 387, for a net increase of $6,588.00, be received, placed on file and approved and Mayor Pro Tem authorized to execute same. Motion carried. 96491 - Moved by Fox, seconded by Buck that communication from Assistant City Engineer transmitting Iowa Department of Transportation Application to Perform Work Within State Highway Right of Way for Best Yet, Incorporated to construct an outlet from their storm water detention facility serving Wash Partners, Inc. Car Wash at LaPorte Road Plaza into right of way adjacent to Interstate 380, together with recommendation of approval, be received, placed on file and approved and Mayor Pro Tem authorized to execute same. Motion carried. BILLS PAYMENT 96492 - Moved by Wright, seconded by Dell that "Resolution approving Schedule A918, pp. 1-61, in the amount of $2,758,053.54, dated October 8, 1990, copies of which are on file in the Clerk/Auditor's Office", be adopted, together with authorization to proceed with the purchase of 13 clerical desk chairs from Matt Parrott & Sons in the amount of $1,204.02. NEW BUSINESS 96493 - Moved by Budak, seconded by Wright that "Resolution authorizing the abandonment of certain assessments in conjunction with F.Y. 1990 Sidewalk Repair Assessment Program - Zone 1, Contract No. 382", be adopted. Michael D. Wagner and Paul Fitzgerald, Sergeants, to attend Supervision of Police Personnel Seminar in Evanston, Illinois, on January 21 -February 1, 1991, with costs not to exceed $1,720.00, including the use of City vehicle. 2. Larry Johnson, Police Sergeant, and Randy Chapman, Police Officer, to attend Canine Handler School in Elkhart, Indiana, on October 21 -November 9, 1990, with costs not to exceed $2,720.80, including the use of City vehicle. 3. Stan Stapella, Fire Chief, to attend Iowa Association of Professional Fire Chiefs Fall Conference in Ames, Iowa, on October 23-25, 1990, with costs not to exceed $175.00, including the use of City vehicle. 4. Dave Keidel, Rental Housing Inspector, to attend IAHO and NAHRO Fall Workshop in Marshalltown, Iowa, on October 24-26, 1990, with costs not to exceed $210.00, including the use of City vehicle. Hennessey, 319 Belmont, suggested that the City look into placing compost receptacles in various locations throughout the City as other cities have done.
