McKinley in the Chair. Roll Call: Dell, Fox, Angel, Buck, Wright, Budak, Brown. Invocation by: Councilperson Josef Fox Pledge of Allegiance: Bruce K. Meisinger, Budget Analyst 97463 - Moved by Buck, seconded by Angel that the Agenda, as amended, for the Regular Session on May 28, 1991, at 7:00 p.m., and the Minutes of the Regular Session on May 20, 1991, at 7:00 p.m., and the Special Session on May 21, 1991, at 4:00 p.m., be accepted and approved. Motion carried. ADJOURNED HEARING 97464 - Moved by Angel, seconded by Wright that the communication from U.S. Postal Service requesting that their request to rezone from "C-2" Commercial District to "C -Z" Conditional Zoning property generally located on the southeast corner of University Avenue and South Hackett Road be withdrawn. (See CR 97344 of May 6, 1991 for hearing.) Motion carried. Motion carried. 97466 - HOLD HEARING --This being the time and place of public hearing, the Mayor called for written and oral objections and there were none. Moved by Brown, seconded by Fox that the hearing be closed and the recommendation of approval of the Planning, Programming and Zoning Commission be received and placed on file. Motion carried. 97467 - Moved by Fox, seconded by Buck that "an Ordinance vacating all the sidewalks in the 500 block of Maynard Avenue and all the sidewalks in the 400 block of Main Street", be received, placed on file, considered and passed for the first time. Ayes: Seven. Motion carried. 97468 - Moved by Dell, seconded by Brown that rules requiring ordinances to be considered and voted for passage at two prior meetings, be suspended. Ayes: Seven. Motion carried. 97469 - Moved by Angel, seconded by Fox that the following ordinance be recorded as having been considered and passed for the second and third times and now placed on its final adoption. Motion carried. 97476 - Moved by Wright, seconded by Fox that the agreement between the City of Waterloo and Powers Manufacturing for the city to acquire and resell certain parcels of land for expansion of Powers Manufacturing facility in the area generally located in the block bounded by East Eleventh, Lafayette, Union and Sycamore Streets, be received, placed on file and "Resolution approving said agreement", be adopted and Mayor and Clerk/Auditor authorized to execute same. Motion carried. ORAL PRESENTATIONS 97511 - Kent Crowell, 1490 Newell Street, asked that the Council consider a truck embargo on Newell Street after its reconstruction. He explained that currently the street is being reconstructed and has caused considerable access problems to residents in the area. He asked that temporary access be provided to them. Mayor McKinley stated that it has not been a past practice of the City to provide alternative access to residential areas and cited other examples, such as Ridgeway Avenue, that had not been serviced with a secondary access point during reconstruction. Don Temeyer, Planning and Development Director, stated that Dubuque Road is scheduled to be reopened this week, which will greatly relieve the truck traffic on Newell Street. He also commented that the Fifth and Sixth Street Extension will greatly relieve the truck traffic on Newell Street and Donald Street. A preliminary staff recommendation would be that an embargo would not be recommended on Newell Street until after the completion of the Sixth Street Extension.
