October 14, 1991 Page 2 Unfinished Business - continued 98396 - Don Temeyer, Planning and Development Director, reported that Parcel No. 3 contains an old structure and has many liens against it. In order to clear the title, this was the only way to proceed. The city could continue to negotiate with the owner of Parcel No. 2. The property owner has agreed to a third party jury who will decide the value of the property. Councilperson Wright indicated that the property owner is willing to proceed with condemnation. Councilperson Budak stated that he has concerns with the negotiating process, but that this appears to be the only course of action. Moved by Dell, seconded by Brown that "Resolution authorizing commencement of condemnation proceedings for Parcel Nos. 2 (1338 Lafayette Street) and 3 (1334 Lafayette Street) in conjunction with Rath Tax Increment Financing Redevelopment Area/Powers Manufacturing Expansion Project", be adopted. ORDINANCES TO BE ADOPTED 98413 - Moved by Brown, seconded by Wright that "an Ordinance establishing the Logan Plaza Urban Revitalization Area (LPURA) located on 19 acres of commercial property on the northeast corner of East Donald Street and Logan Avenue", be tabled indefinitely. Ayes: Seven. Motion carried. 98414 - Councilperson Fox thanked the Council Members for tabling action on this item for one week to allow additional review of the salary structure (see CR 98381 and CR 98382 of October 7, 1991). He stated that following a work session by the City Council Members, it was the consensus to proceed with the original proposal for both the Mayor and Council's salary, which reflects a 4.8 percent increase for each year beginning January 1, 1992 and January 1, 1993. The salary for the Mayor would be $45,600 on January 1, 1992 and $47,800 on January 1, 1993. Councilperson Budak stated that he did not agree with raising the salaries in the middle of a budget year. Moved by Fox, seconded by Angel that "an Ordinance fixing the compensation of Council Members of the City of Waterloo, Iowa, and repealing Ordinance No. 3608", be received, placed on file, considered and passed for the first time. Motion carried. 98415 - Moved by Buck, seconded by Brown that "an Ordinance fixing the compensation of Mayor of the City of Waterloo, Iowa, and repealing Ordinance No. 3604", be received, placed on file, considered and passed for the first time. October 14, 1991 Ordinances to be Adopted - continued 98416 - Moved by Buck, seconded by Wright Page 5 that rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended. Motion carried. 98417 - Moved by Fox, seconded by Buck that the following ordinance be recorded as having been considered and passed for the second and third times and now placed on its final adoption. Ayes: Seven. Motion carried. 98418 - Moved by Buck, seconded by Wright that "an Ordinance fixing the compensation of Mayor of the City of Waterloo, Iowa, and repealing Ordinance No. 3604", be adopted. Ayes: Seven. Ordinance adopted and upon approval by Mayor assigned No. 3828. 98419 - Lou Cutwright, Building Official, stated that the city is currently operating under the 1985 Uniform Building Code (UBC), which has been updated into the 1991 UBC. In addition, he recommended that the Uniform Code for Building Conservation (UCBC) also be adopted, the latter code provides alternatives to standards within the UBC and is particularly helpful in rehabilitating existing, older structures. Building trades personnel have been contacted and have no objections to the adoption of these codes. The adoption of the code would increase building permit fees minimally. Moved by Brown, seconded by Budak that "an Ordinance amending the Code of Ordinances of the City of Waterloo, Iowa, by repealing Sections 9-1, Building Code Adopted, and 9-2, Amendment to Building Code, of Chapter 9, Buildings; and enacting in lieu thereof new Sections 9-1, Building Codes Adopted, and 9-2, Amendments to Building Code, of Chapter 9, Building (adopting 1991 Uniform Building Code)", be received, placed on file, considered and passed for the first time. BONDS 98423 - Moved by Wright, seconded by Angel that the report of the City Attorney and list of bonds filed with the Clerk/Auditor through October 14, 1991, be received, placed on file and report and bonds approved. ORAL PRESENTATIONS 98424 - Mel Smelser, 2235 Temple Avenue, questioned the overtime expenses at the Water Pollution Control Plant in preparation for the open house scheduled for October 18, 1991. Mr. Smelser thought it was foolish to spend money on such an event. John Meyer, Public Works Director, stated that much of the painting and cleaning up that is being done for the open house would need to be done before winter anyway. Also in response to a question from Mr. Smelser, Mr. Meyer reported that wastewater pretreatment personnel from surrounding communities will be invited as a reciprocal measure and to advise them of the improvements at the facility. October 14, 1991 Page 7 Oral Presentations - continued Councilperson Budak questioned whether the city had an ordinance against pit bulls. City Attorney James Walsh stated that the city has a dangerous animal ordinance, but that it does not specifically prohibit by naming pit bulls or any other specific type of animal. Councilperson Brown asked that the Council reconsider the banning of leaf burning prior to October 27, 1991. Currently, the ordinance will allow the burning of yard waste between Sunday, October 27, 1991 and Saturday, November 30, 1991. Moved by Brown, seconded by Budak that the reconsideration of the burning of yard waste be placed on the City Council agenda of Monday, October 21, 1991 for the first reading of an ordinance to expand the burning dates. Ayes: Seven. Motion carried. 98425 - Councilperson Angel questioned the proposed removal of the traffic signal at the corner of Burton and West Parker. City staff stated that public comments are being requested on the removal of said traffic signal. The City Council is required to make a final determination on their permanent removal. Mayor McKinley announced the award of a $190,000 REAP application to the City of Waterloo for east side bike trails. He thanked the Iowa Northland Regional Council of Governments (INRCOG) for their application submission. This will be a vital link to the east side bike trail facility. Councilperson Wright thanked the Public Works Director for the excellent oiling job on Ankeny and Albany Streets. It was noted that this oiling was completed with the local option sales tax funds. Mayor McKinley stated that the passage of the one cent local option sales tax has allowed the oiling of approximately 12 miles of city streets, which is more than the last ten years combined. The Mayor also noted that the East Side of Waterloo has received $12 million in federal grants during the past year.
