Mayor Bernard L. McKinley in the Chair. Roll Call: Dell, Fox, Angel, Buck, Wright, Budak, Brown. Invocation by: Councilperson Dave Buck Pledge of Allegiance: Police Chief Bernal Koehrsen 98549 - Moved by Buck, seconded by Angel that the Agenda, as amended, for the Regular Session on Monday, November 18, 1991, at 7:00 p.m., and the Minutes of the Regular Session on Tuesday, November 12, 1991, at 7:00 p.m., be accepted and approved. Motion carried. HEARINGS 98550 - Moved by Wright, seconded by Angel that proof of publication of notice of public hearing and notice to bidders for the Sixth Street Extension (West), IX -6604(3)--79-07, as published in the Waterloo Courier on November 13, 1991, be received and placed on file. Motion carried. 98551 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. In response to a question from Councilperson Buck, Bob Stevenson, City Planner, stated that the project had been revised to reduce the cost of the total project. The staging elements were reduced from ten to five. Access to all businesses will be maintained throughout the construction. Moved by Budak, seconded by Brown that "Resolution authorizing to proceed on said project", be adopted. Ayes: Six. Resolution adopted and upon approval by Mayor assigned No. 1991-748. 98552 - Moved by Buck, seconded by Wright that proof of publication of notice of public hearing on request of Robert L. Rappaport et al to rezone from A-1" Agricultural District to "C-2" Commercial District and "R-2" One and Two Family Residence District property generally located south of Ralston Road between Logan Avenue (U.S. 63 North) and East Fourth Street, as published in the Waterloo Courier on November 1, 1991, be received and placed on file. Motion carried. 98553 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Bob Stevenson, City Planner, stated that the proposed rezoning is for property north of the Logan Avenue Shopping Center. The property is currently vacant and would be developed in two segments, commercial and residential. Moved by Dell, seconded by Fox that the hearing be closed and the recommendation of approval of the Planning, Programming and Zoning Commission and oral comments, be received and placed on file. Motion carried. 98554 - Moved by Fox, seconded by Budak that "an Ordinance amending Ordinance No. 2479, as amended, City Zoning Ordinance by adding Subsection No. 269 to Section 2A-5, Rezoning Certain Property", be received, placed on file, considered and passed for the first time. Resolution adopted and upon approval by Mayor assigned No. 1991-752. 98561 - Moved by Budak, seconded by Brown that communication from Director of Parks and Forestry transmitting Contracts, Bonds and Certificates of Insurance from Aspro, Inc. of Waterloo, Iowa in the amount of $78,740.00 for the Gates Park Tennis Court, be received, placed on file and "Resolution approving said documents", be adopted and Mayor and Clerk/Auditor authorized to execute same. RESOLUTIONS TO BE ADOPTED 98562 - Moved by Brown, seconded by Angel that "Resolution authorizing various fund transfers within the Municipal Sanitary Sewer System", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1991-754. 98563 - Moved by Brown, seconded by Angel that "Resolution authorizing and providing for the execution of the Iowa Rental Rehabilitation Program Grant No. R -91 -SG -19-0112 with the State of Iowa for financial assistance in the amount of $61,775.00", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1991-755. 98564 - Councilperson Fox stated that the request for a longer Greyhound Racing Season would provide a great economic impact on the area. The State Racing Commission will consider this request and he urged the passage of this resolution. Moved by Brown, seconded by Angel that "Resolution supporting the extension of the 1991-92 racing season for Waterloo Greyhound Park to May 31, 1992", be adopted. Ayes: Seven. Resolution adopted and upon approval by Mayor assigned No. 1991-756. 98565 - Moved by Brown, seconded by Angel that "Resolution accepting the Quit Claim Deed from Black Hawk County for property located at 321-3211 East Mullan Avenue, 40/42/44 Mulberry Street, 318 Oak and adjacent vacant lot", be adopted. Resolution adopted and upon approval by Mayor assigned No. 1991-758. 98567 - Moved by Brown, seconded by Angel that "Resolution approving Resource Enhancement and Protection (REAP) funds from the Iowa Department of Natural Resources in the maximum amount of $190,540 for development of the East Lake Trail", be adopted. Ordinance adopted and upon approval by Mayor assigned No. 3834. 98572 - Moved by Brown, seconded by Fox that "an Ordinance amending the 1988 Traffic Code by repealing Subsection (5) Fourth Street (West) of Section 549, Loading Zones; and by enacting in lieu thereof a new Subsection (5) Fourth Street (West) of Section 549, Loading Zones (removing existing loading zone on the east side of the 300 block of West Fourth Street)", be received, placed on file, considered and passed for the first time. Travel Requests 98577 - Moved by Budak, seconded by Fox that the following travel requests, with expenses not to exceed amount shown, be received, placed on file, and approved: 1. David Keidel, Housing Inspector, to attend Housing Quality Standards Workshop in Des Moines, Iowa on December 5-6, 1991, with costs not to exceed $130.00, including the use of city vehicle. 2. Allen Pryor, Police Lieutenant, and Terry Blank, Police Sergeant, to attend American Society of Law Enforcement Trainers Seminar in Milwaukee, Wisconsin on January 7-11, 1992, with costs not to exceed $740.00. BONDS 98579 - Moved by Wright, seconded by Angel that the report of the City Attorney and list of bonds filed with the Clerk/Auditor through November 18, 1991, be received, placed on file and report and bonds approved. Motion carried. ORAL PRESENTATIONS 98580 - Mary Ellen Warren, committee member, presented the City of Waterloo with various awards given by the Iowa Community Betterment Program. Awards included: two Governor Awards for the private investment by Deere & Co. for window replacement and enhancement of its downtown facility and to KWWL TV for its advertisements of the Cedar Valley Duck Dash held in July 1991. The City's Clean Sweep Program took second in its population division and was awarded a $400 check for this effort. This money will be applied to next year's application process. Mayor McKinley thanked the committee for their hard work and the recognition this has provided the city. Ernie Boykin, a former resident of the City of Waterloo and now a resident of the city of Chicago, was welcomed as a guest at the Council meeting.
