Mayor Bernard L. McKinley in the Chair. Roll Call: Dell, Fox, Angel, Wright, Budak, Brown. Absent: Buck. Invocation by: Mayor Bernie McKinley Pledge of Allegiance: Pack 11, Longfellow School 95261 - Moved by Brown, seconded by Angel that the Agenda, as amended, for the Regular Session on February 12, 1990, at 7:00 p.m. and the Minutes of the Regular Session of February 5, 1990, at 7:00 p.m., be accepted and approved. Motion carried. HEARINGS 95262 - Moved by Angel, seconded by Dell that proof of publication of notice of public hearing on request of Robert Morris to vacate a portion of the platted drainage and utility easements located at 3383 Monticello Avenue, as published in the Waterloo Courier on January 26, 1990, be received and placed on file. Motion carried. 95263 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Moved by Dell, seconded by Fox that the hearing be closed and the recommendation of approval of the Planning, Programming and Zoning Commission, be received and placed on file. Motion carried. 95264 - Moved by Fox, seconded by Wright that "an Ordinance vacating the platted drainage and utility easements located at 3383 Monticello Avenue", be received, placed on file, considered and passed for the first time. Ayes: Six. Absent: Buck. Motion carried. 95265 - Moved by Budak, seconded by Brown that rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended. Ordinance adopted and upon approval by Mayor assigned No. 3700. 95268 - Moved by Angel, seconded by Wright that proof of publication of notice of public hearing on the application of the Waterloo Housing Authority to the U.S. Department of Housing and Urban Development for an additional 100 (one hundred) units under Section 8 Housing Voucher Program, as published in the Waterloo Courier on January 24, 1990, be received and placed on file. Motion carried. February 12, 1990 Page 2 Hearings - continued 95269 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections. Deb Collett, Executive Director of the Waterloo Housing Authority, stated that this application would allow for 100 additional units of rental rehabilitation housing. Currently, there is an extensive waiting list of applicants to rent these units. She noted that no new names have been added to the list since 1987. Moved by Brown, seconded by Dell that the hearing be closed. Motion carried. 95270 - Moved by Wright, seconded by Fox that "Resolution approving said application submission", be adopted. Ayes: Six. UNFINISHED BUSINESS 95271 - Moved by Angel, seconded by Fox that communication from Assistant City Planner transmitting recommendation of award of contract to Jorgensen Construction of Cedar Falls, Iowa-, in the amount of $27,306.00 in conjunction with the Exterior Renovations of Former East Side Library, be received, placed on file and "Resolution approving award of said contract", be adopted. Resolution adopted and upon approval by Mayor assigned No. 1990-81. 95272 - Moved by Angel, seconded by Fox that communication from Assistant City Engineer transmitting recommendation on award of contract to Fuller Roofs, Inc. of Waterloo, Iowa, in the amount of $34,790.00 in conjunction with the Waterloo Central Garage Re -Roofing, be received, placed on file and "Resolution approving award of said contract", be adopted. PETITIONS FROM PUBLIC 95273 - Moved by Dell, seconded by Brown that communication from City Planner transmitting request of Smitty's Trailer Village, Inc. and Tractor Supply Company to sell and convey City -owned property generally located at the northeast corner of University Avenue and Midway Drive, together with recommendation of approval of the Planning, Programming and Zoning Commission staff, be received, placed on file and "Resolution setting date of hearing as March 5, 1990 at 7:00 p.m. in the City Hall Council Chambers on the above described request", be adopted and Deputy Clerk/Auditor, instructed to publish notice of same. DOCUMENTS 95274 - Bob Stevenson, Transportation Program Manager, stated that the agreement concerns an alley located near West Mullan Avenue. The Iowa Department of Transportation had originally proposed that the alley be constructed as a turnaround. Due to City staff concerns, the staff is recommending the construction of an alley connection to West Mullan in lieu of the proposed turnaround. The DOT will reimburse the City $9,433 for the cost of the turnaround and $26,000 for the cost of one house that will not be acquired with the alley connection. Additionally, the agreement proposes the extension of West Mullan Avenue to U.S. Highway 63. City staff contends that the Mullan connection will better serve the traffic pattern in the Belmont Park area. The DOT will reimburse the City $83,000 and an additional $12,450 for design cost for the extension of W st Mullan Avenue. -� Ara February 12, 1990 Page 3 Documents - continued Moved by Wright, seconded by Fox that communication from Transportation Program Manager transmitting a proposed agreement with the Iowa Department of Transportation for the connection of an alley into West Mullan Avenue and the extension of West Mullan Avenue to U.S. Highway 63 in conjunction with Relocated U.S. Highway 218, IX -218-7(63, 78, 120)--3P-07, together with recommendation of approval, be received, placed on file and "Resolution approving said agreement", be adopted and Mayor and Deputy Clerk/Auditor authorized to execute same. Resolution adopted and upon approval by Mayor assigned No. 1990-84. 95275 - Moved by Wright, seconded by Fox that communication from Transportation Program Manager transmitting a proposed agreement with the Iowa Department of Transportation for the elimination of the detention basin to be placed between West Park Avenue and West Fourth Street in conjunction with Relocated U.S. Highway 218, IX -218-7(78)--3P-07, together with recommendation of approval, be received, placed on file and "Resolution approving said agreement", be adopted and Mayor and Deputy Clerk/Auditor authorized to execute same. RESOLUTIONS TO BE ADOPTED 95282 - Moved by Budak, seconded by Angel that "Resolution by the City Council of the City of Waterloo, Iowa, as the Waterloo Housing Authority, approving final modifications of the Administrative Plan and Admission Policy for the Waterloo Section 8 Housing Programs, IA05-E050-001/9 and IA05-V050-001/9 and Ridgeway Towers, IA050003", be adopted. ORDINANCES TO BE ADOPTED 95284 - Councilperson Wright thanked Pat Kinney of the Waterloo Courier for the newspaper article concerning the availability of monthly billing and reduced garbage rates for low-income persons. Moved by Brown, seconded by Budak that "an Ordinance amending the 1988 Code of Ordinances of the City of Waterloo, Iowa, by repealing Subsection 16-8(a), Regarding Fees for Service, of Chapter 16, Garbage and Refuse; and by enacting in lieu thereof a new Subsection 16-8(a), Regarding Fees for Service, to Chapter 16, Garbage and Refuse (increasing monthly garbage collection fees)", be received, placed on file, considered and passed for the third time. Motion carried. 95289 - Moved by Budak, seconded by Brown that "an Ordinance amending the 1988 Traffic Code by repealing the main paragraph of Section 549, Loading Zones, and Subsection (1) Commercial Street of Section 549, Loading Zones; and by enacting in lieu thereof a new main paragraph of Section 549, Loading Zones, and a new Subsection (1) Commercial Street of Section 549, Loading Zones (establishing 15 -minute parking limit in all loading zones)", be adopted. Ayes: Six. Absent: Buck. Motion carried. Ordinance adopted and upon approval by Mayor assigned No. 3702. 95290 - Marge Spiegel, 1813 Byron Avenue, objected to the proposed ordinance prohibiting parking OR the north side of a portion of the 1800 block of Byron Avenue. She indicated that to her knowledge there had been no accidents necessitating the need for the signage. She stated that appropriate signage exists for motorists approaching the intersection. Councilperson Budak suggested the possibility of allowing the Spiegel's to park in front of their home. Moved by Brown, seconded by None that "an Ordinance amending the 1988 Traffic Code by repealing Subsection (35) Byron Avenue of Section 551, Parking Prohibited At All Times On Certain Streets; and by enacting in lieu thereof a new Subsection (35) Byron Avenue to Section 551, Parking Prohibited At All Times On Certain Streets (prohibiting parking on the north side of a portion of the 1800 block of Byron Avenue)", be received, placed on file, considered and passed for the first time. The motion died for a lack of a second. Moved by Dell, seconded by Angel that "an Ordinance amending the 1988 Traffic Code by repealing Subsection (35) Byron Avenue of Section 551, Parking Prohibited At All Times On Certain Streets; and by enacting in lieu thereof a new Subsection (35) Byron Avenue to Section 551, Parking Prohibited At All Times On Certain Streets (prohibiting parking on the north side of a portion of the 1800 block of Byron Avenue)", be received, placed on file, considered and passed for the first time which would relocate the no parking area west approximately 30 feet from the eastern terminus of the proposed zone.
